COUNCIL MEETING DATE: MARCH 5, 2019
SUBJECT: FINAL TRACT MAP NO. 19935
PAGE 2

BACKGROUND
Tract Map No. 19935, as presented by RichmondAmerican Homes, consists of 73 residential lots on approximately 10.3 acres located near the northwest corner of Bickmore and Hellman Avenues ( Exhibit A). Tentative Tract Map No. 19935, processed by Lewis Communities, was conditionallyapprovedbytheCityof ChinoPlanningCommissionon June30, 2015, as a partof the Harvest at The Preserve development.

ISSUES/ ANALYSIS
Duringthe publictestimonyat the December3, 2018PlanningCommissionmeetingfor Site Approval PL18-0075, which is an applicationfor the development of homes within the tract, a discrepancywas discoveredon the map regardingthe Map's privatestreets and sidewalk widths. Additionally, it was pointed out that the City's current Subdivision Ordinance, adopted in 2010, does not allow private streets in single-family home developments. The Preserve DevelopmentAgreement, adoptedin 2004, allowsmapsprocessedby LewisCommunitiesto conform to the subdivision ordinance that was in effect at the time of the Agreement, which had no suchprohibitionon privatestreets. Dueto the potentialissuesthatarisefrom privatestreets andinfrastructureduringtheconstruction/acceptanceprocess, aswellas potentialmaintenance issuesinthelongterm, thePlanningCommissionconditionedtheprojectsto converttheprivate streets to public.

Staff collaborated with the City Attorney, Richmond American, and Lewis Communities to resolvethe discrepanciesof convertingthe privatestreetsto public, wideningthe sidewalks fromfourfeetto fivefeet in width, andaddressingthe infrastructurethat has beenconstructed.

Followingdiscussion, the PlanningCommissionunanimouslyapprovedthesemajorrevisionsto the Site Approval.

TheCityEngineerdeterminedthattheinternalroadsneededto bepublicright-of-wayandthat the sidewalkneededto be fivefeet in widthto bein conformancewiththe MunicipalCodeand CityStandards, respectively. Therevisedmapshavebeenreviewedandit is readyforCouncil's consideration. It shouldbe notedthatapprovalofthischangewouldalso requirean adjustment to the SubdivisionImprovementAgreementsand amountof the necessarysecuritiesto guarantee the construction of public improvements as the roads, sidewalk and water improvementsarepublic. TheCityAttorneywillreviewandapprovethesecuritiesto beposted.
