BACKGROUND
TractMapNo. 19953, as presentedby RichmondAmericanHomesconsistsof 10 residential lotsonapproximately1.3 acreslocatednearthe northwestcornerof BickmoreandHellman Avenues ( Exhibit A). TentativeTract MapNo. 19953, processedby LewisCommunities, was conditionallyapprovedbytheCityofChinoPlanningCommissiononJune30, 2015, asapartof the Harvest at The Preserve development.
ISSUES/ ANALYSIS
DuringthepublictestimonyattheDecember3, 2018PlanningCommissionmeetingforSite ApprovalPL18-0075, whichis anapplicationforthedevelopmentof homeswithinthetract, a discrepancywasdiscoveredon the mapregardingthe Map's privatestreetsand sidewalk widths. Additionally, itwaspointedoutthattheCity's currentSubdivisionOrdinance, adoptedin 2010, does not allow private streets in single- family home developments. The Preserve DevelopmentAgreement, adoptedin2004, allowsmapsprocessedbyLewisCommunitiesto conformto the subdivisionordinancethatwasineffectatthetimeof theAgreement, whichhad nosuchprohibitiononprivatestreets. Duetothepotentialissuesthatarisefromprivatestreets andinfrastructureduringtheconstruction/acceptanceprocess, aswellaspotentialmaintenance issuesinthelongterm, thePlanningCommissionconditionedtheprojectstoconverttheprivatestreets to public.
Staff collaborated with the City Attorney, Richmond American, and Lewis Communities to resolvethediscrepanciesof convertingtheprivatestreetsto public, wideningthesidewalks fromfourfeettofivefeetinwidth, andaddressingtheinfrastructurethathasbeenconstructed.
Followingdiscussion, thePlanningCommissionunanimouslyapprovedthesemajorrevisionstothe Site Approval.
TheCityEngineerdeterminedthattheinternalroadsneededtobepublicright-of-wayandthatthesidewalkneededtobefivefeetinwidthtobeinconformancewiththeMunicipalCodeand CityStandards, respectively.
