RESOLUTION NO. 2024-040
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO, CALIFORNIA, APPROVING Pilot Project MS-254 FOR Rubberized Emulsion Aggregate Slurry (REAS) WHEREAS, the City of Chino (“City”) approved Site Approval PL17-0112 and Tentative Tract Map No 18903 on August 20, 2018, for the development of 38 single-family homes, with Conditions of Approval ("COA") requiring public improvements including pavement on Rushmore Court, Ryan Way, and Denali Lane; and WHEREAS, the public improvements for this tract are substantially complete and all deficiencies have been addressed, except for the pavement cracking on Rushmore Court, Ryan Way, and Denali Lane; and WHEREAS, on June 10, 2024, staff presented a proposal to the Infrastructure Streets Committee regarding the piloting of Rubberized Emulsion Aggregate Slurry (REAS). This technology has been successfully employed in neighboring cities and is designed to meet industry standards. Here are some key points about REAS and its proposed initiative:

Technology and Standards: REAS is a well-established technology known for its adherence to industry standards. It offers enhanced durability and effective coverage of cracks in pavement surfaces.

Pilot Initiative: The proposal suggests piloting REAS in the City of Chino as a trial run. This allows for testing its effectiveness in local conditions and assessing its suitability for wider application across the City's infrastructure.

Maintenance Benefits: One of the advantages of REAS is its ability to be reapplied as necessary. This capability helps in maintaining the integrity of streets over time, contributing to the overall aesthetics and functionality of neighborhoods.

Community Impact: By improving street surfaces and reducing pavement deterioration, REAS can positively impact the quality of life for residents, enhancing both safety and aesthetics.

Long-Term Strategy: Implementing REAS as part of a maintenance strategy can potentially extend the lifespan of roads and reduce the need for more extensive repairs or replacements in the future.

WHEREAS, Meritage Homes of California, the developer, has deposited $121,252.68 with the City for the initial application of Rubberized Emulsion Aggregate Slurry (REAS), in addition a future second application of REAS; and WHEREAS, Petrochem Materials Innovation (“PMI”), LLC, Carlsbad, CA is the sole manufacturer that applies REAS in the Western United States, and while REAS is nonproprietary and available for purchase by other contractors, procurement through Petrochem Materials Innovation, LLC ensures application expertise and efficiency, which may reduce overall costs and ensure quality control; and WHEREAS, REAS has been successfully utilized by PMI for similar projects, including the City of Los Angeles, demonstrating its suitability, performance, and compliance with industry standards; and WHEREAS, City of Los Angeles uses purchasing procedures substantially similar to those that the City would have been required to use, and PMI offers the same price(s) to the City as offered to said agency, thereby satisfying the procurement criteria set forth in the City's policies; and WHEREAS, REAS includes a 7-year warranty ensuring timely contractor response to address any street degradation issues, and its technical characteristics and cost-effectiveness make it the sole viable option; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chino:

The City Council approves the pilot project to use REAS to address pavement cracking on Rushmore Court, Ryan Way, and Denali Lane, based on the findings and justifications provided in this resolution.

The City Council directs staff to monitor the implementation of REAS, assess its performance, and report back to the City Council with findings and recommendations for future applications if successful.

This resolution shall take effect immediately upon passage.
