RESOLUTION NO. 2024-042
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO, CALIFORNIA, APPROVING THE THIRD AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF CHINO AND ALESHIRE AND WYNDER, LLP FOR CITY ATTORNEY SERVICES WHEREAS, on March 7, 2017, the City Council approved a professional services agreement with Aleshire & Wynder, LLP; and WHEREAS, on November 3, 2020, the City Council approved a first amendment to the professional services agreement with Aleshire & Wynder, LLP, increasing select hourly rates; and WHEREAS, on April 4, 2023, the City Council approved a second amendment to the professional services agreement with Aleshire & Wynder, LLP, increasing select hourly rates; and WHEREAS, to allow for specialized legal services related to Watermaster, the proposed third amendment adopts additional rates for Watermaster legal services only, that will include advice and litigation services regarding implementation of the Judgement by the Chino Basin Water Master and subsidiary entities and amend Section 9 of the personnel roles for the Assistant City Attorney and Lead Litigation Counsel; and WHEREAS, to allow for specialized legal services related to Watermaster, the proposed third amendment adopts additional rates for Watermaster legal services only, that will include advice and litigation services regarding implementation of the Judgement by the Chino Basin Water Master and subsidiary entities; and WHEREAS, pursuant to the existing professional services agreement, the hourly rates for legal services as set forth in the second amendment to the agreement (City of Chino Professional Services Agreement Number 2017-281) remain the same.
NOW, THEREFORE BE IT RESOLVED as follows:
1. The City Council hereby approves the third amendment between the City of Chino and Aleshire & Wynder, LLP, increasing the hourly compensation in the amounts stated in the third amendment related to legal rates for Watermaster.
2. The City Clerk shall certify to the adoption of this Resolution.
