RESOLUTION NO. 2026-009
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO, CALIFORNIA, AMENDING THE CITY’S ADMINISTRATIVE FINE SCHEDULE AS IT RELATES TO TRUCK ROUTE VIOLATIONS WHEREAS, the City of Chino has adopted and enforces designated truck routes through its Municipal Code to maintain traffic safety, reduce roadway damage, and minimize the impact of commercial traffic on residential areas; and WHEREAS, per Resolution No. 2022-065 establishing administrative fines for violations of the Chino Municipal Code, adopted by the City Council on October 18, 2022, the current penalty for violating the City’s truck route ordinance is a flat fine of $250 for the first violation, which has proven insufficient in deterring repeat offenders; and WHEREAS, Government Code Sections 53069.4 and 36901 authorize general law cities to impose administrative penalties of up to $1,000 per violation where violations of the city’s municipal code are designated as misdemeanors; and WHEREAS, the City Council desires to amend Resolution No. 2022-065 to implement an increase to the escalating fine schedule for repeat truck route violations within 12 months; and WHEREAS, the proposed ordinance is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15060(c)(2) and Section 15321 (Enforcement Actions by Regulatory Agencies).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHINO DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
