Hello Maria,
Thank you and your fellow City staff for meeting with us on June 3 to discuss a concession for partial undergrounding of utilities on the proposed project at 6210 Riverside Drive. HCD understands that the City has concerns about the safety of leaving utility wires above ground at the intersection of Riverside Drive and Mountain Avenue. Specifically, these concerns are over the potential of a vehicle collision with the pole, which could result in disabling power for the surrounding area, and high winds which pose a fire hazard and may also require the temporary shutoff of power to the surrounding area.
As you are aware, Government Code section 65915, subdivision (d)(1) requires the City to grant a concession unless it makes at least one of three written findings. One of the three findings is that the concession would have a specific, adverse impact (as defined in Government Code 65589.5, subdivision (d)(2)) on public health or safety for which there is no feasible method to mitigate without rendering the project unaffordable to low-and middle-income households.
HCD encourages the City and the applicant to continue to work in good faith to identify and evaluate potential mitigation measures that would address any specific, adverse impact that might arise from maintaining the utility wires in their current above-ground location. For example, the City and the applicant could explore the installation of bollards to prevent collisions from damaging the pole or the relocation of the pole to a place where it will be less at risk from collisions.
HCD remains committed to supporting the City of Chino in facilitating housing at all income levels and hopes the City finds this email helpful. Please let me know if you have any questions.
Thank you,
David YingsIE (any pronouns)
