A request to amend the East Chino Specific Plan to allow homes to front onto Loop Roads, allow on-street parking on Amsterdam Avenue and Aguerre Avenue, and reduce the minimum front yard setback in the RD4.5 land use designation.

Staff Report By: Andrea Gilbert, City Planner
RECOMMENDATION: 1) Conduct a public hearing; and 2) approve the introduction of Ordinance No. 2026-012, to be read by number and title only, amending the East Chino Specific Plan (ECSP) to allow homes to front onto Loop Roads, allow on-street parking on Amsterdam Avenue and Aguerre Avenue, and reduce the minimum front yard setback to 15 feet for homes with swing-in garages within the RD 4.5 (4.5 dwelling units/acre) land use designation of the ECSP.

Chavira, Larry Howard, Linnie Risolo, Derek Webster, Peggy Merrill, and Joanne Webster. All materials were distributed to the City Council and saved to the meeting record.

Mark Thomas, Vice President at PLC Communities, Applicant, addressed the City Council.

Mayor Ulloa closed the public hearing.

The City Council discussed the project's conflict with the area's original street planning intent, traffic concerns with current proposal, reorientation of project, altering the East Chino Specific Plan (ECSP), concerns that denial could prompt a higher density proposal under State housing laws, and recognition that low-density development as proposed is increasingly uncommon and valuable to the community.

At the Mayor's request, Ms. Gilbert provided additional details about project, noting the proposal includes 4.44 units to the acre, which is the range that is allowed in this particular land use designation. Ms. Gilbert confirmed the proposal includes 16 single-story homes and the applicant is not exercising the density bonus and there are no affordable units included in the proposal.

Mayor Ulloa requested a motion for approval. Item No. 18 failed due to a lack of a motion.

City Attorney Galante outlined alternative options, including continuing the public hearing to a date certain or allowing additional time for staff to work with the applicant to explore reorienting the homes toward Cypress Avenue, instead of Amsterdam.

The City Council discussed an alternative motion to return the project to staff to work with the applicant to address issues that had been raised.

Mayor Ulloa re-opened the public hearing.

Discussion ensued between the City Council, City Attorney, and the Applicant on the revised motion to continue the proposed project, re-notice the public hearing, and determine the earliest meeting date to re-schedule the item for consideration.

The following provided public comments in opposition of the proposed project: Resident (name not provided), Derek Webster, and Charles Butler.

Mayor Ulloa closed the public hearing noting the hearing would be noticed again when the item comes back for consideration.

8 In response to safety questions by the City Council, Brian Frink, Retired New York City Battalion Chief, spoke on behalf of the applicant, regarding safety plume guidance, 330-foot exclusion zone, and outdoor storage.

Mayor Ulloa closed the public hearing.

Council discussion followed on the need for reliable power and inevitability of battery storage, grid reliability, fire, smoke, and public health impact concerns, the project could advance even without local approval, outdoor design, and multiple safety layers to reduce risk.

Mayor Pro Tern Burton expressed concerns about the project, citing potential public health impacts and the system's reliability in the event of a fire, the lack of 24/7 onsite monitoring, and noted the possibility that the project could proceed at the state level even if it is denied locally.

Fire Chief Dave Williams, Chino Valley Fire District, reported the Chino Valley Fire District feels well prepared for this project.

Mayor Ulloa requested a motion. Motion by Council Member Flores, seconded by Council Member Lucio.

City Attorney Galante read the Ordinance by number and title only, waiving further reading of the ordinance:
