REIMBURSEMENT AGREEMENT - PINE AVENUE EMERGENCY ROAD REPAIR -

RESOLUTION ADOPTED
Mayor Marquez pulled the item for discussion and separate vote and said that it was great that the City helped fix a problem with drainage and sewage on Pine Avenue. He stated that he listened to the City of Chino Council meeting regarding this road repair and said he was concerned about the traffic flow. He asked staff to elaborate on the project.

City Manager Montgomery stated this item pertains to a reimbursement agreement for work that was done to repair damage from a 2009 storm to the creek conveyance and is limited to that restoration. That segment of the creek crosses Pine Avenue. He said the Chino Council discussed future efforts to either enhance this project to create access potentially on Pine Avenue. BRAND-HUANG-MENDOZA TRIPARTISAN LAND USE INITIATIVE - RESOLUTON

ADOPTED
Mayor Marquez asked for public comments on the item.

Luis Esparza, resident, said it was important to support the land use initiative but stated it seemed misleading to approve the public hearing item on the housing element soon after. He asked if the initiative passes, would a general clause need to be added to the housing element to nullify the required housing units set by the State.

City Attorney Hensley replied that if the initiative were to make it to the ballot it would be retroactive with regard to some of the things that Sacramento has required over the past few years. He stated that because it is part of legislation, the City would be subject to severe penalties from the State Department of Housing and Community Development (HCD), including financial penalties if the City does not approve the Housing Element.

He said that HCD has been given law enforcement rights and that it would be extremely risky not to comply with the State mandates; and if the initiative qualifies and passes, it will put the City in a different position. Community Development Director Lombardo added that the Housing Element, Land Use Plans, and the General Plan could be amended, and that the City would have the opportunity to revisit the required Regional Housing Needs Assessment (RHNA) numbers.

City Manager Montgomery briefed the Council on the report, which is on file in the City Clerk's Office.

Following a lengthy discussion, a motion was made by Vice Mayor Rogers and seconded by Council Member Moran to adopt Resolution No. 2022R-014 of the City of Chino Hills, Expressing Support for the "Brand -Huang -Mendoza Tripartisan Land Use Initiative" to Amend Article XI of the California Constitution to make Zoning and Land Use Issues Community Affairs, and Not of State Interest, and override state laws that conflict with local zoning and land use decisions.

6TH CYCLE HOUSING ELEMENT
Community Development Director Lombardo briefed the Council on the Housing Element update, which is on file in the City Clerk's Office. Community Development

CHINO HILLS CITY COUNCIL 2022-034
REGULAR MEETING FEBRUARY 8, 2022
Director Lombardo stated this is the third public hearing before Council on the Housing Element and that the City never received comments back from HCD, therefore due to the deadline on February 11th to submit the Housing Element, she recommended that Council move forward with adopting the resolution and Housing Element as presented.

Mayor Marquez opened the public hearing and asked if anyone wished to address the City Council on the matter.

Angel Esparza, Southwest Regional Council of Carpenters, voiced his opinions and said that the City should hire local, skilled and trained workforce to mitigate environmental impacts for private developments and projects.

Luis Esparza, resident, spoke in opposition to the Housing Element and said that Measure U was not being honored by the City.

Al Matta, resident, stated that there has always been a lot of concerns of the citizens regarding the growth of the City. He spoke about the Hope for the Hills triumph and said that Chino Hills should be deemed a sanctuary city for common sense and dignity.

Ronnie Guyer, resident, stated that people make emotional comments instead of knowing all the facts, and that the City Council has made great business decisions for the Chino Hills community.

Mayor Marquez closed the public hearing.

Council Member Bennett spoke about approvals on apartment projects occurring prior to cityhood, property owners' rights, and inverse condemnation.

Council Member Moran spoke regarding better approaches to encourage housing and to preserve local control.

Council Member Johsz commended Community Development Director Lombardo and Mayor Marquez for advocating for the City and spoke about our neighbors who will continue to grow and affect traffic.

Vice Mayor Rogers spoke regarding longevity and watching the growth of the City, being forced to follow Sacramento mandates, and being a product of our own success.

Mayor Marquez spoke about the history of General Plan updates and asked City Attorney Hensley why Measure U, which was voted on by the people, was not being honored by the State of California. City Attorney Hensley replied when Measure U was circulated there was no exception for affordable housing in the measure. He said there has been extensive litigation around the State on these kind of housing restrictions for cities that did not have exceptions for affordable housing. He stated that there were a couple of cities that went into litigation, and Measure U was this exception and a release valve for the city to not be sued.

CHINO HILLS CITY COUNCIL 202.2-035
REGULAR MEETING FEBRUARY 8, 2022
Mayor Marquez also spoke about the City's engagement with the State to fight against the RHNA numbers and commended staff for their efforts. Mayor Marquez asked Community Development Director Lombardo to explain the next steps in the approval process. Community Development Director Lombardo explained that the City has tried to get HCD's concurrence with our Housing Element. There may be additional requirements imposed if our Housing Element is not in compliance.

Following discussion, a motion was made by Council Member Bennett and seconded by Mayor Marquez to adopt Resolution No. 2022R-015 of the City of Chino Hills, Adopting a Mitigated Negative Declaration and Mitigation Monitoring Reporting Program under the California Environmental Quality Act, and Approving General Plan Amendment 21 GPA01 for the City of Chino Hills 2021-2029 6th Cycle Housing Element.
