ITEM PULLED FROM CONSENT CALENDAR FOR DISCUSSION
AWARD BIDS AND AGREEMENTS - 1,2,3-TRICHLOROPROPANE (1,2,3-TCP)

REMOVAL TREATMENT PLANT PROJECT- RESOLUTION ADOPTED
Mayor Marquez pulled this item for discussion and separate vote. He asked staff to explain the item.

Public Works Director Bobadilla stated that staff is asking for two different actions to award a contract to Garney Pacific for the construction of the 1,2,3-Trichloropropane (1,2,3-TCP) Removal Treatment Plant and to Butier Engineering for the construction management and special inspection services for the project. He said that all City wells are currently offline because of contaminants with the majority being 1,2,3-TCP. He stated a few years back all City wells were turned off because of new regulations given by the State Water Board. With this 1,2,3-TCP construction plan, it will enable the City to get the wells back online to treat and pump through the City's system and rely less on imported water.

Mayor Marquez inquired if getting the wells up and running will save the City 95% of the water that the City has to import from the Metropolitan Water District. Public Works Director Bobadilla said no, the 95% water usage pertains to current water restrictions implemented by the State to the Metropolitan Water District, which in turn caused the City to move from Stage II to Stage III water conservation efforts because of the limited water supply.

Robert Bowcock, Integrated Resource Management, (IRM) Inc., expressed his concerns with the materials proposed in the project bid by Garney Pacific and requested Council return the bid package and re-bid the project.

Following discussion, a motion was made by Vice Mayor Rogers and seconded by Council Member Johsz to (1) adopt Resolution No. 2022R-063 of the City of Chino Hills, Adopting a Budget Amendment for Fiscal Year 2021-22 Increasing The Water Utility Fund Budget for the 1,2,3-Trichloropropane (1,2,3-TCP) Removal Treatment Plant Project by$13,000,000; (2) award bid and authorize the execution of Agreement No. A2022-159 to Garney Pacific, Inc., in the amount of $12,545,000 for the construction of the 1,2,3-TCP Removal Treatment Plant project; (3) authorize the City Manager, at his discretion, to approve cumulative change orders up to ten percent ($1,254,500) of the awarded contract amount; and (4) authorize the execution of a
