PUBLIC HEARING
VACATION PORTION OF PEYTON DRIVE - RESOLUTION ADOPTED [7:37:23] Engineering Manager Hassel briefed the City Council on the staff report, which is on file in the City Clerk's Office.

Mayor Rogers opened the public hearing and asked if anyone wished to address the City Council on the matter, hearing none, he closed the public hearing.

Council Member Marquez inquired as to why the City is negotiating the price values for the portion of Peyton Drive because that property used to belong to the Coptic Church.

He said that another time the City vacated property they did not charge the property owner and asked why it was different this time. Assistant City Attorney Calciano said that the City actually bought the fee for this property for the portion of Peyton Drive and once vacated underlying fees remain with the City. For that reason, she said it would be considered a gift of public funds and that the City would have to sell it. She stated that the City originally had an easement, there was a dispute, so the City entered into a settlement agreement and purchased it. Community Development Director Lombardo concurred with the recollection.

A lengthy discussion ensured about the sale of the property and appraised values of the property.

City Manager Montgomery suggested that Council take action on the public hearing and adopt the resolution to vacate a portion of Peyton Drive between Morningfield Drive and Eucalyptus Avenue, and to continue discussion at a later date regarding the information of the appraised value of the property.
