CHINO HILLS CITY COUNCIL 2023-102
REGULAR MEETING MAY 9, 2023
Council Member Marquez asked Assistant City Attorney Calciano to explain why the Council cannot respond to public comments.

Assistant City Attorney Calciano responded that the Planning Commission Items are for Council's consideration whether or not to review them. She added if two Council Members wished to pull an item that it would be brought back to a public hearing where they would take full public testimony to conduct the public hearing. If they were to respond today, they could appear biased, it is a quasi-judicial action which is why the Council is counseled not to ask any questions or make any statements prematurely.

City Manager Montgomery briefly spoke about the Paradise Ranch Project approved at the Planning Commission meeting on May 2nd. He provided a summary of the actions taken in advance of the meeting as they related to concerns raised by the public. Topics included: General Development Conditions in the Carbon Canyon Area where he specifically noted that the development scenario that the applicant followed provided for a lower density than allowed by the Cluster development code; Utilities wherein the initial evaluation by staff showed the proposed project could be served by water and sewer utilities; Carbon Canyon Road Traffic including measures taken to install a traffic signal between Carbon Canyon Road and Canyon Hills Road; Emergency Evacuations plans which allows safety professionals to implement evacuation routes dependent on the event providing flexibility to best protect the public; and fire safety. He outlined the actions that the Council could take during the Planning Commission Matters items on the agenda which include either taking no action thereby approving the project or if two members of the Council pull the item for review, it would be brought back to another meeting. He outlined that the Council's discretion will be constrained by a number of laws and actions the public could take such as filing an appeal within 10 working days of the May 2, 2023, Planning Commission meeting.

He spoke about the impacts of SB9 and ADUs. Captain Goodell responded that due to a letter of agency for trespassing which refers to a business that is closed during non - normal business hours and is then signed by the property owner, it empowers law enforcement if posted and outside of business hours to arrest an individual for trespassing but during normal business hours, if open to the public and if individuals are not committing a crime, not a harm to themselves or others are not suffering from any mental incapacity or mental health crises, or under the influence of a narcotic, then there is nothing that law enforcement can legally and lawfully do to detain that person. He provided two resources: Department of Behavioral Health staff, Cynthia Venegas for crisis intervention, and Social Work Action Group (SWAG). Vice Mayor Moran spoke on working with MET team and Code Enforcement to reach out to shopping centers that do not have letters of agency for trespassing.
