WASTEWATER COST-OF-SERVICE RATE STUDY - PROPOSED SEWER RATE INCREASES [02:33:07]
Habib Isaac, Principal/Managing Partner of IB Consulting, provided a PowerPoint presentation and briefed the City Council on the Utility Rate Study, which is on file in the City Clerk's Office. He provided a financial planning summary and spoke about the current and proposed Water and Wastewater Enterprise financial plans, Wastewater cost-of-service analysis and proposed Wastewater rates, the Fiscal Year 2024-28 proposed rate schedule, wastewater monthly bill survey, and outlined the steps for the Proposition 218 noticing and public hearing.

CHINO HILLS CITY COUNCIL 2023-118
ADJOURNED MEETING MAY 24, 2023
Vice Mayor Moran asked for an explanation regarding the definition of account services and Mr. Habib replied that it is incidental insurance that every active account should be paying for.

Council Member Bennett stated that he feels that the Inland Empire Utility Agency should be responsible for their own billing, as Chino Hills is just the pass-through agency.

Council Member Johsz inquired if the Inland Empire Utility Agency reimburses the City for the cost of the Proposition 218 process and City Manager Montgomery stated that the City bears the full cost of the Proposition 218 process.

Council Member Marquez inquired about the pass-through rate charges and whether the Proposition 218 protest ballot process can be bypassed. City Attorney Hensley stated there are two components to these rates which are a City component and an IEUA component and that the Proposition 218 process still needs to be exercised.

Council Member Marquez asked how the City is able to collect fees on July 1, 2023, as stated in the staff report, if this process has not been completed yet. Finance Director Buhagiar explained that the City held a Proposition 218 vote three years ago for the IEUA rates, which is still in effect for two more years. Now that the City is doing their own sewer rates for the next five years she is combining the two to prevent a separate IEUA Prop 218 vote in the future. City Attorney Hensley continued that the previous Prop 218 vote covers the IEUA rates for two more years but the City now wants to increase the City's component through this current Proposition 218 process, the City is increasing the City component for the next two years and then it will be capturing both pricing components for the remaining three years, as this process takes place every five years.

Following discussion, a motion was made by Council Member Johsz and seconded by Council Member Bennett to (1) receive and file Wastewater Cost-of-Service Rate Study draft; (2) approve the Proposition 218 Notice of Proposed Increase in Sewer Rates and Protest ballot attached to the written staff report; (3)direct staff to administer Proposition 218 majority protest ballot process; (3)send out the notice of proposed rates and protest ballots to all property owners and current customers of sewer services in accordance with Resolution No.2015R-43; (4) determine that the subject activity is statutorily exempt from review under the California Environmental Quality Act (CEQA) as rates, tolls fares, and other charges pursuant to Section 15273 of the CEQA Guidelines because it relates to the establishment, modification, structuring, restructuring, or approval of rates; and (5) set a public hearing to consider proposed sewer rate increases for July 11, 2023.
