CONSENT CALENDAR ITEMS PULLED FOR DISCUSSION
AGREEMENT - CHINO BASIN REGIONAL SEWAGE SERVICE [26:55] Council Members Johsz, Bennett, Marquez and Mayor Rogers pulled this item for separate discussion and vote.
Council Member Marquez asked about the other entities that are stakeholders and who they are.
City Manager Montgomery replied that specifically for this contract there are seven entities that will be signing, six are cities and the other is a Water Authority.
Council Member Marquez asked if the City anticipates any problems or future litigation on this agreement.
City Manager Montgomery replied that there are a number of agencies that believe they can move forward with the contract as structured, and there are a few that probably won't and that they have discussed whether nor not litigation will be the next step, but that is not the position of Chino Hills.
Steve Elie, Inland Empire Utilities Agency (IEUA) Board of Directors Vice President, stated that the City of Upland approved the contract last night at their meeting and that a few other cities also have this contract on their agendas to approve tonight. Vice President Elie stated that he appreciates the support of Chino Hills as it has been a difficult and arduous process due to the competing interests. He said there is a lot that needs to be worked on in our region with regards to water and sewers and he thanked staff for working with them on compiling the contract.

AGREEMENT - COMMUNITY PARK ARTIFICIAL TURF REPLACEMENT AND IMPROVEMENTS (PHASE II - FIELDS 5 AND 6) PROJECT [32:50] Council Member Marquez pulled this item for separate discussion and vote.
Council Member Marquez stated he has visited the park several times and that all of the users love the current improvements. He asked Community Services Director Marshall what the start and end times of the construction will be.
Community Services Director Marshall stated that the work will be completed between the middle of November 2023 through January 2024. He stated the reason this has been a phased project is because all six of the fields would not have been able to be completed within the time frame given and the process would have been detrimental to the sports groups that use the fields.
Council Member Marquez stated that this approach has limited the displacement of sports groups and Community Services Director Marshall stated that the City has been able to maintain a level of play by moving people around accordingly and at Community Park as well.
Council Member Marquez asked why this was done in two phases not under one contract.
City Manager Montgomery replied that the scope of work could not be accomplished easily without disrupting the park and user groups. Council Member Marquez asked if there will be one contact if any warranty issues arise in the future. City Manager Montgomery replied that there is one turf provider and effectively the City will be dealing with one team for any warranty issues.
CHINO HILLS CITY COUNCIL 2023-211
REGULAR MEETING SEPTEMBER 26, 2023
Council Member Johsz said the fields are greatly improved and he's happy that Fields 5 and 6 will be upgraded soon, and Mayor Rogers concurred.
Community Services Director Marshall stated that the expansion of the parking lot is impending, and they are looking at potentially two different areas to expand depending on the budget; one area is the grass area near the park's shed and the second is near the trash enclosure and potentially up to the trail fencing.
Mayor Rogers asked how many parking spots the expansion will net, and Community Services Director Marshall said potentially up 80 in the area adjacent to the shed and possibly another 40-60 in the other area.
Following discussion, a motion was made by Council Member Johsz and seconded by Mayor Rogers to (1) award the bid and Agreement No. A2023-199 to Los Angeles Engineering, Inc., in the amount of$887,385 for the construction of the Community Park Artificial Turf Replacement and Improvements(Phase II - Fields 5 and 6) Project located at 3280 Eucalyptus Avenue; and (2) authorized the City Manager, at his discretion, to approve cumulative change orders up to ten percent ($88,738.50) of the awarded construction contract amount.

Mayor Rogers asked for a presentation on the ridgeline ordinance over the next few meetings. City Manager Montgomery stated that the ridgeline ordinance has taken precedence lately in the discussions surrounding cell towers in the open space and the Council has called the question whether or not to lease the land for cell towers and that this would be a perfect time to discuss the ridgeline protection ordinance as well as there are certain designations that are specific to the code regarding defining ridgelines. Mayor Rogers spoke about pickleball at Vellano park and requested staff to define other areas at Grand Avenue Park, potentially Rink One, and address the popular sport. He stated the City has discussed the potential of resurfacing the court and he'd like to discuss it in more depth. Council Member Marquez inquired about the palm tree removal program in the Carbon Canyon creek bed.
