He added that on December 13, 2022, the City adopted Ordinance No. 389 restricting vehicles with more than four axles; however, Caltrans requested the Ordinance be amended to add vehicles or vehicle combinations with more than four axles, for example, if there is an attachment to the vehicle that will count towards the total amount of axles which will give law enforcement the tools needed to enforce. He added that the City of Brea is

also working on a similar ordinance to be approved and adopted in January 2024.

Mayor Moran closed the public hearing.
Council Member Rogers stated that the City has conducted a couple of traffic studies, staff and Public Works Directors Bobadilla and Majaj have been engaged, various conversations have ensued with Caltrans Districts 8 and 12, formed a Carbon Canyon Committee, and worked with the City of Brea to make this happen, a great story of perseverance. He thanked Caltrans locally and in Sacramento for helping to make it happen.

He also thanked City Manager Montgomery, Public Works Director Bobadilla, staff and Council Member Rogers for their efforts.
Council Member Johsz inquired about commercial vehicle enforcement and how that will look. Police Chief Girard responded that his department will work in conjunction with the City of Brea Police Department on informing the public of the law to ensure safe and timely implementation. He noted that CHP has the primary responsibility for enforcement but that the Chino Hills Police Department utilizes their resources to enforce traffic laws as it is the in the best interest of the citizens of Chino Hills.
Vice Mayor Bennett inquired about once a truck is identified and pulled over, how would they turn around. Police Chief Girard responded that they would most likely still proceed through Carbon Canyon but by issuing a citation it will hopefully serve as a deterrent them from accessing Carbon Canyon in the future.
Mayor Moran inquired if the City could impose a fine since it is the City's ordinance. City Manager Montgomery and City Attorney Hensley responded that they would research.
Council Member Marquez asked about someone who is doing business in Carbon Canyon and whether this new law would be an issue for them. Police Chief Girard responded that the way the law is written is that it will allow vehicles, such as moving vehicles and horse trailers, beginning in Carbon Canyon or travelling to Carbon Canyon access.
