Community Development Planning Manager Hofflinger briefed the City Council on the staff report and provided a PowerPoint presentation, which is on file in the City Clerk's Office. He provided the background of previous changes and discussed the difficulties in implementing and enforcing hedge height regulations. He spoke about increased public interest in wood material fencing and height allowances and stated that this presented an opportunity to further clarify existing provisions from previous updates.
Council Member Bennett asked if there is any requirement for construction to include an 18-inch footing, rebar, or concrete fill for standalone walls that are under six feet and Planning Manager Hofflinger replied that those standards only exist for permitted retaining walls. Council Member Bennett stated that he wanted to go on record notating that permits are not required for walls under six feet, therefore he asked residents to be aware as there are not set standards for the contractor to follow.
Council Member Marquez asked if the Community Development Department has entertained the idea of pre-approvals for ADUs and Junior ADUs. Planning Manager Hofflinger responded that the City is collaborating with the San Bernardino County Transportation Authority (SBCTA) on different designs, but nothing has been finalized as of now. He also stated that soon pre-approved plans will be required under state law. Mayor Moran opened the public hearing and asked if anyone wished to speak.
Peter Relich, spoke about Chapter 16.06.120 Fences, Walls, and Hedges, and commended the Community Development Department on a well-thought-out review and update. Mr. Relich asked for homes with current code violations to not be grandfathered in, but rather go through the formal process of being approved under the revised code with minor exceptions.
Mayor Moran closed the public hearing.
Council Member Rogers stated that he would like to echo what Mr. Relich said and commended staff and the Planning Commission for vetting out these complicated issues and listening to homeowners' points of view. Council Member Rogers stated he is concerned about the material made of wood and that he trusts what was stated in the presentation regarding the different stains and so forth to assist with the longevity of the material.
Council Member Bennett made a motion to approve.
Mayor Moran clarified the motion asking if the ordinance needs to be voted on first and then the Council can address the direction of the permitting process since they are two separate items. City Clerk Balz confirmed that was the correct protocol.
