REGULAR MEETING
City Attorney Hensley reminded speakers to keep their public comments to the City's subject matter jurisdiction. He explained what subject matter jurisdiction is and what City business includes: matters over which the City has been granted authority pursuant to State Law, and subject to State, Federal, and legal constitutional limitations. These matters include construction, maintenance and repair of streets, parks and public facilities providing water, sewer, and trash services, recreation services, and programs overseeing land development. To the extent the City has authority that has not been preempted by State or Federal Law providing Public Safety services, including Police, Fire, and Paramedic services, which the City does by contracting with San Bernardino County Sheriff's Department Chino Valley Fire District; and through its own Code Enforcement personnel by imposing regulations over conducting activities in the City to protect the health and safety and welfare of the community. The City has a right to hire and manage personnel, responsibility to maintain public records, and the authority to impose fees, taxes, and provide financial services necessary to all said services.
City Manager Montgomery explained that the traditional public comment timeframe is three minutes; however, for the past several months Council Members have shortened the timeframe to make the public comments accessible to all. He added that the Council is looking for one-minute comments this evening and that they will be taking public comments separately on Item No. 12, pertaining to the resolution affirming Chino Hills' commitment to combat all forms of hate.
Sarah Ramos-Evinger, resident, stated that prior City Council meeting disruptions have made others feel uncomfortable to attend meetings and asked Council what steps could be taken to ensure everyone has a comfortable space.
The following people requested the City to adopt a divestment policy and ceasefire resolution: Ali Ismael, Amir M, Omar Habbck, Safia, Margari Hill, Jasser, Ruba Kharaf, Ame, Suhana, Salma Rashad, and Mahum Shaw.
City Attorney Hensley stated that the issue of divestment is City business but a request for a ceasefire resolution is not.
Jenn spoke about the City's support of the Black Lives Matter movement and said that police presence does not help build trust in any community.
Selena stated that City Council meetings should start with a land acknowledgement of the Tongva people and requested that the Council adopt a divestment policy.
Sansan requested adding Palestinian and Arab to the anti-hate resolution.
Christian Sanchez agreed with the previous speaker to have Council meetings begin with a land acknowledgement and requested that the City Council adopt a divestment policy and ceasefire resolution.

ITEMS INITIATED BY COUNCIL
CITY'S COMMITMENT TO COMBAT ALL FORMS OF HATRED IN THE COMMUNITY RESOLUTION ADOPTED [44:33]
City Manager Ben Montgomery briefed the City Council on the staff report which is on file in the City Clerk's Office. He explained that the proposed resolution, initiated by Council Member Rogers, affirms the City's commitment to combat all forms of hatred in the community denouncing antisemitic and Islamophobic hate crimes and incidents. He stated that the resolution does not cover all the ways in which individuals direct their hate and does not act outside of the City Council's jurisdiction by influencing public policy in a foreign arena, and solely focuses on the City of Chino Hills and its residents.
He spoke about the comments made regarding transparency in the City and said that the Consent Calendar Item No. 17, Investment Policy, illustrates all the City's investments.
Ronnie Guyer, resident, spoke about all the love and hate that has been heard throughout the City, and encouraged the City Council to not discriminate or change a thing about how they conduct City business.
Norma Padilla, resident, stated that she has not witnessed any sign of violence in the City.
Sarah Ramos-Evinger, resident, spoke about incorporating inclusive language in the resolution and requested adding the term "Christian phobia." Safia spoke about encampments and said that the resolution does include anti- Palestinian hate and asked for it to be included in the resolution.
City Attorney Hensley stated that the encampment was not in Chino Hills and that public comments need to be focused on this City only.
The following people spoke about adding anti-Arab and anti-Palestinian hate verbiage to the resolution: Farzana, Suhana, Margari, Jasser, Ali Ismail, Zuhair, Salma Rashad, Imam Dr. Taleb Alsafi, C.P. REGULAR MEETING
Council Member Johsz agreed with Council Member Marquez's inclusion of anti-Arab and anti-Palestinian to the resolution and said to also include anti-Christian verbiage.
A lengthy Council discussion ensued about inclusivity language being incorporated in the proposed resolution and they expressed their concerns of excluding specific groups.
Vice Mayor Bennett provided a perspective of where the City began and added that he supports equal protection, safety, security, and providing peace of mind to all residents, but does not support the resolution in its current form.
Following discussion, a motion was made by Council Member Johsz and seconded by Council Member Marquez to amend the proposed resolution to include anti-Arab, anti- Palestinian, anti-Jewish and anti-Christian.
Council Member Rogers inquired about where the proposed language would be placed in the resolution.
Council Member Johsz recommended the fifth "Whereas" paragraph.
City Manager Montgomery stated that he quickly drafted wording to place at the fifth "Whereas" of the proposed resolution to ensure that he had captured all of Council's requests. He also pointed out that the reason behind terms left out of the resolution, was not to reflect on foreign policy. He read his draft as follows "WHEREAS, the City of Chino Hills denounces antisemitic and Islamophobic conduct and statements in all its forms in Chino Hills and condemns all hate crimes and any other form of racism and religious (Muslim, Jewish, Christian), ethnic (anti-Arab, antisemitic), and ancestry/national origin (Israeli, Palestinian) bias, discrimination, incitement of violence, or targeting of any person in Chino Hills."
Vice Mayor Bennett stated that someone will be excluded, and that the resolution is only a guideline, and it does not cover everything believed.
An Amended motion was made by Council Member Johsz and seconded by Council Member Marquez to adopt Resolution No. 2024R-030 of the City of Chino Hills, Affirming Chino Hills'Commitment to Combat all Forms of Hatred in our Community and Denouncing Antisemitic and Islamophobic Incidents in our Community, with revised language on the fifth "Whereas" of the resolution to read as follows: "WHEREAS, the City of Chino Hills denounces antisemitic and Islamophobic conduct and statements in all its forms in Chino Hills and condemns all hate crimes and any other form of racism and religious (Muslim, Jewish, Christian), ethnic (anti-Arab, antisemitic), and
