ITEMS INITIATED BY COUNCIL
ADMINISTRATIVE POLICIES AND PROCEDURES MANUAL UPDATE [1:42:28] City Manager Montgomery briefed the City Council on the PowerPoint Presentation which is on file in the City Clerk's Office. He spoke about proposed options for the Council to consider regarding the non-agendized public comment portion of the agenda as outlined in the written staff report.
Mayor Bennett confirmed that public speaking items are limited to City business as defined in the policy and on the cover of the agendas.
City Attorney Hensley stated that City Council meetings are not considered open public forums. He said the courts have defined City Council meetings as a limited public forum, which means topics are limited to the jurisdiction of the City Council.
Vice Mayor Johsz stated that he prefers Option C as this option provides the most flexibility for public speakers.
Council Member Moran agreed with Vice Mayor Johsz and stated that the purpose of City Council meetings is to conduct city business and that the meetings are not a forum for free speech. She continued that City Council meetings are a way for the community to communicate with the City Council and said that she supports the separation of Agendized and Non-agendized Public Comments Sections.
Council Member Rogers stated that he is supportive of Option B, which allows each speaker to have a two-minute comment period, with a maximum of 15 speakers.
Council Member Marquez stated that he is supportive of Option C and confirmed the comment period allowance depending on the number of speakers.
Mayor Bennett asked for confirmation that once the time limit was set, or if the speaker went off topic after being cautioned by the City Attorney, that the speaker would then relinquish their time, and the microphone would be turned off. City Manager Montgomery stated that the policy offers clear guidance on discussion topics, and staff will turn off microphones at the end of the time limit.
Mayor Bennett asked when comment cards are no longer accepted and City Clerk Balz said that after the meeting has begun, comment cards are no longer accepted as the number of cards turned in determines the time allotment for each speaker.
Following a lengthy discussion, a motion was made by Vice Mayor Johsz and seconded by Council Member Marquez to (1) change the time limit for public comments on items not appearing on the agenda to match the agendized items' time limit of one to three minutes per person, depending on the total number of speaker cards, to keep public comments to 30 minutes or less as follows: three minutes per speaker for 10 or fewer speakers, two minutes per speaker for 11 to 15 speakers, and one minute per speaker

Rogers: Council Member Rogers asked Police Chief Girard how many tickets have been issued to five-axle or greater vehicles in Carbon Canyon since the beginning of the year. Police Chief Girard responded that since January 1, 2024, Deputies have issued 105 traffic citations in Carbon Canyon, with five of them citing vehicles with five- axles or greater. Police Chief Girard reminded the public that there are certain instances where five-axle or greater vehicles can use Carbon Canyon for travel, such as when conducting business and a few other exceptions per the Municipal Code. Council Member Rogers inquired about how much contact Deputies have made with individuals riding motorized scooters who are not following the newly adopted ordinance. Police Chief Girard stated that no citations have been issued, as Deputies have only given verbal warnings; however, citations and the impounding of electric motorcycles or dirt bikes have taken place due to either not being street legal or the operator wasn't correctly licensed. Police Chief Girard said that May is National Bicycle Safety Month, and the Chino Hills Police Department will have several units emphasizing e-Bike safety and educational information operations throughout the City as part of the programming, as well as issue citations as needed. Council Member Rogers asked for an update on the Buddhist Temple located on Chino Hills Parkway and Rustic Drive that has been under construction for many years. Community Development Director Liguori said that the public improvements on Rustic Drive are close to completion and that they currently have an active grading permit; however, they need additional funding to continue the work and pour the foundation. Council Member Rogers asked about the Egyptian restaurant's status in the Commons and Community Development Director Liguori said

Marquez: Council Member Marquez asked Police Chief Girard if there is a certain age where helmets are required to be worn while riding e-bikes and if the e-bikes are required to ride with the flow of traffic. Police Chief Girard responded that the age requirement is 17 and under for helmets and that any bicycle or e-bike operated on the highway is subject to the rules of the road. Council Member Marquez asked if it was okay to park a trailer between the double yellow lines on Carbon Canyon. Police Chief Girard responded that it is not. Council Member Marquez asked for an update on the water treatment plant on Eucalyptus Road. Public Works Director Bobadilla stated that the construction is near completion as the City is in the final stages of testing and is making sure the water introduced into the facility is being treated properly.
