In addition, a resolution was proposed to designate specified off-street parking spaces for the exclusive use of electric vehicle charging on City-owned property to allow for citations if necessary.
Council Member Marquez inquired about accessory dwelling units (ADUs) parking requirements. The City works with individual homeowners who are building ADUs to accommodate for adequate parking, including the possibility of widening the driveway.

REGULAR MEETING OCTOBER 28, 2025
Council Member Marquez asked the City to investigate a better fire alarm system to assist with a faster response time to limit the amount of water that is used when activated. City Manager Montgomery stated that the City is looking at whether other technology could shrink the response times, but that a new system would be a huge overhaul to the current infrastructure. Council Member Marquez asked that all Fire staff know where all the shut-off valves are located in City Hall. City Manager Montgomery stated that the City has provided that training in the past and can certainly offer a tour again for all Fire personnel.
Following discussion, a motion was made by Vice Mayor Johsz and seconded by Council Member Marquez to (1) review and file the update to the City Hall Fire emergency declaration in accordance with Public Construction Code 22050 and continue to authorize the City Manager to negotiate and execute all necessary agreements related to the repair and restoration of City Hall under Chino Hills Municipal Code 2.08.065.A.1 on an emergency basis and (2) determine by four-fifths vote, there is a need to continue the City Manager's authority under Public Construction Code 22050 to repair City Hall and procure the necessary equipment, services and supplies for these purposes, without giving notice for bids to let contracts, due to the continued existence of the local emergency caused by the City Hall fire and flooding.

DEVELOPMENT IMPACT FEE NEXUS STUDY UPDATE AND PARK DEDICATIONS (ORDINANCES INTRODUCED AND RESOLUTION ADOPTED) [01:07:57] Finance Director Buhagiar provided a PowerPoint presentation and briefed the City Council on the staff report, which is on file in the City Clerk's Office, that examines infrastructure and public facility needs that will result from future growth in the City through 2045 and ensures the new development contributes its fair share to the cost of those facilities. She explained that impact fees are a one-time charge imposed at the building permit or certificate of occupancy stage for most residential projects and are imposed on all projects within a defined area. The fees need to fund facilities that are needed to serve new development and cannot be used for ongoing maintenance and operations or facilities to only serve existing development. Impact fees free up the general fund revenues to be used for ongoing services and those ongoing needs.
City Manager Montgomery spoke about the new Fire Facilities Development Impact Fees that would pay for various equipment and would recover a portion of the $8 million that was appropriated for the new Fire Station 68. Council Member Marquez asked if the apparatus and ladder truck are incorporated as facilities fees and Finance Director Buhagiar confirmed that the fees can be used for the purchase of apparatus. She continued that the purchase must be made to benefit the City. City Attorney Hensley stated that the equipment purchased using the funds would need to stay within the City, except when used for mutual aid purposes. Council Member Marquez asked for the distinction to be made clear regarding the purchase and use of equipment in any future agreements.
Council Member Moran suggested that the Fire Facility Needs ad hoc Committee members reconvene to discuss future funding needs for fire related items. There was a Council consensus to reconvene the Fire Facility Needs ad hoc Committee to discuss future fire matters and funding.
Finance Director Buhagiar continued the PowerPoint presentation and discussed Quimby In-Lieu fees. Vice Mayor Johsz asked why there was not an increase in the fee structure since 1998, and Finance Director Buhagiar stated that she could not speak for

her predecessors, but she was asked to look at the Quimby In-Lieu fees during the next Development Impact Fee update.
Discussion ensued regarding the updated Development Impact fees for several different types for five different project types, municipal code updates regarding various facilities fees and proposed Quimby related changes.
Community Development Director Liguori further continued the PowerPoint presentation and spoke about the Building Industry Association, Lennar Homes, and Warmington Homes who requested the possibility of grandfathering in all projects where there is an approved tentative tract map, as long as that map is finalized by November 1, 2028, and to phase-in the Park and Quimby In-Lieu fees over a four year period, beginning with 25 percent the first year and increasing by 25 percent annually until 100 percent is reached. He mentioned that the current 44 parks in the City will continue to require ongoing maintenance, in addition to any new parks that are added with a new development. Community Development Director Liguori stated that by phasing-in the fees, it can amount to lost revenue for the City as only a portion of the total amount of revenue would be received, which would require the City to take funding from other sources to offset the costs.
Council Member Moran asked how much revenue would potentially be lost with the proposal by BIA, and Community Director Liguori stated that an estimated revenue loss of $8 to $9 million dollars could be lost with the current projects that are in the cue.
Mayor Bennett opened the public hearing and asked if anyone wished to address the City Council on the matter.
Carlos Rodriguez, BIA, requested a continuance on the Park Fees only to allow for discussion on the implications for the request for an exemption and the phase-in approach to better understand the assumptions that were made for the $8 to $9 million dollars of potential revenue loss. He continued that there are two approaches which are to adopt a narrowly defined resolution that includes a defined time-limited grandfather exemption and to assess that the new fees would ultimately be passed on to the aspiring homebuyer. Mr. Rodriguez stated that Chino Hills has reached less than five percent of the Regional Housing Needs Assessment (RHNA) goals at the mid-point of the RHNA cycle. He continued by asking the Council to exercise their local control that would provide for future park investment while protecting housing affordability and implementing a balanced phased approach that would not be a detriment to current projects.
Jeff Smith, Vice President of Planning for Lennar Homes, spoke about an attainable housing crisis in the state that is making it difficult for families to purchase homes, and asked the Council to consider those factors as they make their decision. He asked for the Council to find a balance and phased approach for the projects that have their business plan set and capital secured, as a $11,000 plus fee per home is a significant hardship.

REGULAR MEETING OCTOBER 28, 2025
Debra Madsen, resident, stated that her children cannot afford a home in Chino Hills and asked for Council to help keep housing more affordable.
Mayor Bennett closed the public hearing.
Discussion ensued amongst Council about the need to increase the fees due to the lack of increases over the past 25 years, while keeping in mind the desire to keep housing affordable. Vice Mayor Johsz suggested using a three-year phase-in approach for the new fees versus the four-year year approach with approved tentative tract maps finalized by November 1, 2027, instead of 2028.
City Attorney Hensley advised the Council that they can adopt the new fee schedule and then at the next meeting they can exchange the fee schedule and continue the discussion of grandfathering in the current developments as it relates to the Quimby In-Lieu and Park fees to allow for continued discussion on the issues raised at the meeting by the BIA.
Mayor Bennett stated that it is important for everyone to keep in mind that the City is trying to recuperate the costs that are involved with new developments so as not to subsidize costs.
Council Member Moran asked for clarification on the Vila Borba Project progress and Community Development Director Liguori stated that the stormwater detention basin needs to be constructed before building of the 220 townhomes and 19 single family homes can commence. He stated that once the appropriate permits are obtained, the project can move forward.
Discussion ensued about the collaboration and compromise in the implementation of the new Development Impact Fees for infrastructure and park needs. Mr. Smith and Mr. Rodriguez thanked the City Council for their willingness to work together on a solution that would benefit both entities while keeping housing affordability at an attainable level.
City Attorney Hensley advised the Council to approve the recommendations as outlined in the written staff report on file in the City Clerk's office and request staff to bring back the alternatives discussed with regard to grandfathering in certain projects and the phasing-in of Quimby In-Lieu and Park fees to the next Council meeting.
Following a brief discussion, a motion was made by Vice Mayor Johsz and seconded Council Member Marquez to (1) introduce ordinances entitled: An Ordinance of the City of Chino Hills, Amending Chapter 3.40 (Various Facilities Fees) of the Chino Hills Municipal Code, Repealing Resolution No. 2017r-012, Adopting a Development Impact Fee Nexus Study Including a Capital Improvement Plan, Adopting New Fire Facilities Fees and Increased General City Facilities, Traffic Facilities Impact, and Parks and Recreation Facilities Fees and Finding the Same to be Exempt From the Provisions of the California Environmental Quality Act; (2) An Ordinance of the City of Chino Hills, Repealing Ordinance No. 66, Repealing Chino Hills Municipal Code (CHMC)

PUBLIC COMMENTS - NON-AGENDIZED [01:59:57]
Debra Madsen, resident, spoke about the lack of ingress/egress emergency exits in Carbon Canyon, and stated that the gate toward Vellano is in poor repair. She inquired that in case of the loss of power, will there be sufficient water pressure in Summit Ranch at the pump station.
Public Works Director Bobadilla stated that battery back-up systems or portable power back-up systems are installed throughout the City to assist in case of power outages to provide enough water pressure should the City lose power for an extended period.
Council Member Marquez asked City Manager Montgomery to provide additional information regarding Ms. Madsen's comments, in which he replied that they are going to bring this item back to the Council for discussion at a future meeting.
