COUNCIL AND STAFF VERBAL REPORTS – Section 2

2.1 COUNCIL VERBAL REPORTS
Legislative, Collaborative Agency, Ad Hoc
Mayor Chavez attended the well-attended Chowchilla Western Stampede Dinner.

2.2 STAFF VERBAL REPORTS
City Administrator Pruett attended several meetings with NBS regarding the refinancing of the Community Facilities District (CFD); participated in an Executive Team meeting with multiple agencies, County of Madera, the City of Madera regarding COVID-19 and discussed the impact of the new Omicron variant; attended the Rotary Lunch with the Mayor last week; met with Mid Valley Disposal and Director Rogers regarding implementation of SB 1383 and the contract; introduced the new Finance Director, Kerri Williams, to Council, who started working on Monday, January 3, 2022.

Recreation & Community Engagement Wisener has been training with Civic Plus software website module regarding the City’s Website redesign. The City released the new branding at the beginning of this year. She drafted a new contract with Community Science Workshop Network, and will be brought back for Council review and approval. She continues working with Public Works on the recreation building improvements, getting ready for flooring. We are working on all the Sports Use Contract and updating with other organizations that we are contracted with and will be bringing to Council next month. She is currently assisting the Chowchilla District Chamber of Commerce with the Annual Community Awards Dinner occurring this weekend.

City Council Meeting Agenda January 11, 2022
Finance Director Williams has acclimated with the Finance Department, meeting her new team.

She also attended meetings with the City Administrator and NBS regarding the refunding of the CFD.

Public Work Director Rogers recently received three quotes from contractors regarding the Police Department Plumbing Replacement Project and is currently reviewing all quotes for completeness and plan to bring to Council for approval at the January 25th meeting.

PD Fence Project Update: After delays related to PG&E and the wet weather through December, as of last week, work has resumed on the project. Boring for the column foundations was completed, an old galvanized water line to PD was removed and replaced and a new backflow device was installed. Completion is estimated for March.

Even though December was a much needed rainy/snowy month, most of the State is still classified as being in a drought. As a result, the State Water Resources Control Board adopted new water restrictions for the State. The good news is that they are fairly mild and have already been adopted by the City and incorporated in our Municipal Code.

Today Public Works received a draft grant funding agreement for $3,349,635 from the State Water Resources Control Board for Stormwater Improvements on Sonoma Avenue. We will be meeting with the State within the next month to finalize the agreement and bring back to Council for approval.

Community & Economic Development Director Hamilton handed out the updated copy of the Rancho Calera 2021 Specific Plan. Construction of Riley’s Auto Parts started this past week and is waiting for PG&E clearance to move the project along. Mountain Mikes had their fire inspection today and will be having a soft opening soon. There were seventeen (17) new housing starts this past December, and the City is on track to meet projected goals and exceed the building permits that were originally budgeted. Anticipate a slow down with the Federal Reserve announcement of an increase of loan rates, and the jobs report was not positive. Groundbreaking for Joe’s Car Wash was last weekend, and he was sorry that he missed the event but was told that it was a success and well attended. Director Hamilton reminded Council that the City has purchased two (2) tables for the Chambers Award Ceremony this weekend. The Loan Committee processed one more economic loan for Salter’s Distribution and was funded this past week. The Loan Committee is looking at two (2) more funding applications next week for potential funding. This program has processed a total of six (6) to seven (7) loans at this point.

Mayor Chavez read into minutes a congratulation’s letter to the City of Chowchilla from Senator Anna M. Caballero 12th Senate District California Legislature regarding Permanent Local Housing Allocations (PLHA) Program funds for Homebuyer Assistance in the amount of $164,202.00.

Adoption of a Resolution Awarding the Police Department Water Pipe Rehabilitation Project to Divcon, Inc. in the Amount of $253,067.08 and Authorizing the City Administrator or Designee to Execute all Related documents Thereto

Resolution, Bid Document

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That City Council approve a resolution to authorize the City Administrator or designee to execute an agreement with Divcon, Inc. for the Police Department Water Pipe Rehabilitation Project.

BACKGROUND:

The City of Chowchilla recently requested proposals from qualified building contractors to rehabilitate the aging cold/hot water piping with the police department station located in Chowchilla, California. A majority of the building’s plumbing is over 50 years old and failing, occasionally leading to breaks, leaks and expensive repairs. This project will include removing/replacing the internal water piping system, fixtures, hot water heater and circulator pump. When complete, the building will have a plumbing system to meet the requirements of an essential services building.

The City initially advertised for requests for proposals (RFP) for this project in May 2021 and July 2021.

However, the city did not receive any bids for either RFP. As a result, the reached out directly to multiple vendors through a mini-RFP process and allowed access to the building’s infrastructure in order to put together their best estimate.

As a result of the mini-RFP, three (3) bids were received from:
• Divcon, Inc.
• Diede Construction, Inc.
• Burke Construction
REASON FOR RECOMMENDATION:

The three proposals received were reviewed by City staff for completeness and to ensure that they included the same assumptions. Upon analysis of the bids submitted, Divcon, Inc. submitted the lowest bid.

The breakdown of costs from the respondents for the project are as follows:

CONTRACTOR COST
Divcon, Inc. $253,067.08
Diede Construction, Inc. $435,063.00
Burke Construction $504,528.00
Staff recommends an award be made to Divcon, Inc. In addition to the base bid provided by Divcon, Inc., staff is also recommending a contingency amount equal to 18.5% be set aside for the project in the amount of $46,933. This is higher than the City’s typical 10% contingency allocation on projects and is due to the potential unknowns of the project, such as age of the facility, hazardous material, or additional issues related to the completion of the project. As a result, staff is requesting $300,000.00 for the project.

FISCAL IMPACT:

A total of $300,000 of Measure N funding for this project is currently budgeted in the Council approved FY 2021/22 City Budget.

ALTERNATIVES:

SUBJECT: Resolution Approving Parcel Map No. 21-0007
PREPARED BY: Jerry Jones, City Engineer
ATTACHMENTS: Resolution, Final Parcel Map No. 21-007

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council adopt a resolution approving Parcel Map No. 21-007.

BACKGROUND:

The applicant, CFT NV Developments, LLC, submitted Tentative Parcel Map (TPM) 21-007 in March 2021.

TPM 21-007 proposed to divide the existing 4.88-acre property at 313 Prosperity Blvd near the Robertson Blvd/SR 99 interchange into two (2) parcels, totaling 0.79 and 4.09 acres, for commercial use. The smaller lot was used for the construction of the Panda Express Restaurant and the larger lot is being planned for future development. TPM 21-007 was subsequently approved by the Planning Commission on May 3, 2021 and City Council on May 25, 2021. As conditions of approval for TPM 21-007, the applicant was required to complete the following:

1. Submit a Parcel Map for review and approval by the City.

2. After approval of the Parcel Map and once all final property monuments had been set to provide notice and evidence of such to the City Engineer; and

3. Dedicate private access, private utility, private drainage, private storm drain, and emergency vehicle access easements with the Final Parcel Map.

The improvements associated with the Panda Express development have been completed, and any future improvements needed for the 4.09-acre parcel will be addressed during review of those associated development plans. There are no improvements conditioned with the approval of the parcel map, nor are any public dedications required or proposed.

The Parcel Map has been submitted by the applicant, reviewed and approved by the City Engineer and City Surveyor, and is ready for approval by City Council.

REASON FOR RECOMMENDATION:

The final map is in substantial conformance to the approved tentative map and complies with all necessary requirements of the City’s General Plan.

FISCAL IMPACT:

ALTERNATIVES:

None recommended.

ACTIONS FOLLOWING APPROVAL:

THE AGENDA
Meeting of: January 25, 2022
AGENDA SECTION: New Business
SUBJECT: Council Resolution adopting the submittal of an application for the funding and execution of a grant agreement for the 2020-2021 Funding Year PREPARED BY: Mark Hamilton, Community and Economic Development Director ATTACHMENTS: Resolution approving the submittal of for funding and the execution of a grant agreement from the California Department of Housing and Community Development (HCD).

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Staff recommends the City Council to approve the resolution authorizing application for, and receipt of, Community Development Block Grant for the Economic Development Loan Program.

BACKGROUND:

The California Department of Housing and Community Development (Department) receives funding from the United States Department of Housing and Urban Development (HUD) for the Community Development Block Grant (CDBG) Program and allocates funds to CDBG eligible non-entitlement jurisdictions.

In response to economic hardships experienced by various community businesses due to the COVID-19 pandemic, the City of Chowchilla (City) submitted multiple applications to the California Department of Housing and Community Development (HCD). The City submitted a combined total of five (5) grants to HCD, three (3) non-competitive and two (2) competitive grant applications. Four of the five (5) of the applications submitted were successful. Staff was recently informed the 5th application submitted would also become successful with the reconsideration of the attached resolution.

After City Council approved the submittal of the second “Economic Development Loan Program” application, HCD updated the resolution template. The HCD representative reviewing the City’s application advised staff the resolution authorizing the submittal of the application would need to be reconsidered by our Council prior to HCD awarding the grant to the City. Provided council re-approves the resolution (Attachment 1) authorizing the submittal of application in the fillable-form format, HCD anticipates finalizing the City’s application within 4-6 weeks of re-submittal.

The application submitted was through the competitive HCD – CDBG NOFA process. Once awarded, the funds would continue to assist community businesses. The amount the City is anticipating to receive from HCD is $500,000. Combine this anticipated award with the previous $500,000 the City received, this is a combined $1,000,000 invested into local community businesses.

FISCAL IMPACT:

At this time, there is no fiscal impact to the City of Chowchilla. City Staff will work closely with Michael Baker International, our Economic Development Consultant, to assist City Staff with the submittal of this application. There is no impact to the City’s General Fund.

ACTIONS FOLLOWING DECISION:

Acceptance of any grant awarded and/or additional contracts with Michael Baker International for implementation for the planned activities would be brought before City Council at a later date for consideration and possible action.

Provided HCD approves the City’s CDBG Economic Development Loan Program application for funding, the City Administrator would be required to execute any future documents related to the execution of the grant and the agreement with HCD. Additionally, upon execution of the grant agreement, the Finance Director would accept, appropriate, and modify appropriated city accounts related to awarding of the grant to the City of Chowchilla.

ALTERNATIVES:

1. Approve, subject to other than recommended by staff (identify specific findings and/or conditions amended; or, to be addressed in City Council motion); or,

2. Deny; or,

3. Refer to City Staff for reconsideration of specific items to be addressed in City Council motion).

ACTIONS FOLLOWING APPROVAL:

If Awarded, the City will work with the State of California and Michael Baker International Inc. (vendor) with the implementation of these funds into the community.

THE AGENDA
Meeting of: January 25, 2022
AGENDA SECTION: New Business
SUBJECT: Resolution Approving Final Map and Subdivision Agreement for Subdivision No. 21-0009, Oleander Terrace
PREPARED BY: Jerry Jones, City Engineer
Mark Hamilton, Community and Economic Development Director ATTACHMENTS: Resolution with Exhibit ‘A’ – Subdivision Agreement for Oleander Terrace

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMNDATION:

That the City Council adopts a resolution approving the Final Map and Subdivision Agreement for Subdivision No. 21-0009, Oleander Terrace.

BACKGROUND:

On March 17, 2021 and April 13, 2021 respectively, the Planning Commission and City Council approved Tentative Tract Map No. 20-0020, submitted by Fortis General Construction (Fortis), for property in the western area of the City. The property is generally bounded by the Riverside Park subdivision to the east, the Valley Grove Estates subdivision and Howell Road to the south, rural residential property to the west, and the Ash Slough Bypass Canal to the north. The Tentative Map consisted of property designated for single-family residential use, specifically 28 single-family residential lots. In the time since approval of the Tentative Map, Fortis has submitted the final map, improvement plans, and required technical documents for the subdivision. The final map is included for reference as Exhibit C to the resolution. The final map has been reviewed and was deemed technically correct by City Staff in late 2021. The improvement plans have been reviewed and approved by City Staff.

At this time, Fortis has requested that City Council consider approval of the final map. In order for the final map to be approved and subsequently recorded, Fortis is required to enter into a subdivision agreement with the City. The subdivision agreement requires Fortis to post improvement and warranty securities in favor of the City to ensure that the improvements are completed, if Fortis fails to do so. In addition, the subdivision agreement specifies the development impact fees to be paid by Fortis and the timing of collection by the City. Other provisions of the subdivision agreement include final acceptance terms, annexation to Landscaping and Lighting Maintenance District No. 90-1, annexation to a Community Facilities District or entering into a separate financing agreement to defray costs of municipal services. schedule for completion of improvements, construction standards, and others. Substantial completion (i.e. all utilities completed and tested, streets paved, street lighting installed, and any other improvements necessary to protect public health, safety, and welfare) of the improvements is required by March 31, 2022.

No certificates of occupancy for homes within the subdivision will be granted until the improvements are deemed substantially complete by the City Engineer. The subdivision agreement is included as Exhibit 1 to the resolution provided as Attachment ‘A’. In addition to approving the final map, Staff recommends that Council accept the parcels of land and easements offered for dedication for public use on the final map.

Development Impact Fees:

The single unit development impact fee ($20,323.89) and total development impact fees ($569,068.92) for the project are currently waived until June 30, 2022. The fees were waived for the project due to the building permits for each unit being ready for issuance for each residential unit prior to the June 30, 2021 deadline established by City Council Resolution 80-18. If the building permits are not pulled and applicable building permit fees paid for by the developer prior to June 30, 2022, the developer will be subject to payment of the full development impact fee of $20,323.89 for each remaining single-family unit located within the Oleander Terrace Project.

Waiver of all development impact fees when building on a vacant lot located in Chowchilla, west of the Union Pacific Railroad Tracks.
• City Council Resolution 28-16 “Authorizing Infill Program” 4/01/2016 – 04/01/2018 This program provides for the waiver of all development impact fees in the older, established neighborhoods, defined as that region within the yellow lines on the attached map, providing that builders construct new homes or businesses on vacant infill lots, that the homes or businesses pass their final inspection prior to the end of this program, and meet or make a substantial effort to procure at least 20% of their goods and services originating from within the City of Chowchilla. • City Council Resolution 93-16 “18 Month Extension of Infill Program” 9/13/2016- 12/31/2018 Amending Council Resolution 93-16 to allow builders to procure 20% of their goods locally and still quality for the infill program. City Council Resolution 80-18 Infill Program Deadline Extended to June 30, 2021.

REASON FOR RECOMMENDATION:

The final map is in substantial conformance to the approved tentative map and complies with all necessary requirements of the City’s General Plan.

FISCAL IMPACTS:

There is no negative fiscal impact to the City of Chowchilla with the approval of this development. While the developer was able utilize a now expired “Infill Program” to assist with reducing Development Impact Fees, the Developer is still responsible for cost associated with off-site improvements, building permit fees, and other applicable fees associated with the development.

ALTERNATIVES:

None recommended.

ACTIONS FOLLOWING APPROVAL:

City Staff will execute the map and Subdivision Agreement and deliver both to the County Recorder’s office.

Issue is the agreed upon costs to build that add-on/building has significantly increased since 2009.

In agreement it is $243,800 which is $102 sq. ft. Now the County says the cost is roughly $700 sq. ft = $1.5M. We are continuing to work with the County to find a resolution.

Reviewed the Johnson Plumbing bid and requested a meeting to discuss.

Ongoing project management. Met with PG&E as they
halted the project due to them not notifying us of an
easement for their utility vault under after trenching
was completed. Y&H and I tried to get them to provide
an expedited approval due to their missed oversight but did not see the requested results. As a result, met with Y&H an identified a quicker path to completely remove
PG&E from the equation. The civil plan was revised to
realign the CMU wall outside of PG&E's newly identified easement rather that going through a potentially

This phase will consist of the installation of storm drainage improvements to serve the area south of Robertson
Boulevard. A large-diameter storm drainage pipeline will be installed in Humboldt Avenue from 3rd Street to 15th Street, where it will connect to the existing storm drainage system.

In concept, lateral pipelines will be installed in 10th Street, 5th Street, and 3rd Street to collect surface runoff and convey it to the pipeline in Humboldt. As part of Phase I, Humboldt
Avenue will be reconstructed to improve the pavement
surface. According to the City’s Pavement Management
System, Humboldt is in Poor to Very Poor condition. In Staff’s opinion, this area is best suited as Phase I due to the need not only for storm drainage improvements, but also the
