THE AGENDA
Meeting of: April 12, 2022
AGENDA SECTION: Consent
SUBJECT: Consideration of a Resolution Authorizing Continued Use of Remote Teleconferencing Provisions Pursuant to AB 361 and Government Code Section 54953
PREPARED BY: Joann McClendon, City Clerk
ATTACHMENTS: Resolution

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council adopt a resolution authorizing the continued use of remote teleconferencing provisions pursuant to AB 361 and Government Code section 54953.

BACKGROUND:

On September 16, 2021, the California legislature passed Assembly Bill (“AB”) 361, which amends Government Code, section 54953 and permits a local agency to use teleconferencing to conduct its meetings in any of the following circumstances:
(A) the legislative body holds a meeting during a proclaimed state of emergency, and state or local officials have imposed or recommended measures to promote social distancing; or (B) the legislative body holds a meeting during a proclaimed state of emergency for the purpose of determining, by majority vote, whether as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees; or (C) the legislative body holds a meeting during a proclaimed state of emergency and has determined, by majority vote, pursuant to subparagraph (B), that, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.

REASON FOR RECOMMENDATION:

In order for the City Council to continue use of teleconferencing as allowed by AB 361, it must first adopt the resolution allowing the City Council to conduct teleconferenced meetings for a period of thirty (30) days. In addition, AB 361 requires the City to continue to make specified findings every thirty (30) days thereafter. The last time this was presented on the agenda was March 22, 2022. If we would have waited until April 26, we would have been out of compliance with AB361.

FISCAL IMPACT:

None foreseen at time of report.

ALTERNATIVES:

Not adopt the resolution and revert to the original Brown Act rules for posting agendas when a member of the council remotely joins a City Council meeting.

ACTIONS FOLLOWING APPROVAL:

Continue to place the item on the City Council meeting agenda every 30-days to continue with the AB361 guidelines without disruption.

COUNCIL RESOLUTION # -22

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHOWCHILLA, CALIFORNIA AUTHORIZING CONTINUED USE OF REMOTE TELECONFERENCING PROVISIONS (AB 361 AND GOVERNMENT CODE SECTION 54953)
WHEREAS, the City Council of the City of Chowchilla (“City Council”) is committed to open and transparent government, and full compliance with the Ralph M. Brown Act (“Brown Act”); and WHEREAS, the Brown Act generally requires that a public agency take certain actions in order to use teleconferencing to attend a public meeting virtually; and WHEREAS, the City Council recognizes that a local emergency persists due to the worldwide COVID-19 pandemic; and
WHEREAS, the California Legislature has recognized the ongoing state of emergency due to the COVID-19 pandemic and has responded by creating an additional means for public meetings to be held via teleconference (inclusive of internet-based virtual meetings); and WHEREAS, on September 16, 2021, the California legislature passed Assembly Bill (“AB”) 361, which amends Government Code, section 54953 and permits a local agency to use teleconferencing to conduct its meetings in any of the following circumstances: (A) the legislative body holds a meeting during a proclaimed state of emergency, and state or local officials have imposed or recommended measures to promote social distancing; (B) the legislative body holds a meeting during a proclaimed state of emergency for the purpose of determining, by majority vote, whether as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees; or (C) the legislative body holds a meeting during a proclaimed state of emergency and has determined, by majority vote, pursuant to subparagraph (B), that, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees; and
WHEREAS, in order for the City Council to use teleconferencing as allowed by AB 361 after October 1, 2021, it must first adopt findings in a resolution, allowing the City Council to conduct teleconferenced meetings for a period of thirty (30) days; and WHEREAS, Governor Gavin Newsom declared a state of emergency for the State of California due to the COVID-19 pandemic in his order entitled “Proclamation of a State of Emergency,” signed March 4, 2020; and/or
WHEREAS, the California Occupational and Safety Health Administration (OSHA) continues to recommend certain social distancing requirements, as described in detail in California Code of Regulations Title 8, section 3205 Covid Prevention; and/or WHEREAS, Madera County Health Officer, Dr. Simon Paul issued a letter on October 8, 2021 recommending physical distancing measures by way of utilizing teleconferencing options for public meetings to facilitate participation in public affairs and encourage participants to protect themselves and others from the COVID-19 virus; and
WHEREAS, on March 22, 2022, March 8, 2022, February 8, 2022, January 11, 2022, December 14, 2021, November 23, 2021, and October 26, 2021, the City Council continued use of the remote teleconferencing provisions originally adopted on September 28, 2021; and WHEREAS, the City Council hereby finds that the state and local emergencies have caused and will continue to cause imminent risks to the health or safety of attendees; and WHEREAS, the City Council is conducting its meetings through the use of telephonic and internet-based services so that members of the public may observe and participate in meetings and offer public comment.

NOW THEREFORE, BE IT RESOLVED, that the recitals set forth above are true and correct and fully incorporated into this Resolution by reference.

BE IT FURTHER RESOLVED, that the City Council is conducting meetings during a state of emergency and the County of Madera and OSHA recommend measures to promote social distancing.

BE IT FURTHER RESOLVED, that the City Council has determined that given the state of emergency, holding in-person only meetings would present imminent risks to the health or safety of attendees.

BE IT FURTHER RESOLVED, that the actions taken by the City Council through this resolution shall be applied to all City committees governed by the Brown Act unless otherwise desired by that committee.

BE IT FURTHER RESOLVED, the City Council authorizes the City Manager or their designee(s) to continue to take all actions necessary to conduct City Council meetings in accordance with AB 361 and Government Code section 54953(e) and all other applicable provisions of the Brown Act, using teleconferencing for a period of thirty (30) days from the adoption of this Resolution after which the City Council will again reconsider the circumstances of the state of emergency.

SUBJECT: Consideration of Quarterly Waiver Report
PREPARED BY: Rod Pruett, City Administrator
ATTACHMENTS: Quarterly Fee Waivers Issued

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council approve the Quarterly Fee Waiver Report for the January through March 2022.

BACKGROUND:

Council approved the City Administrator to have the authority to waive penalties, interest, fees, liens, et cetera, up to $10,000. It was requested that a quarterly report be presented that summarized the transaction the City Administrator granted under this authority.

REASON FOR RECOMMENDATION:

This report is a summary of the waivers that were issued and is an element of transparency for the Council and the public. These waivers are issued on a case by case basis and will fluctuate from quarter to quarter.

This is a tool for the Council to evaluate the use and effectiveness of the program.

FISCAL IMPACT:

There was one waiver issued for $195 for Cornerstone Church. This was a waiver of park rental fees for a 3-day Kids Camp to be held at Ed Ray Park April 11 through April 13, 2022.

SUBJECT: A City Council Resolution Approving Amended Applications for Transportation Development Act (TDA) Funds for Fiscal Year 2021/2022 due to Increases in STA and LTF Allocations and Prior Years Carryover of Funds for Pedestrian & Bicycle Program and Authorizing the City Administrator or Designee to Execute and Submit Applications to the Madera County Transportation Commission
PREPARED BY: Sherri Dueker, Accounting Manager
APPROVED BY: Joann McClendon, City Clerk
ATTACHMENTS: Resolution, Final TDA Allocations, Amended Applications

REVIEWED BY

ADMINISTRATOR
☒ REVIEWED BY
ATTORNEY ☒ REVIEWED BY FINANCE ☒
RECOMMENDATION:

Staff recommends that Council approve the resolution (a) approving amended TDA applications for FY 2021/22 TDA Local Transportation (LTF) and State Transit Assistance (STA) funds including carryover balances from prior fiscal years for Pedestrian & Bicycle program; and (b) authorizing the City Administrator or Designee to execute the applications for submittal to the Madera County Transportation Commission (MCTC) for adoption.

BACKGROUND:

On June 29, 2021, Council approved Resolution 49-21 approving applications for Transportation Development Act, Local Transportation Funds (LTF), and State Transit Assistance (STA) annual allocations. Due to a recent increase to both LTF and STA allocations, City Staff is required to advise Council of changes, get approval of these changes and submit approved resolutions to MCTC. Included in this amendment is carryover allocations from previous Fiscal Years for the Pedestrian and Bicycle program and will bring allocations to current year.

As a reminder, the State Controller annually approves LTF and STA apportionments by county pursuant to the Transportation Development Act (TDA). MCTC allocates these funds to local agencies based on each jurisdiction’s percentage share of the total County population. Annually, local agencies are required to submit applications for approval to MCTC. The applications may be amended, as needed.

REASON FOR RECOMMENDATION:

LTF funds are programmed for public transit services; pedestrian and bicycle facilities and streets and roads maintenance and construction projects. Transit must be fully funded consistent with the MCTC annual Unmet Transit Needs findings, as transit has priority use of these funds. A mandatory 2% is allocated for pedestrian and bicycle facilities and 3% for transportation planning. The remaining balance may be expended on street maintenance and construction projects. STA funds may be used only for public transit purposes, including operating and capital projects.

MCTC requires Council approval prior to submittal of LTF and STA applications. The FY 2021/22 LTF and STA amendment request applications have been prepared, as attached, reflecting proposed use of these funds.

The City’s total FY 2021/22 allocation is $446,322 for LTF and $138,243 for STA. The LTF and STA amended applications specify proposed expenditures of these funds. The carryover amount for Pedestrian & Bicycle program for fiscal years 16/17, 17/18, 18/19 and 19/20 is $43,549 to include current year of $9,396 for a total current year allocation of $52,945.00.

FISCAL IMPACT:

No Impact to General Fund.

ALTERNATIVES:

None.

ACTIONS FOLLOWING APPROVAL:

Upon signatures, City Clerk to return documents to Sherri Dueker in Finance.

THE AGENDA
Meeting of: April 12, 2022
AGENDA SECTION: Consent
SUBJECT: Consideration of Monthly Financial Statements
PREPARED BY: Kerri Williams, Finance Director
ATTACHMENTS: February 2022 Budget vs Actual and Balance Sheet

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Approve the February 2022 Financial Statements shown in the attachment.

BACKGROUND:

Staff provides Council with monthly financial information as an ongoing financial status update.

REASON FOR RECOMMENDATION:

The monthly financial statements consist of a Budget vs Actual and a Balance Sheet for the General Fund.

The Budget vs Actual shows the current Month (Period Activity) and current Year (Fiscal Activity) Revenues and Expenses by Department in summary form compared to the current year Original and Current budgets. The Balance Sheet shows the Assets, Liabilities and Fund Balance at the time the report is generated. This provides an overview of cash, amounts owed to the City, amounts the City owes and the fund balance at a specific point in time.

The financial statements are being presented as an overview of the City’s finances and are not meant to be a comprehensive in-depth review. As a reference to compare to the percent remaining column in the report, the percentage of the year remaining 33%.

If the percent remaining column for Revenues is higher than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant. If the percent remaining column for Expenses is lower than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant.

If there are questions regarding the actual amounts or budget vs actual variances, please forward your questions to me in enough time before the meeting for staff to research them.

FISCAL IMPACT:

Revenues
General Administration- Property tax and VLF, which are 2 of our biggest revenues, are only received 2 times a year in February and May so we have only received the 1st distribution. Property tax is coming in less than anticipated but VLF is coming in a little more. We will see how property tax does on the 2nd distribution. We are teetered which means we do not have to worry about delinquencies because the County pays us and goes after the delinquencies themselves. Sales tax payments run a couple months behind and this report amount represents payments received through December 2021. Sales tax is our 2nd largest revenue and it is projected to come in fairly higher than budgeted.

City Attorney- This is the settlement from the HSR and that is not something we budgeted for.

General Services- The budgeted revenue here is from an internal accounting for the POB debt service.

Since the POB expense for debt service in located in this department for the GF we had to bring the revenue from the applicable departments to offset the expense. Public Safety and Miscellaneous Tiers 1 were part of the POB so those respective GF departments have a reduction of PERS cost because of the bond issue so they now have a debt service cost instead of PERS costs. This transfer will happen at the end of the year.

Police Sworn/Net- Budgeted revenue is from school reimbursements for SRO services, SIU from the Count and from grants that are billed periodically. We have not billed the schools or the County yet as we usually bill quarterly. Also, it has $950k of Transfer In from Measure N for the fencing project ($775k) and $175k for recruitment and retention of employees. Also, the Madnet program has not had people in it and the program is reimbursed through the County so we have much less Expense and Revenue.

Fire Services- this revenue is from transfers in from Measure N and the General Fund for the fire station expansion project. That project has not happened yet but the RFP process has been completed and we have awarded the project to a vendor. We are close to beginning construction.

Community & Economic Development- This will fluctuate as building permits are pulled. We budgeted for growth which includes projects like Oleander, Rancho Calera, Montgomery Farms and miscellaneous lots within Greenhills. So far, we have Century Communities building their part of the Montgomery Farms lots but other projects have not pulled their permits. We still have other miscellaneous permits for other items that are happening as well. there is also $185k of grant revenues and we have not received all of that yet.

Parks and Recreation- $200k of this is from a grant that we have not spent yet so we have not requested reimbursements. The rest is overhead allocations from the LLMD that happen at the end of the year.

Community Relations- We will see less than budgeted amounts here due to timing. Revenues are from sports program reimbursements, park pavilion rentals and donations.

Expenses
All departments expenses are within the normal range or better right now.

THE AGENDA
Meeting of: April 12, 2022
AGENDA SECTION: Public Hearing
SUBJECT: Introduction, First Reading with the Option to Waive the First Reading of an Ordinance that Adopts a Military Equipment Use Policy Pursuant to Assembly Bill 481
PREPARED BY: Dave Riviere, Chief of Police
ATTACHMENTS: Ordinance Adopting a Military Equipment Use Policy; and Policy 705 of the Chowchilla Police Department Policy Manual

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

City Council adopts an ordinance that establishes a Military Equipment Use Policy.

BACKGROUND:

On January 1, 2022, Governor Newsom signed into law Assembly Bill 481 (“AB 481”), codified under Government Code sections 7070 through 7075, which requires law enforcement agencies to obtain approval from the applicable governing body, by an ordinance that adopts a military equipment use policy, prior to obtaining funding, acquiring, or using military equipment.

Chowchilla Police Department (“CPD”) seeks City Council’s adoption of the attached Military Equipment Use Policy, Policy 705, by attached Ordinance, in order to allow CPD to continue the use of equipment as specified therein, as well as acquiring new equipment if necessary.

Equipment deemed to be “military equipment” pursuant to AB 481 include, but are not limited to, unmanned aerial or ground vehicles, armored vehicles, command and control vehicles, pepper balls, less lethal shotguns, less lethal 40mm projectile launchers, long range acoustic devices, flashbangs, and foundational equipment, such as rifles. This equipment is used as a component of overall best practices for law enforcement agencies throughout the country. These tools have been tested in the field and are used to enhance citizen and officer safety. Any loss of use on this equipment would jeopardize the welfare of citizens and peace officers within the City.

REASON FOR RECOMMENDATION:

There is a significant interest in ensuring that law enforcement continues to have access to equipment that will provide CPD as many options as possible to safeguard lives, ensure safety, and protect civil liberties.

The use of military equipment is crucial to CPD’s mission and will continue to be strictly regulated through internal processes and oversight.

The proposed ordinance seeks to approve Policy 705, which constitutes CPD’s Military Equipment Use Policy. The purpose of Policy 705 safeguards the public’s welfare, safety, civil rights, and civil liberties.

Policy 705 ensures that there are safeguards, including transparency, oversight, and accountability measures in place. All items which result in a use of force will be investigated.

Policy 705 outlines each item identified in Government Code section 7070 that is current owned by the City. Policy 705 also includes the current use and cost of each item. These particular items, and their stated uses, have been in place prior to the implementation of AB 481. There are no reasonable alternatives to the items listed in Policy 705. CPD has not discovered alternative items that can achieve the same objectives of officer and civilian safety.

AB 481 requires CPD to annually submit a military equipment report for each approved type of military equipment to City Council for as long as the military equipment is available for use. In addition, CPD must make each annual report publicly available on its website for as long as the equipment is available for use.

City Council must annually review the military equipment report submitted by CPD to determine whether each type of military equipment identified in the report continues to comply with the standard of approval, and whether to renew the ordinance at a regular meeting.

Future acquisition of any item deemed to be “military equipment” will require a further public meeting, policy update, and City Council approval.

FISCAL IMPACT:

None foreseen at time of report.

ALTERNATIVES:

Not adopt the ordinance. If the ordinance is not adopted, CPD will not be able to continue the use of military equipment to protect public’s welfare, safety, civil rights, and civil liberties.

ACTIONS FOLLOWING APPROVAL:

None. Resolution and adopted military equipment use policy will become effective in thirty (30) days.

ATTACHMENTS:

Ordinance Adopting a Military Equipment Use Policy; and Policy 705 of the Chowchilla Police Department Policy Manual.

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council approve the resolution to revoke Conditional Use Permit No. 20-0008 granted in June 17, 2020, for an Automotive Repair Shop located at 235 W. Robertson Boulevard (APN No. 002-051-010).

BACKGROUND:

This item was presented at the June 29, 2021 Special City Council meeting and the regularly scheduled July 21, 2021, September 14, 2021, and November 9,2021, City Council meetings as a public hearing, of which the public hearing was opened, but not closed.

Over the course of the past year, one business closed, staff saw the second “Small Engine” Auto Repair shop close due to the business operating outside of the approved conditions of approval for the site.

Recently, staff has made numerous attempts to work with the property owner, but was unsuccessful.

HISTORY / BACKGROUND:

The Project site is located in the MX-D Downtown Mixed-Use zone. With the approval of the Conditional Use Permit and resolution on June 17, 2020, the Planning Commission approved the operation of a “Motor vehicle repair or service, minor” and “Repair Shop, Small Appliance or Equipment” at this location.

During the meeting it was expressed that the property owner had a tenant ready to move in and operate.

After much discussion, the Planning Commission allowed the property owner some flexibility of when various site improvements would be required to be completed. It was determined some of the improvements, such as handicapped parking signs and items related to upgrading the bathroom (i.e. lights, electricity, and hot water heater), would need to be installed prior to issuance of a business license.

To allow the property to generate revenue to assist the property owner with financing many of the required site improvements, the Planning Commission approved various timeframes for the improvements to be installed. A delayed timeframe for these improvements ranged from 20 days for the removal of the barbwire and up to seven (7) months to abandon the existing sump pump.

Of the 24 conditions that were approved by the Planning Commission, four (4) conditions included extended timeframes for the installation of various site improvements. The conditions granting additional time were: Condition 5 – Removal of Sump Pump, Condition 9 – Trash Enclosure, Condition 14 – Removal of Barbwire, and Condition 15 – Neutral Colored Slats in Fence.

Current progress of these conditions:

5. The Applicant shall abandon the existing concrete sump by drilling drainage holes in the bottom, mortaring any pipe openings, and backfilling with sand to within 12” of ground surface, then backfill with native material to ground surface, or per County requirements. Work to be completed within seven (7) months of the approval date of the Conditional Use Permit.

Progress: This condition is now 100% complete, no further action is needed.

9. A trash enclosure shall be constructed per City of Chowchilla Standard Drawing M-18. Staff shall review proposed trash enclosure to determine if the enclosure meets City Standards. The trash enclosure shall be completed within sixty (60) days of the approval date of the Conditional Use Permit.

Progress: The property owner has not submitted an adequate trash enclosure design in compliance with City Standard M-18. Whenever the representative has provided information of their intent staff has requested the submittal of a detail design. Staff estimates this is 0% complete.

It has been stated to the applicant and the property owner the trash enclosure they would like to install at this location would not be in compliance with the following:

1. City Municipal Code Design Standard M-18 (Commercial & Industrial Trash Enclosure)

2. Chowchilla Downtown Design Guidelines

3. Planning Commission Resolution No. 20-04

4. Conditional Use Permit No. 20-0008
Staff has expressed to the applicant the Downtown Design Guidelines included a section regarding Trash Enclosures. The approved Condition 9 was drafted to comply with the City’s Municipal Code and the Downtown Design Guidelines. Staff has expressed if the owner would like to have the condition modified to this steel trash enclosure, he would need to submit a variance application to the City to consider. The variance is due to the fact the conceptual trash enclosure does not meet the City’s downtown design guidelines or City design standards.

14. The Applicant shall remove all barbed wire from the Project site. The barb-wire shall be removed within twenty (20) days of the approval date of the Conditional Use Permit.

Progress: The barb-wire has been removed. This condition is completed and no further action is needed.

15. The Applicant shall install neutral color slats to be inserted into the existing fence along the perimeter of the site. The slats shall be installed within forty (40) days of the approval date of the Conditional Use Permit.

Progress: While the property owner has made progress, this task has not been completed. There are currently numerous slats that are broken or installed incorrectly. Additionally, the fenced area facing Robertson Blvd. is still missing slats. Staff estimates this is approximately 90% complete.

Upon review of the above conditions of approval that have failed to be complete per the timeframes approved, the City Council will be taking testimony during the public hearing and decide whether Conditional Use Permit 20-0008 should be revoked.

The following excerpt from Zoning Ordinance Chapter 18.70.230 identifies the grounds for revocation.

Municipal Code Section 18.70.230 - Suspension and revocation of approved permit.

A. Upon the violation of any applicable provision of this title, the provisions of any use permit, or upon the failure to comply with or satisfy any condition of approval related thereto, the permit or approval issued pursuant to this chapter shall be automatically suspended. Written notice of the suspension shall be sent by the director to the person to whom the use permit was issued, or to their successor if known, advising them of the suspension and the violations causing the suspension.

B. No building, grading, encroachment, or other development permit shall be issued for any building, excavation, or other structures proposed as a part of a permit that has been suspended. For any construction activity taking place on the site that is the subject of the suspended permit, the building official shall issue a stop work order.

C. The city council shall hold a public hearing and hear evidence from city staff, the holder of the permit, and other interested persons. Should the city council find that there has been a violation of this title, the provisions of the permit, or a failure to comply with or satisfy any condition of approval related thereto, the city council may either revoke the permit or take such other action as the city council deems necessary to ensure compliance with the provisions of this title, the permit, and the related conditions of approval.

REASON FOR RECOMMENDATION:

The Planning Commission, at their April 21, 2021, regular meeting, approved Resolution No. 21-05 recommending the City Council revoke Conditional Use Permit #20-0008 due to the property owner’s failure to comply with the conditions of approval and associated time limits for satisfying such conditions.

FISCAL IMPACT:

None.

ALTERNATIVES:

1. Continue the consideration of the Revocation of the Conditional Use Permit to a future City Council meeting (date and time to be specified in City Council motion).

2. Approve, subject to other than recommended by Planning Commission Resolution #21-05 (identify specific findings and/or conditions amended; or, to be addressed in City Council motion); or,

3. Deny; or,

4. Refer to back to the Planning Commission for reconsideration of the Revocation of Conditional Use Permit #20-0008 to be addressed in City Council motion.

5. Refer to City Staff for reconsideration of specific items to be addressed in City Council motion.

ACTIONS FOLLOWING APPROVAL:

Staff will update the project file with the executed resolution noting the project has been revoked.

AGENDA SECTION: New Business
SUBJECT: Consideration and Adoption of a City Council Resolution Approving the Second Amendment of the Employment Agreement Between the Police Chief and the City of Chowchilla, Extending the Term Date to January 13, 2023
PREPARED BY: Joann McClendon, City Clerk
ATTACHMENTS: Resolution, Amendment

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

City Council approve the police chief service contract between City and Police Chief Dave Riviere (“Police Chief”), which was originally set to terminate on June 30, 2022, to extend to January 13, 2023.

BACKGROUND:

On July 12, 2018, City and Police Chief entered a First Amended Agreement to continue the Police Chief’s appointment to June 30, 2022, as well as establishing compensation, benefits, conditions of employments, and working conditions. Now, City and Police Chief share a mutual desire to continue the Police Chief’s service until January 13, 2023 while all established compensation, benefits, conditions of employments, and working conditions remain unchanged.

REASON FOR RECOMMENDATION:

To maintain continuity of Police Chief’s service for approximately six more months.

FISCAL IMPACT:

There is no financial impact as there are no changes in the financial terms of the Agreement.

ALTERNATIVES:

To disprove the extension on Police Chief’s service to January 13, 2023, and to allow the Police Chief’s service to end on June 30, 2022.

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council approve the Resolution accepting the transfer of parcels 001-240-003, 001-240-007, 001-240-010 & 001-240-014 from the Successor Agency to the Chowchilla Redevelopment Agency (RDA) to the City of Chowchilla.

BACKGROUND:

In 2013 the Oversight Board of the Successor Agency to the Chowchilla Redevelopment Agency approved Resolution 07-13 which approved the transfer of the above-mentioned parcels to the City of Chowchilla.

These parcels were determined to be used for government use by the City. The Department of Finance (DOF) approved this action on March 21, 2014.

However, the transfer of these properties was never actually completed and the County still shows these properties as being owned by the Chowchilla RDA. We are just going through with what was previously approved.

REASON FOR RECOMMENDATION:

After legal review, it was determined that a resolution by the City Council would be needed to accept the transfer of these properties. One of the properties is located in the Corporation Yard and is to be merged with the other lot that the City currently owns. This lot merger will create 1 parcel and is where the fire station expansion is being constructed.

FISCAL IMPACT:

There will be some expenses incurred for the preparation and filing of the quitclaim deeds and will be paid for by the General Fund. Staff estimates the expenses to be somewhere around $5,000.

ALTERNATIVES:

Do not accept the properties and they will remain in the RDA name which would go against the previous approved resolutions of the Oversight Board.

ACTIONS FOLLOWING APPROVAL:

The Quitclaim Deeds will be recorded with County.

AUTHORIZING EXECUTION AND RECORDATION OF QUITCLAIM DEEDS QUITCLAIMING REAL

NOW, THEREFORE, the City Council acting as the Successor Agency to the Redevelopment Agency of the City of Chowchilla does resolve as follows:

1. The foregoing recitals are true and correct.

THE AGENDA
Meeting of: April 12, 2022
AGENDA SECTION: New Business
SUBJECT: Consideration and Adoption of a Resolution Approving the Addition of the Deputy Director of Recreation and Community Engagement Position Within the Approved Salary Scale
PREPARED BY: Rod Pruett, City Administrator
ATTACHMENTS: Exhibit A- Proposed Salary Scale

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council adopt a resolution to authorize the City Administrator to establish a Deputy Director of Recreation and Community Engagement position at a pay grade of M7, which is within the approved salary scale.

BACKGROUND:

The City desires to have a position with less job duties and responsibilities than the Director of Recreation and Community Engagement but more than the Recreation and Community Outreach Manager. The main differences are that the Deputy Director position would include social media and website activity (which the Manager position does not) and less supervisorial responsibilities than the Director position. Typically, this department has very few people to supervise/manage. As the department grows, the need for a Director would be necessitated but for now, the City believes a Deputy Director of Recreation and Community Engagement is the ideal position.

REASON FOR RECOMMENDATION:

The new position is desired to be able to provide the maximum Recreation and Community Outreach service the City can provide in the most effective and efficient manner.

FISCAL IMPACT:

The proposed Deputy Director position has a salary scale of an M7 level which has a current annual salary range of $79,870 to $102,240. The current Manager position is at M10 which has an annual range of $68,880 to $88,173 and the Director position is at M11 which has an annual salary range of $89,316 to $114,331. The Deputy Director position pretty much lies right in between the Director and Manager positions.

ALTERNATIVES:

Do not approve the addition of the Deputy Director position ACTIONS FOLLOWING APPROVAL:

The Deputy Director of Recreation and Community Engagement position will be added to the salary scale at an M7 pay level.
