Local Assistance Procedures Manual Exhibit 10-A Checklist * ICR FYE = Indirect Cost Rate Fiscal Year End. Items on this checklist may not be all inclusive. A&I reserves the right to request additional documentats as deemed necessary.
** Caltrans ICR Acceptance ID # is an identification number issued by Caltrans upon review and acceptance of consultant's indirect cost rate(s) schedule for a specific fiscal year. This ID # can be referenced for use on future contracts using the same FYE ICR.
*** Firms using SHR can be reimbursed for the prevailing wage deltas either as an Other Direct Cost or as an Overhead/Indirect Cost - refer to A&I's PW Interpretive Guidance on http://ig.dot.ca.gov/resources/gentrainmod.html (a) Local Agencies are required to complete Exhibit 10-A and include all applicable required documents upon submission. (b) See Table 8-1 of the AASHTO Audit Guide for a listing of common unallowable costs.
For financial document packages received between January 1, 2019 to June 30, 2019, the 2017 FYE ICR could be submitted if the FYE 2018 ICR is not available. For financial document packages received between July 1, 2019 to December 31, 2019, the 2018 ICR must be submitted. SUBJECT: Consideration of a Resolution Canceling Task Orders with Yamabe and Horn and QK for Completing the Environmental Documentation Required for the State Route (SR) 99/SR 233 Interchange Project and Transferring Back to Madera County Transportation Commission (MCTC) and Caltrans District 6 for Completion
and
Consideration of a Resolution of the City of Chowchilla Reaffirming Support of the Development and Construction of the SR 99/SR 233 Interchange Project
APPROVED BY: Jason Rogers, Director of Public Works
ATTACHMENTS: Resolutions, CTC Presentation, Caltrans Proposal
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Council provide direction in regards to whether Caltrans or the City’s contracted consultants, Yamabe and Horn and QK, Inc. complete the required environmental documentation for the SR 99/SR 233 Interchange Project.
BACKGROUND:
On December 10, 2019, City Council approved moving forward with the completion of the required environmental documents for the SR 99/233 Interchange Project by the City’s current consultants Yamabe and Horn and QK, Inc. As a result, the City’s consultants began work on the environmental and technical documents in February 2020. $600,000 of the City’s Measure T Flex Funds was allocated to complete the environmental and technical documents, with Madera County Transportation Commission (MCTC) reimbursing the City for costs accrued. The anticipated completion date of the Project Approval/Environmental Document (PAED) was November 2021.
REASON FOR RECOMMENDATION:
In November 2020, Caltrans stated that an outside consultant could complete the Draft Environmental Document (DED), as long as it was completed to Caltrans guidelines and formats. Caltrans then provided a very rough outline of what needed to be completed, which was provided to our consultants. Additional meetings with Caltrans during development of the DED required additional CEQA reports, new Project Study Report (PSR), 30% design plans, traffic analysis, conversion from Level of Service (LOS) to Vehicle Miles Traveled (VMT) and conversion of all reports to new Caltrans required formats, to be completed as the former 2016 DED developed by Caltrans did not conform to current State requirements.
The City’s consultants used this information to determine additional tasks to complete the environmental document within the $600,000 budget allocated by the City Council. However, QK and Yamabe and Horn have requested amendments to their task orders costs to complete the environmental documentation required for the project. After review, staff has determined that these costs will exceed the allocated budget.
The task orders for our consultants to complete these documents, with the requested amendments to complete additional Caltrans requirements, is $678,000. The breakdown of these costs and expenses to date are as follows:
Description Responsible
Consultant
Cost Expended Remaining
CEQA/NEPA, Biological Update and
Completion of Document
QK, Inc. $166,525.00 $99,096.60 $67,428.40
PSR/PDS, 30% Civil Design,
Geometric Design
Yamabe & Horn $512,000.00 $164,750.07 $347,249.93
TOTAL $678,525.00 $263,846.67 $414,678.33
Additionally, after completing a review of the current status of the of the project, staff has determined that progress on the environmental documentation for the SR 99/SR 233 Interchange Project has not progressed in a timely manner. This is primarily due to impacts of the COVID-19 pandemic, changes in consultant staffing/availability, changes in Caltrans staffing for review and oversight and changes to the requested scope of work. As a result, staff began exploring other alternatives to completing the required environmental documents.
One of the alternatives explored was City staff meeting with Caltrans District 6 upper management to determine the best path forward, including the possibility of Caltrans District 6 completing the completing the required environmental document. Staff provided all documents, reports, geometrics and analyses completed by our consultants and requested Caltrans provide a not to exceed cost estimate for completion of the remaining documents and an estimated completion date. The breakdown of Caltrans District 6’s cost estimate is as follows:
Final Environmental Documents Caltrans $148,033.00
PSR/PDS, 30% Civil Design, Geometric Design Caltrans $251,618.13 TOTAL $399,651.13
It should be noted that the cost provided above would be through a cooperative agreement directly with MCTC as Caltrans is able to offer a discounted rate to Metropolitan Planning Organizations (MPO) as opposed to cities and is lower than the remaining expenses identified by consultants. Additionally, Caltrans District 6 stated that the cost will not exceed their proposal and can be memorialized in the agreement. In addition to the cost estimate, the expected completion date would be July 2023.
Completion of the environmental documents by July 2023 is important as staff and MCTC look for additional funding to cover any possible funding shortfalls. Staff, MCTC and Caltrans District 6 recently met with California Transportation Commission (CTC) regarding an upcoming Notice of Funding Availability (NOFA) for State Local Partnership Program (LPP) competitive grant to be released later this year that will cover a two-year cycle of fiscal years 2023-24 and 2024-25. Staff provided a presentation to CTC which provided an overview of the project, benefits and upcoming schedule that showed construction beginning in 2025. CTC staff was receptive to the project and recommended that staff apply for funding for full buildout of the project.
For these reasons, staff is recommending cancelling the current task orders with the City’s consultants and moving forward with Caltrans District 6 staff for completion of the required documents for the project. At this time, staff believed that Caltrans, in partnership with MCTC and the City, can complete the project in the required time. Once a CEQA document is adopted it is considered “valid” for the life of the project and would not need to be amended unless future changes, such as altered design plans, resulted in a revised project description.
FISCAL IMPACT:
There is no impact to the City’s budget. MCTC will use Measure T Regional/Flexible funds, in the approximate amount of $600,000, to complete the required documents for this project. This project is listed as the next regional project to be funded by Measure T.
ALTERNATIVES:
Continue to complete the environmental documents with the City’s consultants through the existing task orders.
ACTIONS FOLLOWING APPROVAL:
1. Notify QK and Yamabe and Horn that their task orders are cancelled.
2. Notify Caltrans District 6 and MCTC to move forward with completing the environmental document for the SR 99/SR 233 Interchange Project.

ATTACHMENTS: Resolution
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
City Staff recommends the City Council approve the resolution accepting the additional transfer out from Measure N to the General Fund.
BACKGROUND:
The project was approved with Resolution 74-21 at the October 12, 2021 Council Meeting; however, the transfer out was not included in the amounts approved by City Council. We are requesting that Council approve the $250,000 transfer out from Measure N to the General Fund.
REASON FOR RECOMMENDATION:
In order to finish processing the project, the missed Transfer out needs to be approved in the amount of $250,000.
FISCAL IMPACT:
The impact was included in all Measure N meetings and was discussed at the October 12th meeting, the resolution approved the total increase of the $500,000 but didn’t include the transfer out.
ALTERNATIVES:
If not approved, the General Fund will need to pay for the additional $250,000 as the budget was increased, as well as needing to reverse the transfer in since transfers have to match.
ACTIONS FOLLOWING APPROVAL:
The Finance Director or designated staff will post the adjusted budget into the City’s Financial system.

SUBJECT: Consideration and Approval to Authorize the Executive Director of the Chowchilla Redevelopment Successor Agency to Sign the Listing Agreement for APN 002-250-053 with Charitar Realty and Listing the Property for Purchase
PREPARED BY: Mark Hamilton, Community and Economic Development Director ATTACHMENTS: 1. Property Profile

RECOMMENDATION:
Staff Recommends the Successor Agency to authorize the Executive Director to sign the listing agreement with Charitar Realty (Attachment 2).
BACKGROUND:
Prior to 2011, the City acquired the property was proposed to be developed as a parking lot to support the future neighboring users. While the parking lot concept would have benefited future growth, that growth never came. Since the dissolution of the Former Redevelopment Agency in 2011, this property has either been transferred, placed in pre-foreclosure, ownership transferred, and lastly was recently taken back by the City in 2021 (Attachment 1). While the property has had a very interesting history the past decade, the goal for the property has remained the same. To ultimately see the property developed into a viable project for the community.
REASON FOR RECOMMENDATION:
Since reacquiring the property , the City has received multiple inquires from a variety of potential users.
The prospective users include an alternative vehicle recharge facility, a business park, and an industrial user looking to construct a nut processing facility. Due to this renewed interest in developing the property, staff felt it would be best to remarket the property for a future user.
FISCAL IMPACT:
Provided the Successor Agency authorizes the Executive Director to sign the listing agreement and lists the property for sale, the fiscal impact would be a net positive moving forward. All costs associated with the transaction shall be covered through the escrow process. With development, the property taxes received will increase to the City and other County entities benefiting from the increased property value.
Lastly, the future project at this site will provide a ‘community benefit’ with the potential creation of new jobs which will be a positive fiscal impact for other businesses.
ALTERNATIVES:
The Successor Agency denies the request to have the Executive Director sign the listing agreement and have the property remain an asset of the Successor Agency.
ACTIONS FOLLOWING APPROVAL:
Provided the Successor Agency authorizes the Executive Director to sign the listing agreement and lists the property for sale; these would be the next steps required to complete the transaction:
1. City Staff presents the received offers to the Successor Agency for recommendation to the Oversight Board.
2. City Staff presents the recommendations from the Successor Agency to the Oversight Board.
3. The Oversight Board selects a preferred buyer and an alternate.
4. The City enters into escrow with the preferred buyer.
