ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Approve an updated resolution to CalRecycle, as required:
• Authorize the submittal of application(s) to CalRecycle for all Grants for which the City of Chowchilla is eligible.
• Appoint Signature Authority (empowered to execute) to the Acting City Administrator, or his/her designee, all grant documents, including but not limited to, applications, agreements, amendments and requests for payment, necessary to secure grant funds and implement the approved grant project.
• Authorizations are indefinite for the adoption of this resolution.
BACKGROUND:
The City of Chowchilla in the past submitted and received grant funding under what was formally known as California Integrated Waste Management Board (CIWMB). CIWMB is now known as CalRecycle, which is directed to administer various grant programs in furthermore of the State of California’s efforts to reduce, recycle and reuse solid waste generated in the State preserving landfill capacity and protecting public health and safety and environment. Grant funds were used to install loose rubber bark in playgrounds at RC Wisener and VMP Parks, as well as develop a partnership with Madera County to submit Used Oil Payment Program application on behalf of the City.
REASON FOR RECOMMENDATION:
This resolution is created per the required procedures, governing the applications, awarding, and management of the grants.
Recently the City was required to submit a letter of authorization to the County of Madera in order for the County to submit the Used Oil Payment Program grant application. The Department of Resources Recycling and Recovery (CalRecycle) administers a program to provide opportunities for local governments/other eligible jurisdictions to receive payments for used oil and used oil filter collection/recycling programs.
FISCAL IMPACT:
There is no cost to the City for submitting the competitive grant application(s) to CalRecycle.
ALTERNATIVES:
Not to approve an indefinite application process for all CalRecycle Grants.

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
City Council adopt a resolution accepting the improvements and authorizing filing of the Notice of Completion for the Chowchilla Police Department Site Improvements Project.
BACKGROUND:
On August 10, 2021, City Council ratified Emergency Services Director Order #03-2021, relating to the improvements at the Chowchilla Police Department Site to address safety concerns and authorizing emergency procurement measures. The improvements to made at the site included secure fencing around the parking areas, a parking cover structure above the police vehicle parking, rehabilitation of the parking lot, and other associated improvements. As authorized by City Council, Staff advertised for bids and bids were opened in October 2021. The construction contract was awarded to Divcon, Inc. on October 12, 2021.
REASON FOR RECOMMENDATION:
The Contractor, Divcon, Inc., has completed the work required for the Project. The City’s Public Works Inspector has inspected the improvements required by the Project and all of the improvements have been completed. The City must accept the improvements and file the Notice of Completion in order to closeout the Project.
FISCAL IMPACT:
The Project is funded with Measure N and General Funds. The approved construction contract was in the amount of $1,181,925, and City Council approved a total construction budget of $1,550,000 for all engineering, inspection and construction costs. The final construction cost for the Project should not exceed the $1,550,000. The FY 2021-22 Budget included $1,550,000 for construction. We will need to roll over the remaining balance of $22,658 to this year’s budget due to covering inspections and engineering costs that were done in this fiscal year. Tabulated below are the funding and costs related to the project.

SUBJECT: Annual Lease Rates for Aeronautical Land Areas at the Chowchilla Municipal Airport
APPROVED BY: Jason Rogers, Director of Public Works
ATTACHMENTS: Resolution, Rate Study Report
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Adopt a Resolution approving Aeronautical Land Lease Base Rates at the Chowchilla Municipal Airport at $0.20 per square foot per year.
BACKGROUND:
The Chowchilla Municipal Airport (2O6) has been the subject of renewed interest recently. More specifically, individuals have approached the City indicating a desire to enter into long-term land leases where they intend to construct hanger spaces for personal aircraft and potential commercial operations.
Prior to entertaining a lease, staff felt it appropriate to conduct a rent analysis to determine market rates for airport land leases. The analysis reviewed existing airport lease rates and compared Chowchilla to nearby airports. Today, there is currently no base lease rate set for ground leases. Recently, our neighboring city to the south, the City of Madera, conducted a ground rate lease study (attached) that recommended a price range of $.30 to $.35 per sq ft per year for the region and approved a base lease rate of $0.32 sf per year on an annual basis with annual consumer price index (CPI). It is noted though that the base lease rate nationally is at $.26 per sf per year.
REASON FOR RECOMMENDATION:
In June 2020, the City of Madera retained Aviation Consulting Management Group (AMCG) to prepare a lease rate study. In order to derive market lease rates, AMCG analyzed information from national, regional, comparable, and nearby airports, which included the City of Chowchilla. In addition to the comparable and competitive airport data, lease rates from more than 500 airports located throughout the U.S. as well as rents obtained from more than 90 airports in the Federal Aviation Administration (FAA) Western-Pacific Region were analyzed. Table 1 provides an average lease rate from national, regional, comparable and local competitive airports.
Table 1: Airport Rent Comparisons
Component Average Rent Price per square foot per year
National Airports $0.26
Regional Airports $0.32
Local Airports $0.47
In addition, the AMCG report assessed without an air traffic control tower and without a procession approach, in addition to nearby airports. Nearby airports are airports within 55 nautical miles and were included based on relative proximity. Table 2 identifies local competitive airports.
Table 2: Local Competitive Airports
Airport Location Average Rent Price per square
foot per year
Modesto City – County Airport –
Harry Sham Field Modesto, California $.50 to $.95
Fresno Chandler Executive
Airport Fresno, California $.50 to $.60
Fresno Yosemite International
Airport Fresno, California $.55
Visalia Municipal Airport Visalia, California $.26 to $.38 Hanford Municipal Airport Hanford, California $.34
Madera Municipal Airport Madera, CA $.32
Chowchilla Airport Chowchilla, CA $.14 *
*Chowchilla currently does not have a ground lease rate. Rate listed is based off average sq. ft. lease rate of THangars at the Chowchilla Airport.
Based on national, competitive, and comparable airports, the City of Madera adopted a fee of $0.32 per sq ft per year, plus CPI language which allows rates to be adjusted per the AMCG recommendation and has applied a lease rate of $0.32 per sf per year for all new and renewed leases.
However, it should be noted that the Chowchilla Airport is not the Madera Municipal Airport. Due to a lack of amenities at the airport, staff is recommending a lower lease rate in order to draw further interest to the airport, while allowing the airport fund to build up and maintain funding for general maintenance and grant funding matches. As a result, staff is recommending a lease rate of $0.20 per sf per year, plus CPI language which allows rates to be adjusted. For reference, the below picture provides an overview of potential and existing ground lease areas (Green/existing, Blue/open) that could be marketed for lease.
The highlighted sections in the image above covers approximately 21.50 acres of land (15.50 unimproved and 6.0 with a Fixed Base Operator (FBO)), or 936,540 sq ft. At a rate of $0.20 per sq ft per year, if fully developed and all areas leased at the suggested rate, the Airport would generate approximately $187,308 in lease fees to be used towards maintenance and operational costs and grant matching fund requirements.
Currently, the Airport has only one FBO occupying six acres of land. The two long-term lease agreements (each for three acres) initially signed in 1998, recently expired and needs to be updated to the proposed rates as the previous agreement only charged a set Commercial Operator Fee, currently set at an annual Commercial Operator fee of $1,125 per each three-acre site for a total of $2,250, or approximately $0.0086 per sq ft per year. At the suggested rate of $0.20 per sq ft per year, the annual lease rate would be $52,272.
However, it should be noted that the current FBO does provide year-round weed abatement at the airport that could be factored in to a new lease agreement, which would reduce the overall annual lease.
FISCAL IMPACT:
The proposed rates will increase revenue to the City, allowing the City’s Airport rates to remain up to date in today’s market. It is noted that the airport is an enterprise fund and as such, revenue generated from land leases is re-invested into the airport and may not be allocated for non-airport related activities.
ALTERNATIVES:
Leave the airport rates as they currently exist.
ACTIONS FOLLOWING APPROVAL:
1. The City’s Master Fee Schedule will be amended with the approved ground lease rate.
2. The City will list the available lease areas on the City’s website.

I. RENT STUDY SUMMARY
A. Scope of Work
This Rent Study Summary conveys Aviatiorn Management Consulting Group's (AMCG's) opinion of market rent for certain land areas used for Non-Commercial purposes (Subject Property) located at the Madera Municipal Airport (Airport) which are available for lease from the City of Madera (City). AMCG understands the City is currently discussing a potential agreement with a lessee for the Subject Property.
B. Market Rent Defined
Market rent is defined as the rent a proJ)erty (land or improvement) will most likely command in the open market.
C. Project Approach
To achieve the scope of work, AMCG completed the following work plan:
1 . developed a profile of the Airport;
2. identified comparable and competitive airports utilizing the profile of the Airport;
3. obtained rental rates (and related infonnation) from the Airport and comparable and competitive airports identified;
4. analyzed the data obtained from the Airport and comparable and competitive airports identified;
5. analyzed national and regional data; and
6. developed an opinion of market rent for the Subject Property based on the analysis of the Airport, comparable and competitive airports, as well as national and regional data in conjunction with Limiting Conditions outlined in the Appendix.
In drawing opinions of market rent for the Subject Property, consideration was given to those factors that typically affect market rents for on-airport, aeronautical properties (e.g., property use, attributes, restrictions, limitations, etc.). Beyond this, AMCG's opinion of market rent for the Subject Property has been formed based on a comparative analysis of current rents for on-airport, aeronautical properties at national, regional, comparable, and competitive airports and the Airport. It is significant to note that the rental rates currently being charged for non-aeronautical improved land were not included in the national, regional, comparable, and compebitive market rents but were utilized as a point of reference to derive the opinion of market rent conveyed in this summary report.
Market rents for off-airport, non-aeronautical properties were not utilized as this apprnadl is highly problematic due to the different tyJ)es of land use. The adjustment between offairport, non-aeronautical properties and on-airport, aeronautical properties would have to reflect the fact that these land uses do not exhibit the same bundle of rights. II is very difficult, if not impossible, to determine the adjustment applied to unencumbered offairport, non-aeronautical rental rates to reflect the constraints imposed by the Federal Aviation Administration (FAA), the airport owner/operator, and/or others pertaining to the development and/or use of on-airport, aeronautical properties.
Rent Study Summary 2
City of Madera, Madera Municipal Airport (06/17/2020)
RENT STUDY SUMMARY
When renelering an opinion of market rents for on-airport, aeronautical properties, the cost of the real property (land and/or improvements) and desired rates of return are not typically considered. While these factors may be considered when rendeling an opinion of market rents for off-airport, non-aeronautical properties or may be considered by real estate investors, mese ractors are not genera1ry consistent w1tn me rea1111es or me prevailing market for on-airport, aeronautical properties. Therefore, AMCG's opinion of market rent was not based on the cost of real property or desired rates of return.
D. Key Underlying Assumptions
It is noteworthy that the market rent opinions conveyed in this Rent Study Summary are based on the lessee having full (unrestlicted) and continued access (from the Subject Property) to the Airport's airside and landside infrastructure. Additionally, it is important to note that the analysis was based on an evaluation of triple net lease rates (wherein the lessees pay maintenance, utilrties, insurance, and taxes associated with the Subject Property).
Market rents are dliven by the amount a willing buyer (lessee) pays to a willing seller (lessor). To the extent that local economic factors affect rental rates at the national, regional, comparable, and competitive airports, these economic factors will be reflected in the rental rate conclusions. To derive the market rent opinions for the Subject Property, AMCG has identified and analyzed (on a comparative basis) the rents being charged and paid for similar properties (by component) at a cross-section of airports that are considered most comparable to the Airport.
AMCG recognizes that there are differences between the Airport and the comparable airports. Some of the comparable airports exhibit superior characteristics and some exhibit inferior characteristics. In an effort to identify airports that were considered most comparable to the Airport and to draw conclusions that reflect the conditions at the Airport, the comparable airports were compared with the Airport using a number of aeronautical activity and infrastructure indicators, as well as economic valiables.

F. Study Findings
In order to derive an opinion of market rent for the Subject Property, information from similar properties at the Airport as well as national, regional, comparable, and competitive airports were analyzed. As a supplement to the comparable and competitive airport data, rents obtained from more than 500 airports located throughout the United states were analyzed as well as rents obtained from more than 90 airports in the FAA Western-Pacific Region (consisting of Arizona, California, Hawaii, and Nevada}' were analyzed. ' While American Samoa, Commonwealth of the Northem Mariana Islands, and Guam are induded in the FAA Western-Pacific Region, rents from airports in these territories were not included or analyzed.

RENT STUDY SUMMARY
It is significant to note that some airports with a control tower and precision approaeh have been included in list of competitive airports. While these airports may be superior to the subject airport in this area, these airports were considered competitive (to the subject airport) based on the relatively proximity of these airports to the subject airport.
Table 1 provides a summary and statistical analysis of the findings for the national, regional, comparable, and competitive airports.

APPENDIX
► Improved Land - Airport land having access (airside and landside) and utillies to the property boundary.
► Median - Figtl'e Wherein hatt of the data poimts in the number series are belcm the median value While hat of the data points in the number series are above the median value. ► Minimum - Minimum value prasent in the data range.
► Maximum - Maximum value present in the data range.
► Mean - Arithmetic average of all data in the data range. ► Non-Commercial - Not for the purpose of securtng earnings, income, compensation (induding exchange or barter of goods and services), and/or profit. ► Standard Deviation - Statistical method designed to mathematically measure the variability in a set of data points. The calculated figure for standard deviation is indicative of the relative distance between the mean and every data point. For a nonnally distril>uted data range, approximately 68% of the data points would fall within one standard deviation of the mean, as illustrated by a nonnal bell curve. Similarly, approximately 95% of the data points would fall within two standard deviations, while approximately 99.7% of the data points would fall within three standard deviations of the mean.
Assuming the data points from the airports are representative of the population and the population follows a nom,al bell curve, the calculated standard deviation values would illustrate the relative vartability in data points (i.e., hem dose these •data points are to the mean). ► Ranae - Mathematical difference between the nlaximum and minimum values of the data range.
