AGENDA SECTION: Consent
SUBJECT: Consideration of Monthly Financial Statements
PREPARED BY: Kerri Williams, Finance Director
ATTACHMENTS: September 2022 Budget vs Actual and Balance Sheet
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Approve the September 2022 Financial Statements shown in the attachment.
BACKGROUND:
Staff provides Council with monthly financial information as an ongoing financial status update.
REASON FOR RECOMMENDATION:
The monthly financial statements consist of a Budget vs Actual and a Balance Sheet for the General Fund.
The Budget vs Actual shows the current Month (Period Activity) and current Year (Fiscal Activity) Revenues and Expenses by Department in summary form compared to the current year Original and Current budgets. The Balance Sheet shows the Assets, Liabilities and Fund Balance at the time the report is generated. This provides an overview of cash, amounts owed to the City, amounts the City owes and the fund balance at a specific point in time.
The financial statements are being presented as an overview of the City’s finances and are not meant to be a comprehensive in-depth review. As a reference to compare to the percent remaining column in the report, the percentage of the year remaining 75%.
If the percent remaining column for Revenues is higher than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant. If the percent remaining column for Expenses is lower than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant.
If there are questions regarding the actual amounts or budget vs actual variances, please forward your questions to me in enough time before the meeting for staff to research them.
FISCAL IMPACT: Revenues
General Administration- Property tax and VLF, which are 2 of our biggest revenues, are only received 2 times a year in February and May, we have yet to receive a distribution. We are teetered which means we do not have to worry about delinquencies, because the County pays us and goes after the delinquencies themselves. Sales tax payments run a couple months behind and we have yet to receive August’s payment. Sales tax is our 2nd largest revenue.
Police Sworn/Net- Budgeted revenue is from school reimbursements for SRO services, SIU from the County and from grants that are billed periodically. We have not billed the schools or the County yet as we usually bill quarterly. Also, it has $323k Transfer-in from Measure N for the RIMS Software and recruitment and retention of employees. Also, the Madnet program is reimbursed through the County and as of right now we do not have any officers in this program.
Fire Services- This revenue is from transfers-in from Measure N and Fire Impact Fees for the fire station expansion project Phase 1 & Phase 2.
Community & Economic Development- This will fluctuate as building permits are pulled. We budgeted for some growth which includes projects like Oleander, Rancho Calera, Montgomery Farms and miscellaneous lots within Greenhills. So far, we have Century Communities building their part of the Montgomery Farms lots. Oleander Terrace has pulled all of their permits, but other projects have not pulled their permits yet. We still have other miscellaneous permits for other items that are happening as well.
There is also $185k of grant revenues that we have not received as of now.
Parks and Recreation- $200k of this is from a grant that we have not spent yet so we have not requested reimbursements. The rest is overhead allocations from the LLMD that happen at the end of the year.
Community Relations- Revenues are from sports program reimbursements, park pavilion rentals and donations.
Expenses
General Services- This is due to the POB Transfer out, and various PO’s that are open for the year.
Fire Services- The reason this is below the 83.33% is due to the first payment for the Fire Expansion & Renovation project.

REVIEWED BY
FINANCE ☒ REVIEWED BYCITY ATTORNEY ☒ REVIEWED BY EXECUTIVE DIRECTOR ☒ RECOMMENDATION:
Staff recommends the following to the City Council:
A. That the City Council for the City of Chowchilla, transfer APN 002-280-027 (hereinafter “Parcel”) to the Successor Agency of the Chowchilla Redevelopment Agency (“Chowchilla Successor Agency”) and authorize the City Administrator or designee to execute all necessary and related documents to effectuate the transfer.
Provided the City Council recommends approval of conveyance to the Chowchilla Successor Agency:
B. That the Chowchilla Successor Agency recommends to the Madera County Oversight Board to authorize the transfer of the Parcel to the City of Chowchilla and, subject to approval by the Madera County Oversight Board, authorize the Executive Director designee to execute all necessary and related documents to effectuate the transfer.
BACKGROUND:
When redevelopment agencies were dissolved in 2011, the Parcel was transferred to the City. However, the Parcel was transferred prior to the State of California’s (“State”) approval of the long-range property management plan (LRPMP), which included the Parcel.
Below is a timeline related to of the Parcel since the dissolution of the redevelopment agencies:
• The Chowchilla Redevelopment Agency (RDA) conveyed the Parcel, along with other real property assets, to the City of Chowchilla in March 2011. • The State was tasked with reviewing all such asset transfers which occurred after January 1, 2011 pursuant to Health and Safety Code section 34167.5, which included an assessment of whether the asset transfer was allowable and whether the asset should be transferred to the Chowchilla Successor Agency.
• Pursuant to the Asset Transfer Review Report, dated March, 2015, the State identified unallowable transfers that occurred after January 1, 2011, between the RDA and the City of Chowchilla. By law, the State was required to order that such assets, except those that already had been committed to a third party prior to June 28, 2011, be turned over to the Chowchilla Successor Agency. It was determined that the transfer of the Parcel by the RDA to the City of Chowchilla was an unallowable transfer. The City was ordered to reverse the transfer of the Parcel and transfer it to the Chowchilla Successor Agency. • By letter December 30, 2015, the State approved the LRPMP, which included the Parcel.
Since the dissolution of the Former Redevelopment Agency in 2011, and the approval of the LRPMP in 2015, the City has continued to encounter properties such as the Parcel that require corrective action due to the City of Chowchilla’s transfer of such properties prior to the State’s approval of the LRPMP.
Over the past several, years City staff has been working diligently to correct these types of issues associated with these former RDA properties. In order to clear up the title issue associated with this Parcel, the City of Chowchilla seeks to transfer the Parcel to the Chowchilla Successor Agency. Then, subject to Oversight Board approval, the Chowchilla Successor Agency shall properly transfer the Parcel back to the City for City disposal.
ENVIRONMENTAL REVIEW ANALYSIS:
This transfer of property has been reviewed with respect to the applicability of the California Environmental Quality Act (Pub. Resources Code, § 21000 et seq.) (“CEQA”). Pursuant to State CEQA Guidelines (Cal.
Code Regs., tit. 14, § 15000 et seq.), section 15378, subdivision (b)(5), the transfer of this property from the City of Chowchilla to the Chowchilla Successor Agency is an organizational and administrative activity of the government that will not result in direct or indirect physical changes in the environment and therefore not subject to CEQA. Further, it can be seen with certainty that there is no possibility that the mere transfer of title from one City entity to another may have a significant effect on the environment, and thus the transfer is also exempt from CEQA pursuant to State CEQA Guidelines, section 15061, subdivision (b)(3).
FISCAL IMPACT:
There is no fiscal impact to the City’s General Fund.
ALTERNATIVES:
None. Title must be cleared up.
ACTIONS FOLLOWING APPROVAL:
1. If approved, staff will present the item to the Successor Agency of the Chowchilla Redevelopment Agency.
2. The Successor Agency of the Chowchilla Redevelopment Agency will then consider sending the item to the Oversight Board for consideration.

SUBJECT: Council Resolution adopting the CDBG Coronavirus Aid Small Business Loan Program Guidelines
PREPARED BY: Mark Hamilton, Community and Economic Development Director ATTACHMENTS: 1. Resolution for CDBG Coronavirus Aid Small Business Loan Program Guidelines
2. Draft CDBG Economic Development Loan Program Guidelines
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Staff recommends the City Council to approve a resolution adopting the CDBG Coronavirus Aid Small Business Loan Program Guidelines.
BACKGROUND:
Community Development Block Grant Coronavirus Aid (CDBG-CV) is a federally funded program.
CDBG-CV funds may be used to secure economic opportunities for low- and moderate-income persons.
CDBG-CV funds are targeted to businesses of the City that have the highest adverse impact as a result of the Coronavirus.
The City of Chowchilla was awarded two non-competitive CDBG grants in the amounts of $92,456. Due the current program’s restrictive guidelines, these funds have been challenging to distribute to eligible businesses within the community. In partnership with our vendor, staff worked with our grant representative to restructure the program guidelines. The proposed program guidelines expand eligibility of uses to also include payroll.
The CDBG-CV1 were updated to include the following:
• Rent/Mortgage in arrears plus one additional month
• Utilities in arrears
• Payroll (proposed for the revised guidelines
• Personal Protective Equipment, such as plastic gloves and face shields, disposable masks, and touchless hand sanitizer dispensers
It was brought to Staff’s attention these guidelines needed to be updated to allow staff to be able to expend the remaining program funds. One of the primary changes to the guidelines staff is recommending is to increase the award amount. Previously, the maximum a business was eligible for was $10,000, this amount was increased to $50,000. Another item being proposed to be changed is the inclusion of the business payroll amounts. The remaining modifications to the guidelines were administrative changes recommended by California Department of Housing and Community Development (HCD).
With council’s consideration of the updated guidelines, the City will be able to combine the remaining CV1 funds with the CV 2 & 3 Funding source to ensure these funds are expended prior to the program’s expenditure deadline of December 30, 2022. Upon review under the new program guidelines, if the applications are deemed eligible by MBI’s underwriting team, staff will then begin the process of funding the loan accordingly.
FISCAL IMPACT:
At this time, there is no fiscal impact to the City of Chowchilla. City Staff will work closely with Michael Baker International, our Economic Development Consultant to assist City Staff with the submittal of this application. There is no impact to the City’s General Fund.
ACTIONS FOLLOWING DECISION:
Upon approval of the updated guidelines, the City will review the current loan applications previously considered ineligible. Upon review under the new program guidelines, if the applications are deemed eligible by MBI’s underwriting team, staff will then begin the process of funding the loan accordingly.
ALTERNATIVES:
1. Continue the Item to a future City Council meeting (date and time to be specified in City Council motion).
2. Approve, subject to other than those updates recommended by staff (identify specific findings and/or conditions amended; or, to be addressed in City Council motion); or,
3. Deny; or,
4. Refer to City Staff for reconsideration of specific items to be addressed in City Council motion.

Met with AutoZone's legal and our legal to discuss a parcel issue. Apparently the "finger" that was on Buss Oats property from the General Plan is not an easement as we all thought. It is actually owned by the City and we are looking at the fastest route to get it taken care of. A lot line adjustment is being proposed as the fastest route which will just move the property the City owns to a part of the AutoZone project that is not being built on There are some technical issues that have to be evaluated and we have a meeting set up for next week to discuss with the AutoZone team.

August 28 - September 3, 2022 Had a meeting with NBS to discuss the next step in the refunding of the 2006-1 CFD. We believe it is best to not keep any additional bonding authority - this will greatly reduce the assessment on properties. If there is a timing issue for a development and there needs to be bonds issued, we can do that on a project by project basis. Have another meeting schedule in a couple weeks to go over remaining DIF study issues with regarding the Commercial and Park fees. We will schedule a meeting with a few of the larger property owners to show them what we are looking at before we go forward with the refunding but with a reduction in assessments being proposed and no increases to Impact Fees, I can't see a reason why they would not agree.

Meeting of: November 17, 2022
AGENDA SECTION: New Business
SUBJECT: Adoption of a Resolution Approving Change Order No. 1 for the Police Department Domestic Water Piping Retrofit Project in the Amount of $26,000.00, Authorizing the City Administrator or Designee to Execute all Related documents Thereto and Amending the Fiscal Year 2022/23 City Budget
APPROVED BY: Jason Rogers, Director of Public Works
ATTACHMENTS: Resolution, Agreement
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
That City Council approve a resolution to approve a change order in the amount of $26,000.00 with Diede Construction, Inc. for the Police Department Domestic Water Piping Retrofit Project and amend the City of Chowchilla Fiscal Year (FY) 2022/23 Budget.
BACKGROUND:
The City of Chowchilla’s Police Department has experienced numerous plumbing issues and failures related to the age and condition of the water pipe plumbing throughout the building. These issues have led to numerous water leaks throughout the building. While staff has addressed these issues with temporary fixes, staff determined that there was a clear need to repair/replace the aging plumbing system serving the Police Department due to the threat to health and safety of the building’s occupants and the potential to damage essential emergency services equipment, which would impair public safety services.
On August 15, 2022, the City advertised for bids from qualified building contractors to retrofit the existing water piping at the police department. This project will include the installation of new hot and cold domestic water supply piping, replacement of water heater, installation of hot water piping to the holding cells, installation of isolation shut-off valves, and new water efficient fixtures.
On Thursday, September 15, 2022 at 3:00 PM, the bid period was closed at which time one (1) bid was received from Diede Construction, Inc.
On September 27, 2022, City Council awarded the Police Department Domestic Water Piping Retrofit Project to Diede Construction, Inc. in the amount of $510,000.00.
REASON FOR RECOMMENDATION:
After receiving the bid award for the project, Diede Construction, Inc. began work on November 1, 2022.
During demolition, a review of existing plumbing fixtures/equipment/accessories was conducted. During the review, it was discovered that erosion had damaged several plumbing fixtures/equipment/accessories.
As a result, Diede Construction, Inc. has submitted a change order request to replace these items not within the original scope of the project.
Upon review between the Public Works Department and Police Department, staff recommend the approval of the change order.
FISCAL IMPACT:
A total of $510,000.00 of funding for this project is currently budgeted in the FY 2022/23 City Budget and comes from the following funds:
DESCRIPTION AMOUNT
Measure N- Building & Improvements $510,000.00
TOTAL $510,000.00
As a result, the current Council approved budget for this change order is approximately $26,000.00 short and will need to be amended in order to move forward with the project. After discussion with the City Administrator and Finance Director, we determined that a transfer out to the General Fund from Measure N was necessary to maintain the asset for PD.
DESCRIPTION AMOUNT
Measure N- Transfer Out $536,000.00
Transfer In- General Fund $536,000.00
Increase PD Building & Improvements $536,000.00
ALTERNATIVES:
Not to accept the change order.
ACTIONS FOLLOWING APPROVAL:
1. The resolution and budget amendments will be sent to the Finance Department for inclusion into the FY 22/23 Budget.
2. The change order is approved.
