Mayor Chavez thanked Council Member Barragan for everything he has done for the City of Chowchilla. Also, attended the Veteran's Memorial Celebration.

Council Member Palmer attended a Transportation meeting in Newport Beach and reported that there was a consensus within the group that the State regulations are holding up transportation projects; whether in San Francisco, Los Angeles, or Chowchilla. Additionally, she reported that she was stuck on Robertson Boulevard/State Route 233 for 37 minutes because of a train sitting on the rail tracks. She would like the Council to bring back this topic and discuss options the City might have to address this issue. The train sitting on the train tracks is a recurring problem and creates a public safety hazard. She requested that the City get support letters from CHP and Caltrans, if possible.

Council Member Smith gave a big thank you to Council Member Palmer for her dedication to Beautifying Chowchilla project. He also attended the Veteran's Memorial Celebration in the park. There were quite a few people at the event, and the speakers did a wonderful job.

Commander Palmer gave an inspiring speech.

2.2 STAFF VERBAL REPORTS
City Administrator Rod Pruett provided an update on PG&E reconciliation and the JCI project.

Staff identified a well that wasn't on our account and the energy efficiency issues at the Corporation Yard. The Community Facilities District meeting went well, and the City is working on an analysis. The City will likely have two CFDs, and we are working with NBS. Staff is working on the Investment Program and anticipates completion in the first week of December.

Deputy Director of Recreation and Community Engagement Wisener reported on the success of the Halloween Event. She met with the local soccer president regarding the field maintenance concerns and issues. She updated Council on the Centennial Ad Hoc Committee progress and the planned dinner for next year will be September 23, 2023, along with other items. Ms.

Wisener provided an update on the scheduled Christmas activities, including the 1st Hometown Special City Council Meeting November 17, 2022
Lighted Christmas Parade and the 55th Annual Tree Lighting Ceremony scheduled for December 3, 2022.

Public Works Director Rogers thanked Council Member Palmer and those who volunteered for their dedication to the Beautify Chowchilla project. There were so many projects that got done that were on the Public Works Department list, and they could knock them out because of those volunteer events. Concerning the train issue, Public Works have been told numerous reasons why the train sits there. Public Works staff has looked into this issue already and has provided the City Administrator with a timeline of when the trains stop and why. The City Administrator has provided this timeline to legal, and they are drafting a letter to the railroad industry. Mr.

Rogers also attended the Veterans Memorial event. The Humboldt Street improvement project is nearly completed. The contractor completed striping last week and is working on various punch list items. The City is waiting on delivery of the new signage and rectangular, rapidflashing beacons for installation, possibly by January. He met with PPG Traffic Solutions, who provided a demo of a new rumble strip product on N. 5th Street in front of Steven's Elementary.

The City received various positive feedback, and the City is planning on purchasing more to install at various locations. A grant application was submitted for the State's LPP program for the roundabouts project to MCTC for review and waiting for them to submit it to the state. Staff received letters of support from the elementary and high school, MCTC, Chowchilla Chamber of Commerce, Senator Caballero, and Assembly Member Bigelow.

Community & Economic Development Director Hamilton provided an update regarding four commercial activities around the City. He invited Council to the Community & Economic Development Community & Builder's Forum scheduled on December 8, 2022, from 8:30 a.m. to 3:00 p.m. at the Sand Trap Bar and Grill.

Of those, 924 calls for service, and of those calls for service, 737 were self-initiated activities. They made 38 misdemeanor arrests and 11 felony arrests and issued 40 traffic citations. Code Enforcement responded to 32 calls for service and wrote eight reports, served seven notices, and stored three vehicles. He reminded everyone about the Annual Toys and Coats for Kids event on Saturday, December 10, between 10:00 a.m. and 3:00 p.m. at Starbucks with the Volunteer Fire Department.

THE AGENDA
Meeting of: December 13, 2022
AGENDA SECTION: Consent
SUBJECT: Consideration of Monthly Financial Statements
PREPARED BY: Kerri Williams, Finance Director
ATTACHMENTS: October 2022 Budget vs Actual and Balance Sheet

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Approve the October 2022 Financial Statements shown in the attachment.

BACKGROUND:

Staff provides Council with monthly financial information as an ongoing financial status update.

REASON FOR RECOMMENDATION:

The monthly financial statements consist of a Budget vs Actual and a Balance Sheet for the General Fund. The Budget vs Actual shows the current Month (Period Activity) and current Year (Fiscal Activity) Revenues and Expenses by Department in summary form compared to the current year Original and Current budgets. The Balance Sheet shows the Assets, Liabilities and Fund Balance at the time the report is generated. This provides an overview of cash, amounts owed to the City, amounts the City owes and the fund balance at a specific point in time.

The financial statements are being presented as an overview of the City’s finances and are not meant to be a comprehensive in-depth review. As a reference to compare to the percent remaining column in the report, the percentage of the year remaining 66.67%.

If the percent remaining column for Revenues is higher than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant. If the percent remaining column for Expenses is lower than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant.

If there are questions regarding the actual amounts or budget vs actual variances, please forward your questions to me in enough time before the meeting for staff to research them FISCAL IMPACT: Revenues
General Administration- Property tax and VLF, which are 2 of our biggest revenues, are only received 2 times a year in February and May, we have yet to receive a distribution. We are teetered which means we do not have to worry about delinquencies, because the County pays us and goes after the delinquencies themselves. Sales tax payments run a couple months behind and we have yet to receive September’s payment. Sales tax is our 2nd largest revenue.

Police Sworn/Net- Budgeted revenue is from school reimbursements for SRO services, SIU from the County and from grants that are billed periodically. We have not billed the schools or the County yet as we usually bill quarterly. Also, it has $323k Transfer-in from Measure N for the RIMS Software and recruitment and retention of employees. Also, the Madnet program is reimbursed through the County and as of right now we do not have any officers in this program.

Fire Services- This revenue is from transfers-in from Measure N and Fire Impact Fees for the fire station expansion project Phase 1 & Phase 2.

Community & Economic Development- This will fluctuate as building permits are pulled. We budgeted for some growth which includes projects like Oleander, Rancho Calera, Montgomery Farms and miscellaneous lots within Greenhills. So far, we have Century Communities building their part of the Montgomery Farms lots. Oleander Terrace has pulled all of their permits, but other projects have not pulled their permits yet. We still have other miscellaneous permits for other items that are happening as well.

There is also $185k of grant revenues that we have not received as of now.

Parks and Recreation- $200k of this is from a grant that we have not spent yet so we have not requested reimbursements. The rest is overhead allocations from the LLMD that happen at the end of the year.

Community Relations- Revenues are from sports program reimbursements, park pavilion rentals and donations.

THE AGENDA
Meeting of: December 13, 2022
AGENDA SECTION: Consent
SUBJECT: Consideration of Monthly Financial Statements
PREPARED BY: Kerri Williams, Finance Director
ATTACHMENTS: November 2022 Budget vs Actual and Balance Sheet

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Approve the November 2022 Financial Statements shown in the attachment.

As a reference to compare to the percent remaining column in the report, the percentage of the year remaining 58.33%.

Sales tax payments run a couple months behind and we have yet to receive October’s payment.

There is also $185k of grant revenues that we have not received as of now.

Parks and Recreation- $200k of this is from a grant that we have not spent yet so we have not requested reimbursements. The rest is overhead allocations from the LLMD that happen at the end of the year.

THE AGENDA
Meeting of: December 13, 2022
AGENDA SECTION: Public Hearing
SUBJECT: A City Council Resolution Accepting the Annual Report on Development Impact Fees for Fiscal Year 2021/22 and Making Certain Findings Related Thereto (AB1600)
PREPARED BY: Sherri Dueker, Accounting Manager
ATTACHMENTS: Resolution, Annual Development Impact Fee Report

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Staff recommends the City Council approve resolution accepting Annual Report of Development Impact Fees BACKGROUND:

State of California Assembly Bill 1600 (AB 1600) – the Mitigation Fee Act (Gov. Code, Sections 66000 et seq.) sets forth the standards against which monetary exactions on development projects are measured.

The City Council has adopted and updated various development impact fees applicable to new development within the City. The purpose of development impact fees is to finance the design, construction and acquisition of facilities and equipment necessary to accommodate future development within the City.

Development impact fees that are collected are segregated and placed in special funds or accounts, which earn interest. Those funds are held for the facilities for which the fees are collected, in accordance with Government Code Section 66006.

As of June 30, 2022, the City had 9 separate and distinct fees that are collected, pursuant to AB 1600.

Please refer to the attached Annual Development Impact Fee Report for summary and detail information.

REASON FOR RECOMMENDATION:

Required per Assembly Bill 1600 and the Mitigation Fee Act (Gov. Code, Sections FISCAL IMPACT:

Tracking of the fund activities, summarizing the activity for this report and preparation of the report requires resources of the Finance Department. No funds were expended on outside sources to comply with this unfunded State mandate. This is a required reporting and compliance report per the California Government Code. Failure to report on activity and account balances per the applicable regulations could allow a successful challenge to the collection of the related fees in the future or repayment of previously collected fees.

ALTERNATIVES:

Failure to approve could leave City at risk of non-compliance to AB1600 requirements and could result in the reimbursement of funds unspent after 5 years

Legal Requirements
State law (California Government Code Section 66006) requires each local agency that imposes AB 1600 development impact fees to prepare an annual report providing specific information about those fees. Within the AB 1600 legal requirements, it stipulates that fees imposed on new development have the proper nexus to any project on which they are imposed. In addition, AB 1600 imposes certain accounting and reporting requirements with respect to the fees collected. The fees, for accounting purposes, must be segregated from the general funds of the City and from other funds or accounts containing fees collected for other improvements. Interest on each development fee fund or account must be credited to that fund or account and used only for the purposes for which the fees were collected.

Current California Government Code Section 66006 (b) requires that for each separate fund the local agency shall, within 180 days after the last day of each fiscal year, make available to the public the information shown below for the most recent fiscal year.
• A brief description of the type of fee in the account or fund. • The amount of the fee.
• The beginning and ending balance of the account or fund. • The amount of the fees collected and interest earned. • Identify each public improvement on which fees were expended and the amount of expenditures on each improvement, including the total percentage of the cost of the public improvement that was funded with fees. • An identification of an approximate date by which the construction of the public improvement will commence if the local agency determines that sufficient funds have been collected to complete financing on an incomplete public improvement.
• A description of each interfund transfer or loan made from the account or fund, including the public improvement on which the transferred or loaned fees will be expended, and, in the case of an interfund loan, the date on which the loan will be repaid and the rate of interest that the account or fund will receive on the loan.
• The amount of refunds made due to sufficient funds being collected to complete financing on incomplete public improvements, and the amount of reallocation of funds made due to administrative costs of refunding unexpended revenues exceeding the amount to be refunded.

California Government Code Section 66001 (d) requires the local agency make all of the following findings every fifth year with respect to that portion of the account remaining unexpended, whether committed or uncommitted
• Identify the purpose of the fee.
• Demonstrate a reasonable relationship between the fee and purpose for which it is charged. • Identify all sources and amounts of funding anticipated to complete financing in incomplete improvements. • Designate the approximate dates on which the funding is expected to be deposited into the appropriate account or fund.
• In any action imposing a fee as a condition of approval of a development project by a local agency, the local agency shall determine how there is a reasonable relationship between the amount of the fee and the cost of the public facility or portion of the public facility attributable to the development on which the fee is imposed.

Notes:

The City of Chowchilla realized new development within the City limits in the 21/22 FY. Although this is a positive move forward, the City continues to see moderate growth across all sectors. While the City experienced above average growth in the residential sector in Fiscal Year 21/22, current trends show the residential sector slowing to below average growth in Fiscal Year 22/23.

Notes to Development Impact Fee Report
Unspent fund balance indicates lack of growth as originally projected. Funds should remain in fund to support the anticipated future growth.

Unspent fund balance indicates lack of growth as originally projected. Funds should remain in fund to support the anticipated future growth.

Public or General Facilities were developed with Bond Funds in support of future growth which was suppressed due to the recession.

The negative balance is derived from the expansion of City Hall in which costs exceeded the amount of bond proceeds thereby generating a loan from the General Fund. Due to the lack of growth there has been insufficient fees collected to meet the loan repayment at this time. As future fees are collected the loan will be repaid. Future fees collected can then be used to pay for bond debt service new facilities.

Unspent fund balance indicates lack of growth as originally projected. Funds should remain in fund to support the anticipated future growth.

PREPARED BY: Jeff Palmer, Police Commander
ATTACHMENTS: Resolution

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Staff recommends that Council approve the resolution and designate as surplus property Chief of Police, David Riviere’s issued Smith and Wesson M&P Shield (serial# HZZ2388) and approve the transaction of ownership of the weapon for the consideration of $1 to David Riviere. This transfer of ownership would be effective January 6, 2023, upon Riviere’s retirement.

BACKGROUND:

It has become a tradition of the Chowchilla Police Department, to surplus and allow for purchase, the retiring or departing, in good standing Chief of Police, their issued weapon. This was previously done with former Police Chief Jay A. Varney after being elected to the position of Madera County Sheriff.

REASON FOR RECOMMENDATION:

Staff would like to continue this tradition with Chief of Police, David Riviere and present this as a token of our appreciation for the Chief’s loyalty and dedication to the community and department.

FISCAL IMPACT:

There is no financial impact to the City until the weapon would need to be replaced.

ACTIONS FOLLOWING APPROVAL:

Upon approval by Council, clerk to provide Police Department and Chief Riviere with a copy of the signed resolution.

Riviere will be required to transfer, at his cost the weapon in his name immediately upon receipt of the weapon.

APPROVED BY: Jason Rogers, Director of Public Works
ATTACHMENTS: Resolution

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Staff is requesting that City Council approve a resolution rejecting bids received for the Well No. 15 Reverse Rotary Test Well Project.

BACKGROUND:

On November 2, 2022, the City of Chowchilla published a notice inviting bids for the Well No. 15 Reverse Rotary Test Well Project.

REASON FOR RECOMMENDATION:

The City opened bids for the Well No. 15 Reverse Rotary Test Well Project on December 1, 2022. The City received one (1) bid for the project; however, after review, City staff determined that the bid submitted exceeded the Engineer’s Estimate and the City’s allocated budget for the test well.

Per the City’s bid package;
“The City Council reserves the right to reject any or all bids, to waive any informality in the bids received, or to award the contract to the lowest responsible bidder as may serve the best interests of the City of Chowchilla.”
As a result, City Staff recommends City Council reject the Bid on the above-mentioned basis.

FISCAL IMPACT:

There is no fiscal impact to rejecting the bid as the City will not enter into a contract to perform the required services.

ALTERNATIVES:

City Council can direct staff to bring the bid result back to Council for acceptance.

ACTIONS FOLLOWING APPROVAL:

Reduce scope of the project in order to appeal to a wider audience and re-bid the project.

AGENDA SECTION: New Business
SUBJECT: City Council Reorganization – Election of Mayor and Mayor Pro Tem PREPARED BY: Joann McClendon, City Clerk

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Staff recommends that the election of the Mayor and Mayor Pro Tem be held.

HISTORY / BACKGROUND:

Now that the new term is approaching, it is time for the election of the Mayor and Mayor Pro Tem. While Chowchilla’s Municipal Code is silent on the election of the Mayor and Mayor Pro Tem, the City’s practice is that every year there is an election of Mayor and Mayor Pro Tem among the Council Members.

Duties of the Mayor include:

As reflected in the Municipal Code, the Mayor is to preside at all meetings of the City Council and perform such other duties consistent with the office as may be imposed by the Council or by vote of the people. As presiding officer of the Council, the Mayor is to faithfully communicate the will of the Council majority in matters of policy. The Mayor is also recognized as the official head of the city for all ceremonial purposes.

As such, the Mayor shall be the chief spokesperson for the City, representing the City at all ceremonial events and functions, and shall issue all ceremonial proclamations, certificates, and awards.

The Mayor, unless unavailable, shall sign all ordinances, and other documents that have been adopted by the City Council and require an official signature; except when the City Administrator has been authorized by Council action to sign documents. In the event the Mayor is unavailable, the Mayor Pro Tem’s signature may be used.

The Mayor Pro Tem shall be elected by the Council and serve at the pleasure of the Council. The Mayor Pro Tem shall perform the duties of the Mayor whenever the Mayor is absent or is unable to perform such duties.

Reorganization Procedure:

The City Clerk holds the election for the Mayor. This process includes the following:
1) The City Clerk declares that the nominations are open for the office of Mayor. 2) The City Clerk accepts nomination(s) from the Council Members. You may nominate more than one person for a position and you may nominate yourself for a position. 3) When there are no further nomination(s), the City Clerk will close the nominations and take a roll call vote.
4) If there is more than one nomination, a vote will be taken in last name alphabetical order of the nominations.

You may vote for more than one person for the position. The Mayor is elected by majority vote, three (3) votes.

If a tie occurs there will be a runoff vote. If more than one person is nominated, and during the roll call vote the first nomination receives the majority vote the election is complete. Following the vote(s), the City Clerk declares that Mayor elected.

Once the newly elected Mayor is seated, the Mayor holds the election of the Mayor Pro Tem in the same manner as outlined for Mayor.

FINANCIAL IMPACT
None.

That the Mayor selects the collaborative agency appointments.

There are also several agencies that are required to submit a Form 700.

REASON FOR RECOMMENDATION:

This is a routine action that occurs annually.

FISCAL IMPACT:

There is no financial impact to the City.

ACTIONS FOLLOWING APPROVAL:

Once the Council Members are appointed, the City Clerk updates the appointments list for distribution to the Council, notifies each collaborative agency of the appointments and coordinates with the agency clerk any paperwork required by the Fair Political Practices Commission (FPPC) thereafter.
