THE AGENDA
Meeting of: January 10, 2023
AGENDA SECTION: Consent
SUBJECT: Consideration and Approval of Commission/Committee Appointments – Madera County Mosquito and Vector Control District
PREPARED BY: Joann McClendon, City Clerk

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council approve, by consensus, the incumbent’s reappointment to the Madera County Mosquito and Vector Control District (the District).

BACKGROUND:

The District provides for the health, safety, and comfort of the residents within the district boundaries by the abatement of mosquitoes and other vector populations in order to minimize vector-borne diseases.

The District accomplishes this task through constant surveillance and by employing the principles of integrated pest management in our efforts to control vector populations.

The Clerk’s Office received an email from the Manager of the District notifying that the term of office for the current trustee, Mr. David Bump, expired. The email also expressed that the District desires to continue having Mr. Bump serving on the Board of Trustees for another four-year term as he has done an excellent job.

REASON FOR RECOMMENDATION:

The incumbent has continued serving as a Trustee for at least two previous terms and the District supports the reappointment.

FISCAL IMPACT:

There is no financial impact from this appointment as the Trustee does not receive compensation.

ALTERNATIVES:

If the Council desires, a different appointment may be made.

ACTIONS FOLLOWING APPROVAL:

City Clerk to notify the District Manager of the appointment.

THE AGENDA
Meeting of: January 10, 2023
AGENDA SECTION: Consent
SUBJECT: Council Resolution Authorizing Submittal of Application for CalRecycle Annual City/County Payment Program and Related Authorizations PREPARED BY: Jonise Arredondo, Administrative Analyst
APPROVED BY: Jason Rogers, Director of Public Works
ATTACHMENTS: Resolution

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Approve an updated resolution to CalRecycle, as required:
• Authorize the submittal of application to CalRecycle for City/County Annual Payment Program for which the City of Chowchilla is eligible.
• Appoint Signature Authority (empowered to execute) to the City Administrator, or his/her designee, all payment program documents, including but not limited to, applications, agreements, amendments and requests for payment, necessary to secure payment program funds. • Authorizations are indefinite for the adoption of this resolution.

BACKGROUND:

CalRecycle’s Payment Program is offered annually to California Cities and Counties to apply for. Funds are to be used for Beverage Container recycling and litter clean up activities. City of Chowchilla has previously applied and has been awarded funds in the past. Beverage Container recycling cans were purchased and education outreach materials were distributed throughout the local school districts. Both activities were implemented to encourage the public to recycle.

REASON FOR RECOMMENDATION:

In order for City of Chowchilla to apply for Payment Program, Cal Recycle requires an updated and approved resolution specifically for the City/County Payment Program.

FISCAL IMPACT:

There is no cost to the City of Chowchilla for submitting the City/County Payment Program application to CalRecycle.

ALTERNATIVES:

Not to approve an indefinite application process for CalRecycle Payment Program.

ACTIONS FOLLOWING APPROVAL:

Staff will submit approved resolution to complete application process.

AGENDA SECTION: Public Hearing
SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHOWCHILLA

AUTHORIZING THE EXCHANGE OF COMPARABLE PROPERTIES
PREPARED BY: Mark Hamilton, Director of Community & Economic Development ATTACHMENTS: 1. City Council Resolution

2. Exhibit A

3. Exhibit B

4. Public Hearing Notice

REVIEWED BY
FINANCE ☒ REVIEWED BYCITY ATTORNEY ☒ REVIEWED BY CITY ADMINISTRATOR ☒ RECOMMENDATION:

Staff Recommends the following to the City Council:

1. That the City Council for the City of Chowchilla exchange legal title to the property the legal description for which is attached hereto as Exhibit A ("Property A") for title to the property the legal description for which is attached hereto as Exhibit B ("Property B") and authorize the City Administrator or designee to execute all necessary and related documents to effectuate the transfer.

BACKGROUND:

Property A is owned in fee by the City of Chowchilla (“City”), but is completely surrounded by privately held property. Approximately ten (10) years ago, Property A was designated for City use for a roadway extension; however, that roadway extension was subsequently deemed unnecessary and extinguished via an amendment to the City’s General Plan. Consequently, Property A exists in a “land-locked” state and is not subject to beneficial improvement by the City.

The owner of real property immediately to the south of Property A (“Adjacent Owner”) is in the process of constructing a warehouse distribution center (“DC”) on its property. A portion of the Adjacent Owner’s property—Property B—has an existing General Plan designation of "Public Facility," and is not being utilized by the Adjacent Owner in its construction of the DC. The Adjacent Owner is willing to exchange this Property B for the City’s land-locked Property A.

Property A and Property B contain equivalent acreage (Attachments 2 & 3). Property B, with its Public Facility designation and adjacency to Chowchilla Boulevard provides more benefit to the City than Property A in terms of its beneficial future uses. Specifically, Property B can accommodate future public improvements for the City, whereas Property A cannot.

The Surplus Lands Act, among other things, requires that surplus land of cities and counties undergo review by the California Department of Housing and Community Development ("HCD") for potential suitability for the provision of housing. However, certain lands are exempt and not subject to such provisions. Pursuant to California Government Code Section 54221(f)(1)(C), the Property A being exchanged here is "exempt surplus property" that is not subject to the HCD procedures.

The City, as the holder of fee title to Property A, has the authority to effectuate the proposed exchange.

ENVIRONMENTAL REVIEW ANALYSIS:

The exchange of Property for Property B is exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.), section 15378, subdivision (b)(5) and section 15061, subdivision (b)(3). The exchange of these properties is an organizational and administrative activity of the government that will not result in direct or indirect physical changes, and it can be seen with certainty that there is no possibility that the mere exchange of title may have a significant effect on the environment.

FISCAL IMPACT:

There is no fiscal impact to the City’s General Fund.

ALTERNATIVES:

None.

ACTIONS FOLLOWING APPROVAL:

If approved, the City Administrator or designee will execute all necessary and related documents to effectuate such exchange.

COUNCIL RESOLUTION # -23

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHOWCHILLA, CALIFORNIA

AUTHORIZING THE EXCHANGE OF COMPARABLE PROPERTIES OF EXEMPT SURPLUS LAND (APN 002-280-027 & PORTION OF TRACT 1, MADERA COUNTY RECORDER’S BOOK 66 OF RECORD OF SURVEYS AT PAGE 38)
BE IT RESOLVED by the City Council of the City of Chowchilla as follows:

Section 1. WHEREAS:
a) City-owned Property A is completely surrounded by privately held property and is not subject to beneficial improvement (see Exhibit A depicting City Property A); b) The owner of real property immediately adjacent to Property A (“Adjacent Owner”) is willing to exchange a portion of its property, which has a "Public Facility" designation (hereinafter, “Property B”), for the City’s Property A (see Exhibit B depicting Property B); c) Property A and Property B contain equivalent acreage (see Exhibit A as compared to Exhibit B);
d) Property A is of no beneficial future use to the City and Property B is necessary for beneficial future public improvements for the City;
e) Pursuant to Government Code Section 54221(f)(1)(C), exchange of Property A for Property B is "exempt surplus land" not subject procedures of the California Department Housing and Community Development related to implementation of the Surplus Lands Act; f) The exchange of Property A for Property B is exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines (Cal.

Section 2. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chowchilla hereby finds, determines and declares the following:
a) The City of Chowchilla hereby authorizes the exchange of legal title of Property A for Property B.
b) the City to receive legal title to Property B and the Adjacent Owner to receive legal title to Property A.
c) The City Administrator or designee is hereby authorized and directed to execute all necessary and related documents to effectuate such exchange.
