THE AGENDA
Meeting of: April 25, 2023
AGENDA SECTION: Consent
SUBJECT: Consideration of Quarterly Waiver Report
PREPARED BY: Rod Pruett, City Administrator
ATTACHMENTS: Spreadsheet with Detail of the Waivers Issued
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Approve the Quarterly Waivers Report for January through March 2023.
BACKGROUND:
Council approved the City Administrator to have the authority to waive penalties, interest, fees, liens, etc. up to $10,000. It was requested that a quarterly report be presented that summarized the transaction the City Administrator granted under this authority.
REASON FOR RECOMMENDATION:
This report is a summary of the waivers that were issued and is an element of transparency for the Council and the public. These waivers are issued on a case by case basis and will fluctuate from quarter to quarter. This is a tool for the Council to evaluate the use and effectiveness of the program.
FISCAL IMPACT:
There were no waivers issued this quarter.

THE AGENDA
Meeting of: April 25, 2023
AGENDA SECTION: Consent
SUBJECT: Consideration of Monthly Financial Statements
PREPARED BY: Kerri Williams, Finance Director
ATTACHMENTS: February 2023 Budget vs Actual and Balance Sheet
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Approve the February 2023 Financial Statements shown in the attachment.
BACKGROUND:
Staff provides Council with monthly financial information as an ongoing financial status update.
REASON FOR RECOMMENDATION:
The monthly financial statements consist of a Budget vs Actual and a Balance Sheet for the General Fund. The Budget vs Actual shows the current Month (Period Activity) and current Year (Fiscal Activity) Revenues and Expenses by Department in summary form compared to the current year Original and Current budgets. The Balance Sheet shows the Assets, Liabilities and Fund Balance at the time the report is generated. This provides an overview of cash, amounts owed to the City, amounts the City owes and the fund balance at a specific point in time.
The financial statements are being presented as an overview of the City’s finances and are not meant to be a comprehensive in-depth review. As a reference to compare to the percent remaining column in the report, the percentage of the year remaining 33.33%.
If the percent remaining column for Revenues is higher than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant. If the percent remaining column for Expenses is lower than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant.
If there are questions regarding the actual amounts or budget vs actual variances, please forward your questions to me in enough time before the meeting for staff to research them.
FISCAL IMPACT: Revenues
General Administration- Property tax and VLF, which are 2 of our biggest revenues, are only received 2 times a year in February and May, we have only received one distribution. We are teetered which means we do not have to worry about delinquencies, because the County pays us and goes after the delinquencies themselves. Sales tax payments usually run a couple months behind and but we have received February’s payment. Sales tax is our 2nd largest revenue.
Police Sworn/Net- Budgeted revenue is from school reimbursements for SRO services, SIU from the County and from grants that are billed periodically. We have not billed the schools or the County yet as we usually bill quarterly. Also, it has $967k Transfer-in from Measure N for the RIMS Software, Piping Project and recruitment and retention of employees. Also, the Madnet program is reimbursed through the County and as of right now we do not have any officers in this program.
Fire Services- This revenue is from transfers-in from Measure N and Fire Impact Fees for the fire station expansion project Phase 1 & Phase 2.
Community & Economic Development- This will fluctuate as building permits are pulled. We budgeted for some growth which includes projects like Oleander, Rancho Calera, Montgomery Farms and miscellaneous lots within Greenhills. So far, we have Century Communities building their part of the Montgomery Farms lots. Oleander Terrace has pulled all of their permits, but other projects have not pulled their permits yet. We still have other miscellaneous permits for other items that are happening as well.
There is also $185k of grant revenues that we have not received as of now.
Parks and Recreation- $200k of this is from a grant that we have not spent yet so we have not requested reimbursements. The rest is overhead allocations from the LLMD that happen at the end of the year.
Community Relations- Revenues are from sports program reimbursements, park pavilion rentals and donations.
Expenses
All departments expenses are within the normal range or better right now ALTERNATIVES:

THE AGENDA
Meeting of: April 25, 2023
AGENDA SECTION: Consent
SUBJECT: Consideration of Monthly Financial Statements
PREPARED BY: Kerri Williams, Finance Director
ATTACHMENTS: March 2023 Budget vs Actual and Balance Sheet
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Approve the March 2023 Financial Statements shown in the attachment.
As a reference to compare to the percent remaining column in the report, the percentage of the year remaining 25%.
Expenses
All departments expenses are within the normal range or better right now.

However, we also wanted to changed how the 1st to developed were penalized and we spread it out evenly so most of the undeveloped current assessments will go up until they develop. Once developed, the assessments will be significantly less than under the previous model. Incentivizes the developer and easier to market to the end user. We will meet with land owners to show them the model but this will have to be approved by the voters within the district. Staff recommends that the City Council authorize the City Administrator to execute an Airport Land Lease Agreement with Thiel Air Care, Inc. to allow use of the City’s airport for aeronautical activities and business.

• Weed abatement rental credit is $30,272. Credit shall reduce as unimproved land becomes leased and improved.
• Adjusted lease is $22,272
FISCAL IMPACT:
The City will be compensated by Thiel Air Care, Inc. at a rate of $22,272 annually for lease of airport property.

The subsequent acceptance of rent hereunder by CITY shall not be deemed to be a waiver of any preceding breach by TENANT of any term, covenant, or condition of this lease, other than the failure of TENANT to pay the particular rental so accepted, regardless of CITY knowledge of such preceding breach at the time of acceptance of such rent.
15. Right of Entry
10 CITY reserves the right to enter upon the property at a reasonable time for the purpose of making any inspection it may deem expedient or desirable for the proper enforcement of any terms, conditions, provisions, and covenants of this lease agreement.

TENANT shall furnish the CITY with copies of original certificates and endorsements, including amendatory endorsements, effecting coverage required by this clause. All certificates and endorsements are to be received and approved by the CITY before rental commences; however, failure to do so shall not operate as a waiver of these insurance requirements. The CITY reserves the right to require complete, certified copies of all required insurance policies, including endorsements affecting the coverage required by these specifications at any time.
Airport Appropriated by Federal Government
In the event that the Chowchilla Airport or any portion thereof is appropriated by the Federal Government in a national emergency and as a result thereof civil aircraft are prohibited from using said airport, and as a result thereof TENANT is otherwise prohibited by Federal Law, rule or regulation from using and occupying the leased property, and TENANT for such reason does not use or occupy said leased property and 13 TENANT is not compensated for damages caused thereby, then during the period in which all such conditions exist the rental herein required to be paid shall be suspended.
Except for such suspension or rental, each and every provision, term, covenant and condition of this lease shall remain in force and effect, including, but not by way of limitation, TENANT’S obligation to maintain the leased premises. The terms of this lease agreement shall not be extended because of the occurrence of the above conditions.

Subject to the terms and conditions stated herein, it is understood and agreed that until such time as CITY determines that runway 12/30 is serviceable and does not pose any risk TENANT shall have the right to non-exclusive use of Runway 12/30 for the takeoff and landing of aircraft, but at no time shall have the right to park, load, or service aircraft or other equipment on the shoulders of Runway 12/30 or imaginary surfaces except for unique date specific operations that are specifically approved in writing by the Airport Manager. TENANT shall load and service aircraft only on the leased property and no other place on the airport. TENANT shall have the non-exclusive right to use Runway 12/30 for takeoff and landing of aircraft when necessary or convenient. Such property may be removed and stored in a public warehouse or elsewhere at the cost of and for the account of TENANT.
Should CITY elect to re-enter as herein provided, or should CITY take possession pursuant to legal proceedings or pursuant to any notice provided for by law, CITY may either terminate this lease agreement or may, from time to time, without terminating this lease agreement, relet said property or any part thereof for such term or terms and at such rental or rentals and upon such other terms and conditions as CITY, in its sole discretion, may deem advisable with the right to make alterations and repairs to the said property.
Rentals received by CITY from such reletting shall be applied first to payment of any indebtedness other than rental due hereunder from TENANT to CITY; second, to payment of rental due and unpaid hereunder; third, to payment of any cost of such reletting, and fourth, to payment of the cost of any alterations and repairs to the property.
The residue, if any, shall be held by CITY and applied to payment of future rental as the same may become due and payable hereunder. Should such rentals received from such reletting during any period be less than that agreed to be paid during that period by TENANT hereunder, then TENANT shall pay such deficiency to CITY. Such deficiency shall be calculated and paid monthly. No such re-entry or taking possession of said property by CITY shall be construed as an election on its part to terminate this lease for any breach. In addition to any other remedy it may have, CITY may recover from TENANT all damages it may incur by reason of such breach, including the cost of recovering the property and including the worth at the time of such termination, of the excess, if any, of the amount of rental and charges equivalent to rental reserved in this 16 lease for the remainder of the stated term over the then reasonable rental value of the stated term.
22. Airport Restrictions
It is hereby expressly understood and agreed that this lease agreement is subject to all applicable terms and conditions of that certain instrument of release dated September 7, 1962, executed by the Administrator of the Federal Aviation Agency acting on behalf of the United States of America, recorded September 20, 1962, in Book 839, at page 540, Official Records of Madera County, California, and particularly the following reservations, covenants and conditions, to which TENANT hereby agrees to be bound:

In the event the aforesaid covenant is breached, the City of Chowchilla, California, reserves the right to enter on the property leased hereunder and cause the abatement of such interference at the expense of the TENANT.
23. Condemnation Clause
If any part of the property shall be taken or condemned for a public or quasi-public use, and a part thereof remains which is susceptible of occupation hereunder, this lease shall, as to the part so taken, terminate as of the date title shall vest in the condemnor, and the rent payable hereunder shall be adjusted so that TENANT shall be required to pay for the remainder of the term only such portion of such rent as the value of the part remaining after the condemnation bears to the value of the entire property at the date of condemnation; provided, however, in such event CITY shall have the option to terminate this lease agreement as of the date when title to the part so condemned vests in the condemnor. If all the property, or such part thereof be taken or condemned so that there does not remain a portion susceptible of occupation hereunder, this lease agreement shall thereupon terminate. If a part or all of the property be taken or condemned, all compensation awarded upon such condemnation or taking shall go to the CITY and TENANT shall have no claim thereto and TENANT hereby irrevocably assigns and transfers to CITY any right to compensation or damages to which TENANT may become entitled during the term hereof by reason of the condemnation of all or a part of the property.
24. Litigation Involving Lease
18 In the event that CITY is made a party to any litigation concerning this lease agreement or the leased property by reason of any act of omission by TENANT, TENANT promises to defend and hold CITY harmless and indemnify CITY from all loss or liability, including reasonable attorney's fees necessarily incurred by CITY in such litigation. The foregoing sentence shall not apply in the event defense of CITY in any suit is provided for by any insurance carrier. In case suit shall be brought for unlawful detainer of said property, for the recovery of any rental due under the provisions hereof, or because of the breach of any other covenant, term, condition or provision herein contained on the part of TENANT to be kept or performed, and CITY prevails therein, TENANT shall pay to CITY a reasonable attorney's fee which shall be fixed by the Court; provided, however, in the event either party finds it necessary to institute suit for any other purpose in connection with the terms of or the enforcement of this lease agreement, it is agreed that each party shall pay their own attorney’s fees and costs associated with such action.
25. Non-discrimination
TENANT for himself, his personal representatives, successors in interest, and assigns, as part of the consideration hereof does hereby covenant and agree as a covenant running with the property, that:
a) No person on the grounds of race, color, or national origin shall be excluded from participation, denied the benefits of, or be otherwise subjected to discrimination in the use of said property;

d) In the event of breach of any of the above non-discrimination covenants, the City of Chowchilla shall have the right to terminate this lease agreement and to re-enter and repossess said property and the facilities thereon, and hold the same as if said lease had never been made or issued.

Prior to investing in a laddered portfolio of Treasury securities, a significant portion of the City’s funds were deposited in the Local Agency Investment Fund (LAIF), which is part of a large $225 billion pool of funds that is managed by the State Treasurer’s Office on behalf of the State of California, State Agencies, and local governments. LAIF is popular among local governments due to its low cost and convenience and its emphasis on safety and liquidity.
Despite its many advantages however, holding funds in LAIF has two main drawbacks:
Depositors in LAIF forgo the opportunity to potentially earn additional interest income, and
The interest rate or yield paid on deposits in LAIF can be subject to a high degree of volatility, making it difficult to accurately budget annual interest income.
RECENT INTEREST RATE TRENDS
Interest rates or ‘bond yields’ increased dramatically during 2022 and early 2023, due to a sharp and persistent increase in the rate of inflation and due to the Federal Reserve Board’s policy of aggressively raising interest rates to combat inflation. Moreover, the increase in Treasury yields far outpaced the increase in the yield paid by LAIF. 2 For example, on January 3, 2022 the yield on a 1-year Treasury security was 0.40%. By contrast, on March 31, 2023 the yield on a 1-year Treasury security was 4.64%, whereas the yield paid by LAIF as of March 29, 2023 was only 2.88%.
Yield Comparison: LAIF vs. 1-Year U.S. Treasury
(Data Sources: Office of the State Treasurer and U.S. Department of the Treasury) U.S. TREASURY SECURITIES
U.S. Treasury securities are direct debt obligations of the United States Federal Government that are issued to fund its day-to-day outlays for national defense, entitlement programs, discretionary spending, etc. Treasury securities are one of the safest investments available as they are backed by the full faith and credit of the U.S. government. They are divided into three primary categories according to the initial length of maturity. These are Treasury Bills (one year or less), Treasury Notes (2-10 years), and Treasury Bonds (20-30 years). Treasury securities are considered extremely low-risk, although like all investments they can be impacted by inflation and changes in interest rates.
Given the current difference between the yield on Treasury securities and the yield paid on deposits in LAIF, the City chose to invest a portion of its funds in Treasury securities in order to earn additional interest income.

LAIF Yield 1-Year U.S. Treasury Yield
3 CITY OF CHOWCHILLA PORTFOLIO EARNINGS FROM DECEMBER 6, 2022 THROUGH MARCH 31, 2023 During the period from December 6, 2022 through March 31, 2023, the City’s portfolio of Treasury securities generated total earnings of $219,478. These earnings were comprised of the following three components: (1) interest payments, (2) accrued interest, and (3) amortized discount:
Interest payments: Interest payments are cash payments received by the portfolio.
During the period from December 6, 2022 through March 31, 2023, the City received interest payments of $49,7693
Accrued interest: Accrued interest is interest that has been earned but not yet paid.
As of March 31, 2023 the City had earned accrued interest of $38,631.
Amortized discount: Sometimes, prevailing bond market conditions are such that the purchase price of a Treasury security is less than the ‘face value’ or ‘maturity value’ of the security, in which case the security is said to be purchased at a ‘discount’.
To wit, the Treasury securities purchased by the City on December 6, 2022 and March 31, 2023 have an aggregate ‘maturity value’ or ‘face value’ of $18,158,900 but the ‘principal cost’ of the securities was only $17,631,183, meaning the securities were purchased at an aggregate discount of $527,717.
Each time a Treasury security in the portfolio matures, the City will be paid the ‘maturity value’ or ‘face value’ of that security. If such security was purchased at a discount and then held to maturity, then the difference between the discounted principal cost of the security and the face value or maturity value of the security represents ‘income’ to the City, similar to interest earnings. To be fully assured of ultimately receiving the value of amortized discount, a discounted security must be held to final maturity.
‘Amortized discount’ represents that portion of any discount that has been earned, but not yet paid. As of March 31, 2023 the portfolio’s amortized discount was $131,154.
Overall, from December 6, 2022 through March 31, 2023, the portfolio of Treasury securities generated estimated gross earnings before expenses of $219,478 which is equal to an annualized yield of 4.67%. By comparison, during that same period the average daily yield on deposits in LAIF was 2.53%. Total expenses incurred during the period were approximately $3,975 (excluding one-time up-front fees). 4 In summary, the estimated gross earnings from the portfolio of Treasury securities during the reference period were arrived at by considering the following components:

NEXT STEPS
The City does not need to take any further action at this time. The next scheduled maturity of a Treasury security in the City’s portfolio will not occur until June 30, 2023. At or prior to the maturity of each security in the portfolio Wulff, Hansen can assist the City in evaluating its cash flow and liquidity needs, and its potential reinvestment options.
Meanwhile, all of the securities in the portfolio are held in trust for the City by its Custodian Bank (Zions Bank). The scheduled payment of interest and principal on each security will be automatically credited to the custody account upon receipt, and the City will continue to receive monthly account statements from Zions Bank. The portfolio’s market value (as opposed to its face value) typically fluctuates as interest rates change. According to the most recent Custodian’s statement, as of March 31, 2023 the market value was $15,177,226.
Depending on the City’s cash balances, expected cash flow requirements and liquidity needs, the City may wish to consider investing additional funds in one or more Treasury securities, above and beyond the amount currently invested, in order to earn additional interest income. If so, Wulff Hansen can help arrange any such additional investment.
Alternatively, if the City ever needs immediate access to some or all of its invested funds due to a large unanticipated financial obligation or emergency situation, then Wulff Hansen can help arrange for the prompt liquidation of one or more Treasury securities in the portfolio.

THE AGENDA
Meeting of: April 25, 2023
AGENDA SECTION: New Business
SUBJECT: Discussion and Direction Regarding the Use of American Rescue Plan Act Funds
PREPARED BY: Rod Pruett, City Administrator
ATTACHMENTS: None
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
The City Council give direction on the best use of the American Rescue Plan Act (ARPA) funds.
BACKGROUND:
On march 11, 2021 President Biden signed the American Rescue Plan Act on 2021 (ARPA), which contains $1.9 trillion in overall national spending to support relief and economic recovery efforts. Of the $1.9 trillion, $130.2 billion is to go to local governments. $65.1 billion to counties, $45.6 billion to cities with population of 50,000 or greater and $19.5 billion to municipalities with a population less than 50,000.
Municipalities with a population less than 50,000 will receive their funding from their state and all the others receive their funding directly from the federal government. Chowchilla’s allocation is $4.38 million.
Eligible uses of the funds include the following categories:
• Respond to the COVID-19 emergency and address its economic effects, including through aid to households, small businesses, nonprofits, and impacted industries such as tourism and hospitality.
• Provide premium pay to essential employees of state or local governments or make grants to the employers of essential employees.
• Provide government services to the extent of any revenue reduction resulting from COVID-19. • Make investments in water, sewer and broadband infrastructure.
Other requirements are as follows:
• Cities have until December 31, 2024 to obligate funds and until December 31, 2026 to spend the funds.
• State and local governments cannot use the funds to make pension payments. • States cannot use the funds to offset revenue losses resulting from any tax cut, tax delay or tax rebate enacted after March 3, 2021.
• State and local governments may transfer funds to private nonprofit groups, public benefit corporations involved in passenger or cargo transportation, and special-purpose units of state or local governments.
• State and local governments must provide periodic reports to the Secretary of the Treasury giving a detailed accounting of the uses of funds and, in the cases of states, all modifications to the states' tax revenue sources.
In November 2021, staff provided some draft engineer estimates on a few projects that would be a good use of the funds. They are as follows:
Description Draft Estimate Notes
New Water Well $1,750,000
Water Tank #3 $2,500,000 1.5 million gallon tank
Water Stub Outs over Berenda
