THE AGENDA
Meeting of: July 11, 2023
AGENDA SECTION: Public Hearings
SUBJECT: Introduction of an Ordinance Adding Section 4.04.105 and Amending Sections 4.04.070 and 4.04.10 of Chapter 4.04 of the City of Chowchilla Municipal Code Relating to Public Purchasing and Procurement PREPARED BY: Rod Pruett, City Administrator
ATTACHMENTS: Ordinance

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council introduces the proposed amendments, waives the first reading, and brings back the item for a potential second reading and adoption.

BACKGROUND:

At the June 13, 2023 Council Meeting, the Council approved a resolution updating APP.F2.2 a Procurement Policy, setting the policies and procedures regarding procurement to provide more detailed guidelines than are contained within the Municipal Code. It was updated to allow the City Council to make determinations to waive the competitive procurement procedure will make the process more efficient and is in line with industry standards. There are some instances where the competitive procurement process can reduce efficiency due to lack of vendors in a specified service/supply industry.

REASON FOR RECOMMENDATION:

After reviewing the agenda item that was on the June 13, 2023 agenda, it was discovered that the approval was only for updating the policy and didn’t include updating the Ordinance. It is necessary to update both the policy and the Ordinance so we are bringing the item back to update the Ordinance.

FISCAL IMPACT:

There is no fiscal impact to update the Ordinance.

ALTERNATIVES:

Do not update the Ordinance and remain status quo.

ACTIONS FOLLOWING APPROVAL:

There will be a second reading at the next Council Meeting scheduled for 7/25/23. 1 ORDINANCE NO.

THE AGENDA
Meeting of: July 11, 2023
AGENDA SECTION: New Business
SUBJECT: Consideration and Adoption of a Resolution Amending the 2023/2024 Salary Scale to Include the Accounting Technician I, Accounting Technician II, and Utility Billing Clerk Classifications
PREPARED BY: Joann McClendon, City Clerk
ATTACHMENTS: Resolution

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council adopts a resolution amending the 2023/2024 salary scale to include the Accounting Technician I/II, and Utility Billing Clerk classifications.

BACKGROUND:

Currently, the Finance Department is staffed with a Director, Accounting Manager, Fiscal Manager, one Account Clerk II, one Account Clerk III and a part time Account Clerk I. The City Office Employee Association bargaining unit has reviewed and approved adding the positions at the proposed Range 30 for the Accounting Technician I, Range 35 for the Accounting Technician II, and Range 29 for the Utility Billing Clerk, and are all typical with similar-sized agencies.

REASON FOR RECOMMENDATION:

Due to the future planned departure of the Accounting Manager, the Director would like to split that one management position into two clerical positions that will focus on A/P, A/R, Payroll, Business License, as well as working on budget items. The Utility Billing Clerk classification is more aligned to the actual duties performed at the Finance counter instead of the overly-generalized description of the currently used Account Clerk series. This will eliminate the Account Clerk II/III positions, along with the Accounting Manager Position after future departure.

FISCAL IMPACT:

The salary for a Range 30 position would start at $45,822.40 per year and top out at $58,635.20. The salary for a Range 35 position would start at $51,854.40 and top out at $66,372.80. The salary for a Range 29 position would start at $44,699.20 per year and top out at $57,200.00. This includes the 3% COLA effective July 1, 2023 as negotiated per the CCOEA MOU.

ALTERNATIVES:

Do not approve the additional classifications.

ACTIONS FOLLOWING APPROVAL:

Update the salary scale.

THE AGENDA
Meeting of: July 11, 2023
AGENDA SECTION: New Business
SUBJECT: Council Resolution adopting the CDBG Coronavirus Aid Small Business Loan Program Guidelines
PREPARED BY: Mark Hamilton, Community and Economic Development Director ATTACHMENTS: 1. Resolution for CDBG Coronavirus Aid Small Business Loan Program Updated Guidelines

2. Draft Amended CDBG Economic Development Loan Program Guidelines

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Staff recommends the City Council to approve a resolution adopting the Amended CDBG Coronavirus Aid Small Business Loan Program Updated Guidelines.

BACKGROUND:

Community Development Block Grant Coronavirus Aid (CDBG-CV) is a federally funded program.

CDBG-CV funds may be used to secure economic opportunities for low- and moderate-income persons.

CDBG-CV funds are targeted to businesses of the City that have the highest adverse impact as a result of the Coronavirus.

It was brought to Staff’s attention these guidelines needed to be updated to comply with Appendix H, of the California Department of Housing and Community Development (HCD) Economic Development Program Checklist. The following has been updated in the program Guidelines:

1. Program must comply with Federal procurement regulations in 2 CFR 200.318 - 200.326 when procuring goods or services.

2. City must maintain procurement documentation files, including:
• Pre-award independent cost estimate
• Documentation on procurement method
• Copies of procurement documents

3. City must produce, adopt, and maintain written program guidelines.

4. Program guidelines as written must be consistently applied across all awards.

One of the primary changes to the guidelines is the Duplication of Benefits (DOB) policy. This policy requires grantees to check and verify the applicants have received other Federal Funds to reimburse the same expense. The remaining modifications to the guidelines were administrative changes recommended by California Department of Housing and Community Development (HCD).

With council’s consideration of the amended guidelines, the City will be able to continue to distribute the remaining CV funds to ensure they are expended prior to the program’s expenditure deadline of October 2023 and February 2024. Upon review under the new program guidelines, if the applications are deemed eligible by MBI’s underwriting team, staff will then continue the processing the loan accordingly.

FISCAL IMPACT:

At this time, there is no fiscal impact to the City of Chowchilla. City Staff will work closely with Michael Baker International, our Economic Development Consultant to assist City Staff with the submittal of this application. There is no impact to the City’s General Fund.

ACTIONS FOLLOWING DECISION:

Upon approval of the amended guidelines, the City will review the current loan applications previously considered ineligible. Upon review under the new program guidelines, if the applications are deemed eligible by MBI’s underwriting team, staff will then begin the process of funding the loan accordingly.

ALTERNATIVES:

1. Continue the Item to a future City Council meeting (date and time to be specified in City Council motion).

2. Approve, subject to other than those updates recommended by staff (identify specific findings and/or conditions amended; or, to be addressed in City Council motion); or,

3. Deny; or,

4. Refer to City Staff for reconsideration of specific items to be addressed in City Council motion.

PROCUREMENT FILE MAINTENANCE:

The Procurement Checklist must be filled out for each procurement action taken by a subrecipient, according to the procurement methodology used for each solicitation. This checklist must be maintained for each procurement activity and within each procurement file. City of Chowilla staff or consultant will verify, through grant management or monitoring, whether the procurement checklist has been maintained for procurement actions taken by subrecipients. In addition to the procurement checklist, subrecipients will be required to provide the following key documents to assess compliance with procurement activities:
• Independent Cost Estimate

4 Conflicts of Interest and governing the actions of its employees engaged in the selection, award, and administration of contracts.

No employee, officer, or agent may participate in the selection, award, or administration of a contract supported by a Federal award if he or she has a real or apparent conflict of interest. Such a conflict of interest would arise when the employee, officer, or agent, any member of his or her immediate family, his or her partner, or an organization which employs or is about to employ any of the parties indicated herein, has a financial or other interest in or a tangible personal benefit from a firm considered for a contract.

The officers, employees, and agents of the non-Federal entity may neither solicit nor accept gratuities, favors, or anything of monetary value from contractors or parties to subcontracts.

However, non-Federal entities may set standards for situations in which the financial interest is not substantial or the gift is an unsolicited item of nominal value. The standards of conduct must provide for disciplinary actions to be applied for violations of such standards by officers, employees, or agents of the non-Federal entity.

Procurement documentation shall be maintained containing the following elements:
• Pre-award independent cost estimate
• Documentation on procurement method
• Copies of procurement documents
RESTRICTIONS ON DUPLICATION OF BENEFITS:

CDBG funds may not be used to supplant or duplicate private, federal, State, or local government funding.

The Applicant must disclose any funds received in response to the COVID-19 pandemic from private sources, and from any federal, State, or local government programs. Acceptance of other funding will not disqualify an applicant from the Program but may affect the amount of funds available or eligible costs. Applicants will provide personal and business bank statements. The City will review the statements to identify any unreported influx of cash.

If a Borrower receives funds from any source for the same costs that are funded under this Program, the Borrower must repay the duplicative funding. Either the CDBG business loan or the other funding source may be repaid. Other sources may include, but not are not limited to:
• Private sources including bank loans (not including documented loan from a relative); • Small Business Administration (SBA) Paycheck Protection Program (PPP), Economic Injury Disaster Loan Program (EIDL) or Economic Adjustment Assistance Program (EAA); • State of California iBank Small Business Disaster Relief Loan Guarantee Program; • State of California Pandemic Unemployment Assistance; or • Any other federal, State, or local government program providing funding for items noted as eligible costs for this Program.

DUPLICATION OF BENEFITS:

All businesses are required to complete a Duplication of Benefits (DOB) Affidavit as part of the application process. This affidavit acknowledges the City’s requirement that any person or entity 5 receiving CDBG-CV assistance must agree to repay assistance that is determined to be duplicative.

To meet HUD’s requirements, the City has developed a method of assessing whether the use of CDBG-CV funds will duplicate financial assistance that is already received or is likely to be received by acting reasonably in evaluating need and the resources available to meet that need.

This assessment process is as follows:

1. Upon receipt of the completed application packet to the Program, the City of Chowchilla and Consultant will review the Duplication of Benefits Affidavit to determine if the applicant has reported receiving any potentially duplicative assistance.

2. If so, the City or Consultant will request additional information from the applicant, including:
a. Dates funds were received
b. Specific uses of funds received, including receipts and dates as appropriate.

3. Based on a review of this information, the City or Consultant may:
a. Determine that there is no duplication and proceed with consideration of the application for the full amount requested.
b. Determine that there is a partial duplication and proceed with consideration of the application for an amount that reduces the request by the Duplication of Benefits (“DOB”) amount:
i. (Amount Requested) – (Amount of DOB) = Eligible Amount c. Determine that there is a complete duplication and deny the application.

4. In the event that an application moves forward and is approved, in whole or in part, the applicant will be required to sign a Subrogation Agreement to address concerns around the potential for future duplication (for example a Paycheck Protection Program application was made and was not denied but the applicant has not heard back).

5. In the event that an application is approved in part, the City will also include in the funding documents specific information around what the funds may be spent on so as to avoid duplication of benefits.

6. The City or Consultant will require all successful applicants to provide documentation as to how funds are actually expended and will review this documentation to ensure no duplication has taken place.

All application documents, including the Affidavit and Subrogation Agreement, shall be retained in compliance with HUD’s record retention requirements.

REVIEW PROCESS:

The following priorities will be considered when awarding funds:
• The business provides jobs to low- to moderate-income individuals. • The number of jobs that the business sustains during a normal business cycle. • The business demonstrates that it has lost a significant share (25% or more) of revenue due to the COVID-19 pandemic.

d. Other program documentation

3. Certification that no additional benefits have been received. This can be a signed affidavit from the beneficiary or other form as created by the program.

4. A signed subrogation agreement from the recipient
Note: Items 3. and 4. can be on the same form.

For businesses opening after March 27, 2020, COVID 19 impact must be demonstrated by evidence of one of the following:

Comparison tax returns 2019/2020 or 2020/2021.

MONITORING:

The applicant is responsible for providing the Program with documentation demonstrating that grant funds were used in the way they were intended.

The City will review the business’ application to identify how the business said they would use funds and will collect supporting documents. If a business finds it necessary to change their intended use of the funds, they must seek approval from the City in writing before making any changes and submit an updated itemized lists of business expenses.

Although this list is not intended to be exhaustive, supporting documents may include:

• Project costs are reasonable as evidenced by 3rd party cost estimates (e.g., vendor quotes, copy of online search, etc.).
• All project costs are eligible per federal regulations and HCD guidelines. • All sources of project financing are committed to support the financial projections that demonstrate that, with EDLP funds, the business is likely to continue operations and retain (or re-create) the projected number of jobs (51% of which are filled by LMI individuals or, if lost due to normal turnover, will be may available to LMI individuals). This may include:

o The management team has the capacity to execute the business plan and meet the financial projections (i.e., sales revenues, COGS, operating expenses, and profitability).

THE AGENDA
Meeting of: July 11, 2023
AGENDA SECTION: New Business
SUBJECT: Consideration of a Resolution Declaring an Emergency Condition Necessitating Approving a Specialized Utility Services Program Agreement with California Rural Water Association to Safeguard Life And Property and Continue Essential Services Of The City Of Chowchilla
PREPARED BY: Jason Rogers, Director of Public Works
ATTACHMENTS: Resolution, Service Proposal, References

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

The City Council Conduct approve a resolution approving a Specialized Utility Services Program Agreement between the City of Chowchilla and California Rural Water Association.

BACKGROUND:

Certification Requirements for Operating Wastewater Treatment Plants are regulated by Title 23 of the California Code of Regulations (CCR). The City of Chowchilla’s Wastewater Treatment Plant (WWTP) is activated sludge facility designed for a treatment capacity of 1.8 million gallons per day (MGD) and currently treats approximately 0.80 MGD during dry weather conditions and an occasional peak flow of 1.1 MGD during wet weather conditions. As such, the WWTP is currently identified by the State Water Resources Control Board (SWRCB) as a class III wastewater treatment plant.

Per the CCR, each Chief Plant Operator (CPO) and designated operator-in-charge of a facility shall possess a valid operator certificate at a grade level at least equivalent to the Wastewater Treatment Plant Classification. As such, the City is required to have a CPO with a minimum Grade III Wastewater Operator Certification. However, due to recent retirements and resignations, the City currently does not have any staffing with the State required certification.

REASON FOR RECOMMENDATION:

Recently the City has used part-time staffing with the proper grade certification to manage staff and meet State requirements but the staff member has accepted a position with another agency. Additionally, the City has focused on providing training to the three operators remaining at the plant, but the closest operator to the grade III certification is approximately one to two years away from attaining the needed certification grade. As a result, the City has been advertising the position since March but has only received one viable applicant that turned the position down.

The City of Chowchilla is currently member of the California Rural Water Association (CRWA). CRWA is the State’s leading association dedicated to providing on-site technical assistance and specialized training for rural water and wastewater systems. In addition to technical assistance and specialized training, CRWA provides a Specialized Utility Services Program (SUSP), a fee-based program that provides a full range of services to CRWA member systems that need assistance in all areas and phases of utility operations and maintenance.

General Services - CWRA will provide the following services:

1. Provide an operator with a minimum Grade 3 certification of higher for onsite visits

2. Weekly site visits from the registered Chief Plant Operator (CPO).

3. While onsite, CRWA staff will review and assist in daily operations of the treatment facility and routine testing and sampling along with any treatment facility process control adjustments and review operations with staff as needed.

4. Complete and submit all necessary reports.

5. Provide all necessary training and reporting of Operators and/or any OIT Operators and sign off during OIT Operator hours.

6. Provide 24/Hr. emergency response and phone availability for the systems operator and the utility itself per the requirements of Title 23 wastewater certification operations requirements.

7. Be available for all scheduled inspections and meetings with SWRCB staff regarding the operation of the treatment facility.

CWRA will provide the general and direct services as outlined under the proposal scope of services at a monthly rate of $8,300, or $99,600 annually. Any additional hours or emergency services, requested, or required, will be billed at a rate of $95.00 per hour per person, plus travel costs at Federal per diem rates.

FISCAL IMPACT:

The related costs for the SUSP have been included in the City of Chowchilla Fiscal Year 2023/24 Budget and is funded by the Wastewater Enterprise Fund.

ALTERNATIVES:

Failure to have a CPO with a minimum Grade III Wastewater Operator Certification will result in the City being out of compliance with Title 23 requirements.

ACTIONS FOLLOWING APPROVAL:

An agreement with CRWA will be entered into. City staff will continue to recruit for the open position.

Specialized Utility Services Program (SUSP) is a subsidiary of the California Rural Water Association (CRWA). SUSP was formally organized in September of 2012 and has been providing fee-for-services to the rural and mid-sized communities of California since that time. CRWA established the SUSP program to answer requests from member and nonmember systems for assistance and services that require more time and resources than CRWA can provide to systems utilizing our technical assistance and training programs. The SUSP business model is shaped by the values of its parent company, CRWA, in that we are first and foremost concerned about protecting public health and providing a needed service on a long-term basis to the rural communities that can utilize this kind of assistance. SUSP has a full engineering team as well as a large existing operator base. The SUSP program is set up to provide services in contract water and wastewater operations, contract utility management, sewer collections system smoke testing, leak detection, system security assessment and training, and a variety of contract management and operator training. Our staff is committed to the cause of assisting rural communities and SUSP enjoys a very stable operations group. Most of our staff have been with SUSP since the program started.

SUSP is based out of its main offices in Sacramento, with staff located throughout the state. Our tax identification number is 46-1147856. The principal contact for SUSP is Dan DeMoss, Executive Director. Our address is:

SUSP operations staff have a combined 150 years’ experience in management and operation of both water and wastewater systems. SUSP has worked with major engineering firms such as NV5 and Quad Knopf. NV5 and SUSP are in the process of implementing master plan improvements, including a funding application for an Iron and Manganese removal plant, as well as addressing radiological contamination concerns.

P a g e | 3
SUSP staff has provided start-up services to the new wastewater Treatment facility at the City of San Joaquin, and established standard operating procedures and testing that will keep the city in compliance with new plant permit discharge standards. SUSP staff has established Emergency Response Plans (ERP’s) and procedures as needed for all the communities under contract. SUSP staff recently utilized emergency plans during an instance of a complete water lateral-line failure and was able to provide emergency services, and work with local contractors to complete the installation of approximately 1,000 feet of 4-inch water line to replace the failed portion of the system.

To date, SUSP has not had any OSHA Health or Safety violations. SUSP is proactive in our approach to compliance. Our first step before starting a new contract is to evaluate the current compliance record of the system or city, and then to evaluate any compliance problems, factoring in the severity and rate of occurrence. We will then develop a sampling and reporting schedule for the onsite operators that ensures compliance based on the timeliness of samples. In the case of inherent water quality problems, i.e., arsenic, SUSP can offer possible solutions and treatment ideas for the compliance issue.

Our operations staff will provide this information to the city for its use and implementation. SUSP does require that a system with chronic compliance issues regarding water/wastewater quality problems implement a plan for compliance and will assist the city or district to do so.

SUSP will utilize the expertise and experience of CRWA training staff to train onsite operations’ staff working in the city. The training will be provided onsite, as needed, and will incorporate the City’s facilities so the staff is trained.

These are the principals of the SUSP program and are the staff that our contracts typically utilize as onsite operators for the communities that we serve.

SUSP currently has operations contracts with the following districts or cities:

Yolo County: contract ongoing – SUSP provides operation and management services of the Wild Wings CSA. SUSP has 1 Grade 5 operator/manager as well as two onsite fulltime operations staff working in both the water and wastewater system. Wild Wings has 320 connections with two wells, two storage tanks, Wastewater Activated Sludge Treatment and with Tertiary Treatment for recycling water to the golf course.

City of Huron: contract ongoing – SUSP currently provides onsite operations and management of the City’s Water, Wastewater, and Public Works department.

DCWD is a community with 330 connections located just outside of Alpine, California. SUSP reads meters, does all billing, mailings, and record-keeping functions, as well as maintains the customer service phone lines and communications during normal business hours. SUSP provides emergency response in all aspects of the operation of the district, as well as applies for grants and loans of behalf of the District in support of the system’s master plan and compliance-related needs of the District.

County of Napa LBRID and NBRID: contract ongoing – SUSP daily operations and reporting for two water treatment and distribution systems as well as wastewater plants.

P a g e | 8
Knights Landing CSD: contract ongoing – SUSP provides managerial, administrative, and technical oversight of the Knights Landing Community Services District’s ponds and wastewater treatment facility.

Fee for Services contracts: SUSP currently has multiple contracts to provide fee-forservices in such areas as Leak Detection/Line Location, Rate studies, MHI Studies, and Operator Training.

SUSP provides multiple services for water systems. These services include Engineering Services, Leak Detection and Line Location, Backflow Testing Services, Rate Studies, and MHI Studies. We also provide water and sewer plant evaluations, smoke testing for sewer collection systems, and energy efficiency evaluations for facilities. SUSP will provide loan and grant application services to those systems that do not qualify for assistance from the State or current CRWA programs. SUSP provides operation and management training via the Academy of Water Education (AWE) for CEU’s and California required contact hours.

SUSP staff has provided start-up services to the new Wastewater Treatment facility and established standard operating procedures and testing that will keep a water system or city in compliance with new plant permit discharge standards. SUSP staff have established Emergency Response Plans (ERP’s) and procedures as needed for all the communities under contract.

In the area of Chowchilla, we would be able to pull in resources from existing SUSP staff and CRWA staff within your region. SUSP onsite staff will be able to utilize other staff in emergency situations. CRWA has two staff members within 200 miles of the city that could be utilized if needed.

SUSP operations staff have been able to work successfully with SWRCB and Local Primacy Agency (LPA) staff everywhere we have worked. SUSP staff have all worked in previous roles with CRWA doing Technical Assistance and Training and have had extensive networking with the California Department of Public Health/SWRCB, as well as the State Regional Board.

SUSP has been able to provide electronic reporting capabilities to several systems that we have worked with. SUSP staff, in the case of a small CSD, implemented a brand-new billing system, and created a system website which gave customers the ability to pay bills online in addition to paying by phone. In doing so, we were able to reduce the number of delinquent accounts dramatically. SUSP staff utilized RVS Utility Billing software as a billing P a g e | 9
system in that particular case. We have also implemented improved record keeping onsite, and preventive maintenance programs for systems that did not have either at the time we took over the operation of the system. We utilized internal Excel programs for tracking PM in the systems. SUSP also performed TMF capacity assessments utilizing the State’s TMF format and program to assist the system in development of the Technical, Managerial, and financial capacity needed for the approval of applications for State and Federal infrastructure funding programs.

We will then develop a sampling and reporting schedule for the operators onsite that ensures compliance based on the timelines of samples. In the case of inherent water quality problems, i.e., arsenic, SUSP can offer possible solutions and treatment ideas for the compliance issue. Our operations staff will provide this information to the System for its use and implementation. SUSP does require that a system with chronic compliance issues regarding water/wastewater quality problems implement a plan for compliance, and will assist the city or district to do so.

SUSP will utilize the expertise and experience of CRWA training staff to train onsite operations staff working in the system. The training will be provided onsite as needed and will incorporate the System’s facilities so the staff is trained.

SUSP will be able to provide needed liability and property damage coverage, as well as performance bonding, if required.
