Meeting of: August 22, 2023
AGENDA SECTION: Presentations/Workshop
SUBJECT: Housing Element – Informational Presentation
Housing Element Cycle 2024 – 2032
PREPARED BY: Bonique Emerson, AICP, Precision Civil Engineering Housing Element Consultant Team
REVIEWED BY: Mark Hamilton, Community and Economic Development Director
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ STAFF RECOMMENDATION:
There is no action or staff recommendation at this time. The purpose of this presentation is for informational purposes to advise the City Council on the process for the Housing Element 2024-2032. This presentation was recently presented to the Planning Commission on August 16, 2023.
The purpose of the Housing Element is to keep the City in compliance with State law, to keep the City eligible to continue pursuing housing-related grant funding, and to adopt strategies to assist the City in achieving their housing needs goals.
HISTORY / BACKGROUND:
Precision Civil Engineering was contracted to complete and submit the 8-year Housing Element Update on the City’s behalf. The Housing Element is one of eight state mandated elements that every general plan must contain. The purpose of the Housing Element is to identify the community's housing needs; to state the community’s goals and objectives with regards to housing production, rehabilitation, and conservation; and to define the policies and programs that the community will implement to achieve the stated goals and objectives.
The City’s 2020-2024 Chowchilla Housing Element was adopted by the City on January 28, 2020 and certified by HCD in June 2020. Since then, the State has passed legislation to both encourage housing for residents of all income levels and to punish jurisdictions not in compliance with housing laws.
For example, the State’s Department of Housing and Community Development (HCD) will designate cities and counties as "pro-housing" if they voluntarily adopt ordinances that make it easier to plan, approve, or construct new projects. Chowchilla already has actions outlined to do this; it needs only to find ways to implement more of these planned actions. This would allow the City to earn "bonus points" for existing housing-related competitive grants that would help the City meet their other housing goals. The State can sue a city or county for failing to comply with certain housing requirements, and the State may fine cities and counties with housing elements HCD determines are out of compliance with State housing law.
Under Assembly Bill (AB) 32, a jurisdiction is eligible to complete a housing element for an 8-year period if the housing element is submitted to the State Department of Housing and Community Development (HCD) by the State’s deadline. Only when the City has submitted two housing element updates within the period due to HCD, can Chowchilla move to an 8-year cycle. The City’s January 28, 2020 adoption met the requirement of the second four-year update. Provided the City adopts a housing element pursuant to the requirements of Government Code section 65585 on or before the due date February 1, 2024 for the 6th cycle, the City will remain eligible to stay on the 8-year cycles.
The purpose of the 6th cycle Housing Element update is to identify the community's housing needs; to state the community’s goals and objectives with regard to housing production, rehabilitation, and conservation to meet those needs; and to define the policies and programs that the community will implement to achieve the stated goals and objectives. The law acknowledges that, in order for the private market to adequately address housing needs and demand, local governments must adopt land use plans and regulatory systems that provide opportunities for, and do not unduly constrain, housing development. State law also requires cities and counties to address the needs of all income groups in their Housing Elements.
Pursuant to state housing element law (Government Code section 65584, et. Seq.), the department of Housing and Community Development (HCD) is required to provide the determination of Madera County’s existing and projected housing need. In assessing Madera County’s regional housing need, HCD and Madera County Transportation Commission (MCTC) staff completed a consultation process from September 2021 through January 2022 that included the methodology, data sources, and timeline for HCD’s determination of the Regional Housing Need. In determining Madera County’s housing need, HCD considered all the information specified in state housing law (64484.01(c)). HCD’s methodology and RHNA Plan for the region was for the projection period beginning June 30, 2023. and ending January 31, 2032.
Madera County local governments are responsible for updating their housing elements for the planning period beginning January 31, 2024 and ending January 31, 2032 to accommodate their share of new housing need for each income category.
The purpose of the Regional Housing Need Allocation Plan (RHNA) is to comply with state law (Gov. Code section 65584, et. seq.) in allocating to each local government a share of regional housing need for use in updating the General Plan housing element. The housing element must accommodate that total RHNA for each of four (4) income categories (very low, low, moderate, and above-moderate) over the designated planning period. These requirements were enacted into state housing law (Article 10.6 of the Government Code) upon the California legislature determining that the provision of adequate housing is an issue of statewide concern.

AGENDA SECTION: Consent
SUBJECT: Consideration of Monthly Financial Statements
PREPARED BY: Kerri Williams, Finance Director
ATTACHMENTS: July 2023 Budget vs Actual and Balance Sheet
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Approve the July 2023 Financial Statements shown in the attachment.
BACKGROUND:
Staff provides Council with monthly financial information as an ongoing financial status update.
REASON FOR RECOMMENDATION:
The monthly financial statements consist of a Budget vs Actual and a Balance Sheet for the General Fund. The Budget vs Actual shows the current Month (Period Activity) and current Year (Fiscal Activity) Revenues and Expenses by Department in summary form compared to the current year Original and Current budgets. The Balance Sheet shows the Assets, Liabilities and Fund Balance at the time the report is generated. This provides an overview of cash, amounts owed to the City, amounts the City owes and the fund balance at a specific point in time.
The financial statements are being presented as an overview of the City’s finances and are not meant to be a comprehensive in-depth review. As a reference to compare to the percent remaining column in the report, the percentage of the year remaining 91.67%.
If the percent remaining column for Revenues is higher than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant. If the percent remaining column for Expenses is lower than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant.
If there are questions regarding the actual amounts or budget vs actual variances, please forward your questions to me in enough time before the meeting for staff to research them.
FISCAL IMPACT: Revenues
General Administration- Property tax and VLF, which are 2 of our biggest revenues, are only received 2 times a year in February and May, we have yet to receive a distribution. We are teetered which means we do not have to worry about delinquencies, because the County pays us and goes after the delinquencies themselves. Sales tax payments run a couple months behind and we have yet to receive July’s payment.
Sales tax is our 2nd largest revenue.
Police Sworn/Net- Budgeted revenue is from school reimbursements for SRO service, which we have not billed the schools yet as we usually bill quarterly. Also, it has $541k Transfer-in from Measure N for the RIMS Software, recruitment and retention of employees, and additional equipment.
Fire Services- This revenue is from transfers-in from Measure N for the fire station expansion project Phase 2.
Community & Economic Development- This will fluctuate as building permits are pulled. We budgeted for the following projects like Rancho Calera, Montgomery Farms, Solar Permits, and various other projects within the City. So far, we have Century Communities building their part of the Montgomery Farms lots.
We still have other miscellaneous permits for other items that are happening as well. There is also $85k of grant revenues that we have not received as of now.
Parks and Recreation- $140k of this is from a grant that we have not spent yet so we have not requested reimbursements. The rest is overhead allocations from the LLMD that happen at the end of the year.
Community Relations- Revenues are from sports program reimbursements, park pavilion rentals and donations.
Expenses
General Services- Budgeted Expenses are more than usual as of right now due to the POB Transfer out.
Police Sworn/Net- Budgeted Expenses are more than usual as of right now due to the POB Transfer out.
Community Relations- Budgeted Expenses are more than usual as of right now due to the cost of the Tower Clock being paid for.

AGENDA SECTION: Consent
SUBJECT: Consideration of a Resolution Authorizing the City Administrator or Designee to Enter Into an Agreement with Enterprise Fleet Management for Fleet Services and Execute All Related Documents Thereto PREPARED BY: Jason Rogers, Director of Public Works
ATTACHMENTS: Resolution, Agreements
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
The City Council Conduct approve a resolution authorizing the City Administrator to enter into an agreement with Enterprise Fleet Management for fleet services.
BACKGROUND:
The City fleet has an aging fleet with the average age of the fleet ranging from ten to twenty years old.
Maintaining an aging fleet increases the cost of repairs, the frequency of repairs, and the amount of time the vehicles are out of service.
In late 2022, early 2023, City of Chowchilla staff reached out to Enterprise Fleet Management for fleet services and asset replacement. Staff researched the use of an equity lease agreement to evaluate usefulness as an economical acquisition method.
On June 13, 2023, Enterprise Fleet Management provided a presentation to the City Council regarding the program and estimated costs were included in the Fiscal Year (FY) 2023-24 City Budget adopted by the Council on June 27, 2023.
REASON FOR RECOMMENDATION:
With the exception of a few recently replaced vehicles, the balance of the City’s fleet has not been replaced on a regular basis. As a result, the City’s fleet is aged to the point that, in many cases, the annual cost of maintaining an aged unit exceeds its salvage value.
Excessive cost of maintenance due to the overall age and condition of the fleet does not provide opportunities to appropriately fund the City’s Fleet Replacement Program. This is not a sustainable mode of operation. As such, early in 2023, staff started to research various options to improve the status quo by implementing a viable Vehicle Replacement and Maintenance Program.
Staff’s review of the fleet replacement and maintenance programs in other cities indicated that a number of cities, over the course of the last few years, have opted to adopt a vehicle lease program and use contract services for maintenance of their fleets. Their programs have resulted in substantial cost savings while allowing them to benefit from use of vehicles, generally, between three to five years old, which in turn has contributed to reduction of maintenance costs.
Enterprise Fleet Management has successfully partnered with a number of agencies to implement programs with tangible results. In order to evaluate feasibility of implementing a similar program in the City of Chowchilla, over the course of the last few months, staff has met with representatives of Enterprise Fleet Management to put together a plan. In doing so, certain parameters were established:
1. The City’s proposed Fleet Replacement and Maintenance Program would encompass all City fleet vehicles.
2. The City will establish a list of the vehicles marked for replacement.
3. A viable vehicle replacement program either with a four year or five-year replacement cycle, depending on economic feasibility, should be considered.
4. City staff would identify the required specifications and types of replacement vehicles.
5. The average age of the fleet should be reduced significantly.
6. Net operating costs should also be reduced, knowing that newer vehicles significantly lower maintenance expenses and that newer vehicles have increased fuel efficiency.
After several meetings and evaluations of various options based on the above listed parameters, it was decided that a five-year replacement cycle will best suit the City’s needs.
This program could be addressed through an “open-ended” lease structure which would allow the City to replace more vehicles with less upfront capital. Below are highlights of this program:
• No mileage restrictions, no abnormal wear and tear, and no early termination penalties. • The City has all rights of ownership and can up-fit some of the vehicles with aftermarket equipment (utility bodies, tool boxes, etc.).
• Leasing will minimize the amount of large capital outlays necessary for purchasing vehicles, and allow the City to get back on track with vehicle replacement. • The City would establish a proactive fleet replacement plan to acquire vehicles on a more consistent basis.
Refreshing the aged fleet will have a positive impact on fuel expenses. With CAFÉ standards and technology increasing the miles per gallon of newer vehicles, the City can increase the fuel efficiency of its fleet. There is a substantial savings in fuel by replacing the old vehicles with more fuel-efficient ones.
Enterprise will provide a local Account Team to assist the City with implementing and executing the Vehicle Lease and Replacement program. Their services are included in the program:
• Make recommendations on the most cost-effective vehicles in each class • Review the best time to order or sell vehicles
• Monitor the fleet to ensure efficiencies with maintenance and fuel • Compile analysis on the best alternative fuel vehicles • Review mileage patterns and fuel miles per gallon
• Establish a proactive replacement plan
It is staff’s recommendation that the City Council approve the implementation of the Vehicle Leasing and Replacement Program. Implementation of the program will provide staff with accurate costs to use when budgeting for fleet expenses during the budgeting process. This will assure the City maintains a safe, reliable service fleet while, at the same time, remaining fiscally prudent.
FISCAL IMPACT:
An agreement with Enterprise Fleet Management, Inc. can be executed without going through the traditional bidding process by piggybacking off of the existing Sourcewell for Fleet Management Services.
Sourcewell is a government agency that has been providing cooperative purchasing programs throughout North America for over 40 years. This cooperative purchasing system enables member entities to purchase on an “as needed” basis from competitively awarded contracts with high performance vendors. The City of Chowchilla is a current member of Sourcewell, and since Enterprise has been awarded a contract with Sourcewell through a competitive process for Fleet Management Services, the City can enter into an agreement with Enterprise.
The related costs for the Enterprise Fleet Management Services have been included in the City of Chowchilla Fiscal Year 2023/24 Budget and is funded within each division of each fund of the City.
ALTERNATIVES:
Not to enter into an agreement with Enterprise Fleet Management.
ACTIONS FOLLOWING APPROVAL:
An agreement with Enterprise Fleet Management will be entered into.

THIS AMENDMENT (“Amendment”) dated this ____ day of _____________, 2023 is attached to, and made a part of, the MASTER EQUITY LEASE AGREEMENT entered into on the ____ day of ____________, 2023 (“Agreement”) by and between Enterprise FM Trust, a Delaware statutory trust (“Lessor”) and City of Chowchilla ("Lessee"). This Amendment is made for good and valuable consideration, the receipt of which is hereby acknowledged by the parties.
Section 1 of the Master Equity Lease Agreement is amended to read as follows:
Lessor hereby leases to Lessee and Lessee hereby leases from Lessor the vehicles (individually, a “Vehicle” and collectively, the “Vehicles”) described in the schedules from time to time delivered by Lessor to Lessee as set forth below (“Schedule(s)”) for the rentals and on the terms and conditions set forth in this Agreement and in the applicable Schedule. References to this “Agreement” shall include this Master Equity Lease Agreement and the various Schedules and addenda to this Master Equity Lease Agreement, each of which are incorporated herein as part of a single, unitary Agreement. Lessor will, on or about the date of delivery of each Vehicle to Lessee, send Lessee a Schedule covering the Vehicle, which will include, among other things, a description of the Vehicle, the lease term and the monthly rental and other payments due with respect to the Vehicle. The terms contained in each such Schedule will be binding on Lessee unless Lessee objects in writing to such Schedule within fifteen (15) days after the date of delivery of the Vehicle covered by such Schedule. Lessor is the sole legal owner of each Vehicle. This Agreement is a lease only and Lessee will have no right, title or interest in or to the Vehicles except for the use of the Vehicles as described in this Agreement. This Agreement shall be treated as a true lease for federal and applicable state income tax purposes with Lessor having all benefits of ownership of the Vehicles. It is understood and agreed that Enterprise Fleet Management, Inc. or an affiliate thereof (together with any subservicer, agent, successor or assign as servicer on behalf of Lessor, “Servicer”) may administer this Agreement on behalf of Lessor and may perform the service functions herein provided to be performed by Lessor.
Section 2 of the Master Equity Lease Agreement is amended to add the following paragraph:
Termination: Lessee reserves the right to cancel this Agreement for any reason at all upon thirty (30) days prior written notice to Lessor. In the event of such termination, Lessor shall be paid all rentals due and owing hereunder up until the actual day of termination in accordance with Section 3(b) and 3(c) of the Master Equity Lease Agreement.
Additionally, termination should not affect Lessee’s obligation to pay any indemnities under this agreement.
Section 3(g) of the Master Equity Lease Agreement is amended to add the following additional paragraph:
In the event Lessee notifies Lessor of any claim or dispute under this Agreement, and/or any claim involving the Vehicle, Lessor will, in good faith, attempt to resolve the Lessee’s claims in a manner satisfactory to all parties and Lessor will provide commercially reasonable assistance to Lessee in any communications and/or negotiations with the Vehicle’s manufacturer with respect to claims relating to such Vehicle.
Section 4 of the Master Equity Lease Agreement is amended to read as follows:
Lessee agrees to allow only duly authorized, licensed and insured drivers to use and operate the Vehicles. Lessee agrees to comply with, and cause its drivers to comply with, all laws, statutes, rules, regulations and ordinances (including without limitation such federal, state and local laws, statutes, rules, regulations and ordinances governing autonomous vehicles and automated driving systems and any parts, components and products related thereto) and the provisions of all insurance policies affecting or covering the Vehicles or their use or operation. In connection with autonomous vehicles and automated driving systems and the parts, components and products related thereto, Lessee agrees to comply with all applicable guidance and professional standards issued, released or published by governmental and quasi-governmental agencies, including without limitation the federal guidance for automated vehicles published by the Department of Transportation and the Federal Automated Vehicle Policy issued by the U.S.
Department of Transportation and the National Highway Traffic Safety Administration. Lessee agrees to keep the Vehicles free of all liens, charges and encumbrances. Lessee agrees that in no event will any Vehicle be used or operated for transporting hazardous substances or persons for hire, for any illegal purpose or to pull trailers that exceed the manufacturer's trailer towing recommendations. Lessee agrees that no Vehicle is intended to be or will be utilized as a “school bus” as defined in the Code of Federal Regulations or any applicable state or municipal statute or regulation. Lessee agrees not to remove any Vehicle from the continental United States without first obtaining Lessor's written consent. At the expiration or earlier termination of this Agreement with respect to each Vehicle, or upon demand by Lessor made pursuant to Section 14, Lessee at its risk and expense agrees to return such Vehicle to Lessor at such place and by such reasonable means as may be designated by Lessor. If for any reason Lessee fails to return any Vehicle to Lessor as and when required in accordance with this Section, Lessee agrees to pay Lessor additional rent for such Vehicle at the normal pro-rated daily rent. Acceptance of such additional rent by Lessor will in no way limit Lessor’s remedies with respect to Lessee’s failure to return any Vehicle as required hereunder.
Section 13 of the Master Equity Lease Agreement is amended to read as follows:
Lessee agrees to accomplish, at its expense, all inspections of the Vehicles required by any governmental authority during the Term. Lessor, Servicer, any other agent of Lessor and any of their respective successors or assigns will have the right to inspect any Vehicle at any reasonable time(s) and upon two (2) days written notice during the Term and for this purpose to enter into or upon any building or place where any Vehicle is located. Lessee agrees to comply with all odometer disclosure laws, rules and regulations and to provide such written and signed disclosure information on such forms and in such manner as directed by Lessor. Providing false information or failure to complete the odometer disclosure form as required by law may result in fines and/or imprisonment. Lessee hereby agrees to promptly deliver to Lessor such financial statements and other financial information regarding Lessee as Lessor may from time to time reasonably request.
Section 14(e) second paragraph of the Master Equity Lease Agreement is amended to read as follows:
Upon the occurrence of any Event of Default, Lessor, without notice to Lessee, will have the right to exercise concurrently or separately (and without any election of remedies being deemed made), the following remedies: (a) Lessor may demand and receive immediate possession of any or all of the Vehicles from Lessee, without releasing Lessee from its obligations under this Agreement; if Lessee fails to surrender possession of the Vehicles to Lessor on default (or termination or expiration of the Term), Lessor, Servicer, any other agent of Lessor and any of Lessor’s independent contractors shall have the right to enter upon any premises, according to California state law where the Vehicles may be located and to remove and repossess the Vehicles; (b) Lessor may enforce performance by Lessee of its obligations under this Agreement; (c) Lessor may recover damages and expenses sustained by Lessor, Servicer, any other agent of Lessor or any of their respective successors or assigns by reason of Lessee's default including, to the extent permitted by applicable law, all costs and expenses, including court costs and reasonable attorneys' fees and expenses, incurred by Lessor, Servicer, any other agent of Lessor or any of their respective successors or assigns in attempting or effecting enforcement of Lessor’s rights under this Agreement (whether or not litigation is commenced) and/or in connection with bankruptcy or insolvency proceedings; (d) upon written notice to Lessee, Lessor may terminate Lessee's rights under this Agreement; (e) with respect to each Vehicle, Lessor may recover from Lessee all amounts owed by Lessee under Sections 3(b) and 3(c) of this Agreement (and, if Lessor does not recover possession of a Vehicle, (i) the estimated wholesale value of such Vehicle for purposes of Section 3(c) shall be deemed to be $0.00 and (ii) the calculations described in the first two sentences of Section 3(c) shall be made without giving effect to clause (ii) in each such sentence); and/or (f) Lessor may exercise any other right or remedy which may be available to Lessor under the Uniform Commercial Code, any other applicable law or in equity. Lessor has an absolute right to recoup any obligations Lessor would owe to Lessee under this Agreement against any obligations of Lessee to Lessor under this Agreement including, without limitation, under Sections 3, 5, 8, 10 and 12 of this Agreement. A termination of this Agreement shall occur only upon written notice by Lessor to Lessee. Any termination shall not affect Lessee's obligation to pay all amounts due for periods prior to the effective date of such termination or Lessee's obligation to pay any indemnities under this Agreement. All remedies of Lessor under this Agreement or at law or in equity are cumulative.
Section 17 of the Master Equity Lease Agreement is amended to read as follows:
Subject to the provisions of Section 15, this Agreement will be binding upon Lessee and its heirs, executors, personal representatives, successors and assigns, and will inure to the benefit of Lessor, Servicer, any other agent of Lessor and their respective successors and assigns. This Agreement will be governed by and construed in accordance with the substantive laws of the State of California (determined without reference to conflict of law principles).

Except to the extent specifically amended by this Amendment, all of the terms, provisions, conditions, covenants, representations and warranties contained in the Agreement shall be and remain in full force and effect and the same are hereby ratified and confirmed.

ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
That Council holds the public hearing, accept testimony regarding the Master User Fee Schedule and adopt, by motion, a Resolution establishing the 2022-2023 Master User Fee Schedule.
BACKGROUND:
The California Government Code Sections 66012 – 66018.5 grants cities the authority to establish and charge user fees in connection with certain public services that are provided to businesses and individuals.
Historically Chowchilla has set these fees by departments at different times of the year, not in a consolidated fashion. In 2012, Council consolidated the fees into one document with the adoption of Resolution 84-12, ensuring ease of use by the City’s customers.
REASON FOR RECOMMENDATION:
There are no CPI increases as they are done every other year. The changes in this master fee schedule are direct from the departments and their explanation is attached.
FISCAL IMPACT:
The projected revenue is included in the 2023-2024 City of Chowchilla budget.
ALTERNATIVES:
Do not approve; remain status quo and adjust the 2023-2024 City budget.

ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
City Council adopt a resolution awarding the construction contract for the Robertson/Kings & Robertson/Trinity Alley Paving Project, Federal Project No. CML-5258(041), to Avison Construction, Inc. in the Amount of $688,086.00 and authorizing the City Administrator to execute the contract on behalf of the City and amend the City of Chowchilla Fiscal Year (FY) 2023/24 Budget.
BACKGROUND:
The Robertson/Kings & Robertson/Trinity Alley Paving Project, Federal Project No. CML-5258(041), will consist of the paving of the alley between Robertson Boulevard and Kings Avenue from 7th to 8th and 9th to 13th, as well as the alley between Robertson Boulevard and Trinity Avenue from 6th to 7th and northeast of 8th to 11th. The project will also include concrete valley gutters for improved alley drainage and concrete alley approaches with an ADA accessible path of travel around the approaches. The City began advertising the Project for bids on May 17, 2023. The Notice Inviting Bids was published in the Madera Tribune, posted on OpenGov, and submitted to the appropriate construction trade journals and builder’s exchanges.
REASON FOR RECOMMENDATION:
Bids were received from four contractors on June 8, 2023, as follows:
Contractor Base Bid
Tosted Asphalt $513,083.39
Avison Construction, Inc. $688,086.00
Terra West Construction $692,918.00
Cal Valley Construction $951,128.50
The Engineer’s Estimate was $580,000. This Project is being funded in part by Federal Congestion Mitigation and Air Quality Improvement (CMAQ) program funds. As a requirement of this funding, the City must establish a Disadvantaged Business Enterprise (DBE) participation goal that bidders must meet, or bidders must demonstrate that they made a Good Faith Effort (GFE) in attempting to meet the established DBE goal. The DBE goal for this Project was 17%. The bid submitted by Tosted Asphalt committed to DBE participation in the amount of 6.80%. Since they did not meet the DBE goal, they are required to provide evidence that they made a GFE to try and meet the goal. Staff reviewed the GFE documentation submitted by Tosted Asphalt and determined that the GFE made was not sufficient to comply with the requirements of the CMAQ funding. As such, Staff has determined that the bid submitted by Tosted Asphalt is nonresponsive. Tosted Asphalt was provided with the opportunity for Administrative Reconsideration, which they declined.
Since the bid submitted by Tosted Asphalt was deemed non-responsive, Staff reviewed the second lowest bid, submitted by Avison Construction, Inc., along with information regarding their previous work experience. Avison Construction, Inc. has committed to DBE participation in the amount of 7.00%.
Although Avison also did not meet the DBE goal, Staff has reviewed their GFE and determined that it was sufficient. Based on review, Staff has determined the bid received to be responsive and Avison Construction, Inc. to be a responsible contractor.
FISCAL IMPACT:
The construction costs and available funding as approved in the FY 2023/24 City Budget for the Project are summarized in the following table.
Amount
Construction Costs
Contract $688,086.00
Contingency (10%) $68,809.00
CM/Inspection/Testing (15% of
Construction incl. Contingency)
$113,534.00
Total Construction $870,429.00
Available Construction Funding
CMAQ $648,000.00
Gas Tax $83,683.00
Total Available Construction Funding $731,683.00
As there is a deficit in funding, the project requires the budget be amended in order to fully fund the project.
The Humboldt Street Improvement Project, which was recently completed, experienced savings of approximately $736,000. As such, staff is requesting Council amend the budget as follows.

Available Construction Funding
CMAQ $648,000.00 $0.00 $648,000.00

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
That City Council adopt a resolution approving the Side Letter Agreement (Agreement) between the City of Chowchilla (City) and the Chowchilla Police Officers Association (POA) and authorizing the City Administrator to execute the Agreement on behalf of the City.
BACKGROUND:
In an effort to retain law enforcement personnel, beginning July 1, 2023, and subject to certain eligibility requirements as set forth below and in the Agreement, all eligible sworn and non-sworn members of the Chowchilla Police Department (excluding the Chief of Police) shall receive a $2,500.00 bi-annual payment, subject to standard payroll deductions. These payments shall occur on the first pay period of July and January, respectively, with the exception of the first payment being retroactively applied to July 2023. Said one-time retroactive payment shall be made on the second pay period in August 2023.
To qualify for the payments certain eligibility requirements must be met. First, each sworn and non-sworn officer must have been employed with the City of Chowchilla Police Department in a full-time position for one continuous year prior to each of the July and January payment dates; and second, the payments are conditioned solely upon the current Measure N being in effect and having sufficient funds.
This Agreement will automatically terminate after the January 2027 payment. This termination date runs concurrent with the expiration of the current Measure N that was previously approved by the voters on November 6, 2018.
This Agreement is separate and apart from the current MOU dated July 1, 2022 through June 30, 2025, and no portion of this Agreement is intended to be incorporated into the current MOU.
REASON FOR RECOMMENDATION:
This payment will encourage those designated employees to remain a part of the Chowchilla Police Department as well as assist with recruitment in a field that is seeing steady declines and increased competition for officers.
FISCAL IMPACT:
The annual impact to the Measure N budget is $160,000.00.
ALTERNATIVES:
None as the Agreement was approved by the POA.
ACTIONS FOLLOWING APPROVAL:
1. Execution of Agreement.

SUBJECT: RESOLUTION APPROVING A DEPOSIT/REIMBURSEMENT AGREEMENT,
DESIGNATING CONSULTANTS, AND AUTHORIZING AND DIRECTING
CERTAIN ACTIONS RELATED TO THE PROPOSED FORMATION OF A
COMMUNITY FACILITIES DISTRICT
PREPARED BY: Mark Hamilton, Community & Economic Development Director ATTACHMENTS: Resolution, Letter describing Deposit/Reimbursement Agreement
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
That the City Council approve the attached Resolution.
BACKGROUND:
In 2006, the City formed the City of Chowchilla Community Facilities District No.2006-1 (“CFD 2006-1”), pursuant to the Mello-Roos Community Facilities Act of 1982, as amended, constituting Section 53311 et. seq. of the California Government Code (the “Act”) and designated an Improvement Area 1 (“Area 1”) within CFD 2006-1, to finance certain public improvements and to issue $8,615,000 of special tax bonds (the “2007 Bonds”). CFD 2006-1 has a total bonding authority of $50 million and property owners in Area 1 of CFD 2006-1 are subject to special tax levies that are sufficient to pay debt service. CFD 2006-1 has a remaining bonding authority of $41,385,000.
The rate and method of apportionment of special taxes (“RMA”) within CFD 2006-1 has been a point of contention with property owners in CFD 2006-1 for a number of years and development of certain property within CFD 2006-1 has been stagnant due to unintended effects of the RMA.
For the last five years, the City has been working with its Area 1 of CFD 2006-1 in a manner that benefits all interested parties.
After extensive discussions with stakeholders, the City intends to pursue the formation of a new Community Facilities District (“CFD 2023-1”) that will replace CFD 2006-1. A resolution to form CFD 2023-1 will be presented to the City Council for consideration at a later date and will be followed by a Public Hearing. The intention of CFD 2023-1 is to eliminate the unused bonding authority of CFD 2006-1, lower special tax levies on property owners within CFD 2006-1, and to issue new special tax bonds, the proceeds of which are to be used to redeem the outstanding 2007 Bonds.
There are certain non-contingent costs required to pursue the formation of CFD 2023-1 that are estimated in the amount of $110,000. AutoZone Texas LCC (“AutoZone”) is an owner of property in Area 1 of CFD 2006-1 and it has agreed to advance funds to the City to cover these costs. If CFD 2023-1 is formed AutoZone shall be reimbursed $110,000 from the proceeds of special tax bonds that are issued to redeem the 2007 Bonds, subject to the attached Deposit Reimbursement Agreement. AutoZone has provided the City with a check in the amount of $110,000.
The purpose of the attached resolution is to authorize the City Administrator to execute the attached Deposit/Reimbursement Agreement with AutoZone.
The Resolution also designates NBS Government Finance Group as Special Tax Consultant, Wulff, Hansen & Co as Municipal Advisor, and Quint & Thimmig as Special Counsel to the City, each in connection with the formation of CFD 2023-1.
Furthermore, the Resolution authorizes and directs City Staff to take all actions necessary or advisable to present to the City Council for its review and consideration the proceedings necessary to form CFD 2023-
1. The passage of the Resolution in no way obligates the City Council to take any specific action related to the formation of CFD 2023-1.
REASON FOR RECOMMENDATION:
To pass on a CFD 2023-1 formation costs to a third party.
FISCAL IMPACT:
Passage of the Resolution will move the $110,000 of formation costs that would otherwise be paid by the City to AutoZone. In any respect, whether the City or AutoZone were to pay the $110,000 in formation costs, such costs would be reimbursed to the respective party from the proceeds of new refunding bonds, if and when they are issued.
ALTERNATIVES:
Alternatively, the City Council may elect to pay the $110,000 in formation costs from City funds, subject to reimbursement from the proceeds of bonds.
ACTIONS FOLLOWING APPROVAL:
City Staff will bring to the City Council at a later date specific actions related to the formation of CFD 2023-

It is expected that the compensation to such firms with respect to the formation of the New CFD will be paid from the Deposit.
3. City Staff are hereby authorized and directed to take all actions necessary or advisable to present to the City Council for its review and consideration the proceedings necessary to form the New CFD. Re: Proposed Community Facilities District No. 2023-1 (Replacement of CFD 2006-1) Gentleman and Mary:
Now that AutoZone has provided the $110,000 deposit to the City and has executed the Deposit/Reimbursement Agreement related to the formation of the new CFD, accompanying this letter is a Resolution ratifying Rod’s execution of the Agreement and designating the team to assist the City with the formation of the new CFD. Also included with this letter is a proposed agreement between the City and my firm for certain services related to actions needed to form the new CFD.
Please let me know if you have any questions or comments with respect to the accompanying documents. I expect that Wulff Hansen and NBS will submit to the City proposed agreements for their respective firms for their services in connection with the activities to form the new CFD.
Very truly yours,
Paul J. Thimmig, Esq.
