SUBJECT: Resolution Accepting Public Street and Utility Easement for the Road 16/5th Street Curve Reconstruction Project
PREPARED BY: Jerry Jones, City Engineer
ATTACHMENTS: Resolution, Deed of Easement
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
That the City Council adopt a resolution accepting the public street and utility easement for the Road 16/5th Street Curve Reconstruction Project.
BACKGROUND:
The Road 16/5th Street Curve Reconstruction Project (Project) is included in the City’s Capital Budget for FY 2019-20 and will consist of the reconstruction of the existing pavement on Road 16 from the Mariposa Avenue alignment to Avenue 25. As the first step in the development of the design for the Project, the City Engineer’s Office performed a boundary and topographic survey of the Project limits. At this time, it was determined that a portion of the roadway, specifically at the curve, was outside of any recorded right of way or easement, and thus was deemed to be a prescriptive easement. The diagram included with the attached Deed of Easement shows the subject portion of land. In basic principle, a prescriptive easement is established when use of a subject portion of land is continuous and uninterrupted for a specified period of time.
A prescriptive easement typically does not ripen against a public entity (California Civil Code Section 1007), and in this case the underlying fee title owner of the land is Chowchilla Union High School District (District).
As such, City Staff reached out to the District, and requested that the District grant an easement for public street and utility purposes to the City to clean up the title for the subject roadway segment. The District agreed to grant the easement and has executed the deed of easement. In summary, this action is simply a step to clean up the existing record title between the City and the District, regarding the subject portion of land.
REASON FOR RECOMMENDATION:
In order for the public street and utility easement to be recorded with the Madera County Recorder, Council must accept the easement on behalf of the public for public use.
FISCAL IMPACT:
There is no fiscal impact, the easement was granted by the District for no fee.
ALTERNATIVES:
If Council does not accept the easement for public use, there remains a title issue for this segment of Road 16 at the curve.
ACTIONS FOLLOWING APPROVAL:
The Deed of Easement will be submitted to the Madera County Recorder for recordation.

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
That the City Council adopts a resolution to approve an agreement with FM3 to provide public opinion research services for the Measure N renewal which will be on the 2024 General Election Ballot BACKGROUND:
The voters approved Measure N on the 2018 ballot and became effective in April 2019. Measure N, a special tax, is a Full Cent sales tax add-on that is required to be spent on Public Safety. Measure N is set to expire April 2027. The City used FM3 for the public opinion research and we were successful.
REASON FOR RECOMMENDATION:
Staff would like to use FM3 for the renewal since this is a specialized service, they were successful on the original measure, know all the history with the measure and they are familiar with our community. If Measure N is not renewed, the City would lose a significant funding resource that is estimated to bring in roughly $2.6M for FY 23/24. Measure N is used for necessary infrastructure, equipment and increases in personnel. Since Measure N was passed, the City has seen a significant reduction in crime rates.
FISCAL IMPACT:
The contract is for $29,750 and will be paid from our Measure N fund.
ALTERNATIVES:
Do not approve the agreement and wait until the 2026 election for renewal.
ACTIONS FOLLOWING APPROVAL:
The City Administrator will sign the Agreement.

AND AUTHORIZING THE CITY ADMINISTRATOR TO EXECUTE AND NEGOTIATE ANY
NECESSARY REVISIONS TO THE AGREEMENT
WHEREAS, The City of Chowchilla places a strong social priority on public safety; and WHEREAS, Measure N is specifically designated for public safety; and WHEREAS, Measure N is set to expire in April 2027; and

THE AGENDA
Meeting of: October 10, 2023
AGENDA SECTION: Public Hearing
SUBJECT: Consideration of a Resolution and Measure T Annual Expenditure Plan (AEP) for Fiscal Year (FY) 2023-24 and Authorizing the Public Works Director or Designee to submit the Plan to the Madera County Transportation Authority (MCTA) for adoption
PREPARED BY: Jonise Arredondo, Administrative Analyst
ATTACHMENTS: Resolution, Measure T AEP Plan for FY 2023-24
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
The City Council adopt a resolution approving the Measure T AEP for FY 2023/24 and authorizing the submission of the AEP to the Madera County Transportation Authority (MCTA) for adoption.
BACKGROUND:
The Annual Expenditure Plan (AEP) is required by the MCTA to claim Measure T funds that will be allocated to the City as specified in the Transportation Sales Tax Measure Investment Plan (Plan) approved by the voters in the November 2006 election. The AEP is completed annually. The proposed funding for the projects and programs in the AEP is consistent with the requirements specified in the Measure T 2007 Strategic Plan (Strategic Plan) adopted by the MCTA and with the Capital Improvement Program (CIP) proposed in the City’s FY 2023/24 Budget.
Measure T is a ½ cent sales tax measure approved by Madera County voters in the November 2006 election. The measure took effect on April 1, 2007, with a sunset provision of 20 years. As part of the measure’s implementation, local agencies submit an AEP. The AEP is a multi-modal funding program that commits funding for the following program categories:
Regional Transportation and Highways ADA Compliance Local Street Maintenance Transit Enhancement
Local Street Supplemental Maintenance ADA/Seniors/Paratransit Flexible (Miscellaneous Street programs) Environmental Enhancement
The Regional Streets and Highways program consists of two elements:
1. One is the responsibility of MCTA to manage and deliver projects of regional significance. MCTA may elect to agree with the local agency to perform the engineering and construction activities of this element.
2. The second element is the responsibility of the local agencies to manage the construction, rehabilitation, and maintenance of the agency’s arterial and collector streets.
All other programs are the responsibility of the local agency to deliver. The MCTA and Citizens Advisory Committee monitor the local agencies' progress in the delivery of these programs.
REASON FOR RECOMMENDATION:
The implementation guidelines in the Strategic Plan adopted by the MCTA require the City to prepare and adopt an AEP that must be approved during a noticed public hearing. This agenda item will satisfy this requirement. The proposed expenditures in each program category must meet the objectives and guidelines specified in the Strategic Plan. The Strategic Plan is a 5-year plan that is updated every 2 years to adjust the project based on sales tax receipts, ensuring that the projects are consistent with future investments.
DISCUSSION:
MCTA has provided the City with the funding allocation for each of the program categories. The total allocation for FY 2023/24 is $1,003,835. MTCA has also allocated a disbursement of excess tax revenues received in FY 2022/23 above the final allocation. The City will receive $56,511 in FY 2022/23 excess disbursement. Those funds are included with the new allocation for programming in the AEP. A summary of allocations and distributions of prior year excess funds to the City for the past five years is shown below in Table 1.
Table 1. Allocations & Excess Funds for Past 5 Years
Fiscal Year Allocation Prior Year Excess FY Total
2023/24 $1,003,835 $56,511 $1,060,347

That the City Council approve the attached Resolutions.
BACKGROUND:
In 2006, the City formed the City of Chowchilla Community Facilities District No.2006-1 (“CFD 2006-1”), pursuant to the Mello-Roos Community Facilities Act of 1982, as amended, constituting Section 53311 et. seq. of the California Government Code (the “Act”) and designated an Improvement Area 1 (“Area 1”) within CFD 2006-1, to finance certain public improvements and to issue $8,615,000 of special tax bonds (the “2007 Bonds”). CFD 2006-1 has a total bonding authority of $50 million and property owners in Area 1 of CFD 2006-1 are subject to special tax levies that are sufficient to pay debt service on the entire $50 million. CFD 2006-1 has a remaining bonding authority of $41,385,000.
The rate and method of apportionment of special taxes (“RMA”) within CFD 2006-1 has been a point of contention with property owners in CFD 2006-1 for a number of years and development of certain property within CFD 2006-1 has been stagnant due to unintended effects of the RMA.
For the last five years, the City has been working with its consultants and interested parties in Area 1 of CFD 2006-1 in an effort to provide relief from the burdensome 2006-1 RMA and to rejuvenate development within Area 1.
After extensive discussions with stakeholders, the City intends to pursue the formation of a new Community Facilities District (“CFD 2023-1”) that will replace CFD 2006-1 and the prior RMA.
The City Council approved a Resolution on August 22, 2023 which designated NBS Government Finance Group as Special Tax Consultant, Wulff, Hansen & Co as Municipal Advisor, and Quint & Thimmig as Special Counsel to the City, each in connection with the formation of CFD 2023-1.
In 2006, under the Mello-Roos Community Facilities Act of 1982, constituting Section 53311 et seq. of the California Government Code (the “Law”), the City Council of the City of Chowchilla (the “City”) held proceedings that established the City of Chowchilla Community Facilities District No. 2006-1 (“CFD 2006- 1”) with a designated Improvement Area 1 (“Area 1”) therein. On June 7, 2007, the City issued $8,615,000 of special tax bonds for CFD 2006-1 (the “2007 Bonds”) payable from special taxes levied on property in Area 1.
The City Council is currently in process of forming a new community facilities district under the Law to be known as the City of Chowchilla Community Facilities District No. 2023-1 (Replacement of CFD 2006-1) (the “District”) and to issue special tax bonds for the District to refund the 2007 Bonds, and to otherwise continue to provide funding of municipal services that were authorized to be funded by CFD 2006-1.
Under the Law, the City Council is empowered with the authority to establish the District and levy special taxes within the District. Upon formation of the District, issuance of special tax bonds for the District and the defeasance of the 2007 Bonds with proceeds of the bonds, the City Council will dissolve CFD 2006-1, and will dissolve the lien of the special taxes for CFD 2006-1 on property in Area 1.
The City Council has this date adopted its Resolution entitled “A Resolution of the City Council of the City of Chowchilla Declaring Its Intention to Establish a Community Facilities District and To Authorize the Levy of Special Taxes Therein – Replacement of CFD 2006-1,” (the “Resolution of Intention to Form”) stating its intention to form a community facilities district pursuant to the Mello-Roos Community Facilities Act of 1982 (the “Law”), for the purpose of financing the costs of the repayment of certain 2007 Bonds, and the costs of providing certain municipal services, all as further described in the Resolution of Intention to Form.
The City Council estimates the amount required for the financing of the costs of the repayment of the 2007 Bonds to be up to $6,500,000.
REASON FOR RECOMMENDATION:
These Resolutions are needed to form the new CFD 2023-1 and to issue bonds to refund the 2007 Bonds.
FISCAL IMPACT:
The formation and bond issuance costs, also referred to as the Cost of Issuance (COI), are estimated to be roughly $485,000, inclusive of the Underwriter’s Discount. The COI will be paid from CFD 2023-1 bond proceeds.
ALTERNATIVES:
Not approve the Resolutions and stay with the current CFD 2006-1.
ACTIONS FOLLOWING APPROVAL:
The consultants will move forward with the formation of the CFD 2023-1. 03083.04:J19269
COUNCIL RESOLUTION # -23
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHOWCHILLA, CALIFORNIA
DECLARING ITS INTENTION TO ESTABLISH A COMMUNITY FACILITIES DISTRICT AND TO AUTHORIZE THE LEVY OF SPECIAL TAXES THEREIN – REPLACEMENT OF CFD 2006-1

WHEREAS, pursuant to the Law, the City Council has formed the City of Chowchilla Community Facilities District No. 2006-1 (“CFD 2006-1”) and has designated an Improvement Area 1 (“Area 1”) therein; and
WHEREAS, on June 7, 2007, the City issued $8,615,000 of special tax bonds for CFD 2006-1 (the “2007 Bonds”) payable from special taxes levied on property in Area 1; and WHEREAS, the City Council intends to form a new community facilities district under the Law to be known as the City of Chowchilla Community Facilities District No. 2023-1 (Replacement of CFD 2006-1) (the “District”) and to issue special tax bonds for the District to refund the 2007 Bonds, and to otherwise continue to provide the funding of municipal services that were authorized to be funded by CFD 2006-1; and
WHEREAS, under the Law, the City Council is empowered with the authority to establish the District and levy special taxes within the District; and WHEREAS, upon formation of the District, issuance of special tax bonds for the District and the defeasance of the 2007 Bonds with proceeds of the bonds, the City Council will dissolve CFD 2006-1, and will dissolve the lien of the special taxes for CFD 2006-1 on property in Area 1.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chowchilla hereby finds, determines and declares the following:
1. The City Council proposes to begin the proceedings necessary to establish the District pursuant to the Law.
2. The name proposed for the District is City of Chowchilla Community Facilities District No. 2023-1 (Replacement of CFD 2006-1).
3. The proposed boundaries of the District are as shown on the map of the District on file with the City Clerk, which boundaries are hereby preliminarily approved. 4. The purposes of the District shall include the repayment of the 2007 Bonds and the provision of the municipal services that were authorized to be provided by CFD 2006-1 (the “Services”), as described in Exhibit A hereto, which Exhibit is by this reference incorporated herein.

Except to the extent that funds are otherwise available to the District to repay the 2007 Bonds or to pay for the Services, and/or pay the principal and interest as it becomes due on bonds of the District issued to finance the repayment of the 2007 Bonds, a special tax sufficient to pay the costs thereof, secured by recordation of a continuing lien against all non-exempt real property in the District, will be levied within the District and collected in the same manner as ordinary ad valorem property taxes or in such other manner as the City Council or its designee shall determine, including direct billing of the affected property owners. The proposed rate and method of apportionment of the special tax among the parcels of real property within the District, in sufficient detail to allow each landowner within the proposed District to estimate the maximum amount such owner will have to pay, and which specifies the tax year after which no further special tax will be levied on land used for private residential purposes and which otherwise complies with applicable provisions of the Act is described in Exhibit B attached hereto which Exhibit is by this reference incorporated herein.

6. It is the intention of the City Council to cause bonds of the City of Chowchilla to be issued for the District pursuant to the Law to finance the costs of the repayment of the 2007 Bonds. If so issued, the bonds shall be in the aggregate principal amount of not to exceed $6,500,000, shall bear interest payable semi-annually or in such other manner as the City Council shall determine, at a rate not to exceed the maximum rate of interest as may be authorized by applicable law at the time of sale of such bonds, and shall mature not to exceed 40 years from the date of the issuance thereof.
7. The levy of said proposed special tax shall be subject to the approval of the qualified electors of the District at a special election. The proposed voting procedure shall be by mailed ballots among the registered voters residing in the proposed District as of the close of the public hearing referred to in Section 11 below.
8. Except as may otherwise be provided by the Law or the rate and method of apportionment of the special tax for the District, all lands owned by any public entity, including the United States, the State of California and/or the City, or any departments or political subdivisions of any thereof, shall be omitted from the levy of the special tax to be made to cover the costs and expenses of the repayment of the 2007 Bonds, of the Services, of the issuance and repayment of bonds by the City for the District and of any expenses of the District.

An estimate of the fair and reasonable cost of repaying the 2007 Bonds and of providing the Services, including the incidental expenses in connection therewith, including the costs of the proposed bond financing, any City administrative costs and all other related costs.
The report shall be made a part of the record of the public hearing provided for below. -3-

This procedure shall be exclusive and its exhaustion by any property owner shall be a condition precedent to filing any legal action by such owner.
I. INTERPRETATION OF RATE AND METHOD OF APPORTIONMENT
The City may, by resolution or ordinance, interpret, clarify and/or revise this Rate and Method of Apportionment to correct any inconsistency, vagueness, or ambiguity as it relates to the Special Taxes, method of apportionment, classification of Assessor’s Parcels, or any definition used herein, as long as once CFD No. 2023-1 Bonds have been issued such correction does not materially adversely affect the levy and collection of Special Taxes on any Assessor’s Parcel needed to repay the CFD No. 2023-1 Bonds.
In addition, the interpretation and application of any section of this document shall be at the CFD Administrator’s discretion.
J. MANNER OF COLLECTION
The Special Taxes shall be collected in the same manner and at the same time as ordinary ad valorem property taxes, provided, that the CFD Administrator may directly bill the Special Tax, may collect the Special Tax at a different time or in a different manner if needed to meet the financial obligations of CFD No. 2023-1. The City may covenant to foreclose and may actually foreclose or cause an action for foreclosure to be prosecuted in respect of Assessor's Parcels of Taxable Property that are delinquent in the payment of the Special Tax.
K. PREPAYMENT OF SPECIAL TAX BOND PAYMENT
1. Prepayment in Full
The Special Tax Bond Payment obligation of an Assessor's Parcel of Developed Property, Taxable Property Association Property, Taxable Public Property, or Final Map Property may be prepaid and permanently satisfied as described herein; provided that there are no delinquent installments of the Special Tax with respect to such Assessor's Parcel at the time of prepayment. An owner of an Assessor's Parcel intending to prepay the Special Tax Bond Payment obligation shall provide the CFD Administrator with written notice of intent to prepay. Within 45 days of receipt of such written notice, the CFD Administrator shall notify such owner of the prepayment amount for such Assessor's Parcel. Prepayment must be made not less than 75 days prior to the next occurring date that notice of redemption of outstanding CFD No. 2023-1 Bonds, if any. If a prepayment is made prior to the issuance of CFD No. 2023-1 Bonds, the Redemption Premium, Interest Amount, Reserve Fund Credit and Capitalized Interest Credit as calculated below, shall be zero. The CFD City of Chowchilla
Community Facilities District No. 2023-1 (Chowchilla Facilities and Services) Page 13 Administrator may charge the property owner requesting a prepayment calculation a fee for providing this service.
The Special Tax Bond Payment Prepayment Amount (defined below) shall be calculated as summarized below (capitalized terms as defined below):
Bond Redemption Amount
plus Redemption Premium
plus Interest Amount
plus Administrative Fees and Expenses
less Reserve Fund Credit
less Capitalized Interest Credit
Total: equals Special Tax Prepayment Amount
As of the proposed date of prepayment, the Special Tax Bond Payment Prepayment Amount (defined below) shall be calculated by the CFD Administrator as follows:
Step Number:
1. Confirm that no Special Tax delinquency apply to such Assessor’s Parcel, and if delinquencies are applicable compute all amounts due, including interest and penalties.
2. For Assessor’s Parcels of Developed Property, Taxable Property Association Property, Taxable Public Property, and Final Map Property compute the Assigned Special Tax Bond Payment and Backup Special Tax Bond Payment.
3. a. Divide the Assigned Special Tax Bond Payment computed pursuant to Step 2 by the total estimated Assigned Special Tax Bond Payment for CFD No. 2023-1 based on the Special Tax Bond Payment which could be charged in the current Fiscal Year. b. Divide the Backup Special Tax Bond Payment computed pursuant to Step 2 by the total estimated Backup Special Bond Payment Tax for CFD No. 2023-1 which could be charged in the current Fiscal Year.
c. Determine which quotient computed pursuant to Step 3.a or 3.b is larger (the “Maximum Special Tax Bond Payment Percentage”).
4. Multiply the Maximum Special Tax Bond Payment Percentage by the outstanding CFD No. 2023-1 Bonds to compute the principal amount of outstanding CFD No. 2023-1 to be redeemed (the “Bond Redemption Amount”).
5. Multiply the Bond Redemption Amount computed pursuant to Step 4 by the applicable redemption premium, if any, on the outstanding CFD No. 2023-1 Bonds to be redeemed (the "Redemption Premium") determined by reference to the Indenture.
City of Chowchilla
Community Facilities District No. 2023-1 (Chowchilla Facilities and Services) Page 14
6. Compute the amount needed to pay interest on the Bond Redemption Amount from the first bond interest and/or principal payment date following the current Fiscal Year until the earliest redemption date for the Outstanding CFD No. 2023-1 Bonds (the “Interest Amount”).
7. Verify the administrative fees and expenses, including the costs of computation of the prepayment, the costs to invest the prepayment proceeds, the costs of redeeming the outstanding CFD No. 2023-1 Bonds, and the costs of recording any notices to evidence the prepayment and the redemption (the “Administrative Fees and Expenses”).
8. If reserve funds for the outstanding CFD No. 2023-1 Bonds held under the Indenture, if any, are at or above 100% of the then reserve requirement (as required by the Indenture) on the prepayment date, a reserve fund credit shall be calculated as a reduction in the applicable reserve requirement for the outstanding CFD No. 2023-1 Bonds to be redeemed pursuant to the prepayment (the "Reserve Fund Credit"). No Reserve Fund Credit shall be granted if reserve funds are below 100% of the applicable reserve requirement on the prepayment date or if the Reserve Fund is satisfied by a credit instrument rather than cash funded.
9. If any capitalized interest for the outstanding CFD No. 2023-1 Bonds will not have been expended at the time of the first interest and/or principal payment following the current Fiscal Year, a capitalized interest credit shall be calculated by multiplying the Maximum Special Tax Percentage by the expected balance in the capitalized interest fund after such first interest and/or principal payment (the "Capitalized Interest Credit").
10. The Special Tax prepayment is equal to the sum of the amounts computed pursuant to Steps 4, 5, 6, and 7 less the amount computed pursuant to Steps 8 and 9 (the " Prepayment Amount").
11. From the Prepayment Amount, the amounts computed pursuant to Steps 4, 5, 6, and 7 shall be deposited into the appropriate fund as established under the Indenture and be used to redeem outstanding CFD No. 2023-1 Bonds or make Debt Service payments. The amount computed pursuant to Step 7 shall be retained by the City for the payment of Administrative Fees and Expenses.
The Special Tax Prepayment Amount may be sufficient to redeem other than a $5,000 increment of outstanding CFD No. 2023-1 Bonds. In such cases, the increment above $5,000 or integral multiple thereof will be retained in the appropriate fund established under the Indenture to be used with the next prepayment of outstanding CFD No. 2023-1 Bonds or to make Debt Service payments.
Current year Special Taxes that are not yet paid will remain outstanding and will be collected in the manner billed. With respect to any Assessor's Parcel that is prepaid, the CFD Administrator shall cause a suitable notice to be recorded in compliance with the Act to indicate the prepayment of the Special Tax and the obligation of such Assessor's Parcel satisfied.
Notwithstanding the foregoing, no prepayment will be allowed unless the Maximum Special Tax that may be levied on Taxable Property both prior to and after the proposed prepayment is at least 1.1 times the maximum annual Debt Service on all Outstanding CFD No. 2023-1 Bonds plus annual Administrative Expenses, as reasonably estimated by the CFD Administrator.
City of Chowchilla
Community Facilities District No. 2023-1 (Chowchilla Facilities and Services) Page 15
2. Prepayment in Part
The Special Tax Bond Payment may be partially prepaid, provided that a partial prepayment may be made only after all authorized CFD No. 2023-1 Bonds have been issued and only if there are no delinquent Annual Special Taxes with respect to such Assessor's Parcel at the time of partial prepayment. The amount of the prepayment shall be calculated as in Section I.1; except that a partial prepayment shall be calculated by the CFD Administrator according to the following formula:
PP = PE x F.
These terms have the following meaning:
PP = the partial prepayment
PE = the Special Tax Prepayment Amount calculated according to Section I.1 F = the Maximum Special Tax Bond Payment Percentage
The Special Tax Bond Payment partial prepayment amount must be sufficient to redeem at least a $5,000 increment of Bonds.
The owner of any Assessor’s Parcel who desires such partial prepayment shall notify the CFD Administrator of such owner’s intent to partially prepay the Special Tax and the percentage by which the Special Tax Bond Payment shall be prepaid. The CFD Administrator shall provide the owner with a statement of the amount required for the partial prepayment of the Special Tax Bond Payment for an Assessor’s Parcel within 45 days of the request and may charge a fee for providing this service. With respect to any Assessor’s Parcel that is partially prepaid, the CFD Administrator shall (i) distribute the prepayment funds remitted according to Section I.1, and (ii) indicate in the records of CFD No. 2023-1 that there has been a partial prepayment of the Special Tax Bond Payment and that a portion of the Special Tax Bond Payment with respect to such Assessor’s Parcel, equal to the outstanding percentage (1.00 - F) of the remaining Maximum Special Tax Bond Payment, shall continue to be levied on such Assessor’s Parcel pursuant to Section E.
L. PREPAYMENT OF SPECIAL TAX SERVICES
The Special Tax Services may not be prepaid.
M. TERM
The Special Tax Bond Payment shall be levied and collected as needed to fund the Annual Bond Payment Special Tax Requirement for up to 13 years from the initial levy of the Special Tax Bond Payment. In any event no Special Tax Bond Payment shall be levied for CFD. No. 2023-1 after the 2036/37 Fiscal Year.
The Special Tax Services shall be levied commencing in Fiscal Year 2024/25 to the extent necessary to satisfy the Annual Services Special Tax Requirement and shall be levied each Fiscal Year thereafter in perpetuity for as long as required to satisfy the Annual Services Special Tax Requirement. However, should Initiative #1935 be included as an initiative measure at election and subsequently be approved by voters, the duration of the Special Tax Services is 500 years.
