THE AGENDA
Meeting of: June 25, 2024
AGENDA SECTION: Consent
SUBJECT: Consideration of Monthly Financial Statements
PREPARED BY: Kerri Williams, Finance Director
ATTACHMENTS: May 2024 Budget vs Actual and Balance Sheet

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Approve the May 2024 Financial Statements shown in the attachment.

BACKGROUND:

Staff provides Council with monthly financial information as an ongoing financial status update.

REASON FOR RECOMMENDATION:

The monthly financial statements consist of a Budget vs Actual and a Balance Sheet for the General Fund. The Budget vs Actual shows the current Month (Period Activity) and current Year (Fiscal Activity) Revenues and Expenses by Department in summary form compared to the current year Original and Current budgets. The Balance Sheet shows the Assets, Liabilities and Fund Balance at the time the report is generated. This provides an overview of cash, amounts owed to the City, amounts the City owes and the fund balance at a specific point in time.

The financial statements are being presented as an overview of the City’s finances and are not meant to be a comprehensive in-depth review. As a reference to compare to the percent remaining column in the report, the percentage of the year remaining 8.33%.

If the percent remaining column for Revenues is higher than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant. If the percent remaining column for Expenses is lower than the above-mentioned percentage, that is an unfavorable variance and should be explained if significant.

If there are questions regarding the actual amounts or budget vs actual variances, please forward your questions to me in enough time before the meeting for staff to research them.

FISCAL IMPACT: Revenues
General Administration- Property tax and VLF, which are 2 of our biggest revenues, are only received 2 times a year in February and May, we have received both distributions. We are teetered which means we do not have to worry about delinquencies, because the County pays us and goes after the delinquencies themselves. Sales tax payments run a month or two behind and we have yet to receive April’s payment.

Sales tax is our 2nd largest revenue. As of right now sales tax is expected to come in at the budgeted amount. We still have Transient Occupancy tax, Franchise Fees, and Overhead Allocations to be posted in June.

Police Department- Budgeted revenue is from school reimbursements for SRO service, we have received the school’s payment as they are being billed annually in September now. Also, it has $405k Transfer-in from Measure N for the RIMS Software, Traffic Signs for Ventura St., Light Board & Tower, and additional equipment that will be transferred at the end of the year. It also included recruitment and retention of employees that has already been transferred for the year. We also have received more revenue in Fines and Penalties then initially budgeted for. At mid-year we anticipated $50k in revenue for the K9 Dinner, the full amount should be reflected on the June Financial Statement.

Fire Department- This revenue is from transfers-in from Measure N for the fire station expansion project Phase 2 that will be completed at the end of the year.

Community & Economic Development- This will fluctuate as building permits are pulled. We budgeted for the following projects like Rancho Calera, Montgomery Farms, Solar Permits, and various other projects within the City. So far, we have Century Communities that has completed their portion of Montgomery Farms and Self Help building their part of the Montgomery Farms lots. We still have other miscellaneous permits for other items that are happening as well.

Parks & Facilities- $140k of this is from a grant that we have not spent yet so we have not requested reimbursements. The rest is overhead allocations from the LLMD that happen at the end of the year.

Community Relations- Revenues are from sports program reimbursements, park pavilion rentals and donations.

Expenses
All departments expenses are within the normal range or better right now.

SUBJECT: A Resolution Requesting the Madera County Clerk to Render Specified Services to the City of Chowchilla Relating to the Conduct of Municipal Elections
PREPARED BY: Joann McClendon, City Clerk
ATTACHMENTS: Resolution, Exhibit A

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council approves the attached resolution requesting the Madera County Clerk-Recorder to render specified services to the City of Chowchilla to conduct the 2024 Municipal Elections.

BACKGROUND:

On election years, it is required to request the services of the County Clerk/Recorder from the Board of Supervisors, by resolution, to conduct the municipal election. The Madera County Clerk/Recorder has performed the following functions for the City of Chowchilla:
a) Prepare and publish all required notices (nominee for public office, election officers and polling places, central counting place).
b) Issue and file nomination documents and verify nomination petitions. c) Issue and file conflict of interest and campaign disclosure statements.

REASON FOR RECOMMENDATION:

The City has always consolidated with the County during election years. There was an exception for the 2012 election year. At the request of the City Administrator at that time, all of the issuances, filings and verifications were completed by the City Clerk. This resulted in unnecessary increase of staff time and cost.

There will be two (2) 4-year terms for Districts 3 & 4 and one (1) 2-year term for Mayor At-Large this election year for the City Council; and, a possible measure.

FISCAL IMPACT:

It was determined by County Clerk’s Office that the estimated costs for a vote of three City Council seats, Districting, and potential measure at the November 5, 2024 Presidential General Election, based on 11,700 voters, is estimated at $170,000.

ALTERNATIVES:

None. A resolution must be approved for the elections.

ACTIONS FOLLOWING APPROVAL:

The executed resolution will be submitted to the County Elections Office for processing.

SUBJECT: Aerial Fireworks Display at Chowchilla Fairgrounds PREPARED BY: Fred Gaumnitz, Fire Chief
ATTACHMENTS: Application, Certificate of Insurance, Map

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council approve an aerial fireworks display for July 6, 2024 at the Chowchilla Fairgrounds and authorize the Fire Chief to approve necessary documents thereto (State and Local Permits).

BACKGROUND:

Historically the Chowchilla Lions Club has provided an annual aerial firework display for the community.

Originally this event was held at the fairgrounds and later at Berenda Reservoir for Independence Day.

Due to dry conditions and lack of water in the reservoir this event was moved back to the fairgrounds and has now been held there for the past several years. This year Rotary is providing the annual firework display.

REASON FOR RECOMMENDATION:

The Chowchilla Rotary Club representatives have met with City Staff and staff from Chowchilla Fair and desire to again conduct this event at the fairgrounds as has been done for the last several years. This event is open to the public at no charge as a community celebration event.

With the fairgrounds, Rotary, and City working together, the Rotary club has been able to bring the annual fireworks display back to the fairgrounds.

Additional items that were discussed in the above-mentioned meeting were A- The need for the City Public Works Department to post a NOTAM with FAA advising of the aerial fireworks display and its proximity to the airport.

B- Rotary representatives to check and remove any larger debris from the airport that would hinder the normal operation of the airport and/or planes using the airport C- Rotary Club to arrange for City application for aerial fireworks display.

D- Rotary Club contractor (pyrotechnician) to obtain permit from State Fire Marshal’s Office for aerial fireworks display.

E- Pyrotechnician to provide insurance at required amounts and name City, Chowchilla Fairgrounds, and Chowchilla Fire Department as additional insured’s.

F- Fire department representative to inspect and approve mortars for safety and compliance prior to discharge.

G- Fire department to provide stand-by service aerial fireworks event.

FISCAL IMPACT:

Staff and equipment costs to provide fire inspections and stand-by for event.

ALTERNATIVES:

Deny the permit and do not have aerial fireworks.

ACTIONS FOLLOWING APPROVAL:

Verify receipt of City application, State application, and insurance certificates.

Public Works (as airport manager) to post NOTAM for airport, notifying of aerial fireworks.

SUBJECT: Resolution Awarding Construction Contract for the Robertson Boulevard - Downtown Beautification Project (Clean CA Grant) to Granite Construction Company in the Amount of $1,084,880.00 and Authorizing the City Administrator or Designee to Execute All Related Documents Thereto and Amending the Fiscal Year 2024/25 City Budget

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

City Council adopt a resolution awarding the construction contract for the Robertson Boulevard - Downtown Beautification Project (Clean CA Grant) to Granite Construction Company in the Amount of $1,084,880.00 and authorizing the City Administrator to execute the contract on behalf of the City and amending the Fiscal Year 2024/25 City Budget.

BACKGROUND:

California Department of Transportation (Caltrans) developed the Clean California Program as part of the nearly $1.1 billion Clean California initiative, which makes a significant investment in beautifying local communities to create spaces of pride for all Californians. The Clean California Local Grant Program included nearly $300 million for communities to beautify and improve local streets and roads, tribal lands, parks, pathways, and transit centers to restore pride in public spaces. Caltrans District 6 staff worked with City staff to identify an eligible project to be funded with district allocated Clean California funds.

The project identified for Clean California funding includes design and installation of beautification elements for the Robertson Blvd. median at the railroad track, traffic-calming corner bulb-outs, highvisibility crosswalk facilities, and ADA compliant curb ramps. This project will help the City in creating a safer pedestrian network. With the location being on State Route 233 through downtown Chowchilla, these improvements are needed in order to calm traffic and provide pedestrians with better access while providing much needed beautification of the area. The Notice Inviting Bids was published in the Madera Tribune, posted on OpenGov, and submitted to the appropriate construction trade journals and builder’s exchanges.

REASON FOR RECOMMENDATION:

Bids were received from two contractors on June 13, 2024, as follows:

Contractor Base Bid
Granite Construction Company $ 1,084,880.00
Cal Valley Construction 1,326,510.00
Staff reviewed the bids received. Based on review, Staff has determined the low bid received by Granite Construction to be responsive and complete and recommend award of the bid at this time.

FISCAL IMPACT:

With the bid received from Granite Construction, all anticipated construction, engineering and design costs for the project are as follows:

Amount
Construction Costs
Contract $1,084,880.00
Engineering/CM/Inspection/Testing 215,000.00
Recommended Contingency 100,000.00
Total Construction $1,399,880.00
Available funding for the Project is summarized in the following table:

Amount
Funding Allocation
Construction $856,000.00
Engineering/CM/Inspection/Testing 215,000.00
Total Construction $1,071,000.00
Funding Source
Clean CA Funding $1,071,000.00
Total Funding $1,071,000.00
As there is a deficit in funding in the upcoming 2024/2025 Fiscal Year, the project requires the budgets be amended in order to fully fund the project, including contingency. As such, staff is requesting Council amend the FY 2024/25 budget as follows:

Amount Requested

The additional funding comes from a combination of Gas Tax, Measure T, LTF Bicycle & Pedestrian and Signalization funds.

ALTERNATIVES:

City Council may reject all bids.

ACTIONS FOLLOWING APPROVAL:

Finance will amend the FY 24/25 City Budget; Execution of Contract, Pre-Construction Meeting and Notice to Proceed.

TO PREPARE AN IMPARTIAL ANALYSIS OF THE MEASURE
PREPARED BY: Mary Lerner, City Attorney

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council consider and approve a Resolution ordering that a measure to reauthorize Measure N, a special public safety sales tax be submitted to the voters at the November 5, 2024, general election and directing the city attorney to prepare an impartial analysis of the measure.

BACKGROUND:

Over the past several months, the City has engaged hundreds of residents through an independently commissioned community survey and The Chowchilla Community Safety Chat, to gather input on local public safety services, needs, and priorities.

The recent Chowchilla community survey showed residents want the City’s 911, fire, and emergency response times maintained. Residents identified the following public safety priorities:
• Preventing and investigating violent crimes
• Maintaining 911 fire and medical emergency response times • Providing training for volunteer firefighters
• Preventing cuts to essential fire protection equipment, including fire engines • Preventing the loss of Chowchilla police officers
• Maintaining the safety of neighborhood parks and recreation areas However, Measure N – Chowchilla’s 911 Fire/Public Safety Measure – expires soon and unless reauthorized, the City will lose $2.5 million a year that provides funding for preventing and investigating violent crimes, maintaining 911 emergency medical response, and training for volunteer firefighters.

Chowchilla Fire Department’s volunteers rely on Measure N funding to provide firefighting and emergency medical response. Re-authorizing Measure N could allow the Chowchilla Fire Department to realize its continued goal of hiring full-time firefighters critical to keeping Chowchilla safe.

By law, if renewed every dime of this Measure N is legally required only to be spent in Chowchilla specifically for local police and fire needs and cannot be spent on any other purpose. It is important to note that reauthorization of Measure N funding does not increase Chowchilla’s tax rates, but simply continues an existing one-cent public safety sales tax passed by 73% of local voters in 2018.

Over the last 15 years, Sacramento has taken away significant local funding from Chowchilla and requires expensive regulations and bureaucracy, and the City needs to reauthorize Measure’s locally controlled funds as they cannot be taken by the State. Doing so will prevent cuts to essential fire protection equipment, fire engines and experienced police officers.

State funding for the investigation and prosecution of certain crimes have been eliminated recently, and reauthorizing this measure allows the City to continue ensuring crimes like drug dealing and elder abuse get investigated, so that criminals are prosecuted, and justice is served.

Chowchilla practices strict fiscal accountability over spending, and Measure N’s stringent accountability provisions including continued independent citizens’ oversight of spending, public spending reports, and annual independent financial audits to ensure all voter-approved funds are used only for the public safety needs of Chowchilla residents.

REASON FOR RECOMMENDATION:

Reauthorizing Measure N will maintain funding for preventing and investigating violent crimes, maintaining 911 emergency police, fire, and medical response, training for volunteer firefighters, preventing cuts to fire protection equipment, including fire engines, and maintaining safe parks.

FISCAL IMPACT:

If reauthorized by voters, Measure N, a continued 1¢ sales tax, will provide at least $2,500,000 annually to be used only for Chowchilla public safety.

ALTERNATIVES:

Do not approve the resolution and forego placing a measure on the November 5, 2024 General Election Ballot.

ACTIONS FOLLOWING APPROVAL:

Following approval, the resolution will be submitted to the Madera County Elections Office by the City Clerk.

SUBJECT: Consideration of a Resolution to Approve a Reimbursement Agreement with the California High-Speed Rail Authority and Authorizing the City Administrator to Execute all Related Documents Thereto
PREPARED BY: Rod Pruett, City Administrator
ATTACHMENTS: Resolution, Standard Agreement

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council adopts a resolution to approve a Reimbursement Agreement with the California HighSpeed Rail Authority (CAHSRA).

BACKGROUND:

In May 2021, the City and the CAHSRA entered into a Cooperative Agreement that covered the 75-mile section of the overall high-speed rail project that spans from Merced to Fresno which is referred to as the Central Valley Wye section.

Since then the CAHSRA has completed the environmental documents and are now ready to move into the design phase. As a part of the Cooperative Agreement, CAHSRA is supposed to work with the City on mitigations the design of the project would have on the City.

The City has concerns regarding physical, environmental, social, economic and political impacts of the project on current and expected Chowchilla residents and businesses.

The City and the CAHSRA have been working together since the Cooperative Agreement was signed and this reimbursement agreement allows the City to have input on parts of the project’s design that could impact our infrastructure and facilities.

REASON FOR RECOMMENDATION:

The reimbursement agreement will reimburse the City for its personnel and consultant costs that will be required for the input and review of the proposed design. It allows the City to be involved and to be compensated for its time and resources as well.

Both the CAHSRA and the City’s Attorneys as well as the City Administrator have reviewed the agreement and approve it.

FISCAL IMPACT:

The City provided fully weighted salaries for employees that will be used in the process as well as our consultant hourly rates. It is on an as needed basis but the agreement is estimated to cover $220,000.

ALTERNATIVES:

Do not approve entering into the agreement and/or modify the agreement.

ACTIONS FOLLOWING APPROVAL:

City Administrator will sign the related documents.

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council adopt the attached resolutions in regards to the FY 2024/2025 budget.

BACKGROUND:

The City of Chowchilla, as a result of strong recessionary pressure, went through a very difficult financial period from 2008 through 2012. During this difficult period, the City Council made timely critical decisions related to budget adjustments that significantly reduced city staff, expenditures and services delivered to the public. These adjustments made by the City Council during this period kept the City financially solvent.

The City of Chowchilla is using a conservative approach in revenues. The City is using estimates from Muni-Services, the State of California, County of Madera and Federal trends to forecast revenues.

Fiscal responsibility is of the highest importance and the 2024-2025 budget reflects that. With the help of staff city-wide, the Finance Department has put together a balanced budget. We will re-evaluate the economy and City needs at mid-year review and hopefully have a better picture of what things will look like moving forward.

REASON FOR RECOMMENDATION:

We are presenting a balanced budget that utilizes current year resources and unappropriated fund balance for all funds. This is the budget that was presented in the Budget Workshop on May 28, 2024.

FISCAL IMPACT:

The fund summaries for each City and Agency fund are contained in the proposed budget and reflect the net changes in fund balance.

Below is the chart for expenses and revenues that were presented as part of the budget workshop. There have been some changes to the numbers that were presented at the budget workshop and those changes will be discussed in detail at the council meeting.

City Wide Revenues FY 23/24 Budget City Wide Expenses FY 23/24 Budget Capital Projects 2,383,000 Capital Projects 2,383,000

• The Proposed Fiscal Year 2024-2025 Budget Book will be available to view at City Hall and on the City’s website www.cityofchowchilla.org by 5pm on Friday, June 21, 2024.

ALTERNATIVES:

If not approved, the city would need to approve an emergency plan to continue funding until a budget is passed.
