PRESENTATIONS/WORKSHOP - Section 1
1.1 Proclamation: Fire Prevention Week, October 6 – 12, 2024
PUBLIC ADDRESS
Tammie LaMattina addressed the City Council over the City’s “broken down car” ordinance as she has seen many more of these types of violations around the city. She also asked if the City had a color scheme for the Robertson Boulevard corridor (not just downtown). She addressed the very bad road conditions on Road 15 ½ and Avenue 24, wondering who is responsible for its upkeep (City or county). Public Works Director Rogers responded to her questions regarding the roads.
Pastor Luke Waters at hope fellowship who received a violation for having goats. He was not aware that the City’s ordinance prohibited such animals within the city limits. The church has a large lot and use the goat to help maintain the weeds. He asked if the council can explore allowing this type of land management.
Kendall Flint, DKS Associates, works closely with the Madera County Transportation Authority on an education program for Measure T, reported to the Council on misinformation that has been out on the community. There is a citizen initiative launched earlier this summer which basically took the existing expenditure plan that was developed by the Measure T Steering Committee and put that out to voters so that they can do a petition driven initiative which lowers the threshold for passage. It is exactly the same expenditure plan that was developed by a citizen advisory committee. If anyone needs more information about Measure T, look up MeasureT-2024.com.

THE AGENDA
Meeting of: October 8, 2024
AGENDA SECTION: Public Hearing
SUBJECT: Consideration of a Resolution and Measure T Annual Expenditure Plan (AEP) for Fiscal Year (FY) 2024-25 and Authorizing the Public Works Director or Designee to submit the Plan to the Madera County Transportation Authority (MCTA) for adoption
PREPARED BY: Jason Rogers, Director of Public Works
ATTACHMENTS: Resolution, Measure T AEP Plan for FY 2024-25
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
The City Council adopt a resolution approving the Measure T AEP for FY 2024/25 and authorizing the submission of the AEP to the Madera County Transportation Authority (MCTA) for adoption.
BACKGROUND:
The Annual Expenditure Plan (AEP) is required by the MCTA to claim Measure T funds that will be allocated to the City as specified in the Transportation Sales Tax Measure Investment Plan (Plan) approved by the voters in the November 2006 election. The AEP is completed annually. The proposed funding for the projects and programs in the AEP is consistent with the requirements specified in the Measure T 2007 Strategic Plan (Strategic Plan) adopted by the MCTA and with the Capital Improvement Program (CIP) proposed in the City’s FY 2024/25 Budget.
Measure T is a ½ cent sales tax measure approved by Madera County voters in the November 2006 election. The measure took effect on April 1, 2007, with a sunset provision of 20 years. As part of the measure’s implementation, local agencies submit an AEP. The AEP is a multi-modal funding program that commits funding for the following program categories:
Regional Transportation and Highways ADA Compliance Local Street Maintenance Transit Enhancement
Local Street Supplemental Maintenance ADA/Seniors/Paratransit Flexible (Miscellaneous Street programs) Environmental Enhancement
The Regional Streets and Highways program consists of two elements:
1. One is the responsibility of MCTA to manage and deliver projects of regional significance. MCTA may elect to agree with the local agency to perform the engineering and construction activities of this element.
2. The second element is the responsibility of the local agencies to manage the construction, rehabilitation, and maintenance of the agency’s arterial and collector streets.
All other programs are the responsibility of the local agency to deliver. The MCTA and Citizens Advisory Committee monitor the local agencies' progress in the delivery of these programs.
REASON FOR RECOMMENDATION:
The implementation guidelines in the Strategic Plan adopted by the MCTA require the City to prepare and adopt an AEP that must be approved during a noticed public hearing. This agenda item will satisfy this requirement. The proposed expenditures in each program category must meet the objectives and guidelines specified in the Strategic Plan. The Strategic Plan is a 5-year plan that is updated every 2 years to adjust the project based on sales tax receipts, ensuring that the projects are consistent with future investments.
DISCUSSION:
MCTA has provided the City with the funding allocation for each of the program categories. The total allocation for FY 2024/25 is $1,007,099. There was no allocated disbursement of excess tax revenues received in FY 2023/24 above the final allocation. A summary of allocations and distributions of prior year excess funds to the City for the past five years is shown below in Table 1.
Table 1. Allocations & Excess Funds for Past 5 Years

THE AGENDA
Meeting of: October 8, 2024
AGENDA SECTION: Deferred Business
SUBJECT: Request for Direction of the City of Chowchilla’s Former Library and Future Use of the Facility
APPROVED BY: Jason Rogers, Director of Public Works
ATTACHMENTS: None
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Staff requests City Council provide direction regarding the City’s former library located at 621 Robertson Blvd. as related to a Memorandum of Understanding (MOU) with the Chowchilla Historical Society to designate the former Chowchilla branch library as a State historical landmark.
BACKGROUND:
In 1940, the City of Chowchilla gave three lots (4,5, and 6 of Block 88 and now currently APN 002-041- 007), located at 621 West Robertson Boulevard within the City of Chowchilla, to Madera County for the purpose of building a library. Madera County contributed $5,400 toward a total building cost of $15,800.
The library, built by the Work Progress Administration (WPA), was made of adobe brick, and included a basement. It is reputed to be the last structure built by the agency in Madera County. The library opened to the public on August 1, 1941. It closed on February 1, 2003, and was replaced by a new library on Kings Avenue.
In March, 2009, the City of Chowchilla purchased the old library from the County of Madera for a purchase price of $225,000. The purchase was made through the City’s Redevelopment Agency.
In March, 2012, the City applied for Community Development Block Grant (CDBG) Funds in the amount of $635,500 in order to remodel and restore the dilapidated old library building to create public space for social organizations providing services to low- and moderate-income persons so that it can be used again as a meeting room for a disadvantaged segment of the population. Unfortunately, the City was not awarded any CDBG funds for rehabilitation of the facility.
In 2018, the Chowchilla District Historical Society expressed an interest in leasing the Library building from the City. In January 2019, the City of Chowchilla agreed to allow the Historical Society to enter the building and initiate a survey, collecting measurements and taking photographs of the property in order to submit the building for historical preservation to the State of California, in addition to using the information collected to submit the Old Library for possible grant funds. Due to the COVID-19 Pandemic, the Historical Society was only recently able to enter beginning January, 2021.
On April 13, 2021, staff presented an agenda item to City Council to discuss the current status of the facility. City Council provided direction to staff to come back to Council at a later date and conduct a workshop in order to gather additional comment from the public.
On May 11, 2021, the City hosted a workshop as part of the regular City Council meeting to discuss the status of the former library and receive additional comment from the public. Chris Thomas and Dale Thomas of the Chowchilla Historical Society addressed the City Council in support of salvaging the building by using the CA Historical Building Code, which they stated could be used so that a majority of the repairs could be completed for $30,000 to $50,000. Additionally, they requested that the City allow the Historical Society to submit an application to the State, on behalf of the City, to have the facility be considered as a state historical landmark. It was the consensus of the City Council to bring back the item at the June 22, 2021 meeting with additional information.
On June 29, 2021, the City Council reviewed a draft application from the Chowchilla Historical Society for consideration of State historical recognition. Due to concerns regarding the structural safety of the building and potentially significant repairs needed, Council declined to submit the application to the State for review at this time.
On September 14, 2021, after receiving a quote from the Historical Society that a multitude of repairs could be completed for approximately $30,000 to $50,000. The City was not able to assess the Historical Society’s claims that repairs for the facility could be completed for approximately $50,000 as the City was not provided any detailed quotes. As a result, staff was directed to contract with an outside firm to complete a structural assessment and ascertain potential costs to repair the building. Advanced Structural Design, Inc. (ASDI) completed the structural assessment of the former library for the City.
On May 24, 2022, City Council reviewed the structural assessment of the former library from ASDI. The report noted several safety concerns related to the structure and recommended an additional in-depth structural study or construction work necessary to address only the most critical structural deficiencies according to the report. The total cost for the recommended structural repairs by a licensed contractor is $494,565. At the meeting, the Chowchilla Historical Society requested that the City Council once again allow them to submit an application to the State of California for consideration of State historical recognition. At the time, Council declined to submit the application to the State for review and directed staff to look into the effects of such a designation on the building.
On January, 10, 2023, City Council received a verbal presentation on the former library that included past history, current status according to the most recent structural assessment and California Environmental Quality Act (CEQA) protections and processes to follow if the facility receives State Historical Designation.
Additionally, the City received public comment from the Chowchilla Historical Society and members from the public requesting the City to allow submittal of an application to the State of California for consideration of State historical recognition. As a result, Council directed staff to bring a resolution back at the January 24, 2023 meeting authorizing the Historical Society to submit an application to the State for consideration and subsequently received direction to draft a MOU between the City and Historical Society in regards to terms and time limits for the Historical Society to attain designation and grant funding.
On May 9, 2023, City Council approved entering into an MOU between the City and Historical Society in regards to terms and time limits for the Historical Society to attain designation and grant funding. The MOU was executed in July 2023.
REASON FOR RECOMMENDATION:
The MOU with the Chowchilla Historical Society has expired. Per direction of the City Council, the MOU had the following deadlines:
1. May 9, 2023 – Council approved entering into an MOU with CHS.
2. July 7, 2023 – MOU executed by both parties
3. January 3, 2024 – Date to submit application to State for consideration
4. April 2, 2024 – Effective date for 90 day review by the State
5. July 1, 2024 – Effective date if the state exceeds the 90-days to make the determination.
6. CHS has one year from the date of the state historical designation to apply for and receive grant funding for the renovation of the Library.
Per the terms of the MOU, CHS stated they submitted an application to the State for determination of historic preservation.
At the September 10, 2024 Council meeting, staff stated that the State has not provided any determination regarding the former library. Staff has reviewed the agendas for the State Historical Resources Commission (SHRC) and for their upcoming November 7, 2024 meeting. The former library has not been considered for nomination on any of the SHRC agendas. Staff contacted the State Historic Preservation Office (SHPO) but they stated that they do not have an application on file. Dale Thomas, representing the CHS, stated that they recently met with the State in person and the application had been found.
Staff contacted the SHPO after the last Council meeting. According to SHPO staff, no nomination has been received by their office, and there is nothing logged in to their registration system under the name Chowchilla. Additionally, the staff member asked the only other person in their office who reviews nominations, and their executive secretary, who answers the front desk phone and interacts with the public the most, and neither of them are aware of a meeting with a CHS representative or this nomination’s existence at all. City Staff has requested backup information from the Historical Society related to the certified mail receipt, meeting dates, names of State staff they talked to, and if the application had been submitted to another State agency, but has not received anything from CHS prior to submittal of this report.
At the September 24, 2024 meeting, CHS representatives stated that they mailed a revised application to the SHPO for review on September 24, 2024. In order to allow delivery of the application, staff reached out to the SHPO on October 1, 2024 to verify if they had received any application from CHS. SHPO responded that they received the application on September 30, 2024. Based upon their initial review, this looks like the first submittal and will require revisions. As to potential timelines for State review and potential nomination, typically, the nomination process takes about 6-12 months, assuming the nomination does not require extensive revision.
FISCAL IMPACT:
As this is a request for direction, there is no fiscal impact.
ALTERNATIVES:
Not to provide direction.
ACTIONS FOLLOWING APPROVAL:
Execute the direction of Council.

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Adopt a Resolution establishing an annual 30-day public review period for Measure T for proposed use of funds by the City.
BACKGROUND:
On June 24, 2024, proponents of Measure T filed with the Madera County Clerk-Recorder and Registrar of Voters the Petition to renew an existing sales tax of one-half (½) cent for local transportation funding for twenty (20) years (the “Initiative Measure”). The Notice of Intention to Circulate was filed with the Madera County Clerk-Recorder and Registrar of Voters on June 10, 2024 and submitted to you’re the Board of Supervisors (the “Board”) on July 2, 2024.
The Board passed a resolution submitting the Initiative Measure, without alteration, to the voters pursuant to Elections Code section 1405; on July 16, 2024.
The Initiative Measure and expenditure plan is nearly identical to the Measure T renewal that was developed by the Measure T Steering Committee. The sole difference between the Initiative Measure and the renewal developed by the Steering Committee was the omission of a requirement that:
“Each jurisdiction will annually identify specific streets and roads that will be prioritized for repair and/or refurbishment and hold annual public meetings to review the proposed plan not less than 30 days prior to adoption by the local jurisdiction and the MCTA board.” Once submitted the Initiative Measure could not be modified to incorporate the above language and requirements; however, in an effort to ensure continued transparency, accountability and community engagement, the affected agencies are considering resolutions to voluntary incorporate the annual work plan and public meeting requirements as local requirements.
There is currently in place a fifteen (15) day review period and this action would extend the review period to thirty (30) days.
REASON FOR RECOMMENDATION:
Staff recommends adopting a resolution that calls for this review period beginning in 2025 for all Measure T expenditures for as long as such revenues are received. Although not required to incorporate the work plan review and public hearing process, voluntary incorporation by the affected agencies will safeguard public trust by ensuring continued transparency, accountability, and community engagement.
FISCAL IMPACT:
None, as the City has already adopted a 15-day review period. This resolution just extends the time for public input and comment.
ALTERNATIVES:
Council may elect to reject the Resolution.
ACTIONS FOLLOWING APPROVAL:
Future Measure T annual work plans will have a 30-day review period.
