THE AGENDA
Meeting of: February 11, 2025
AGENDA SECTION: Consent
SUBJECT: A City Council Resolution Amending Council Resolution #94-13, Passed and Adopted on November 12, 2013, Relating to the Council Contingency Fund Policy to Enhance Accessibility, Flexibility and Administrative Efficiency PREPARED BY: Stacy Wisener, Deputy Director of Recreation & Community Engagement ATTACHMENTS: Resolution approving an amendment to CCF Policy; Updated Council Continency Fund Manual & Application; Updated Council Contingency Policy.

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Staff recommends that the City Council approve the attached resolution amending the Council Contingency Fund (CCF) policy to reflect the following changes:
• Expanding eligibility to include contributions to organizations benefiting the community. • Modifying documentation requirements from mandatory to "if requested." • Granting the City Council discretion to waive the nonprofit requirement. • Adjusting the requirement for alternative funding from "required" to "make known." • Simplifying post-event reporting to a follow-up report at a City Council meeting. • Removing redundant and excessive administrative requirements, including grant reporting, reimbursement restrictions, and Chamber of Commerce involvement. • Eliminating Sections 7 (Reporting Requirements), 8 (Grant Timeline), and 9 (Promotion of City Amenities and Services) from the manual.

BACKGROUND:

The Council Contingency Fund (CCF) was initially established through Council Resolution #94-13, passed and adopted by the City Council of the City of Chowchilla on November 12, 2013. The fund was designed to assist community-based initiatives that contribute to Chowchilla's cultural, economic, and civic engagement at the City Council's discretion. However, portions of the current policy have created unnecessary administrative barriers, limiting participation and efficiency.

The proposed amendments aim to simplify the application process, increase accessibility for local organizations, and improve the efficiency of fund administration while maintaining accountability and fiscal oversight.

FISCAL IMPACT:

These changes will not impact the total annual allocation for the Council Contingency Fund ($25,000).

However, they will reduce administrative costs and processing time for applicants and city staff.

ALTERNATIVES:

The City Council could choose to:

Maintain the current policy without changes, preserving existing requirements and administrative processes.

Modify only specific sections, such as documentation flexibility or alternative funding requirements, while keeping other parts unchanged.

CONCLUSION
Staff recommends approval of the attached resolution, implementing these policy changes to enhance the efficiency and accessibility of the Council Contingency Fund.

THE AGENDA
Meeting of: February 11, 2025
AGENDA SECTION: Consent
SUBJECT: Consideration and Adoption of a Flag Policy
PREPARED BY: Joann McClendon, City Clerk
ATTACHMENTS: Flag Policy

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council adopts the proposed Flag Policy.

BACKGROUND:

In completing research regarding proper flag placement, we became aware that various public agencies adopted flag policies. I shared a draft of the policy with Deputy Director Wisener who added verbiage addressing special event banners and street light pole flags.

REASON FOR RECOMMENDATION:

It is important to develop a flag policy as not many people know the rules of display and care of the American flag. It also will be a policy the Council and City staff can refer to whenever outside groups request to fly their flags (other than the ones that are noted in the policy), and serves as a guide on what types of flags or banners can be displayed at City-owned buildings, at special events, and who approves placement.

FISCAL IMPACT:

None.

ALTERNATIVES:

Do not approve the policy.

ACTIONS FOLLOWING APPROVAL:

If approved, add the policy to the current APO list and send a copy to each department.

Flag Policy for City-Owned Buildings, Events and Holidays

PURPOSE
To establish guidelines for (1) the exhibition of the flag of the United States of America, the California State flag, and the Chowchilla City flag from City buildings, (2) the display of street flags for parades and holidays, and (3) the display of ceremonial flags.

The City’s flagpoles are not intended to serve as a forum for free expression by the public.

This policy applies exclusively to flags displayed on city-owned buildings, properties, and street fixtures. It does not regulate or restrict flags displayed by private businesses or individuals on their own property, which remain subject to applicable zoning and signage regulations.

Display of Flag
The flag of the United States, the flag of California, and the flag of the City of Chowchilla shall be displayed at City-owned buildings. At all times, the national flag shall be placed in the position of first honor. (Government Code 431, 436; 4 USC 6) When displayed on a building or on a flagstaff in the open, the national flag shall be displayed only from sunrise to sunset unless properly illuminated during the hours of darkness.

The flag should not be displayed during inclement weather unless an all-weather flag is used. (4 USC 6)
POLICY
It is the policy of the City of Chowchilla that flags should be displayed in conformance with Federal and State policies, as stated in the Federal “Our Flag” publication of the Congress, House Document No. 96-144, and the State of California Government Code Sections 430 and 437.

In order to establish a policy with respect to the locations and days when the United States of America, California State, and City of Chowchilla flags should be displayed, the following standards should be followed.

The Public Works Director is responsible for ensuring the proper execution of this policy at all City facilities except the Police and Fire Stations, where the respective Chiefs are responsible for proper execution of this policy.

STANDARDS

A. Federal, State, and City Flags

1. Outdoor flags will be flown at City facilities in the following order of precedence: first, the United States flag; second, the California State flag; third, the City of Chowchilla flag.

2. Weather permitting, flags should be displayed daily in front of or at a location near City Hall, the Police Administration Building, the Senior Center, the Airport, and all Fire and Police facilities during business hours. Maintenance, replacement of damaged flags, or ensuring illumination where required is the responsibility of Public Works Department.

3. Flags should not be displayed in inclement weather. However, all-weather flags may be flown on a 24-hour basis as long as they are illuminated from sunset to sunrise.

Illumination of flags is permitted where available.

Flag Policy for City-Owned Buildings, Events and Holidays

4. The City of Chowchilla flag will be flown wherever there are sufficient poles to do so in accordance with #2 above. The City flag may be displayed on the same pole with and underneath the State flag whenever the pole is of sufficient height. Only one flag may be flown per pole unless the pole is tall enough to accommodate multiple flags, in which case the City flag may be flown beneath the State flag.

5. New City facilities where any flags are to be flown shall be constructed with a sufficient number of poles to allow the City flag to be flown.

6. Indoor City flags shall be displayed at a minimum in the City Council Chambers and in the City Council Office.

B. The national flag shall fly at half-staff on the following occasions: (4 USC 7)

1. For 30 days from the death of the President or a former President

2. For 10 days from the death of the Vice President, the Chief Justice or a retired Chief Justice, or the Speaker of the House of Representatives

3. From the day of death until the interment of an Associate Justice of the Supreme Court, a secretary of an executive or military department, former Vice President, or the Governor of a state

4. On the day of death and the following day for a Member of Congress

5. On Memorial Day, until noon only

6. On Peace Officers Memorial Day (May 15), unless it falls on Armed Forces Day

7. Upon a proclamation from the Governor in the event of the death of a present or former official of the state government or a member of the Armed Forces of the state who has died while serving on active duty

8. On other occasions, by order of the President and in accordance with presidential instructions or orders

9. Flags at all City facilities shall be displayed in accordance with the above standards.

However, the City Administrator may order flags to be lowered to half-staff, including, but not limited to, flags of the United States of America and the State of California in honor of the death of a City employee killed in the line of duty or as deemed appropriate by the City Administrator.

C. Street Flags
Street flags are flags mounted on individual flagpole brackets attached to city poles or streetlights. In the downtown area, City-owned flags will be displayed on Veterans Day and Memorial Day.

D. Ceremonial Flags
The City’s flagpoles are not intended to serve as a forum for free expression by the public.

Flag Policy for City-Owned Buildings, Events and Holidays No flag other than the United States of America, State of California, and the City of Chowchilla may be displayed on City grounds unless it is a country, state, or United States military flag, Veterans of War and their commemorative flags are permitted for use solely for event purposes.

Any other flag is prohibited on City-owned flagpoles.

E. Pole Banners
Pole Banners are attached to light or power poles. Pole Banners are allowed only by the City of Chowchilla as a design element to beautify or promote the City. No Outside organizations are permitted to have pole banners.

F. Banner at Veterans Memorial Park
Banners that are hung facing Robertson Boulevard in the Veterans Memorial Park are used solely for the City of Chowchilla promotions. Outside agencies are not permitted to use this area for their promotions.

THE AGENDA
Meeting of: February 11, 2025
AGENDA SECTION: Deferred Business
SUBJECT: Consideration to approve a budget amendment and distribute a financial contribution to the Chowchilla District Chamber of Commerce for the 2025 Calendar Year
PREPARED BY: Stacy Wisener, Deputy Director of Recreation & Community Engagement ATTACHMENTS: Resolution, Chambers Request for Funding, Chambers 2025 Budget

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

The recommendation is that the City Council consider a resolution approving a budget amendment for a financial contribution of $7,000 to the Chowchilla District Chamber of Commerce for the 2025 calendar year with provisions.

In the interest of strengthening a partnership between the City and the Chamber, it is recommended that the contribution be contingent upon the Chamber’s active participation in at least three city-hosted events.

Additionally, the Chamber’s support of local businesses, promoting economic growth, and fostering connections among businesses is key thereby providing a benefit to the community as a whole.

BACKGROUND:

The City has historically provided financial contributions to the Chowchilla District Chamber of Commerce routinely every calendar year. In addition to monetary support, the City provides the Chamber with ample office space and free internet service.

All contribution requests must now go to the city council for individual discretion and approval instead of through the budget process.

FISCAL IMPACT:

A budget amendment of $7,000 from the general fund would need to be completed, as contributions are no longer a budgeted item.

ALTERNATIVES:
1) Disapprove.
2) Eliminate recommended provisions and approve.
3) Add further provisions and approve.

Request For Funding to the Chowchilla City Council
DATE: December 18, 2024
TO: Chowchilla City Council
From: Dillon Haworth, Executive Director
Chowchilla District Chamber of Commerce
RE: Chowchilla District Chamber of Commerce
2024/2025 Budget and Yearly City of Chowchilla Contribution I. REQUEST
The Chowchilla District Chamber of Commerce is requesting the Chowchilla City Council to approve the yearly contribution of $7,000 to assist in the continued funding and support for the Chowchilla Chamber of Commerce activities, community support, and resources.

II. BACKGROUND
The Chowchilla Chamber of Commerce is a key part of our community as it serves foremost to the City of Chowchilla as a welcome center for the town. Our activities are a key source of community leadership and support to the citizens of our community as we use our funding and support from members to put on events and better support our members and local businesses. Our two main events are key factors to economic growth and community support. Our Annual Classic Car & Custom Bike Show is the second largest tourism event in our town just behind the Fair; and our Awards & Installation Dinner serves to recognize and award key businesses, service groups, and citizens of our community. With this, the Chamber is also responsible for being a guide to businesses such as providing information and resources into opening a business, getting permits, finding locations, advertising, corresponding with local and state level government agencies, community relations, key information, and much more. We have developed a very successful Biweekly Newsletter to provide our members with information and updates from the Chamber, as well as a successful social media accounts that those in our community look to for important information and updates.

III. Summary
We are requesting the yearly City of Chowchilla contribution of $7,000 to help fund and aide in the Chowchilla Chamber of Commerce funding. This yearly contribution also includes the annual membership the City of Chowchilla has with the Chowchilla Chamber of Commerce. We are unlike many other community organizations in that we have one full time employee whose wages we need to be able to pay on top of also using our finances to provide for our members and community. The Chowchilla Chamber business member dues are some of the lowest in the state, and the donation money helps keep those dues low for our local businesses. Our Dinner and Car Show make up a large sum of this expense however by receiving this contribution from the City of Chowchilla, we can do more year on year and be of better service to the community. Our work, though mainly acknowledged by our two events, is largely done behind the scenes as we work each day to bring economic growth to our two and service as a community center to much needed information and resources to all peoples.

IV: Where the Funding Goes
Each year the Chamber allocates a portion of our budget to community support, such as donations, sponsorships, etc., as well as our yearly scholarship of $2,000 for high school students, payroll to ensure we have an employee at the office Monday through Friday keeping the welcome center open to the public, as well as all other expenses such as the Car Show, Awards Dinner, etc. The $7,000 contribution would be put into our yearly budget and split between each of these many things to be a source of funding for our yearly community support. As a small nonprofit, our budget is very small and the $7,000 would go a long way in terms of support to the Chamber and the affect it has on our ability to do more for our community. The things we do cost money, and many times we generate no profit from them such is the case with our Day of Prayer event or monthly Coffee at the Chamber. These events can only happen because of the money we bring in from member dues, the City of Chowchilla contribution, and the Car Show/Awards Dinner.

RE: Madera County Economic Development Commission
2025/26 Annual Basic Service Level Budget
I. RECOMMENDATION
The Madera County Economic Development Commission (MCEDC) recommends the Chowchilla City Council (Council) approve the Fiscal Year (FY) 2025/26 Basic Service Level Budget in the amount of $39,789.51.

II. BACKGROUND
MCEDC was created by the County of Madera and the cities of Madera and Chowchilla (PARTIES) through a Joint Powers Agreement (JPA) in 1968. MCEDC is required by the JPA to submit a Basic Service Level Budget to the PARTIES on an annual basis. Once approved the budget is divided between PARTIES proportionally based on population. Throughout the past several years MCEDC has worked diligently on attraction of new business, expansion and retention efforts with local businesses throughout the County. MCEDC also acts as the lead agency on a county-wide basis for several agencies, organizations and programs such as the Greater Madera County Industrial Association, the Central California Valley Economic Development Corporation, CalRecyle, the Madera County and City of Madera Revolving Loan Fund programs and others. MCEDC is also a leader in promoting Madera County, including the City of Chowchilla with ongoing press releases, social media, and Real Estate Updates.

III. SUMMARY
The 2025/26 Basic Service Level Budget has an increase of $1,172.24 compared to the 2024/2025 FY which reflects a slight increase in salary and overhead expenses. The JPA states that each jurisdiction shall pay a prorated share of the MCEDC Basic Service Level Budget based on population. MCEDC has reviewed the most current State of California Department of Finance (DOF) population data. The May 1, 2024 DOF reports the population of the City of Chowchilla as 18,930, the County of Madera as 73,838 and the City of Madera as 66,560. Pursuant to an agreement between the County and Chowchilla dated May 21, 1996 there shall be an adjustment based on the prison population. The State of California Department of Corrections reported the prison population of 5,330 as of Jan. 31, 2024. Therefore, in calculating the percentage for Chowchilla the prison population of 5,330 was subtracted from the City of Chowchilla DOF population and added to the County of Madera DOF population. The adjusted numbers are 13,600 for Chowchilla and 79,168 for the County. These numbers calculate to a prorated rate of 8.54% for Chowchilla and 49.69 % for the County. This is consistent with the funding formulas of the Madera County Transportation Commission. In fiscal year 2024/2025, the prorated formula for Chowchilla was 8.60% and the county was 49.96%.

IV. FISCAL IMPACT
This request will have an impact to the General fund in the amount of $39,789.51 MCEDC invoices the City on a quarterly basis.
