REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY DIRECTOR ☒ PLANNING COMMISSION RECOMMENDATION:

At their February 19, 2025 meeting, the Planning Commission voted 4-0 with 1 abstention, to adopt a resolution recommending that the City Council approve Zone Text Amendment (ZTA) #24-0762 Housing Element Program HE-2(l) - Lower Income Opportunities and the accompanying Notice of Exemption. On February 25, 2025 the City Council approved the waiving of the first reading of the same with recommendation to consider and adopt at the next City Council meeting.

BACKGROUND:

The City of Chowchilla’s 6th cycle Housing Element was adopted by the City Council on September 10, 2024 and subsequently certified by the California Department of Housing & Community Development. As part of that certification, the City was required to complete certain code amendments in accordance with the Housing Element Programs contained in the 2024-2032 Housing Element Update. The first Housing Element program coming before the Planning Commission for consideration is Housing Element Program HE-2(l) - Lower Income Opportunities. The purpose of ZTA #24-0762 is to implement HE-2(l), (Government Code Section 65583.2(c)). The goal of this program would be to increase housing opportunities for lower income households.

To achieve this, the following code section is proposed to be added:

Chapter 18.94 HOUSING ELEMENT SITES

18.94.010 Purpose
The purpose of this chapter is to create procedures to implement State Housing Element Law related to sites that are identified by the Housing Element of the General Plan and its associated implementation programs.

18.94.020 Applicability
These regulations shall apply to the Sites Inventory and Prior Housing Element Sites identified in the most recently adopted Housing Element.

18.94.030 Definitions
For the purposes of this chapter, the following words and phrases are defined as follows.

A. “Housing Development Project” has the same meaning as defined in paragraph (3) of subdivision (b) of California Government Code Section 65905.5.

B. “Housing Element Sites” means sites listed on the inventory of land suitable for residential development developed pursuant to paragraph (3) of subdivision (a) of the California Government Code Section 65583 that exists in the adopted Housing Element.

C. “Lower Income Households” has the same meaning as defined in Health and Safety Code Section 50079.5.

D. “Ministerial Approval” means a process for development approval to approve a “use by right” as this term is defined in California Government Code Section 65583.2(i).

E. “Prior Housing Element Sites” means Housing Element Sites identified as meeting the criteria for a prior housing element site in the most recently adopted Housing Element, including non-vacant sites that were identified in the prior Housing Element and vacant sites that were identified in the prior two Housing Elements.

18.94.040 Approval Requirements
A. Prior Housing Element Sites. If a Housing Development Project is proposed on a Prior Housing Element Site and at least twenty percent of the project’s units will be made affordable and available to Lower Income Households, then the project shall be subject to ministerial approval pursuant to California Government Code Section 65583.2(i) and thus not subject to CEQA. Projects will be reviewed against the requirements in municipal code, general plan specific plans, and any applicable objective design standards. No discretionary conditions will be administered, and the project will not be subject to appeal before a discretionary body. The interpretation of objective requirements may be appealed by the applicant to the appropriate decision making body.

GENERAL PLAN/ZONING ANALYSIS
The Housing Element is one of nine mandated elements within the General Plan. This proposed zone text amendment will satisfy one of the implementation items contained within the City’s 6th Cycle Housing Element.

ENVIRONMENTAL REVIEW ANALYSIS:

The City is the Lead Agency for this Project pursuant to CEQA Guidelines (Public Resources Code [PRC] Section 15000 et seq.). This update is subject to CEQA Guidelines section 15061, which states that “The activity is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.” The proposed implementation item of the Housing Element does include changes to the zoning code to bring it into conformance with state law and to promote more affordable housing in the city, but nothing in the proposed changes would alter the existing development potential of the City as expressed in the General Plan.

CITY COUNCIL FINDINGS
The City Council, before granting an Ordinance Text Amendment, must make all the following findings (CMC 18.86.030):

1. The amendment is internally consistent with the goals, objectives, and policies of the General Plan and this title;
The proposed Ordinance Text Amendment is consistent with the City’s goals, objectives, and policies of the General Plan.

2. The amendment would not be detrimental to the public health, safety, or welfare of the community;
The proposed Ordinance Text Amendment would implement the City’s Housing Element.

These would not be detrimental to the public health, safety, or welfare of the community.

3. The amendment would maintain the appropriate balance of land uses within the city; The proposed Ordinance Text Amendment does not include any map amendments, therefore, there would be no impact to the balancing of land uses.

4. The anticipated land uses on the subject site would be compatible with existing and future surrounding uses.

The proposed Ordinance Text Amendment does not include any map amendments, therefore, there would be no compatibility impacts to existing or future surrounding land uses.

FISCAL IMPACT:

None.

ALTERNATIVES:

The City Council can vote to deny ZTA #24-0762 and the accompanied Notice of Exemption.

ACTIONS FOLLOWING APPROVAL:

If approved, staff will bring back the item at the next City Council meeting for 2nd reading and adoption.

THE AGENDA
Meeting of: March 11, 2025
AGENDA SECTION: Public Hearing
SUBJECT: 2024-2025 Master Fee Schedule Amendment Relating to Concealed Carry Weapon (CCW) Permit Fees
PREPARED BY: Kerri Williams, Finance Director
ATTACHMENTS: Resolution, Update 2024-2025 Master Fee Schedule

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That Council holds the public hearing, accept testimony regarding the Master User Fee Schedule Amendment and adopt, by motion, a Resolution updating the 2024-2025 Master User Fee Schedule.

BACKGROUND:

In response to increasing demand and a growing interest in Concealed Carry Weapon (CCW) permits, the City has decided to offer this service to local residents. Under state law, the City will be responsible for processing CCW applications, conducting background checks, issuing permits, and ensuring compliance with both state and local regulations. To support the administration of this service, the establishment of appropriate fees is necessary to cover the costs associated with the program.

The California Government Code Sections 66012 – 66018.5 grants cities the authority to establish and charge user fees in connection with certain public services that are provided to businesses and individuals.

Historically Chowchilla has set these fees by departments at different times of the year, not in a consolidated fashion. In 2012, Council consolidated the fees into one document with the adoption of Resolution 84-12, ensuring ease of use by the City’s customers.

REASON FOR RECOMMENDATION:

It is recommended that the City Council approve the inclusion of CCW fees in the 2024-2025 Master Fee Schedule. This will allow the City to implement the program and begin offering CCW permits to residents.

FISCAL IMPACT:

The projected revenue will be included in the 2024-2025 City of Chowchilla budget.

ALTERNATIVES:

Do not approve; remain status quo.

WHEREAS the City of Chowchilla has held a public hearing concerning the adoption of said fees and has made available to the public data on the amount of costs or estimated costs required to provide the services for which the fees are levied and the revenue sources anticipated to provide the services.

1. The Council finds that the updated fees propose a reasonable relationship between the fees and services, and the time for payment set forth in this resolution are proper and necessary and the information upon which the fees are based is correct and accurate; and,

AGENDA SECTION: Deferred Business
SUBJECT: Request for Direction of the City of Chowchilla’s Former Library and Future Use of the Facility
APPROVED BY: Jason Rogers, Director of Public Works
ATTACHMENTS: State Revision Letter, Application

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Staff requests City Council provide direction regarding the City’s former library located at 621 Robertson Blvd. as related to a Memorandum of Understanding (MOU) with the Chowchilla Historical Society to designate the former Chowchilla branch library as a State historical landmark.

BACKGROUND:

In 1940, the City of Chowchilla gave three lots (4,5, and 6 of Block 88 and now currently APN 002-041- 007), located at 621 West Robertson Boulevard within the City of Chowchilla, to Madera County for the purpose of building a library. Madera County contributed $5,400 toward a total building cost of $15,800.

The library, built by the Work Progress Administration (WPA), was made of adobe brick, and included a basement. It is reputed to be the last structure built by the agency in Madera County. The library opened to the public on August 1, 1941. It closed on February 1, 2003, and was replaced by a new library on Kings Avenue.

In March, 2009, the City of Chowchilla purchased the old library from the County of Madera for a purchase price of $225,000. The purchase was made through the City’s Redevelopment Agency.

In March, 2012, the City applied for Community Development Block Grant (CDBG) Funds in the amount of $635,500 in order to remodel and restore the dilapidated old library building to create public space for social organizations providing services to low- and moderate-income persons so that it can be used again as a meeting room for a disadvantaged segment of the population. Unfortunately, the City was not awarded any CDBG funds for rehabilitation of the facility.

In 2018, the Chowchilla District Historical Society expressed an interest in leasing the Library building from the City. In January 2019, the City of Chowchilla agreed to allow the Historical Society to enter the building and initiate a survey, collecting measurements and taking photographs of the property in order to submit the building for historical preservation to the State of California, in addition to using the information collected to submit the Old Library for possible grant funds. Due to the COVID-19 Pandemic, the Historical Society was only recently able to enter beginning January, 2021.

On April 13, 2021, staff presented an agenda item to City Council to discuss the current status of the facility. City Council provided direction to staff to come back to Council at a later date and conduct a workshop in order to gather additional comment from the public.

On May 11, 2021, the City hosted a workshop as part of the regular City Council meeting to discuss the status of the former library and receive additional comment from the public. Chris Thomas and Dale Thomas of the Chowchilla Historical Society addressed the City Council in support of salvaging the building by using the CA Historical Building Code, which they stated could be used so that a majority of the repairs could be completed for $30,000 to $50,000. Additionally, they requested that the City allow the Historical Society to submit an application to the State, on behalf of the City, to have the facility be considered as a state historical landmark. It was the consensus of the City Council to bring back the item at the June 22, 2021 meeting with additional information.

On June 29, 2021, the City Council reviewed a draft application from the Chowchilla Historical Society for consideration of State historical recognition. Due to concerns regarding the structural safety of the building and potentially significant repairs needed, Council declined to submit the application to the State for review at this time.

On September 14, 2021, after receiving a quote from the Historical Society that a multitude of repairs could be completed for approximately $30,000 to $50,000. The City was not able to assess the Historical Society’s claims that repairs for the facility could be completed for approximately $50,000 as the City was not provided any detailed quotes. As a result, staff was directed to contract with an outside firm to complete a structural assessment and ascertain potential costs to repair the building. Advanced Structural Design, Inc. (ASDI) completed the structural assessment of the former library for the City.

On May 24, 2022, City Council reviewed the structural assessment of the former library from ASDI. The report noted several safety concerns related to the structure and recommended an additional in-depth structural study or construction work necessary to address only the most critical structural deficiencies according to the report. The total cost for the recommended structural repairs by a licensed contractor is $494,565. At the meeting, the Chowchilla Historical Society requested that the City Council once again allow them to submit an application to the State of California for consideration of State historical recognition. At the time, Council declined to submit the application to the State for review and directed staff to look into the effects of such a designation on the building.

On January, 10, 2023, City Council received a verbal presentation on the former library that included past history, current status according to the most recent structural assessment and California Environmental Quality Act (CEQA) protections and processes to follow if the facility receives State Historical Designation.

Additionally, the City received public comment from the Chowchilla Historical Society and members from the public requesting the City to allow submittal of an application to the State of California for consideration of State historical recognition. As a result, Council directed staff to bring a resolution back at the January 24, 2023 meeting authorizing the Historical Society to submit an application to the State for consideration and subsequently received direction to draft a MOU between the City and Historical Society in regards to terms and time limits for the Historical Society to attain designation and grant funding.

On May 9, 2023, City Council approved entering into an MOU between the City and Historical Society in regards to terms and time limits for the Historical Society to attain designation and grant funding. The MOU was executed in July 2023.

At the September 10, 2024 Council meeting, staff stated that the State has not provided any determination regarding the former library. Staff has reviewed the agendas for the State Historical Resources Commission (SHRC) and for their upcoming November 7, 2024 meeting. The former library has not been considered for nomination on any of the SHRC agendas. At the September 24, 2024 meeting, CHS representatives stated that they mailed a revised application to the SHPO for review on September 24, 2024.

At the October 8, 2024 Council meeting, staff confirmed that the SHPO received an application from CHS on September 30, 2024. Based upon their initial review, the application appeared to be the first submittal. and would require revisions. Additionally, staff noted that the CHS did not meet the deadline requirements of the MOU and that the MOU had expired.

1. May 9, 2023 – Council approved entering into an MOU with CHS.

2. July 7, 2023 – MOU executed by both parties

3. January 3, 2024 – Date to submit application to State for consideration

4. April 2, 2024 – Effective date for 90-day review by the State

5. July 1, 2024 – Effective date if the state exceeds the 90-days to make the determination.

6. CHS has one year from the date of the state historical designation to apply for and receive grant funding for the renovation of the Library.

REASON FOR RECOMMENDATION:

On October 15, 2024, city staff received an application from CHS for review and request to submit to the SHPO. Additionally, the City also received correspondence from the SHPO regarding needed corrections for the original application SHPO received from CHS on September 30, 2024. City staff contacted and met with the Historical Society president, Dale Thomas, on October 16th to review the correspondence from the State. Mr. Thomas stated that CHS had discussed changes needed with the SHPO via phone but did not know if the required changes had been incorporated into the new application. Staff requested him to provide a letter from the Historical Society stating they had reviewed the letter and revised accordingly. He took the package and said they would review, correct the application, and provide the requested verification. Council’s direction to staff at the October 8th meeting was to bring back an application that was revised per the State’s requirements in order to consider a new MOU as the previous MOU had expired.

Now that the Historical Society has provided the requested verification, we can take the application back to Council along with a request for a revised MOU.

FISCAL IMPACT:

As this is a request for direction, there is no fiscal impact.

ALTERNATIVES:

Not to provide direction.

ACTIONS FOLLOWING APPROVAL:

Execute the direction of Council.

RE: Chowchilla Library Nomination as a Point of Historical Interest Dear Mr. Thomas:

Please find enclosed the California Register of Historical Resources nomination for the abovenamed resource. It is being returned for technical insufficiency; the comments below will hopefully help guide you to a successful resubmittal of the nomination.

Program: As conveyed in our telephone call on October 1, it was difficult to determine which program you were nominating the property to, based on the supplied materials. It is strongly recommended that you revise the nomination as either a California Register of Historical Resources (California Register) or National Register of Historic Places (National Register) nomination, rather than a Point of Historical Interest (Points). It is not necessary to apply as a Point and then the California Register prior to nominating to the National Register. To this end, I have included copies of National Register Bulletins 15 and 16A, which explain how to evaluate properties using National Register criteria, and how to fill out the form; I have also included hardcopies of the checklists for submittal for both California and National Registers, since some of the information and components in Bulletin 16A (such as black & white photo prints, USGS maps, archival paper, and the use of UTMs instead of decimal degrees) is out of date and no longer required. These bulletins will also be useful if you choose to proceed with a California Register nomination, as California Register criteria are similar to National Register criteria, but with numbers instead of letters (1 instead of A, 2 instead of B, 3 instead of C, and 4 instead of D.)
Forms: If you choose to nominate the property to the National Register, please use the NPS 10-900 form. If you choose to nominate to the California Register, all nomination forms should be in a single document, or, at least, one DPR 523A document, one DPR 523B document, one photo record, and one DPR 523L continuation sheet with multiple pages (the header should appear at the top of each page as you type), including continuations where necessary from the A and B forms, and photographs. Photographs of the property should not include separate text in the photos; descriptions and numbering of each photo should be below the photo in the Word document, to facilitate Americans with Disabilities Act (ADA) accessibility and readability.

Criteria and Statement of Significance: The nomination submitted states that the property meets “the criteria”, but does not specify which criteria it meets. You must specify which criteria the property meets (1, 2, 3, 4 for California Register, A, B, C, D for National Register), including areas of significance (consult Bulletin 15 for areas of significance explanation), and then explain in the text why the property meets the requirements for the selected criteria, for each area of significance.

Strengths: The building’s property description is excellent and complete. Evaluation of the building’s historic integrity is also well written, but should be moved to the property description; the Statement of Significance should focus on support for the building’s eligibility under the appropriate criteria, as mentioned above. The photographs are also well-composed, aside from the note above about captions, but ensure that all photos meet the minimum resolution standard of 1200x1600 (or 1600x1200) pixels in size; do not shrink, expand, or edit photos.

Use the same method you used for figures, where you used captions in the Word document instead of the image; the Figures section is also well-done and can be pasted into the single Word document. The architectural renderings are not required, but are very helpful and are obviously the work of a professional. The bibliography is also in great shape, and unless you add more sources, needs no further revision.

Notification: As mentioned in our October 1 call, the nomination will have to be re-submitted to local government by registered mail if you choose to nominate the property to the California Register, followed by a 90 day wait for a response from local government. If you nominate the property to the National Register, no local government advance notification or waiting period is required; upon receipt, our office would send a copy of the nomination to the property owner, which in this case is also the local government. The final decision regarding which program you select is up to you.

If you have any questions, please feel free to call me at (916) 445-7004 or via email at [email protected].

William Burg

SUBJECT: Approval of a Resolution Awarding Contract for Emergency Services Communication Tower at Edward Ray Park and Authorizing the City Administrator or Designee to Execute Related Documents and Amending the Fiscal Year 2024/25 City Budget
PREPARED BY: Spencer Supinger, Contract City Engineer
APPROVED BY: Jason Rogers, Director of Public Works
ATTACHMENTS: Resolution

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Staff recommends that the City Council Adopt a resolution of the City Council of the City of Chowchilla awarding contract for the Emergency Services Communication Tower at Edward Ray Park in the amount of $185,760.00 and authorizing the City Administrator or designee to execute related documents on behalf of the City and amend the City of Chowchilla Fiscal Year (FY) 2024/25 Budget.

BACKGROUND:

In November 2024, the City Council provided direction to staff to move forward with the process to construct an emergency services communication tower at Edward Ray Park. City Council requested that a 100 ft monopole able to accommodate the city’s emergency services communication needs and up to two potential cell phone service carriers.

REASON FOR RECOMMENDATION:

The City opened bids for the Emergency Services Communication Tower at Edward Ray Park Project on January 28, 2025. The City received three (3) bids for the project as follows:

Contractor Base Bid
Howell Communications Inc. $185,760.00
Tashjian Towers Co. $218,827.00
LD Strobel Co., Inc. $293,375.00
Staff has reviewed the bid submitted by Howell Communications, Inc, along with information regarding their previous work experience. Based on review, Staff has determined the bid submitted is responsive and Howell Communications, Inc to be a responsible contractor. Staff recommends City Council award the contract, for the Emergency Services Communication Tower at Edward Ray Park Project, to Howell Communications, Inc.

FISCAL IMPACT:

The construction costs and available funding for the Project were not included in the Fiscal Year 2024/25 Budget and Capital Improvement Plan (CIP). As a result, the project requires the budgets be amended in order to fully fund the projects. As such, staff is requesting Council amend the budget and CIP as follows.

Amount
Construction Costs
Emergency Services Communication Tower $185,760.00
CM/Inspection $20,000.00
Contingency $18,000.00
Total Construction $223,760.00

THE AGENDA
Meeting of: March 11, 2025
AGENDA SECTION: New Business
SUBJECT: Adopt a Resolution Accepting and Entering into a New Freeway Agreement for the State Route 99/233 Chowchilla Multimodal Interchange Project that Replaces the Previous Agreement Between the County of Madera and the State of California Department of Transportation
APPROVED BY: Jason Rogers, Public Works Director
ATTACHMENTS: Resolution

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Staff recommends that the City Council adopt a resolution approving the new Freeway Agreement for the State Route 99/233 Project, and authorize the City Administrator, or designee, to sign the same.

BACKGROUND:

The State of California Department of Transportation (Caltrans) District 6, with the cooperation of the City of Madera (City) and the Madera County Transportation Commission (MCTC), proposes to reconstruct the existing State Route (SR) 99/233 Interchange. This project will provide multimodal transportation improvements to enhance accessibility and connectivity of the local transportation network. The Project will widen SR 233 and construct a new parallel overcrossing at SR 99 to carry eastbound traffic and a 10- foot Class I shared path. The Project will construct two multi-lane roundabouts at the northbound and southbound on-ramp and off-ramp termini. Sidewalks, crosswalks, and lighting will also be built. The Project components work together to enhance safety, accessibility, and connectivity to local businesses and services by removing barriers to east-west pedestrian and bicycle movements and improving local circulation.

REASON FOR RECOMMENDATION:

The State of California Department of Transportation (Caltrans) is in the design phase of the SR 99/233 Chowchilla Multimodal Interchange Project (Project) to make improvements along SR 99 and SR 233 interchange, and other streets within the City limits. Caltrans and the County of Madera previously entered into a Freeway Agreement on July 10, 1979, relating to that portion of State Highway 99 currently within City limits from 0.3 south of Avenue 24/Robertson Blvd to 0.3 north of State Highway Route 233.

Caltrans is proposing a new Freeway Agreement, to replace the existing agreement signed on July 10, 1979, in order to carry out highway and road improvements as part of the Project. The new Freeway Agreement would require the closing of City streets, relocation of City streets, construction of frontage and local roads, and other construction affecting City streets.

Once improvements are completed, the City will accept control and maintenance over each of the relocated or reconstructed City streets, any frontage roads, and other local streets constructed as part of the project. .

FISCAL IMPACT:

No fiscal impact at this time. Separate cooperate agreement(s) between Caltrans and the City for funding of the construction project will be created at a future date.

ALTERNATIVES:

Not adopt resolution. In this case, the project will not be able to move forward.

ACTIONS FOLLOWING APPROVAL:

1. City Administrator will sign the agreement with Caltrans.

THE AGENDA
Meeting of: March 11, 2025
AGENDA SECTION: New Business
SUBJECT: Presentation of the City’s Mid-Year Budget for FY 24/25 PREPARED BY: Kerri Williams- Finance Director
ATTACHMENTS: Presentation, Budget Adjustment Spreadsheet

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Presentation only.

BACKGROUND:

In June 2024, Council approved the fiscal year 2024/2025 Operational and Capital Outlay Budget. A budget is an estimate of expenditures and revenues for the upcoming year and is monitored throughout the year for unforeseen activities. Annually, a mid-year review of the budget is performed to identify modifications that need to be made to the budget to reflect year-to-date activity and resulting year-end projections.

The mid-year review for the fiscal year 2024/2025 budget was performed through January 2025. This provides the most up to date and accurate information regarding actual revenue and expenses the City has incurred, which allows for the most accurate year-end projections.

REASON FOR RECOMMENDATION:

It is necessary to analyze where the City is at with the current year budget and any potential changes that will be needed for the rest of the year. Even if there are no budget amendments proposed, it is vital to have an update on the City’s financial position half way through the fiscal year. This information is relied upon for forecasting the next year’s budget.

FISCAL IMPACT:

All funds are evaluated in the mid-year review. Significant funds (General Fund & Enterprise Funds) are gone over in detail in the Power Point presentation. Any other significant items will be included in the presentation as well.
