SUBJECT: Amendment to the City of Chowchilla Salary Scale for Fiscal Year 2025- 2026
PREPARED BY: Kerri Williams, Finance Director
ATTACHMENTS: Resolution, Salary Scale
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
Adopt a resolution amending the City of Chowchilla Salary Scale for Fiscal Year 2025-2026 to reflect accurate step increases and to ensure consistency across all positions based off of the approved labor agreements.
BACKGROUND:
During a recent review of all approved labor agreements and salary schedules, staff identified discrepancies between the salary scale attached to the Police Officers Association (POA) MOU and the salary scale adopted by City Council. While the Council-adopted salary scale correctly implemented 5% step increases in accordance with the negotiated terms, the version attached to the POA MOU did not reflect consistent 5% calculations between steps.
Additionally, three employee positions that are not part of the POA bargaining unit—but are subject to the “me too” clause—were brought separately to Council as separate negotiations, and were erroneously missed in the final salary scale. These positions have now been reviewed and corrected.
As part of a thorough audit, staff reviewed the salary scale for all bargaining units and employee groups to ensure consistency, accuracy, and full compliance with approved MOUs. This review was not limited to any one bargaining group, rather it included all classifications and positions to ensure full compliance and accuracy moving forward.
REASON FOR RECOMMENDATION:
The amended salary scale now reflects the correct implementation of all negotiated provisions, including proper 5% step increases and placement for all classifications both represented and unrepresented. This action ensures transparency, accuracy, and alignment with previously approved agreements.
FISCAL IMPACT:
There is no immediate fiscal impact from this action. As noted during the budget presentation, all salary related adjustments will be incorporated during the mid-year budget process. This amendment ensures the salary scale reflects accurate and approved compensation levels ahead of those planned adjustments.
ALTERNATIVES:
The City Council may choose not to adopt the revised salary scale. However, this would result in the continued use of a salary schedule that does not fully reflect the negotiated terms in the MOUs or accurate step placement for certain positions. This alternative may lead to discrepancies in compensation and potential labor relations issues.
ACTIONS FOLLOWING APPROVAL:
Updated salary scale will be formally published.

Meeting of: July 8, 2025
AGENDA SECTION: Public Hearing
SUBJECT: Presentation and First Reading of an Ordinance Amending Section 2.04.110 of the Chowchilla Municipal Code to Authorize the Mayor to Temporarily Receive Additional Compensation
PREPARED BY: City Attorney
ATTACHMENTS: Ordinance
REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
That City Council receive staff presentation of the proposed Ordinance and its findings and set the Ordinance for adoption at the next regular meeting.
BACKGROUND:
The current salary for the Mayor is Three Hundred Dollars ($300) per month but will increase to Nine Hundred Fifty Dollars per month ($950) as approved by the City Council on April 22, 2025, and effective after the next municipal election.
California Government Code section 36516.1 authorizes the Mayor to receive compensation in addition to that which the Mayor receives as a Councilmember.
State law generally prohibits Councilmember salary increases from taking effect during the current Councilmember’s term of office. (Gov. Code, § 36516.5.) However, the California Attorney General has opinioned that the additional compensation authorized for the mayor of a general law city may be increased during his or her term of office as mayor because additional compensation for performing mayoral duties is not received as “a councilperson.” (89 Ops.Cal.Atty.Gen. 159 (2006).) The City Council has expressed its desire to authorize the Mayor to receive the Nine Hundred Fifty Dollar ($950) councilmember salary immediately as additional mayoral compensation rather than waiting until the next municipal election, effective May 22, 2025.
FISCAL IMPACT:
The proposed increase represents an additional annual cost of $7,800.00 from the General Fund. 1 ORDINANCE # xxx-25
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHOWCHILLA AMENDING SECTION 2.04.110 OF THE CHOWCHILLA MUNICIPAL CODE
WHEREAS, the current salary for City of Chowchilla (“City”) Mayor is Three Hundred Dollars ($300) per month;
WHEREAS, on April 22, 2025, the City Council increased councilmember compensation, including the Mayor, to Nine Hundred Fifty Dollars ($950) per month; WHEREAS, pursuant to Government Code section 36516.5, the Nine Hundred Fifty Dollar ($950) councilmember salary will not become effective until after the next municipal election; WHEREAS, pursuant to Government Code section 36516.1, the City Council may pass a resolution to authorize the Mayor to receive compensation, in addition to that which the Mayor receives as a councilmember;
WHEREAS, the California Attorney General has opinioned that the additional compensation authorized for a mayor of a general law city may be increased during his or her term of office as mayor because additional compensation for performing mayoral duties is not received as “a councilperson.” (89 Ops.Cal.Atty.Gen. 159 (2006)); WHEREAS, the City Council desires to authorize the Mayor to receive the Nine Hundred Fifty Dollar ($950) councilmember salary immediately as additional mayoral compensation rather than waiting until the next municipal election, effective May 22, 2025, which was the date Ordinance 525-25 became effective; and
WHEREAS, the City Council finds that this increase is necessary and appropriate to ensure fair compensation for the additional services provided by the Mayor to the community.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHOWCHILLA DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 2.04.110 (“Council salaries–Established”) of Chapter 2.04 (“City Council”) of Title 2 (“Administration and Personnel”) of the City Municipal Code is hereby amended to read as follows:
“2.04.110 - Council salaries—Established.
Each member of the city council shall receive a salary in the amount of nine hundred fifty dollars ($950) per month as prescribed in section 36516 of the California Government Code for cities up to and including thirty-five thousand (35,000) in population. Following any amendments to the Government Code that permits an increase or requires a decrease in the salary to councilmembers, this section shall be amended to reflect the maximum amount of compensation permitted under California law. Provided, however, that the salary as so increased shall become effective as to all members only on and after the date upon which one or more members of the council become eligible therefore by virtue of beginning a new term of office following the next succeeding general municipal election held in the city.
2 The Mayor shall receive additional compensation of six hundred fifty dollars ($650) per month from May 22, 2025, until after the 2026 municipal election.” SECTION 2. SEVERABILITY. If any part of this Ordinance is held invalid for any reason by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portion of this Ordinance, and the City Council hereby declares that it would have passed the remainder of the Ordinance if such invalid portion thereof had been deleted.
SECTION 3. EFFECTIVE DATE. This Ordinance shall take effect and be in force thirty (30) days from and after its final passage.
SECTION 4. PUBLICATION. The City Clerk is hereby directed to post a summary and certified copy of this Ordinance in the City Clerk’s office at least five (5) days prior to adoption and to publish a summary of the Ordinance in the Madera Tribune, a newspaper of general circulation, within fifteen (15) days after its adoption.

The Regional Streets and Highways program consists of two elements:
1. One is the responsibility of MCTA to manage and deliver projects of regional significance. MCTA may elect to agree with the local agency to perform the engineering and construction activities of this element.

ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:
That Council waive the second reading and adopt an ordinance adding Section 9.29 – Abandoned Shopping Carts to the Chowchilla Municipal Code.
BACKGROUND:
Allowing abandoned shopping carts to collect around the City creates a potential hazard to the health and safety of the public, and interfere with pedestrian and vehicular traffic and create a public nuisance. REASON FOR RECOMMENDATION:
This ordinance is intended to ensure that measures are taken by the owners of the shopping carts to prevent the removal of the shopping carts from the cart owner’s business premises, to make removal of the cart a violation of Code, and to facilitate the retrieval of abandoned shopping carts in a manner consistent with State law and to use an administrative citation program to establish appropriate fined intended to act a reasonable deterrent in preventing violations.
FISCAL IMPACT:
If approved the ordinance will help to reimburse the City of Chowchilla for any cost incurred for removal of shopping carts in the City.
ALTERNATIVES:
Do not approve and the City will incur the cost of removal of the abandoned carts.
ACTIONS FOLLOWING APPROVAL:
Send ordinance to Civic Plus for codification. Ordinance will take effect after 30 days.

Chapter 9.29 ABANONED SHOPPING CARTS
9.29.10 Findings and purpose.
Abandoned shopping carts on public and private property create conditions that reduce property values, promote blight and deterioration, and result in a public nuisance.
