COUNCIL AND STAFF VERBAL REPORTS – Section 2

2.1 COUNCIL VERBAL REPORTS
Mayor Pro Tem Troost reported, “I met with the Mayor and Congresswoman Soria to discuss the Caltrans projects here in the city. I also attended the Veterans Day ceremony in the park, which was very well attended and a really nice event.”
Council Member Ahmed reported, “I attended the State of the County event in Madera County, the MCTC meeting and the ADHOC meeting.”
Mayor Smith reported, “I went to the third Cowboy Christmas event. I wasn’t able to make it on Saturday to the Veterans Day Memorial, but I heard it was very well attended.”

2.2 STAFF VERBAL REPORTS
City Council Meeting MINUTES November 25, 2025
Lt. Denny reported, since we last met, we responded to 1,522 incidents, with 720 officer-initiated activities, two arrests, and several citations issued. We have two academy graduates who will be graduating this Friday.

Fire Chief Gaumnitz, A quick public service announcement: it has been very foggy lately, and automatic vehicle lights do not work well in heavy fog. Please manually turn on your headlights.

This greatly improves visibility for our officers and for other drivers. Our volunteers will be out on December 13th for the Toys for Kids event at Starbucks. Toys and monetary donations will be accepted on behalf of Pastor Walker. I’d like to briefly share the history of this program: Ten years ago, the Police Department, Gospel, and Starbucks began a partnership to collect toys for families in need here in Chowchilla. Each year we added more partners and expanded donations throughout the local area. During the COVID pandemic, we adapted and held drivethrough pickups so families could still receive toys safely. Every toy collected stays within our local community. I’m grateful for the opportunity to continue this tradition with so many partners who help make it possible each year. I’m handing out two flyers:

Toy sign-ups: Saturday, December 6th and December 13th, from 11 AM–2 PM at the church Toy & Coat Drive: Saturday, December 13th, from 10 AM–3 PM at Starbucks Thank you, Council, for your continued support.

Deputy Director Roman reported, our team has been very busy catching up this week. We’ve been completing the Christmas tree assembly at Veterans Park, and we are prepping for next week’s Christmas Parade. We look forward to working with PD on traffic control and supporting the entire Chowchilla team. We are continuing the compost giveaway—compost is still available on Colusa Avenue. If you know anyone who signed up and hasn’t picked up their compost yet, please remind them. We also met with Caltrans district staff regarding project updates and areas where we can assist one another. We are currently working on the Avenue 24½ and 25 improvement projects, which is underway. If you’ve been out there recently, they are paving the intersection at Road 15½ and will begin paving the remaining roadway next. Additionally, we held the pre-construction meeting for the Pedestrian Improvement Project at Kings and Riverside. The tentative start date is December 15, weather permitting. This project will install new sidewalk improvements in that area.

Community & Economic Development Director Munoz reported, last week, Junior’s Auto held their grand opening and ribbon-cutting ceremony, which was a very nice event. Healthcare Inc., doing business as Main Pharmacies, is opening at 413 W. Robertson Blvd. Mark 4 Metal Products is opening at Fort Kings, where they will operate a warehouse and distribution center for galvanized steel.

Finance Director Seeto reported, Last week we completed negotiations with our credit-card processing company for utility payments. We are expecting to save approximately $25,000 to $30,000 per month moving forward. That’s all I have.

Recreation and Community Engagement Director Wisener reported, we are working on Christmas decorations, year-end items, employee appreciation items, and preparations for next Saturday’s Christmas event. We are finalizing plans for the Christmas tree and the lighting ceremony. This year’s parade float theme is “Red, White, and Blue Christmas Crew.” The event will include: Face painting, a bounce house, balloon twister, train ride, Hot chocolate and coffee, Christmas carolers, craft stations, snow play area, a giant snow globe for photos and of course Santa Claus. We are currently seeking donations from businesses to help cover the cost of the City Council Meeting MINUTES November 25, 2025
train so we can offer it for free to the community. We also encourage everyone to register early for the parade so community voting is easier. I’d like to wish the Council a very Happy Thanksgiving, and I hope you enjoy time with your families.

City Administrator Pruett reported, we continue to work on the CD with the refunding team, and the latest update is that we’ve brought MBS on for the outreach portion. We’re planning to meet next week to develop a new outreach plan. It will be a bit different from the last round preliminarily, we’re looking at creating a video, which we didn’t do before, that can be posted on the City’s website. We will still continue with the outreach methods we used previously for the residents in the district who will be voting, but we’re trying to expand that effort this time around.

I also met with the Rancho Calera engineer and QK to review the proposed restriping at the Robertson intersection and to determine whether it would adequately address traffic for the first four blocks they are planning to build, construction that would go past the current trigger point in the Development Agreement. We advised them that they will need to provide a new traffic study to support that claim, and then our engineers will evaluate it. Right now, we’re in a bit of a holding pattern. However, I did ask them to let Rancho Calera know that I still believe the intersection improvements need to move forward regardless. Our current issues at that location aren’t going away, and improvements are necessary. I’m waiting to hear back from them on that. This was part of the same series of meetings we held with Caltrans. I also met with MCTA regarding the Measure T implementation guidelines, which we brought to the County.

THE AGENDA
Meeting of: December 9, 2025
AGENDA SECTION: Public Hearing
SUBJECT: A City Council Resolution Accepting the Annual Report on Development Impact Fees for Fiscal Year 2024/25 and Making Certain Findings Related Thereto (AB1600)
PREPARED BY: Daniel Seeto, Finance Director
ATTACHMENTS: Resolution, Annual Development Impact Fee Report

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

Staff recommends the City Council approve resolution accepting Annual Report of Development Impact Fees.

BACKGROUND:

State of California Assembly Bill 1600 (AB 1600) – the Mitigation Fee Act (Gov. Code, Sections 66000 et seq.) sets forth the standards against which monetary exactions on development projects are measured.

The City Council has adopted and updated various development impact fees applicable to new development within the City. The purpose of development impact fees is to finance the design, construction and acquisition of facilities and equipment necessary to accommodate future development within the City.

Development impact fees that are collected are segregated and placed in special funds or accounts, which earn interest. Those funds are held for the facilities for which the fees are collected, in accordance with Government Code Section 66006.

As of June 30, 2025, the City had 11 separate and distinct fees that are collected, pursuant to AB 1600. Please refer to the attached Annual Development Impact Fee Report for summary and detail information.

REASON FOR RECOMMENDATION:

Required per Assembly Bill 1600 and the Mitigation Fee Act.

FISCAL IMPACT:

Tracking of the fund activities, summarizing the activity for this report and preparation of the report requires resources of the Finance Department. No funds were expended on outside sources to comply with this unfunded State mandate. This is a required reporting and compliance report per the California Government Code. Failure to report on activity and account balances per the applicable regulations could allow a successful challenge to the collection of the related fees in the future or repayment of previously collected fees.

ALTERNATIVES:

Failure to approve could leave City at risk of non-compliance to AB1600 requirements and could result in the reimbursement of funds unspent after 5 years.

ACTIONS FOLLOWING APPROVAL:

Will post on the City’s website as it is a state requirement.

Legal Requirements
State law (California Government Code Section 66006) requires each local agency that imposes AB 1600 development impact fees to prepare an annual report providing specific information about those fees. Within the AB 1600 legal requirements, it stipulates that fees imposed on new development have the proper nexus to any project on which they are imposed. In addition, AB 1600 imposes certain accounting and reporting requirements with respect to the fees collected. The fees, for accounting purposes, must be segregated from the general funds of the City and from other funds or accounts containing fees collected for other improvements. Interest on each development fee fund or account must be credited to that fund or account and used only for the purposes for which the fees were collected.

Current California Government Code Section 66006 (b) requires that for each separate fund the local agency shall, within 180 days after the last day of each fiscal year, make available to the public the information shown below for the most recent fiscal year. • A brief description of the type of fee in the account or fund. • The amount of the fee. • The beginning and ending balance of the account or fund. • The amount of the fees collected and interest earned. • Identify each public improvement on which fees were expended and the amount of expenditures on each improvement, including the total percentage of the cost of the public improvement that was funded with fees. • An identification of an approximate date by which the construction of the public improvement will commence if the local agency determines that sufficient funds have been collected to complete financing on an incomplete public improvement. • A description of each interfund transfer or loan made from the account or fund, including the public improvement on which the transferred or loaned fees will be expended, and, in the case of an interfund loan, the date on which the loan will be repaid and the rate of interest that the account or fund will receive on the loan. • The amount of refunds made due to sufficient funds being collected to complete financing on incomplete public improvements, and the amount of reallocation of funds made due to administrative costs of refunding unexpended revenues exceeding the amount to be refunded.

California Government Code Section 66001 (d) requires the local agency make all of the following findings every fifth year with respect to that portion of the account remaining unexpended, whether committed or uncommitted • Identify the purpose of the fee.
• Demonstrate a reasonable relationship between the fee and purpose for which it is charged.• Identify all sources and amounts of funding anticipated to complete financing in incomplete improvements.• Designate the approximate dates on which the funding is expected to be deposited into the appropriate account or fund.
• In any action imposing a fee as a condition of approval of a development project by a local agency, the local agency shall determine how there is a reasonable relationship between the amount of the fee and the cost of the public facility or portion of the public facility attributable to the development on which the fee is imposed.

Notes:

The City of Chowchilla realized new development within the City limits in the 21/22 FY. Although this is a positive move forward, the City continues to see moderate growth across all sectors. While the City experienced above average growth in the residential sector in Fiscal Year 21/22, current trends show the residential sector slowing to below average growth in Fiscal Year 22/23.

Notes to Development Impact Fee Report
Unspent fund balance indicates lack of growth as originally projected. Funds should remain in fund to support the anticipated future growth.

Unspent fund balance indicates lack of growth as originally projected. Funds should remain in fund to support the anticipated future growth.

Public or General Facilities were developed with Bond Funds in support of future growth which was suppressed due to the recession.

The negative balance is derived from the expansion of City Hall in which costs exceeded the amount of bond proceeds thereby generating a loan from the General Fund. Due to the lack of growth there has been insufficient fees collected to meet the loan repayment at this time. As future fees are collected the loan will be repaid. Future fees collected can then be used to pay for bond debt service new facilities.
