Mayor Pro Tem Barragan reported attending Economic Development Ad Hoc meeting.

Council Member Ahmed reported attending California Association of Local Agency Formation Commissions (CALAFCO) business meeting and The Chowchilla Athletic Foundation (CAF) Dinner.

Council Member Chavez reported attending The Chowchilla Athletic Foundation (CAF) Dinner.

Mayor Smith reported attending the CAF Dinner.

Additionally, Chowchilla Rotary will be purchasing 100 bus passes to be distributed through the Senior Citizen Center to assist seniors with transportation access.

2.2 STAFF VERBAL REPORTS
Fire Chief Gaumnitz reported that preparations are underway for the fair. Landscaping improvements are being completed to ensure the grounds are presentable prior to the event. He noted significant growth within the department this year. The Chief also reported that the Local Hazard Mitigation Planning Committee concluded its year-and-a-half planning process. A public hearing was held last Wednesday, followed by the final committee meeting last Thursday.

Completion of the plan allows the city to apply for mitigation grant funding opportunities. The plan will be brought back to the Council for approval in the coming months.

Deputy Director Joe Roman reported that during last week’s storm event, staff responded to drainage issues, clearing debris from storm drains and inlets to ensure proper water flow. Several trees were down in parks and throughout the city; staff worked throughout the week to remove debris and address damaged trees. He met with MCTC regarding continued discussions on the Highway 233 interchange project and related funding. Monthly water shutoffs were also conducted. Staff met with QK Engineering regarding Well 15 and flooding issues caused by excessive rainfall. It was determined that grading issues near the AutoZone/Mid Valley development site contributed to water damming. The City is coordinating with the adjacent property developers, who have agreed to assist with regrading and creating proper swales to improve drainage around the storage tank property. Preparations are underway for the Chowchilla Stampede next week, including weed abatement and cleanup along Robertson Boulevard to ensure the corridor is presentable. Parks are experiencing increased activity due to spring sports, and staff continue mowing and field preparations for softball, Little League, and JV baseball. The Director expressed appreciation for staff support and introduced Dustin, who has returned to serve as Public Works Director.

Public Works Director Ensminger introduced himself. He reported that he is currently focused on onboarding and reacclimating to operations. He expressed appreciation for the opportunity to serve the Council and community.

Community & Economic Development Director Munoz reported that A&M Mercantile is anticipated to open in April at 14905 East Robertson Boulevard. Staff continue processing permits and supporting ongoing residential and commercial development projects. Meetings were held with developers, property owners, brokers, and existing business owners to discuss expansion opportunities within the City.

City Council Meeting MINUTES February 24, 2026
Finance Director Seeto reported that auditors are currently onsite conducting fieldwork. At this time, no issues have been identified. Fieldwork is expected to conclude this week, with financial statements anticipated by early next week.

Director of Recreation & Community Engagement Wisener reported coordination of project information in preparation for implementation of a new formal project tracking system. All bands have been secured for the upcoming concert series; contract coordination is underway. Continued election outreach efforts. The ribbon-cutting ceremony for the concession stand has been rescheduled to March 4 due to the recent storm. The mural at Cornerstone, originally painted in 2012, has been refreshed in preparation for the ribbon cutting. Ongoing coordination of Easter event logistics, vendor and sponsorship coordination, sports field scheduling, camera coverage planning at City Hall, IT and facilities coordination, website updates, and updates to the economic development brochure for International Council of Shopping Centers (ICSC) preparation.

Technology upgrades are nearly complete, including Microsoft 365 deployment, backup system licensing, and storage efficiency improvements with development of a long-term archival strategy.

Upcoming events:
• February 26 – Edward Ray Day
• March 6 – Stampede Cattle Drive at 10:00 a.m. on Robertson Boulevard • March 7 – Rotary Crab Feed
• March 21 – Easter Event
• March 28 – Fair Kickoff Dinner
City Administrator Pruett reported attending the League of California Cities City Managers Conference last week. Today is the final day for CFD ballot submissions. As of yesterday, 18 ballots had been received, with an additional six received today, totaling 24. This is an increase from the previous effort, which yielded seven ballots. A two-thirds threshold is required. The ballots will be opened tomorrow after signatures are verified by the City Clerk. The city submitted a federal BUILD grant application today for the roundabout project. Updated cost estimates from Caltrans revealed a larger funding deficit than originally anticipated; therefore, the city requested additional funding. While the grant is competitive, the city is proceeding with the application. The City Manager noted that the Public Works Director began earlier than originally scheduled and expressed appreciation for his early start. An Economic Development Ad Hoc Committee meeting was held prior to the Council meeting. Additionally, staff met with Muni Services to review the quarterly sales tax report. Revenues were slightly below projections, partially due to the departure of Pacific. Staff will monitor future revenue trends as new businesses, including the auto center, become operational.

Meeting of: Tuesday, March 10, 2026
AGENDA SECTION: New Business
SUBJECT: RESOLUTION DECLARING RESULTS OF SPECIAL ELECTION AND DIRECTING RECORDING OF NOTICE OF SPECIAL TAX LIEN – CITY OF CHOWCHILLA COMMUNITY FACILITIES DISTRICT NO. 2025-2
(REPLACEMENT OF CFD 2006-1)
PREPARED BY: Rod Pruett, City Administrator
ATTACHMENTS: Resolution Declaring Results of Election

REVIEWED BY
ADMINISTRATOR ☒ REVIEWED BYATTORNEY ☒ REVIEWED BY FINANCE ☒ RECOMMENDATION:

That the City Council adopt the Resolution Declaring Results of the Special Election referenced above (the “Resolution”) which Resolution approves the “Canvass and Statement of Results of Election” prepared and filed by the City Clerk and attached as Exhibit A to the Resolution.

BACKGROUND:

On February 24, 2026, the City Council held a special election within CFD No. 2025-2. The issues presented to the qualified electors at the special election were the incurring of a bonded indebtedness in the maximum aggregate principal amount of $6,500,000, the levy of a special tax within CFD No. 2025-2 in accordance with the rate and method of apportionment of special taxes heretofore approved by this City Council by its Resolution No. #87-25 adopted October 28, 2025 (the “Resolution of Formation”), and the approval of an appropriations limit for CFD No. 2025-2.

Pursuant to the “Canvass and Statement of Results of Election” on file with the City Clerk, the issues presented at the special election were approved by in excess of two-thirds of the qualified electors of CFD No. 2025-2 that submitted ballots in the election.

Pursuant to said voter approval, the Resolution declares CFD No. 2025-2 to be fully formed with the authority to incur bonded indebtedness and to levy special taxes.

REASON FOR RECOMMENDATION:

Certification of the election results is a necessary step in the formation and authorization of CFD No. 2025- 2, in order to replace the existing CFD No. 2006-1, issue bonds to refinance the prior bonds issued in 2007, levy the special tax, and continue to provide funding of municipal services that were originally authorized to be funded by CFD No. 2006-1.

FISCAL IMPACT:

None
ACTIONS FOLLOWING APPROVAL:

In an agenda item following this item, the Council will conduct a first reading of the Special Tax Ordinance, which will later be adopted at a future meeting of the City Council, on April 14, 2026.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chowchilla does hereby ordain as follows:

SECTION 1. By the passage of this Ordinance this City Council hereby authorizes and levies special taxes within CFD No. 2025-2 pursuant to the Law, at the rate and in accordance with the rate and method of apportionment of special taxes for CFD No. 2025-2 approved by, and attached as Exhibit B to, the Resolution of Intention (the “Rate and Method”) which Resolution is by this reference incorporated herein. The special taxes are hereby levied commencing in Fiscal Year 2026-2027 and in each fiscal year thereafter until payment in full of any bonds issued by the City for CFD No. 2025-2 (the “Bonds”) as contemplated by the Resolution of Formation and the Resolution of Necessity, payment in full all costs of administering CFD No. 2025-2, and so long as necessary to pay for the Services.

SECTION 2. The City Finance Director is hereby authorized and directed each fiscal year to determine the specific special tax rate and amount to be levied for each parcel of real property within CFD No. 2025-2, in the manner and as provided in the Rate and Method.

SECTION 3. Properties or entities of the State, federal or local governments shall be exempt from any levy of the special taxes, to the extent set forth in the Rate and Method attached as Exhibit B to the Resolution of Intention. In no event shall the special taxes be levied on any parcel within CFD No. 2025-2 in excess of the maximum tax specified in the Rate and Method.

SECTION 4. All of the collections of the special tax shall be used as provided for in the Law and in the Resolution of Formation including the payment of principal and interest on the Bonds, the replenishment of the reserves for the Bonds, the payment of the costs to provide the Services, the costs of the City of Chowchilla in administering CFD No. 2025-2, and the costs of collecting and administering the special tax.

SECTION 5. Pursuant to Section 53340 of the Government Code, the special taxes shall be collected on the secured real property tax roll in the same manner as ordinary ad valorem taxes are collected. The special taxes shall have the same lien priority, and be subject to the same penalties and the same procedure and sale in cases of delinquency as provided for ad valorem taxes. In addition, the provisions of Section 53356.1 of the California Government Code shall apply to delinquent special tax payments. The Finance Director is hereby authorized and directed to provide all necessary information to the auditor/tax collector of the County of Madera and to otherwise take all actions necessary in order to effect proper billing and collection of the special tax, so that the special tax shall be levied and collected in sufficient amounts and at the times necessary to satisfy the financial obligations of CFD No. 2025-2 in each fiscal year until the Bonds are paid in full and so long as necessary to pay for the Services, and provision has been made for payment of all of the administrative costs of CFD No. 2025-2.

Notwithstanding the foregoing, the Finance Director may collect one or more installments of the special taxes on any one or more parcels in CFD No. 2025-2 by means of direct billing by the City of the property owners within CFD No. 2025-2, if any of the Bonds bear interest at a variable interest rate, or otherwise if, in the judgment of the Finance Director, such means of collection will reduce the administrative burden on the City in administering CFD No. 2025-2 or is otherwise appropriate in the circumstances. In such event, the special taxes shall become delinquent if not paid when due as set forth in any such respective billing to the applicable property owners.

SECTION 6. Claims for refund of the special tax shall comply with the following and any additional procedures as established by the City Council:
-3-
a. All claims shall be filed, in writing, with the City Clerk no later than one year after the date the tax became payable. The claimant shall file the claim within this time period and the claim shall be finally acted upon by the City Council as a prerequisite to bringing suit thereon.
b. Pursuant to Government Code section 935(b), the claim shall be subject to the provisions of Government Code sections 945.6 and 946.
c. The City Council shall act on a timely claim within the time period required by Government Code section 912.4.
d. The procedure described in this Ordinance, and any additional procedures established by the City Council, shall be the exclusive claims procedure for claimants seeking a refund of the tax. The decision of the City Council shall be final.

SECTION 7. This Ordinance is not intended to and shall not be construed or given effect in a manner that imposes upon the City or any officer or employee thereof a mandatory duty of care towards persons and property within or without the City, so as to provide a basis of civil liability for damages, except as otherwise imposed by law.

SECTION 8. If for any reason any portion of this Ordinance is found to be invalid, or if the special tax is found inapplicable to any particular parcel within CFD No. 2025-2, by a court of competent jurisdiction, the balance of this Ordinance, and the application of the special tax to the remaining parcels within CFD No. 2025-2 shall not be affected.

SECTION 9. This ordinance shall take effect and be in force thirty (30) days from and after its final passage.

SECTION 10. With fifteen (15) days after passage, the City Clerk shall cause this ordinance to be published in a newspaper of general circulation.
