RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AUTHORIZING A DEED RESTR ICTION FOR
THE EUCALYPTUS PARK PROPERTY THAT IS REQUIRED
AS A CONDITION OF THE GRANT AWARD FOR THE
STATEWIDE PARK DEVELOPMENT AND COMMUNITY
REVITALIZATION PROGRAM FROM TH E STATE OF
CALIFORNIA DEPARTMENT OF PARKS AND
RECREATION OFFICE OF LOCAL GRANTS AND SERVICES
WHEREAS, the City of Chula Vist a (City) is the recorded owner of the real property described in Exhibit B, attached and incorporated herein by reference (the “Property”); and
WHEREAS, the Calif ornia Department of Parks and Recreation ( “DPR”) is a public agency created and existing under the a uthority of sect ion 5001 of the Cal ifornia Public Resources Code ( “PRC”); and
WHEREAS, the City applied to DPR for grant funds available pursuant to the California Drought, Water, Parks , Climate, Coastal Protection, and Outdoor Access For All of 2018 Parks Bond Act, Statewid e Park Development and Community Re vitalization Pro gram to improve Eucalyptus Park in the City of Chula Vista including the construction of an artific ial turf multipurpose field with lights, interactive water feature, skate/scooter plaza, bi ke skills and jump area, walking path wi th fitness equipment, and pickleball courts with lig hts, and renovation of the recreation building, playground, dog park, parking lo t, lighting, and fencing around the park on the Property; and
WHEREAS, on July 1, 2021, DPR ’s Office of Grants and Local Services conditionally approved Grant SW -37-015 ( “Grant”) to improve Eucalyptus Park in the City of Chula Vista including the construction of an artific ial turf multipurpose field with lights, interactive water feature, skate/scooter plaza, bi ke skills and jump area, walking path wi th fitness equipment, and pickleball courts with lights, and renovation of the recreation building, play ground, dog park, parking lo t, lighting , and fencing around the park on the Property , subject to, among other conditions, recordation of a Deed Restriction on the Property; and
WHEREAS, but for the i mposition of the Dee d Restriction condition of the Grant, the Grant would not be consistent with the public purposes of the 2018 Parks Bond Act, Statew ide Park Development and Community R evitalization Program and the funds that are su bject of the Grant could therefore not have been allocated; and
WHEREAS, the C ity elected to comply with the Deed Restriction of the Grant so as to enable the City to receive the Grant funds and perform the work described in the Grant; and
WHEREAS, the Deed Restriction shall remain in full force a nd effect and shall bind the City of Chula Vista for the period running from July 1, 2020 through June 30, 2050.

NOW, THEREFO RE, BE IT RESOLVE D that the City C ouncil of the C ity of Chula Vista that, in consideration of the issuance of the Grant funds by DPR, it authorizes the execution of a Deed Restriction to the title of the property for Eucalyptus Park in the manner and form as attached hereto and by reference mad e a part hereof, subject to such minor modifications as may be required or approved by the City Attorney, , and authorizes the City Manager or desig nee to execute the Deed Restriction.
