DISCUSSION
P a g e | 2
In 2002, the City of Chula Vista (City) and the San Diego Unified Port District (Port) began a collaborative planning process to create a master plan for the approximately 535 -acre Chula Vista Bayfront area. The master plan was designed to transform Chula Vista’s underutilized industrial Bayfront landscape into a thriving residential and world -class waterfront resort destination. The result of that effort was The Chula Vista Bayfront Master Plan (the “ Bayfront Master Plan”) which represents an essential planning document for the last significant waterfront development opportunity in Southern California and is the result of a decades-long joint planning effort by a broad coalition of stakeholders, the Port, the City, and Pacifica Companies.
On January 24, 1985 , the City Council approved the Bayfront Specific Plan via City Council Resolution No. 11903. On September 25, 2012, the City Council approved amendments to the Bayfront Specific Plan via Ordinance No. 3238 and City Council Resolution No. 2012-189. The amended Bayfront Specific Plan included the realignment of portions of existing Marina Parkway and G Street that are the subject of this action and included findings that the amended Bayfront Specific Plan was consistent wi th the City’s General Plan and the California Coastal Act.
California Streets and Highways Code (SHC) section 8312 provides that a city may vacate all or part of a street, highway, or public service easement within the city in accordance with that code . Per Chula Vista Municipal Code (CVMC) section 12.40.010, the City has determined the public interest would be served by vacating these streets to allow for street realignments that will allow the Bayfront project to proceed in conformance with the Bayfront Specific Plan. Per CVMC section 12.40.010 and SHC section 8322, City staff published notice of the public hearing for the proposed street vacations for May 10, 2022 at 5:00 p.m. in the City Council chambers . Per SHC 8323, City staff also caused notices of the of the public hearing for the proposed street vacations to be posted at the required locations. Per SHC section 8347, all utilities having facilities within the streets to be vacated have been notified of the proposed vacation s and the City and the utility companies have made arrangements to have those facilities relocated into the newly aligned streets .
SHC section 8340 allows a city to reserve and except out from the vacation an easement and other rights necessary to maintain, operate, replace, remove, or renew public utility facilities.
City staff recommends vacation of the streets identified herein subject to the reservations and exceptions needed for the relocation of the utilities. The construction for the Bayfront development infrastructure has commenced and the next phase will require the realignments of existing Marina Parkway and G Street, and the relocation of utilities from those street sections, to allow the Bayfront project to proceed and to be in conformance with the Bayfront Specific Plan. Approval of this action would approve the vacations, subject to the reservations and exceptions, and the Port would then dedicate the new streets to the City in a manner that conforms to the alignments found in the Bayfront Specific Plan. The newly aligned and dedicated streets will allow for the utilities to be placed back into permanent locations. A map showing the areas proposed to be vacated is attached to this report as Exhibit “A”.
