Asa ChulaVista homeowner and taxpayer, I opposeItem 7.2. The ordinance harms our community by violating our private property rights, enablesbad and criminal behavior, encouragesfrivolous lawsuits, and reduces the value of our homes. ChulaVista doesn’t need to copy ordinances from the cities of Los Angelesand SanFrancisco. The City shouldn' t require that property owners pay off criminal squatters and attorneys in order to move back into their own home. Pleasevote NOon City AgendaItem 7.2 and listen to ChulaVista residents.

Re: Chula Vista Lacks Justification and Data for the Proposed Tenant Protection Ordinance
Dear Mayor Salas & Members of the ChulaVista City Council:
The California Apartment Association (CAA) hassignificant concernsregarding the proposed Tenant Protection Ordinance. CAAis the nation’s largest statewide trade group representing owners, investors, developers, managers, and suppliers of rental housing. Our membership is diverse representing individual " mom -and-pop" owners of rental housing to the largest apartment operators throughout SanDiego County and California. Our membership provides over 70,000 rental homes acrossSanDiegoCounty.
As you may know, the Stateof California has been heralded for having the “strongest tenant protections in the nation” through the adoption of AB 1482 (Chiu) in 2019. This legislation establisheda statewide, consistent standard to protect renters from excessiverent increasesand arbitrary evictions. Establishing new laws and policies will only create inconsistenciesfor landlords and tenants acrossthe state. CAAhashad constructive discussions with City staff on methods to enhancea landlord and tenant’s understanding of their rights and responsibilities.
CAAencouragesthe City to fully investigate and validate its findings with context before adopting citywide policy that could hinder community reinvestment and accelerate a departure of rental housing. The City will find there are agenciesresponsible for enforcing these measures, the data that has been presented has not been validated, and that city public records do not substantiate a needfor a local ordinance. The City’s ordinance meets the very definition of a solution seekinga problem.
As reported in the City’s 2021-2029 Housing Element, “CSASanDiego County received 300,000 Fair Housing Initiatives grant from HUDto carry out investigations and other enforcement activities to prevent or eliminate discriminatory housing practices” (pageAE - 2). While CSASanDiegohasreported an averageof 264 casesannually over the past three 2 years, the City’s Housing Element highlights that the U.S. Department of Housing and Urban Development found only 29 harassmentcasesspecificto ChulaVista in a five -year period 2014-2019). To put into context, harassment allegations in Chula Vista amount to less than a fraction of one-percent of its 82,000 households. Reports of substantial rehabilitation are equally aslow. The 2008 USCensusfound that 48% of ChulaVista’s housing stock is over 40 years of ageand yet, lessthan 70 multifamily properties underwent substantial rehabilitation over the last reporting period. It is also unclear from the data if those rehabilitations resulted in evictions.
At the April 12, 2022 Council hearing, staff presented on the casesthat havebeenreferred to CSAup until 2018 but did not provide data for any of the most recent years. When pushedon the issue, staff said that that data was unclear becausealmost no caseshad been referred to CSASanDiegoduring that time. The item before staff was to extend the contract with CSASanDiego to collect better data to justify possible action in the future. This data is essentialto ensure ChulaVista understands the scopeand magnitude of the problem it is trying to solve. The new contract is set to begin on July1st after another round of stakeholder and community input. Despite expanding this contract less than a month ago, the ordinance is still being pushedforward.
Clearly, there is not a prevalent or ongoing practice of fair housing issuesand appropriate enforcement mechanismsare available. CSASanDiegohasfunding for investigations, works directly with the City of ChulaVista, and works directly with the California Department of Fair Employment and Housing. Like all SanDiego residents, CSASanDiego County and the City of ChulaVista canalso refer harassmentcasesto the SanDiegoCounty District Attorney. As of April 20, 2022, the SanDiego County District Attorney hasnot publicly reported any harassmentcasesfrom ChulaVista over the last reporting period.
The Housing Advisory Commission took up the ordinance on April 19, 2022. The Housing Advisory Commissionexists to adviseand to make recommendations to the Housing Authority, City Council, and City Manager on housing issuesand opportunities that would benefit the community. The HACdid not reach an agreement on how to address the issue.
After much deliberation they agreedto forward the ordinance to the Councilbut only with more community and stakeholder input. Thesefurther opportunities for community input have not occurred.
3 Councilmembersexpressedconcernsabout increasing rents, the financial hardship of residents and a desire to addressthe bad actors. The proposed Tenant Protection Ordinance does not address the concerns laid out by the council. Instead, the proposed ordinance would ( 1) inhibit any substantial investment that improves the quality of life for tenants and updatesthe City’s agingstock and (2) penalizeinnocent activities often part of normal property management operations with excessivecriminal and civil penalties.
Adoption of the ordinance would discourageownership, development, and maintenanceof rental housing, putting renters and quality housing at -risk in the long-term.
The City hasan opportunity to educatetenants about the abundanceof existing laws and better define the problems being addressed with these policies before moving forward with any new laws. Pleaseconsider further due diligence to make a data driven decision before penalizing ChulaVista’s housing providers. CAAopposesthe proposed ordinance and strongly encouragesyou to vote NO.
Respectfully,
Melanie Woods

RE: Item 7.2 TenantProtections: Considerationof OrdinanceRegardingLocalTenantProtectionsto AddressNo-FaultJustCauseTerminationsof Tenancy
DearHonorableMayor andCouncilMembers:
Mobilehomeparkownersare supportiveof the staff recommendationto exempt “MRLtenancies” or spacelot rentalsfrom the proposedTenant-Landlordordinanceandthe EmergencyTemporaryNo- FaultEvictionMoratorium.
Mobilehometenanciesare uniquelydifferent than apartmentrentals. Residentsown their homeand rent the spaceor lot from the parkowner. Ourresidentsliving in our communitieshavea significant investmentin their home. Dueto this investment, StateLawhasnearlyalwaystreated our residents differently. Mobilehomeparkresidentsenjoyan arrayof enhancedsafeguardswell beyondtraditional tenant protections. Toapplythe proposedordinancesto MRLtenancieswould conflict with statelaw, be confusingandpunitive.
Mobile HomeResidencyLaw (MRL) Chapter2.5 of the CaliforniaCivilCode California’sMobilehomeResidenceLawisthe most robust in the nation andregulatesnearlyevery aspectof mobilehomeparkliving. Hereisa short list:

Attention please,
As a ChulaVista homeowner and taxpayer, I oppose Item 7.2. I personally have had a bad experience living next door to a house that is currently being run by squatters. They listed the house for short term rentals and had lots of illegal activities such asdrugs, underagedrinking, large loud parties of over 100 people, etc. The housenext door is a messin such a beautiful neighborhood. Pleasekeep ChulaVista a safeand quiet family neighborhood.

IAs a ChulaVista homeowner and taxpayer, I opposeItem 7.2. The ordinance harms our community by violating our private property rights, enablesbad and criminal behavior, encouragesfrivolous lawsuits, and reduces the value of our homes. ChulaVista doesn’t need to copy ordinances from the cities of Los Angelesand SanFrancisco. The City shouldn' t require that property owners pay off criminal squatters and attorneys in order to move backinto their own home. Pleasevote NOon City AgendaItem 7.2 and listen to ChulaVista residents.
I vote NOon City AgendaItem 7.2.
