Honorable Mayor & City Council March 7, 2023
1 am here making another naive attempt to tug at your
conscience. I have been pleading with you since June urging you to modify certain clauses within Chula Vista's Municipal Code Ordinance Number 3527 which places a devastating
financial hardship on Chula Vista renters.
You are well aware, if a Tenant terminates their lease and moves away, Tenants and Landlords encounter a complex paper work maze which is difficult to navigate. Clause 9.65.060E States: "Owners and Tenants shall provide City with
information regarding termination of Tenancies at such
time(s) and with such details as shall be required by city in the attendant Administration Regulations." I challenge anyone in this room to comprehend what action to take in order to comply.
Additionally, Tenants and Landlords who make procedural errors in paperwork face huge fines and are not afforded the opportunity to correct those errors. Clause 9.65.080C2 States:
"Civil penalties for violations of this chapter may be assessed at a rate not to exceed $ 5,000 per violation per day. When a violation occurs it is not required that a warning or notice to cure must first be given before an administrative citation or civil penalty may be issued."
Although the "Tenant Protection Act" contains several
clauses which inflicts financial harm on Chula Vista renters, most detrimental effects can be mitigated with the following simple modification:
As previously noted Clause 9.65.080C2 states in part:
When a violation occurs it is not required that a warning or notice to cure must first be given before an administrative citation or civil penalty may be issued." This Clause should be modified to read: "When a violation occurs, upon notification, Tenant andlor Landlords have 30 days to correct violation before an administrative citation or civil penalty may be issued."
Attending this Council Meeting tonight are individuals of all political persuasions. Some on the left prefer to be cared for from cradle to grave. Those on the right just want to be left alone to live their lives as they see fit. Most of us reside in the middle. However, I guarantee you, no one in attendance this evening would endorse the financial harm you are causing Chula Vista renters by allowing this Ordinance to move forward as written. In supporting this Ordinance you have personally interfered with and negatively affected the lives of thousands of Chula Vista families. Thank you for your time.
