Recommended Action
Conduct interviews of all three applicants for the Planning Commission who submitted a qualified application during the specified application period to fill one vacancy for an At -Large seat and make the appointment as appropriate.
The following applicants will be interviewed: Tim P. Jones, Charles Sanfilippo, and James Smyth.
SUMMARY
Three individuals submitted a qualified application during the application period and have been invited to interview to fill one vacancy on the Planning Commission for an At-Large seat. Following the interviews, the City Council may deliberate and consider making an appointment to fill the vacancy.

DISCUSSION
A member of the Planning Commission has served the maximum number of consecutive terms effective June 30, 2024, resulting in one vacancy for an At-Large seat. Members of the Planning Commission are appointed in accordance with the full Council interview appointment process specified in Chula Vista Municipal Code section 2.25.052(B), which incorporates Chula Vista Municipal Code chapter 2.53 processes. Nominations for interviews are not necessary since fewer than five qualified applications we re received during the application period, in accordance with Chula Vista Municipal Code section 2.53.040. Therefore, all applicants have been invited to interview.
Vacancy:
- At-Large – to replace Max Zaker – term expired 06/30/2024 Per Chula Vista Municipal Code 2.42.030 : Members of the Planning Commission shall be nominated and appointed by the City Council from the registered voters of the City. The current Planning Commission roster has been provided as Attachment 1.
The individuals listed below submitted qualified applications during the application period. The applications are provided in Attachment 2.

DECISION-MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is not site -specific, and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11), is not applicable to this decision for purposes of determining a disqualifying real property -related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.). Staff is not independently aware and has not been informed by any City Councilmember of any other fact that may constitute a basis for a decision-maker conflict of interest in this matter.

This item will have no impact on the general fund.
