RESOLUTION NO. __________
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AUTHORIZING $130,000 TO THE CITY
ATTORNEY FOR PAYMENT OF INVOICES TO OUTSIDE
COUNSEL IN THE NUNIS LITIGATION
WHEREAS, the City of Chula Vista retained attorneys with the outside law firm of Manning & Kass, Ellrod, Ramirez, Trester LLP (“Manning Kass”) to defend City and its Police Officers against litigation initiated by the Oral Nunis family; and
WHEREAS, the attorneys retained from Manning Kass to defend City and i ts Police Officers in the Nunis case later left Manning Kass to work for Lewis Brisbois Bisgaard & Smith LLP (“Lewis Brisbois”), but continued to defend City and its Officers in the lawsuit; and
WHEREAS, City and its outside counsel retained experts and vendors to provide services for the defense of City and its Police Officers during the pretrial and trial phases of the Nunis lawsuit; and
WHEREAS, City has been awaiting final invoices from Manning Kass and Lewis Brisbois since the conclusion of the lawsuit and now requests additional spending authority to make final payments to the outside attorneys and vendors for their services during the Nunis litigation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista, that it authorizes $130,000 in authority to the City Attorney for payment of invoices from Manning Kass and Lewis Brisbois for outside counsel and vendors services in the Nunis litigation.
