DISCUSSION
In December 2024, the City Counci l adopted Resolution Nos. 2024 -239 through 2024 -241, appropriating funds to complete construction of the Millenia Library and Office Building and two non -binding letters of intent (“LOIs”) with San Diego State University ( “SDSU”) and Chula Vista Entertainment Complex (“CVEC”) for tenancy within the building.

The Millenia Library and Office Building is approximately 168,000 square feet of class “A” library and office space. Building tenants include the Chula Vista Library on Levels 1 and 2, CVEC on Levels 3 and 4 and SDSU on a portion of the Lower Level. The Lower Level is approximately 18,000 square feet, of which SDSU is anticipated to occupy about 7,100 square feet.

For the remainder of the Lower-Level space, staff has been working with Sweetwa ter Union High School District ( “SUHSD”) regarding their desired use of approximately 8,420 square feet for its Launch Virtual Academy.

Launch Virtual Academy (“LVA”) was conceptualized in 2016 with the goal of providing a unique 21st century educational experience centered on continuous improvement. LVA is a flexible, engaging, and equitable online public school experience serving students in grades 7 through 12 that reside in San Diego County. The Academy utilizes various elements of proven educational m odels such as Online Collaborative Learning, Project-Problem Based Learning, Multiple Intelligence Learning Theory, Connectivism, and others and has been serving its students since 2020.

Certain negotiated terms are incorporated in the LOI (Attachment 1) including SUHSD’s responsibility for tenant improvements (design, construction and project management costs). Base rent will be negotiated as part of lease negotiations.

The SUHSD Board of Trustees approved the attached LOI on June 23, 2025.

DECISION-MAKER CONFLICT
Staff has reviewed the property holdings of the City Council members and has found no property holdings within 1,000 feet of the boundaries of the property which is the subject of this action. Consequently, this item does not present a disqualifying real p roperty-related financial conflict of interest under California Code of Regulations Title 2, section 18702.2(a)(7) or (8), for purposes of the Political Reform Act (Cal. Gov’t Code §87100, et seq.).

Staff is not independently aware, and has not been infor med by any City Council member, of any other fact that may constitute a basis for a decision-maker conflict of interest in this matter.

CURRENT-YEAR FISCAL IMPACT
There is no current-year fiscal impact as a result of this action. Approval of the proposed LOI allows staff to proceed coordinating tenant improvements for SUHSD within the Millenia Library Building.

ONGOING FISCAL IMPACT
The LOI presented for Council consideration reflect s tenant responsibility for certain operations and maintenance expenses, reducing the ongoing costs to be funded by the City. Rent to be paid by SUHSD for 8,420 SF in the Millenia Library Building will be subject to future negotiation between the parties, and such monies will be available to offset operational costs of the building.
