DISCUSSION
SBCS is constructing a commercial building at 318 Fourth Avenue (the “Project”). The construction involves the replacement of a 14,640 square-foot commercial building with a four-story 56,797 square-foot building.

The subject property is a 1.46 -acre site located on the southwesterly corner of Fourth Avenue and F Street within the UCSP.

During the Project design review process, it was determined by City staff that a 12-foot-wide ingress and egress easement for driveway purposes recorded with San Diego County on October 21, 1999 (Attachment 2), is no longer needed. It was also determined that the construction of the new building required the realignment of a segment of the public storm drain that passes through 318 Fourth Avenue (APN: 568-181- 50) and 434 F Street (APN: 568-181-23).

Due to the realignment of the storm drain, the existing drainage easement granted per Document No. 85 - 175037 (Attachment 3) recorded with San Diego County on May 17, 1985 , no longer coincides with the location of the storm drainpipe. To revise the easement alignment, the City must vacate a portion of the existing 10-foot-wide drainage easement and acquire a new storm drain easement from the property owner, the County of San Diego, at 434 F Street. Acceptance of the new easement will occur ministerially following this action.

With these proposed actions, the City will vacate these easements in accordance with Section 7050 of the California Government Code and Chapter 4, Section 8335 of the California Streets and Highways Code. these proposed actions, the City will vacate these easements in accordance with Section 7050 of the California Government Code and Chapter 4, Section 8335 of the California Streets and Highways Code. These types of vacations (i.e., summary vacations) may be performed through adoption of a resolution of vacation by the City Council and recordation of a certified copy of the resolution attested to by the City Clerk.

Gov’t Code §87100, et seq.).

Staff is not independently aware and has not been informed by any City Council member, of any ot her fact that may constitute a basis for a decision-maker conflict of interest in this matter.
