ESOLUTION NO. 18968
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THE REGIONAL WASTEWATER DISPOSAL
AGREEMENT WITH THE CITY OF SAN DIEGO AND
PARTICIPATING AGENCIES
WHEREAS, Chula Vista has been working with other regional sewer agencies and the City of San Diego to develop a new Metro Sewage agreement which would extend the existing agreement past 2013 to 2050 and allow guaranteed service beyond 2050: and WHEREAS, this new agreement is based on the " Principles of Understanding" which were approved by Council in December of 1996; and
WHEREAS, a final agreement has been prepared; and
WHEREAS, the Chula Vista City Council' s approval of the final agreement is based on its understandings that ( 1) San Diego has advised Chula Vista that it has no intention of selling the Metro System, ( 2) the agreement allows San Diego the right to sell the Metro System, and ( 3) in the event that San Diego should decide in the future to sell the Metro System, Chula Vista' s rights under the agreement remain protected and Chula Vista will not suffer adverse financial consequences as a result of any such sale.
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista does hereby approve the Regional Wastewater Disposal Agreement with the City of San Diego and the Participating Agencies, a copy of which is on file in the office of the City Clerk as Document No. CO98- 060.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is hereby authorized and directed to execute said Agreement for and on behalf of the City of Chula Vista.
