ITEM TITLE
Agreement Amendment and Appropriation: Approve an Amendment to the Agreement with Garland, DBS Inc. and Amend the Fiscal Year 2026 -27 Capital Improvement Program Budgets for the Police Department Headquarters’ Roof Replacement
Report Number: 26-0249
Location: 315 Fourth Avenue
Department: Public Works
G.C. § 84308 Regulations Apply: Yes
Environmental Notice : The project qualifies for a Categorical Exemption pursuant to State California Environmental Quality Act Guidelines Section 15301 (Existing Facilities).
Recommended Action
Adopt a resolution, A) approving a second amendment with Garland DBS, Inc. to increase the maximum not- to-exceed contract amount from $6,000,000 to $7,000,000 over the term of the agreement, B) amending the fiscal year 2026-27 Capital Improvement Program Budgets and appropriating funds for roof replacement of the Police Department headquarters. (4/5 Vote Required).
SUMMARY
The Police Department Headquarters, located at 315 Fourth Avenue, is more than 20 years old. The facility’s roof has reached the end of its useful service life and requires full replacement to maintain the building’s integrity and ensure continued operational reliability.
The Public Works Department recommends proceeding with replacement of the Police Department Headquarters roof. Adoption of the proposed resolution would authorize the City to move forward with the project and reallocate avail able funding among Capital Improvement Program (CIP) projects within the Measure P Fund for fiscal year 2026-27 to fund the work.
Adding this project to the City’s other planned roof repair and replacement projects would cause total expenditures to exceed the current maximum not -to-exceed amount under the City’s agreement with Garland DBS, Inc. Accordingly, staff recommends approval of a second amendment to the P a g e | 2
agreement, increasing the maximum not -to-exceed contract amount from $6,000,000 to $7,000,000.
ENVIRONMENTAL REVIEW
The proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA), and it has been determined that the project qualifies for a Categorical Exemption pursuant to State CEQA Guidelines Section 15301 (Existing Facilities), which consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use and where the exceptions listed in State CEQA Guidelines Section 15300.2 would not apply in that no cumulative impacts were identified, no significant effects on the environment were identified, the project is not adjacent to a scenic highway, no historical resources would be affected by the action, and the project was not identified on a list of hazardous waste sites pursuant to Section 65962.5 of the Government Code. Thus, no further environmental review is required.
BOARD/COMMISSION/COMMITTEE RECOMMENDATION
The regularly scheduled Measure P Citizens’ Oversight Committee (COC) meeting for July was cancelled due to lack of quorum. The proposed reallocation among CIP Projects within the Measure P Fund to fund the roof replacement will be presented at the next scheduled COC meeting.
DISCUSSION
Police Department Headquarters’ Roof
The Police Department is committed to providing community-focused policing that enhances the quality of life in Chula Vista and helps ensure the safety of its residents. The Police Department Headquarters, located at 315 Fourth Avenue, is more than 20 years old and r equires significant facility repairs. Most notably, the building’s roof has reached the end of its useful service life and requires replacement. This work is particularly important following the recent completion of the building’s HVAC replacement project, as a new roof will help protect that substantial investment and preserve the overall integrity of the facility.
On July 7, 2026, the City received a service proposal from Garland DBS, Inc. in the amount of $2,224,850. The proposed scope of work includes removal of the existing roofing system down to the insulation; repair and infill of damaged roof decking; installation of new base sheeting, coverboard, base sheet, and roofing membrane; replacement of curb and wall base flashings and roof penetration cover ings; improvements to duct seams and roof drains; and installation of new sheet metal roofing components.
Including project contingencies, the total estimated cost of the roof replacement project is approximately $2,676,000.
Garland Contract
On June 17, 2024, the City entered into a cooperative agreement with Garland DBS, Inc. ( “Garland”) for citywide roof replacement, repair, and maintenance services. The initial term of the agreement extended through June 17, 2026, with a maximum not-to-exceed amount of $2,000,000.
P a g e | 3
On October 30, 2024, the agreement was amended to increase the not-to-exceed amount to $6,000,000 and extend the term through June 30, 2029.
Based on the volume and cost of roof maintenance, repair, and replacement projects completed and planned citywide, including the proposed Police Department Headquarters roof replacement project, expenditures under the agreement are expected to exceed the current $6,000,000 limit. Accordingly, staff recommend a second amendment to increase the agreement’s n ot-to-exceed amount to $7,000,000. This increase will provide sufficient contract capacity to complete the Police Department Headquarters roof replacement project and address additional roof maintenance and repair needs anticipated during fiscal year 2026-27.
Garland competitively bids individual projects to qualified local subcontractors, helping the City obtain competitive pricing while maintaining an efficient procurement process. Continuing to utilize Garland under the existing cooperative agreement is also expected to provide cost savings and administrative efficiencies over the remaining term of the agreement.
For the Police Department Headquarters Roof Replacement Project, Garland received the following bids:
Police Department Roof: Garland/DBS Bid Based Price
Contractor Bid Price
1) A Good Roofer, Inc. $2,224,850
2) Preman $2,409,235
3) Roof Construction $2,559,819
4) C&I $2,601,731
The Police Facility Repair Project (GGV0232) currently has an available balance of approximately $1,106,264, primarily resulting from cost savings associated with the Police Department HVAC Replacement Project (GGV0261), which is nearing completion.
To fully fund the proposed Police Department Headquarters roof replacement, staff recommends transferring an additional $1,57 0,000 in Measure P funds to the Police Facility Repair Project (GGV0232).
With this transfer, the project will have sufficient funding to cover the total anticipated cost of the roof replacement.
DECISION-MAKER CONFLICT
Staff has reviewed the property hold ings of the City Council members and has found no property holdings within 1,000 feet of the boundaries of the property which is the subject of this action. Consequently, this item does not present a disqualifying real property -related financial conflict of interest under California Code of Regulations Title 2, section 18702.2(a)(7) or (8), for the purposes of the Political Reform Act (Cal. Gov’t Code §87100, et seq.).
Staff is not independently aware, and has not been informed by Council members, of any o ther fact that may constitute a basis for a decision-maker conflict of interest in this matter.
CURRENT-YEAR FISCAL IMPACT
Approval of this resolution will result in the following:
P a g e | 4
Amends the fiscal year 2026 -27 Capital Improvement Projects Program Budget by transferring $1,570,000 in the Measure P Fund from the Police Department HVAC Replacement Project (GGV0261) to the Police Facility Repair Project (GGV0232) in the Police Facility Repairs category within the Measure P Spending Plan.
Approves the second amendment to the contract with Garland DBS, Inc. to increase the maximum not-to-exceed amount from $6,000,000 to $7,000,000.
The above adjustments do not have a current year fiscal impact, as funds for the Police Department headquarters’ roof replacement are available in Measure P Fund, Police Facility Repairs category, within the Measure P Spending Plan.
ONGOING FISCAL IMPACT
Ongoing costs of the project will primarily consist of routine maintenance and periodic minor repairs necessary to preserve the roof’s condition and extend its useful life. These expenses will be incorporated into future budgets as part of the annual budget development process.
