PUBLIC HEARING

9. SUBJECT: Public Hearing Regarding Rate Increases by Republic Services for its Residential Garbage, Recycling, and Organic Waste Services in the City of Citrus Heights STAFF: M. Poole
RECOMMENDATION: The following is recommended;

a. Conduct a Public Hearing to receive public comment and accept written protests on the proposed residential solid waste rate increases; and

b. Adopt Resolution No. 2022 - 010, A Resolution of the City Council of the City of Citrus Heights, California, Affirming the Customer Rate Schedule Effective July 1, 2022 through December 31, 2027 as Set Forth in the 2021 Amended and Restated Residential Solid Waste and Recycling Collection Services Agreement with Allied Waste Services of North America, LLC

Operations Manager Poole provided an overview of the proposed residential rate increases by Republic Services for its residential garbage, recycling, and organics waste services. On October 28, the City Council approved the residential amendment with Republic Services. Since October, staff have conducted extensive public outreach for the proposed organics and waste service rate increases. The proposed organics recycling will affect residents and businesses within Citrus Heights.

The proposed amendment with Republic Services includes collection and cart options, processing options, outreach and education, monitoring and reporting, and updating the implementation schedule. Customer rates remain as low as possible. With the proposed changes, rates would increase 3.5% effective January 2022 with the 26.2% rate increase coming into effect July 2022. Staff recommends holding the public hearing for public comment and then staff will count the protests received and report to the City Council for further action.

Council comments and discussion followed.

Mayor Middleton opened the public hearing at 7:41 p.m.

PUBLIC COMMENT

Roger Johnson provided a written comment, “2 rate increases in a 6 month period does not make sense. The 2nd rate increase actually increases the 1st increase. Please inform the Public in detail what the cost per can size is PER each type of can. This is a HUGE increase for those of Us that are Seniors, Veterans, Immigrants and living on 'fixed incomes'. Please reconsider, Thank You and BE Well.”

John Kane addressed the Council regarding the proposed rate increase for organics and recycling services.

He stated he believes mandates from the state should be covered by the state and not residents. He shared his opposition on the proposed rate increases and encouraged Council to find a different level of increases in the future.

Glenda Green addressed the Council regarding her support of SB 1383. She stated she is in favor of composting and already does so at her home. She pointed out that while the increases are high, residents will have an option to receive a smaller trash bin for a lower cost.

Summary and Recommendation
Staff recommends the City Council adopt Resolution No. 2022-___ a resolution making the legally required findings to continue to authorize the conduct of remote “telephonic” meetings during the State of Emergency.

Fiscal Impact
The
re is no fiscal impact associated with this item.

Background and Analysis
At t
he October 14, 2021 regular meeting, the City Council adopted Resolution No. 2021-082 authorizing the conduct of remote “telephonic” meetings during a declared state of emergency pursuant to Government Code. The City Council determined that as a result of the COVID-19 pandemic and state of emergency, meetings in person of the City Council and all legislative bodies of the City would present imminent risks to the health or safety of attendees.

In the
event of an ongoing proclaimed state of emergency, in order to continue to conduct meetings remotely, any time after the first remote meeting of the legislative body, it can meet remotely if both of the following apply:

1. State
/local emergency/social distancing. Either:
a. “a state of emergency remains active” or
b. “state or local officials have imposed or recommended measures to promote social distancing” and

2. 30 days . Within the last 30 days (which vote may occur at that meeting) the legislative body has made the following findings by majority vote “(A) The legislative body has reconsidered the circumstances of the state of emergency. (B) Any of the following circumstances exist (i) The state of emergency continues to directly impact the ability of the members to meet safely in person. (ii) State or local officials continue to impose or recommend measures to promote social distancing.”
If t
he City intends to conduct meetings remotely, it should add to every agenda a consent calendar item to reaffirm the findings described above, which are required to allow the remote meetings. This resolution also makes the necessary finings for all subordinate legislative bodies of the City, such as the Planning Commission, so these bodies can also continue to meet remotely on an ongoing basis.

Rising prices

The consumer price index (CPI) rose 0.5 percent in December, a 7 percent surge in 2021, the greatest annual pace since 1982.

The increase in the CPI is particularly seen in new and used cars and trucks, commodities, shelter, food and clothing prices.

Energy costs fell for the month, but economists expect that to be temporary.

Producer prices increased 0.2 percent in December, gaining 9.8 percent in 2021 as material costs have risen rapidly amid transportation bottlenecks, robust demand, and labor
constraints. Many businesses have successfully passed the added costs on to custom ers through higher prices, and the latest report suggests additional consumer price increases in the coming months.

Employment

U.S. employers added 199k new jobs in December, missing the 450k forecasted. In the separate unemployment household survey, the unemployment r ate dipped to a new pandemic low of 3.9 percent, with the participation rate holding steady at 61.9 percent.

Wage growth continued to accelerate in December, with the year-on-year rate jumping 4.7 percent. A record 4.5 million Americans quit their jobs in November as job openings
remained elevated at 10.6 million, workers have many more options for employment and compensation.

Fed watch

At the December FOMC, the Federal Reserve announced it
will double the speed of taper (reducing purchases $30bil a month) to be completed by mid-March 2022. Committee
members forecast three 25bps rate hikes in 2022, three in 2023 and two more in 2024, bringing fed funds to 2.1 percent by the end of 2024.

BJECT: Striping and Marking Maintenance Services 2022-2025 Award of Contract
Summary and Recommendation
In 2018, the City Council awarded a seven-year contract to Centerline Striping Company, Inc. to maintain roadway striping and pavement markings throughout the city. Unfortunately, the contractor is out of compliance with the requirements set forth in the contract. Accordingly, the General Services Department (GSD) sent the required termination notice to the current contractor and circulated a Request for Proposals (RFP) for Striping and Marking Maintenance Services. Two proposals were received and evaluated based on criteria specified in the RFP.

Sierra Traffic Markings, Inc. (Sierra Traffic Markings) was selected as the top ranked contractor for the striping and marking services.

Sta
ff recommends the City Council adopt Resolution No. 2022-____, a Resolution of the City Council of the City of Citrus Heights, California, authorizing the City Manager to execute an agreement with Sierra Traffic Markings, Inc. for Striping and Marking Maintenance Services 2022–2025 and further authorizing the City Manager or his designee to execute any extensions and/or non-substantive amendments to this contract consistent with the City Manager’s general signing authority.

Fiscal Impact
Thi
s contract will have no fiscal impact on the city. All services will be funded with sources established in the associated Fiscal Year maintenance budgets approved annually during the term of the contract.

Whi
le Sierra Traffic Marking’s bid was based on estimated annual quantities produced by staff for the purpose of obtaining proposals, the contractor will be paid for actual work performed generated by staff-issued work orders. The total approved budget for FY’s 21/22 and 22/23 for striping maintenance is $75,000 per year funded by Gas Tax Funds. In the event additional work Item 10

is needed and the $75,000 budget exhausted, line item adjustments with the existing approved budget will be made. Future fiscal years will be budgeted similarly and based upon available transportation funds.

Background and Analysis

On November 8, 2018, the city awarded a seven year contract for striping and marking services to Centerline Striping, Inc. to install and refresh traffic striping and markings throughout the city.

Following ongoing concerns regarding timeliness of work as well as multiple letters and various correspondence regarding the status of the contract, staff elected to exercise its option to terminate the contract with Centerline Striping, Inc. and move forward with soliciting a new contract.

On December 6, 2021, staff released an RFP for striping and marking maintenance services. On January 13, 2022, staff received two proposals from qualified contractors. After reviewing each proposal in accordance with the criteria described in the RFP, including unit pricing, financial stability, experience, and qualifications, staff recommends entering into a contract with Sierra Traffic Markings.

The proposed contract is for three and one-half fiscal years with provisions for up to two one- year contract extensions. The contractor will hold firm the unit prices for the full term of the contract. As outlined in the RFP and prior to completion of the initial contract term, the city and contractor may elect to extend the contract during which the unit prices will increase based upon the Consumer Price Index with a maximum increase of 3-percent per year.

This item aligns with the City’s 3-year strategic goal to maintain public infrastructure and enhance alternative modes of transportation.

BJECT: Public Hearing #1 on the Redistricting Process
Summary and Recommendation
Staff recommends the City Council:

1. Hol
d a public hearing to receive public input on the composition of districts for the purposes of redrawing election district boundaries;

2. Receive a presentation from the City’s demographic consulting firm, National Demographics Corporation (NDC); and

3. Set the next public hearing for March 3, 2022
Fiscal Impact
For
the 2022 redistricting process, the City Clerk’s Office has sufficient funds available in the FY 2021/22 Budget for costs associated with hiring a demographic consulting firm, public outreach, and advertising.

Background and Analysis
Ea
ch city with district-based elections is required to update (“redistrict”) the district boundaries every ten years, following the receipt of updated population data from each federal decennial census. The City is required to redistrict the district boundaries prior to the next election in November 2022. Although the City recently transitioned to district-based elections in 2019, the boundaries are based on the 2010 federal census, which means the City must now update the boundaries through the redistricting process based on the 2020 federal census.

Overview of the Process
Pu
rsuant to Elections Code Section 21607.1, the City must hold at least four public hearings that enable the community to provide input on the drawing of district maps:

Item 11
Agenda Packet Page 25

Page 2 of 4 ends

• At least one hearing must occur before the City draws draft maps. • At least two hearings must happen after the drawing of draft maps. • At least one public hearing or public workshop shall be held on a Saturday, on a Sunday or after 6 p.m. on a weekday Monday through Friday.
• If a redistricting hearing is consolidated with a regular or special meeting of the Council, the hearing portion must begin at a pre-designated time.

The City must take steps to encourage residents, including those in underrepresented communities and non-English speaking communities, to participate in the redistricting public review process. A good faith effort satisfies the requirement and includes:

• Providing information to media organizations that provide City news coverage, including media organizations that serve language minority communities. • Providing information through local community groups and organizations (including those active in language minority communities, those that are based on good government, civil rights, or civic engagement, and those that have requested to be notified concerning City redistricting).
• Additionally, the City is required, upon request, to conduct the public hearings with live translation in “an applicable language” (i.e., 3% of total population over four years old; which for Citrus Heights, is Spanish language).

The City is required to publish information regarding the redistricting process and draft maps on the City’s website in English and Spanish.

The redistricting process must be completed, and a new district boundary map must be adopted by the City Council no later than April 17, 2022. This hearing is the first of four required hearings. The purpose of this public hearing is focused on receiving public comment and input regarding communities of interest and other local factors that should be considered while drafting district maps. A community of interest pursuant to Elections Code Section 21601(c) is defined as “a population that shares common social or economic interests that should be included within a single district for purposes of its effective and fair representation.”

Criteria to be Considered in the Drawing of District Maps

In accordance with the Fair and Inclusive Redistricting for Municipalities and Political Subdivisions (“FAIR MAPS”) Act, the City Council shall draw and adopt boundaries using the following criteria in the order of priority (Elections Code Section 21601(b),(c)):

1. Comply with the federal requirements of equal population and the Federal Voting Rights Act (FVRA);

2. Geographically contiguous, to the extent practicable. A district is not contiguous if it includes areas that: (a) meet only at the point of adjoining corners, or (b) are separated by water and not connected by a bridge;
Agenda Packet Page 26

Page 3 of 4 ends

3. Geographic integrity of any local neighborhood or local “community of interest” (socio- economic geographic areas that should be kept together) shall be respected in a manner that minimizes its division;

4. Boundaries should be easily identifiable and understandable by residents. To the extent practicable, council districts shall be bounded by natural and artificial barriers, by streets, or by the boundaries of the City;

5. Districts shall be geographically compact in a manner that nearby areas of population are not bypassed in favor of more distant populations, to the extent practicable; and

6. Districts must not be adopted for the purpose of favoring or discriminating against a political party.

Demographer and Census Data

NDC will provide a presentation about the overall population changes within the City according to the 2020 federal census data, as well as an overview of the legal requirements under the FAIR MAPS Act that must be considered when drawing districts.

In addition to the first public hearing, NDC will also be available at the remainder of the public hearings to assist with questions and provide guidance to the development of new district boundaries.

Public Outreach

In order to increase public awareness and participation in the redrawing of election district boundaries, the City Clerk’s Office has begun implementing the following community outreach plan.

Public messaging via the City’s website, social media, press releases, newsletters, and other public communications, in English and Spanish, including:

• Dedicated webpage on City’s website for redistricting updates and information http://citrusheights.net/1159/Redistricting

• Social media engagement on Facebook, Instagram, Twitter, and NextDoor • Information provided via the City’s electronic newsletter • Press releases
• Public notices posted at City Hall and on the City’s website • Display advertisements on local public access channel by using Sacramento Metropolitan Cable TV’s Channel 14
• Public Hearing Notices
• Collaboration with Community Partners. For example, Connect Citrus Heights coalition, Citrus Heights Chamber of Commerce Government Relations Committee, REACH, and Neighborhood Associations
