Council Member Nelson read and presented the proclamation to Sunrise Recreation and Park District staff. District Administrator Huntzinger introduced the Executive Team and staff members and announced the park district’s 75
th Anniversary celebration scheduled for October 4, 2025.

4b. Presentation by American Legion Post 637 – Citrus Heights

Charles Stone, Commander of American Legion Post #637, announced the Battle of the Bands & BBQ event and distributed event flyers. He provided a presentation in memoriam of California service members killed in the global War on Terror. He distributed copies of the banner that has been developed with the names, including four service members from Citrus Heights. He then surprised Post members Ben Lehr and Steve Gall by presenting them with Certificates of Appreciation for their services to veterans.

PUBLIC COMMENT

Darrell Mott provided a presentation and spoke about problem housing issues and code enforcement.

He referred to his public comments from the August 14, 2024 and May 28, 2025 City Council meetings.

He inquired about how to submit insurance claims or restraining orders if there are no police reports associated with the issues. He requested a City Council agenda item to discuss specifics.

Melissa Hayden of Citrus Heights Rescues Animals spoke about the positive changes happening in the City; her efforts with kitten rescues; and announced that a fundraiser will be held to cover the cost of an upcoming spay and neuter clinic for feral trapped cats and kittens.

Angeliki Rosenberg and Florence Cordingley commented together at the podium on poor road and sidewalk conditions and needed maintenance. They have also spoken with Operations Manager Poole.

City Clerk Van read the following written public comment submitted by Alfred Sanchez, “We are concerned about the Citrus Heights Chronic Offenders Program, specifically the criteria used to identify chronic offenders. According to my understanding, the program considers individuals with 10 citations in a year as chronic offenders, regardless of whether those citations result in convictions. I strongly believe that citations and convictions are two different things, and convictions should be the basis for determining chronic offender status. Ten citations can be issued for various reasons, including misunderstandings or dismissed charges, which may not necessarily indicate a pattern of chronic offending behavior. I respectfully request that city officials consider revising the program’s criteria to focus on convictions ITEM 5

rather than citations. This change would ensure that the program targets individuals who have been proven to engage in repeat offending behavior, rather than those who may have been unfairly or mistakenly cited.”

City Clerk Van read the following written public comment submitted by Rick Hodgkins, “Well mayor and members of the city council. It has been a long time since I addressed all of you! But I just wanted to take this opportunity to thank you for shooting down the most previous proposed land for sunrise mall, that which would have included an In-N-Out Burger. Even though we need more In-N-Out Burger locations, I would have to agree. Sunrise mall is not the place for an In-N-Out Burger. As I remember telling Casey camper about almost 4 years ago, is that where are people going to go when it’s rainy and windy outside? I would highly recommend that any current or future stores inside the mall, have a way to enter them from the inside, as well as from the outside. This is the way the anchor stores in the mall are built, that way you can enter the store from either the inside of the mall or from the outside of the mall. Maybe if we just do that, tenants might be willing to have space there! As far as getting rid of a lot of the parking available at the mall, I would agree having places outside for the spring and summertime are warranted.

But please, let’s keep the inside of the malland redesign store fronts and restaurants both for current and future tenants for people to be able to enter, not only from the inside of the and outside just like the way, the anchor stores have their entrances and exits set up. Thank you.”

b. Adopt Resolution No. 2025-063, A Resolution of the City Council of the City of Citrus Heights, California, to Confirm the Diagram and Assessment and to Levy Fiscal Year 2025/2026 Assessments for the Citrus Heights Lighting Assessment District

City Engineer Blomquist presented on the item and responded to Council questions.

Mayor Karpinski-Costa opened the public hearing at 7:03 p.m.

Public Comment

David B. Shelton inquired about how the assessments will be used, specifically the $200,000 of funding for roads that is going to provide lighting. He stated that those funds are needed for roads.

City Clerk Van read the following written public comment submitted by Rick Hodgkins, “This one I’m
going to keep short and sweet, because a few months ago, or maybe it was a few weeks ago, that there was public comment about they’re not being enough lighting in a particular neighborhood. I cannot remember if it was general public comment or, public comment on the agenda identical to this one. But that wherever there isn’t enough light, let there be light, because that while most homeless people are good people, you never know when someone will hide in a dark place and engage in something crazy. I can tell you that there was a time when I had to walk up sunrise and I would be on this cliff, or would look like a small cliff and that there was very little light. Luckily, that we got rid of that little cliff, as it was a high step down to the street and I remember it like yesterday. It was a sidewalk on a little cliff, and there was a fence on one sideto peoples yards. And so that I think we need to continue to look at areas up-and-down sunrise within our city limits to see where we could use more of that light. Thank you.”

Hearing no additional public comment, Mayor Karpinski-Costa closed the public hearing at 7:08 p.m.

ACTION: On a motion by Council Member Schaefer, seconded by Council Member Nelson, the City Council adopted Resolution No. 2025-063, A Resolution of the City Council of the City of Citrus Heights, California, to Confirm the Diagram and Assessment and to Levy Fiscal Year 2025/2026 Assessments for the Citrus Heights Lighting Assessment District.

tion of the City’s investments are under management by Chandler Asset Management (Investment Manager) as of March 2023. For more information regarding the City’s investments under management, see schedules included as Attachment 1.

The
report includes all securities managed by the City and its Investment Manager (excluding bond proceeds) and provides information on the values (par, fair, and cost), term, and yield of each security. Of note, because the safe-keeping custodian and the Investment Manager may use different pricing sources to determine the market value of the securities, there can be minor differences in fair values shown on the custodian’s monthly statement as compared to the Investment Manager’s monthly statement.

Fa
ir Value of individual securities has been provided by Chandler Asset Management. The City uses US Bank as its third-party custodian for safekeeping of all investments except for the Local Agency Investment Fund (LAIF) and the California Asset Management Program (CAMP). LAIF is a money market fund administered by the State Treasurer that has many governmental agency participants and holds securities through its own administrator.

In J
uly 2024, the City joined the California Asset Management Program (CAMP). CAMP is a California Joint Powers Authority (JPA), a government agency that was established in 1989 to provide public agencies in California with professional investment services and options. CAMP is governed by a Board of Trustees comprised of experienced local government finance directors and treasurers. The City has invested funds in the CAMP Pool, a stable net asset value investment rated AAAm by S&P Global. The CAMP Pool offers same-day liquidity similar to LAIF. Investments in the CAMP Pool are permitted under California Government Code Section 53601(p) and the City’s Investment Policy.

The
value of fixed-income securities may fluctuate with changes in interest rates. As interest rates go up, the fair value of the securities may go down, and the reverse is true; when interest rates go down, the market value of the securities may go up. The difference between the book and fair market value is considered an unrealized gain or loss. The unrealized gain for this ITEM 6

reporting period is $97,752. It is important to note that a loss or gain is realized when an investment is redeemed or sold before its maturity date. The City’s investments are typically retained until the maturity date, at which point the City’s full investment is returned.

Nonetheless, the City may elect to sell an investment before its maturity and record a capital gain or loss to manage the portfolio’s quality, liquidity or yield in response to market conditions or the City’s risk preferences.

Compliance
All investment transactions were executed in accordance with the California Government Code and the City’s Investment Policy. In accordance with California Government Code section 53646(b)(3), staff believes that the investments and budgeted revenues for the City will provide sufficient cash flow to meet the anticipated cash flow requirements of each entity for the next six months.

Pooled cash and investment book balances are adjusted annually to reflect fair value as required by Generally Accepted Accounting Principles (GAAP). The term fair value was formerly known as market value and became effective with the mandatory implementation of the Governmental Accounting Standards Board (GASB) Statement No. 31 in fiscal year 1998. The CAMP Pool complies with requirements outlined by GASB Statement No. 79, which allow the City to record its investment at amortized cost instead of fair value. The attached investment schedules meet all applicable GASB requirements.

American Rescue Plan Act Summary
Included in the City’s investment portfolio are the American Rescue Plan Act (ARPA) funds.

The City received an ARPA allocation of $15.7 million of which the total funds used by end of June 2025 were $13.6 million. As of December 31, 2024, all funds have been obligated and reported to the US Treasury. Remaining funds need to be expended by December 31, 2026.

At the August 14, 2024, City Council meeting, Council approved the allocation of the remaining funds towards general government services and critical projects. This is reflected on the schedule below in accordance with the US Treasury guidelines. General government services and critical projects include but are not limited to necessary improvements to infrastructure such as sidewalks, pedestrian safety features like crosswalks, streetlights, neighborhood cleanup, and other projects to revitalize public spaces; replace and update technology tools to effectively develop, execute, and evaluate government programs; and general government services such as rehire public safety to pre-pandemic levels.

Background and Analysis

Fireworks Ordinance

At the June 24, 2021, Citrus Heights City Council meeting, council voted to adopt Urgency Ordinance No. 2021-001, related to the regulation and enforcement of fireworks in Citrus Heights. The urgency ordinance created social host language for those allowing the use of illegal fireworks at their residence. In June 2022, the City Council voted to permanently adopt the language from the urgency ordinance into the Citrus Heights Municipal Code (CHMC) via Ordinance 2022-004.

On April 29, 2025, voted to amend the social host ordinance to include street and/or sidewalk adjacent to hosts property and increase the penalties for those found responsible for illegal fireworks violations.

After additional review of the CHMC fireworks ordinance and in effort to remain consistent with our regional partners, the following are recommendations for amendments to the Citrus Heights Municipal Code Chapter 38; grammatical and verbiage changes have also been made to these sections but do not alter the intent of the sections.

Sec.38-69. - Exception for sale of safe and sane fireworks

Changed the hours for dates and times for legal fireworks sales. • Current date/time: From 12:00 p.m. on June 28 to 11:00 p.m. on July 5 • Proposed date/time: beginning June 28 and ending on July 4 of the same year. Specific hours for sale between these dates are 9:00 a.m. to 10:00 p.m.

Sec. 38-81. - Penalty for violation

• Section (c) added reference to social host definition from section 38-67 and $5,000 per device fine for third and subsequent offenses within one year of second violation. This fine amount, for third violation, is consistent with Council’s original direction but was left off previous draft in error.
• Section (d) remove section. The addition of the social host definition in Section (c) removes the need for Section (d).I
• Section (g) previously referred to these violations as misdemeanors, changes made to reflect the correct violation type as an infraction and that persons will be issued an administrative citation or notice of violation.
• Section (h) stated that the parents of the juvenile and the juvenile were liable for the response costs; the update removes the juvenile’s responsibility for financial costs associated with response, as juveniles are not typically responsible for the financial burden which is left to the parents.

• Section (j) new ordinance allows for City to utilize a designated payment collector • Section (n) contained nuisance language for uncorrected violations over multiple days.

This does not apply to this type of violation and was therefore removed. • Sections (p) and (q) are currently duplicates and section (q) will be removed.

Shopping Cart Ordinance:

On November 10, 2022, the Citrus Heights City Council adopted Ordinance number 2022-012, related to the regulations and enforcement of shopping carts in Citrus Heights. In November 2022 the City Council voted to permanently adopt the language of this ordinance into the Citrus Heights Municipal Code (CHMC).

Shopping carts constitute a nuisance within the community by promoting blight within the city’s residential and commercial areas. The Citrus Heights Police Department uses this section as an enforcement measure focusing on the beautification and quality of life within the community.

Staff recommends amending CHMC Sec. 50-905 to clarify that mere possession of a shopping cart, without written consent of the business owner, is a violation and does not require an officer prove the cart was removed from the business.

Recommended changes are:

Title Update: Sec. 50-905 – Unauthorized removal and/or possession of a shopping cart.

Without the prior written consent of the owner, it is unlawful for any person to remove, or cause to be removed, or be in the possession any shopping cart which is the property of the business establishment furnishing such carts for its customers’ use, from the parking lot or other premises of said business establishment.

AN ORDINANCE OF THE CITY OF CITRUS HEIGHTS AMENDING CITRUS HEIGHTS MUNICIPAL CODE CHAPTER 38 – FIRE PREVENTION AND PROTECTION, ARTICLE III. – FIREWORKS, SECTIONS 38-78AND 38-81

The City Council of the City of Citrus Heights does ordain as follows:

The provisions of Chapter 38, Article III. of the Citrus Heights Municipal Code

SECTION 1. Amendment. Section 38.69 of the Citrus Heights Code is hereby amended to read as set forth below:

Sec 38-78 – Exception for safe and sane fireworks.

It shall not be unlawful to possess, sell within the city those fireworks as are defined and cl
assified as "safe and sane fireworks" in Health and Safety Code § 12500 et seq., during that time period beginning June 28 and ending on July 4 of the same year. Specific hours for sale between these dates are 9:00a.m. to 10:00p.m.

It shall not be unlawful to use or discharge safe and sane fireworks during either of the fol
lowing time periods:
1) Between the hours of noon and 11:00 p.m. on June 28, or 2) Between the hours of 9:00 a.m. and 11:00 p.m. from June 29 through July 5 of the same year.

SECTION 2. Amendment. Section 38.81 of the Citrus Heights Code is hereby amended to read as set forth below:

Sec. 38-81. - Penalty for violation.

(a) Any person who allows, permits, aids, or abets any discharge of fireworks (including a public display) without having first obtained a permit therefore from the Fire Marshal, or designee, shall be in violation of this section, unless otherwise permitted by ordinance.
(b) Any person who stores fireworks, including those classified as "safe and sane" by the California State Fire Marshal, except as expressly allowed by this Code, shall be in violation of this section.
(c) Administrative Citation. Upon identification of an unpermitted discharge or i
llegal storage of fireworks, law enforcement may issue an administrative citation or a notice of violation to all responsible person(s) present at the unpermitted discharge of fireworks or to a host as defined by Section 38-67 who is found in violation of this section. Law enforcement shall notify persons, found responsible for unpermitted discharge or illegal storage that further violation of the ordinance may result in the issuance of increased subsequent fines and assessment of response costs as outlined in section 38-67. Each device (firework) possessed, ignited, exploded, discharged, used, or displayed constitutes a violation of the ordinance and therefore is subject to an administrative fine:

ITEM 8
Agenda Packet Page #34

1. One thousand dollars ($1,000.00) fine, for each device

2. Two thousand five hundred dollars ($2,500.00) fine for each device on subsequent offenses within one year from the date of the administrative citation or notice of violation.

3. Five thousand dollars ($5,000.00) fine for third and subsequent offenses within one year from the date of the administrative citation or notice of second violation.

(d) Upon identification of an unpermitted discharge of fireworks, law enforcement may also issue a written notice to all other identifiable responsible persons not present at the unpermitted discharge of fireworks that a violation of the fireworks ordinance has occurred and that further violations may result in the assessment of response costs. (e) Nothing in this chapter shall be intended to limit any of the penalties provided for under the California Health and Safety Code or Penal Code with regard to the sale, use, possession, delivery, storage, and/or transportation of dangerous fireworks. (f) The penalties set forth herein are intended to be nonexclusive and are intended to be in addition to any other remedies provided in this chapter or any other law, statute, ordinance or regulation.
(g) Any person who violates this section shall be guilty of an infraction and shall receive an administrative citation or notice of violation. (h) Response Costs. A responsible person(s) who has been issued a subsequent a
dministrative citation and/or written notice of violation of this ordinance may be liable for response costs incurred in responding to the unpermitted discharge or illegal storage of fireworks. All responsible persons shall be jointly and severally liable for the response costs incurred in the response and all subsequent responses. The amount of response costs constitutes a debt owed to the city.

If a responsible person is a juvenile, then their parents or guardians will be jointly and severally liable for the response costs incurred pursuant to this chapter. To incur liability for response costs imposed by this chapter, the person responsible for the unpermitted discharge or illegal storage of fireworks need not be present at the event that causes the response giving rise to the imposition of response costs. This chapter therefore imposes vicarious as well as direct liability upon responsible persons. (i) Notice of the response costs shall be served by first-c lass mail to the persons liable
for such costs. The notice shall contain the following information:

1. The name of the person who is liable for the response costs;

2. The address of the private property where the incident occurred;

3. The date and time of the response;

4. The law enforcement, fire, or other emergency response personnel who responded; and

5. An itemized list of the response costs.
(j) Payment for response costs shall be remitted to the city of Citrus Heights, or designated payment collector, within thirty (30) calendar days of the date of the notice.

The payment of any such costs shall be stayed upon the filing of a timely appeal.

ITEM 8
Agenda Packet Page #35

(k) A person charged with response costs may, within ten (10) calendar days of the date of the notice of response costs, appeal the response costs. The appeal hearing shall be scheduled and conducted in the manner prescribed in this chapter. (l) Failure to timely file an appeal constitutes a failure to exhaust available administrative remedies and bars any further review or administrative appeal of the response costs.
(m) Violations of this chapter are hereby declared to be a public nuisance. (n) Any person who violates a provision of this chapter is liable for civil penalties of not less than $1,000 or more than $25,000 for each day the violation continues. (o) All remedies prescribed under this chapter are cumulative and the election of one or more remedies does not bar the city from the pursuit of any other remedy to enforce this chapter.
(p) Any recipient of an administrative citation or notice of violation may appeal the citation by completing and submitting the approved review form to the city within thirty (30) days from the date of the administrative citation or notice of violation. If the violation is upheld after review, the recipient may request a formal administrative hearing with an advance deposit of the fine.

SECTION 4. Severability. If any section, subdivision, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions thereof.

SECTION 5. Effective Date and Notice. This ordinance shall take effect thirty (30) days after its adoption, provided it is published in full or in summary within fifteen (15) days of its adoption, in a newspaper of general circulation published and circulated in the City of Citrus Heights.

CITY COUNCIL STAFF REPORT

MEMORANDUM

DATE: August 13, 2025

TO: Mayor and City Council Members
Ashley J. Feeney, City Manager

FROM: Casey Kempenaar, Community Development Director

SUBJECT: Potential Annexation Work Plan

Summary and Recommendation

At the May 28, 2025, City Council meeting, two members of Council directed staff to agendize the exploration for the potential annexation of the northwest corner of Fair Oaks Boulevard and Madison Avenue into the Citrus Heights city limits. This area is currently developed with a multi-story commercial building, a commercial center, and adjacent multi-family residential units. This staff report serves as a preliminary annexation work plan for City Council consideration and provides an opportunity for the Council to offer further direction.

Staff recommends the City Council review the information provided in this report and presentation and provide direction to staff regarding whether to proceed with the proposed annexation work plan. Staff also recommends the Council provide direction whether they would like the Finance Committee or Quality of Life Committee to serve as the committee for this item if it moves forward.

City Council Strategic Goal/Objective

This staff report aligns with the following Citrus Heights City Council Strategic Plan Goals:

Goals: - Maintain a nd Enhance Fiscal Stability while Supporting Operational Excellence - Enhance Community Vibrancy and Engagement

Fiscal Impact

There is no immediate fiscal impact associated with this action. However, future fiscal impacts may result depending on the direction provided by the City Council.

Background and Analysis

On September 22, 2022, City staff presented information from a Council Strategic Objective to evaluate the annexation potential of five distinct areas into the City of Citrus Heights, including the Fair Oaks and Madison area.

The presentation included an overview of the annexation process, an introduction to LAFCo procedures, a summary of prior annexation efforts, and a proposed work plan for further evaluation. The Staff Report from the 2022 meeting is included as Attachment 1, and the video recording of that meeting is available online at: Regular City Council Meeting September 22, 2022 (starts at 1:05).

The report identified negative fiscal impacts for each of the five annexation areas. Following the presentation, the City Council opted not to pursue any of the proposed annexation work plans at that time but did direct the City Manager to approach Sacramento County about potential opportunities to modify infrastructure conditions in a manner that would result in bringing some of the annexation areas to a fiscally neutral or positive condition. Discussions were held with county staff however, the majority of the work required is not in their Capital Improvement Plan priority areas. The area at Madison and Fair Oaks is however envisioned to be addressed in a coordinated paving project between the City and the County which would result in this area being a fiscally neutral to slightly positive annexation.

Current Consideration

Earlier this year, the City Council asked staff to revisit annexation consideration, specifically the northwest corner of Fair Oaks Boulevard and Madison Avenue. The subject area, Figure 1 shown below, encompasses approximately 5.4 acres:

Figure 1: Map of Proposed Annexation Area

Thi
s site is adjacent to the City’s eastern boundary and represents the only unincorporated land on the west side of Fair Oaks Boulevard between Madison Avenue and the City’s northern boundary — a distance of nearly four miles. The area includes a multi-story commercial building, a commercial retail center, and a multi-family residential development.

Anne
xing this corner would “square off” the City’s boundaries and potentially allow the City greater control over the Fair Oaks Boulevard/Madison Avenue intersection, a significant gateway and activity node.

The 2022 A
nnexation Analysis indicated that the Fair Oaks/Madison annexation area would result in negative fiscal impacts in the range of $5,541 to $16,287 annually. A significant contributor to the negative fiscal impacts is associated with the capital costs of bringing the Fair Oaks/Madison Avenue intersection up to City standards.

Si
nce the 2022 Annexation analysis, Sacramento County has moved forward with plans to improve Madison Avenue, including the subject intersection. Construction is anticipated for 2026. Upon completion of the roadway improvements, the annexation impact is anticipated to be revenue neutral to slightly positive.

Pr
oposed Work Plan
To a
dvance the City Council’s request to consider the annexation of the Fair Oaks/Madison area, further outreach to affected property owners is suggested. Ultimately, property owners and residents within a proposed annexation would be required to vote to be annexed into Citrus Heights.

In o
rder to share the proposal with impacted owners, discuss the benefits of annexation, and gauge the level of interest from property owners, staff suggest hosting an open house event with participation from City staff and other key stakeholders. Attachment 2 is a draft letter from the Mayor anticipated to be utilized for facilitating this engagement. Phone calls would also be made to major property owners in advance of the workshop. After outreach is conducted, if it is determined that the majority of property owners are interested in annexation to the City of Citrus Heights, a formal application process would begin with the Sacramento Local Agency Formation Commission.

Af
ter property owner engagement, staff would present the findings to City Council for review and receive direction on whether to proceed with further fiscal analysis and additional annexation proceedings.

Ther
e is no fiscal impact related to this action. There may be future fiscal impacts depending on the direction of the City Council. Based on discussions with Sacramento County Local Agency Formation Commission (LAFCo), annexation costs can vary widely; however, expenditures for an annexation similar to Roseville Pointe are anticipated to be about $100,000 to $150,000.

As outl
ined later in this staff report, a Fiscal Impact Analysis is required for each proposed area of annexation. It is anticipated that each Fiscal Impact Analysis will range between $8,000 and $40,000 depending on the geography and land use for each area. If the Council elects to move forward with this step, staff will release a Request for Proposals for Fiscal Impact Analysis services, which will require a budget allocation and approval from the City Council.

General Plan Context
Shortly after incorporation, the City prepared its first General Plan which was adopted in 2000.

The original General Plan and subsequent 2011 update included several actions related to annexation:

Goal 16: Make adequate land available for economic development opportunities Policy 16.1: Expand the boundaries of the City to provide for future non- residential development, as shown on Map 1: Land Use Diagram.

Actions:

A. Request LAFCo to amend the City’s Sphere of Influence to allow for future expansion of the City to accommodate new businesses and industry to diversify the City’s economic base.

B. Pursue possible annexations of all or parts of areas around the Greenback Lane and Auburn Boulevard/Riverside Avenue
interchanges to gain better control of routes into the City and to establish a distinctive City presence along Interstate 80.

C. Pursue annexation of land northwest of the current city limits to provide for existing and future industrial development.

D. Conduct a fiscal analysis of potential annexations.

Annexation History
Since incorporation, annexation of various portions of unincorporated Sacramento County have been considered and analyzed. For a number of reasons, largely fiscally driven, annexation has not been pursued beyond the initial analysis phase. Some conversations related to annexation progressed further than others; however none came to fruition.

The following is a brief summary of two annexations and associated fiscal analysis considered in the past. The results included in the associated attachments are likely to change if updated to reflect current market conditions, property values, and property tax exchange agreements; however, these results are included as a baseline for reference.

Roseville Pointe/Northwest Reserve
In 2006, the City contemplated annexation of the Roseville Pointe neighborhood (sometimes referred to the Northwest Reserve). Attachment A depicts the Proposed Sphere of Influence affiliated with this effort. This area includes 289 single-family units, three vacant parcels (6.8 acres zoned commercial, 1.1 acres with a water tank, and a 1.8 acre park).

In 2006, the City contracted with Economic and Planning Systems (EPS) to evaluate the fiscal impacts of the proposed annexation. One report, “Northwest Reserve Annexation Fiscal Impact Analysis, August 9, 2006” (Attachment B), analyzed the potential fiscal impact of the proposed annexation. Under this analysis, the report concluded that without the development of the ITEM 9

commercially zoned parcels into a Neighborhood Commercial retail space1, the annexation would result in a deficit of approximately of $100,000 annually. However, if the commercial parcels were included in the annexation, the results would be a $40,000 annual surplus (if developed with a Neighborhood Commercial retail space).

Subsequently, in 2007, EPS prepared a memo, “Roseville Pointe Annexation Fiscal Impact Analysis Update” (Attachment C), updating the original analysis to reflect State legislation related to Vehicle License Fee revenues and additional revenue sharing discussions between Sacramento County and the City at that time. This updated analysis anticipated a $27,000 General Fund deficit.

Greenback Gateway
In 2006, the City contemplated annexation of the Greenback Gateway area, west of the current City Limits to Interstate 80. Attachment D depicts the Proposed Sphere of Influence affiliated with this effort. This annexation would include Verner Oaks Apartments, Country Squire Estates Mobile Home Park, Century Theaters, Public Storage and the East Lawn Cemetery.

The Fiscal Impact Analysis (Attachment E) and Updated Fiscal Analysis (Attachment F) for the Greenback Gateway determined that the annexation would result in an annual General Fund deficit of $45,000 - $134,000.

Annexation Process
The process of annexation is a lengthy and complex process. The process involves many stakeholders including the City, Sacramento County, LAFCo, and property owners/residents of any area considered for annexation. The process may be accomplished by petition of registered voters or land owners or by resolution of the City Council.

LAFCo has the authority to approve, disapprove, modify or condition changes of organization, annexation, detachment, consolidation, district formation or city incorporation. There are three LAFCo hearings required for annexation to occur:

1. Sphere of Influence Amendment Hearing: At this hearing, LAFCo would consider Citrus Heights’ Sphere of Influence (SOI) and determine whether it should be amended based upon a Municipal Service Review (MSR), prepared by LAFCo. The MSR is a snapshot in time on how well an agency is currently providing service. The data from the MSR is then used to determine how the agency should grow and by how much. Amending an SOI to include areas outside of an agency’s service area sets the stage for future annexations.

2. Approval Hearing: At this hearing, the Commission considers whether to approve (conditionally or unconditionally) or deny an annexation request. This is where LAFCo

1 The vacant site located at the northwestern corner of Roseville Road and Antelope Road is currently comprised of three parcels that are zoned MP (Industrial Office Park) to the north and LC (Light Commercial) to the south. The northern portion of the site is currently owned by a mini-storage developer and the southern portion is owned by a petroleum company.

staff’s review and recommendation on the need for annexation, the analysis of the environmental consequences, and the tax sharing agreement between city and county are provided for the Commission’s review and determination.

3. Conducting Authority (Protest) Hearing: This hearing only happens if the Commission approves an annexation. At this hearing, LAFCo determines whether there is a sufficient amount of protests by the landowners and/or voters2 in the annexing areas to determine whether the annexation moves forward, fails, or becomes subject to an election.

If a group of opponents within the annexation area do not want to see the area annexed to the city, they have the ability to protest the action and stop it outright with a majority protest (50% plus one) or force the issue to election if more than 25% protest but less than 50% to force the issue to election.

The period between initiation of proceeding (petition/resolution) and commission action can take 6-12 months. If an election is required, it can be handled in the traditional sense at a regularly scheduled election or, in special circumstances, by mailed ballot to registered voters in the annexation area. (Government Code Section 57125).

The City would be responsible for the expense of the election in conjunction with the County Elections Department. Costs for incorporating an annexation into a General Election are anticipated to range between $2,500 and $6,000 (Special Elections are significantly more expensive and based on actual costs).

Key LAFCo considerations

Attachment G provides an overview of the LAFCo process and key considerations for LAFCo during the annexation process. Prior to considering any annexation, the City is required to demonstrate to LAFCo that it will collect sufficient revenues to offset the costs to serve the annexed land.

A financial analysis is required to determine if sufficient revenues are generated by the annexed areas to offset costs to serve. Revenues evaluated as part of the analysis may include:

- Extend existing charges (Utility User Tax, Sales Tax, etc.) - Potential property tax exchange with the County
- Permits/Licenses
- Special District Revenue (Stormwater)

If the Financial Analysis concludes there is a revenue shortfall to serve the annexed areas, additional revenue will be required before the annexation can proceed. This would typically be addressed by implementing a special tax or benefit assessment on the subject parcels. If this is

2 LAFCO mails written notice of a hearing to both registered voters and land owners which are able to file a protest.

Each registered voter is able to protest and landowners are able to vote proportionately based on current assessed value of land within the annexation area

the case LAFCo can approve the annexation contingent upon those residents voting for and approving a special tax or benefit assessment. If the impacted owners vote to tax themselves for the shortfall, the annexation may proceed; however, if they vote against the assessment, the annexation would fail.

Council Direction

At the May 10, 2022 Strategic Planning Meeting, the City Council established an objective to evaluate opportunities for annexation. During this meeting the Council discussed Roseville Pointe for consideration but also suggested other locations along the City’s border should be evaluated as well. Locations discussed during this meeting include:
a. Roseville Pointe
b. Dewey Drive/Celtic Cross Church

3 Annexation attempts can fail if the affected city and county cannot reach agreement on a property tax split. In the early planning stages, the applicant should ascertain if a master property tax exchange agreement exists between the affected city and the county, and if there are concerns about the likelihood of a property tax exchange agreement.

Property tax exchange agreements can be structured to address fiscal and related issues. (OPR 2012) ITEM 9

Subject: Exploring Potential Annexation of Properties at Fair Oaks Boulevard and Madison Avenue

Dear [Property Owner],

The City of Citrus Heights is currently exploring the level of interest among property and business owners in the potential annexation of the area located at the corner of Fair Oaks Boulevard and Madison Avenue into the City limits.

As you may know, annexation is a formal process through which properties are transferred from unincorporated county jurisdiction into a city’s boundaries. This process requires thorough planning, coordination with Sacramento County and the Local Agency Formation Commission (LAFCo), and input from affected property owners and residents.

At this early stage, the City Council is evaluating the feasibility and interest in this potential annexation , including your property at XXXX Fair Oaks Boulevard. As part of this effort, we would welcome the opportunity to meet with you to discuss the annexation concept, answer any questions you may have, and hear your thoughts on the future of this area.

Annexation into the City of Citrus Heights could bring a range of benefits to property and business owners, including:
• Enhanced local services such as quicker response times for police, code enforcement, and emergency services.
• Access to City resources and programs that support business development and property improvements.
• More direct representation and influence on local policies through the City Council. • Streamlined permitting and zoning processes, tailored to meet local needs. • Opportunities for infrastructure improvements and streetscape enhancements aligned with City plans.

We would like to set up a time for you to meet with City staff and members of the Council’s ad-hoc committee evaluating annexation. Your feedback is a critical part of understanding whether this effort is in the best interest of all parties involved.

To express your interest or to schedule a meeting, please contact Casey Kempenaar , Community Development Director at [email protected] or (916) 727-4764. We hope to hear from you soon and look forward to an open and productive dialogue.
