CITY OF INDUSTRY

MEMORANDUM
TO: Honorable Mayor Moss and Members of the City Council FROM:

Josh Nelson, City Manager Unr
STAFF: Yamini Pathak, Finance Director
DATE: March 24, 2022
SUBJECT: Consideration of Amendment No. 1 to the Professional Services Agreement with Hinderliter, de Llamas & Associates, for sales and use tax services, extending the term through March 28, 2025, updating the rate schedule, the addresses of the City and City Attorney, and the indemnity provisions consistent with best practices for independent contractors Background:

On March 28, 2019, the City Council approved a Professional Services Agreement (Agreement") with Hinderliter, de Llamas and Associates ("HDL") for sales and use tax services. HDL has provided services to the City since 2013.

Discussion:

The Agreement expires on March 28, 2022. Amendment No. 1 extends the Agreement for an additional five (5) years through March 28, 2027. Additionally, the amendment will revise the addresses of the City and City Attorney, revise the termination section to allow either Party to terminate the agreement by providing 30 days prior written notice, and add indemnity provisions for independent contractors.

Fiscal Impact:

Sales tax comprises about $34 million of the City's General Fund revenues. As a major City revenue source, continuous monitoring and auditing of sales tax data allows for the correction of allocation errors and ensures the City receives all sales and use tax it is due.

HDL recovers sales tax due to the City through its audit and recovery services. The service cost is based on the amount of sales tax that is recovered. HDL receives 15 percent of the recovered amount between $0 to $1,000,000, 10 percent of amounts between $1,000,001 to $2,500,000, and five percent of amounts over $2,500,001.

In addition to sales tax auditing and recovery, performing regular analysis of sales tax receipts allows Staff to identify economic development opportunities and trends. HDL 15625 Mayor Dave Way • City of Industry, California 91744 • 626.333.2211 • www.cityofindustry.org currently provides this analysis service at $823.35 per month. The Agreement allows for this service fee to change annually according to CPI.

No changes to the rate schedule are proposed at this time.

Recommendation:

Staff recommends that the City Council approve Amendment No. 1 to the Professional Services Agreement with HdL.

PRICELES BOD

MEMORANDUM
TO: Honorable Mayor Moss and Members of the City Council FROM: Joshua Nelson, Gily Manager Omn
STAFF:

DATE: March 24, 2022
SUBJECT: Consideration of Housing Element Annual Progress Report Background:

California Government Code Section 65300 requires every city and county within the State to adopt a General Plan for the physical development of the jurisdiction. In short, a General Plan establishes the City's vision for long-term growth and provides strategies and implementing actions to achieve this vision. The General Plan helps to guide decision-making by residents, property owners, business interests, and elected and appointed officials about public and private land use and development.

Industry's General Plan includes seven state-mandated element topics: Land Use, Circulation, Housing, Safety, Noise, Conservation, and Open Space. Unlike other elements, the Housing Element undergoes a rigorous review and certification process with the California Department of Housing and Community Development ("HCD"). The City's General Plan, including the certified Housing Element, was adopted in 2014. The Housing Element covers an eight-year period and is typically updated more frequently than the rest of the General Plan due to requirements established by State law.

The City Council authorized submission of the Draft Housing Element to HCD in September 2021. HCD responded to the City in December 2021 with comments on the Draft. Staff and the City's consultant are continuing to work with HCD toward certification and bringing the Housing Element back to City Council for final adoption.

Discussion:

Housing Elements are subject to mandated reporting requirements. Historically, general law cities were required to prepare a Housing Element Annual Progress Report ("APR") and submit it to HCD and the Governor's Office of Planning and Research ("OPR") for review. However, passage of AB 879 (Grayson), extended that requirement to charter cities. Beginning with the 2017 APR, all California cities (general law and charter) are 15625 Mayor Dave Way • City of Industry, California 91744 • 626.333.2211 • www.cityofindustry.org required to send a Housing Element APR to HCD and OPR, annually on April 1st.

Government Code Section 65400 requires APRs to cover the status of program implementation, including progress toward meeting the jurisdiction's share of regional housing needs (pursuant to Govt. Code §65584) and local efforts to remove governmental constraints to the development and maintenance of housing. APRs must be considered at a public meeting before the City Council so members of the public have an opportunity to provide oral or written comments.

The City's APR for 2021 reports no activity regarding receiving housing development applications or building housing developments.

The attached document conforms to State requirements for the Housing Element APR in 2021. After review, staff recommends that the City Council authorize transmittal of the APR to HCD and OPR.

Fiscal Impact:

No fiscal impact.

Recommendation:

1.) City Staff recommends that City Council receive and file the Housing Element Annual Progress Report for 2021; and

2.) Direct staff to transmit copies to the California Department of Housing and Community Development and Governor's Office of Planning and Research by email not later than April 1, 2022, as required by State law.

CITY COUNCIL
ITEM NO. 5.5

CITY OF INDUSTRY

MEMORANDUM
TO: Honorable Mayor Moss and Members of the City Council FROM:

Joshua Nelson, Cly Manager gon
DATE: March 24, 2022
SUBJECT: Consideration of Resolution No. CC 2022-12 approving a General Services Agreement between the City of Industry and the County of Los Angeles Background:

On March 9, 2017, the City Council adopted Resolution No. CC 2017-06, approving a General Services Agreement with the County of Los Angeles ("County"). This agreement, which became effective on July 1, 2017, expires June 30, 2022.

General Services Agreements ("GSAs") have been executed with most contract cities within the County. The GSA is general in nature and simply authorizes the County to provide "as-needed" time-limited services requested by the City, such as predatory animal control, prosecution of City ordinances, direct assessment collection, and a variety of public works services. Ongoing services, such as law enforcement and public health code enforcement, are provided by the responsible County departments through Specific Service Agreements ("SSAs"). Any SSAs between the City and the County are not affected by the renewal of this GSA
Discussion:

On February 7, 2022, the County sent a request to renew the existing General Services Agreement for a five-year period, commencing on July 1, 2022. The new GSA will be effective through June 30, 2027, and at the option of the City Council and with the consent of the Board of Supervisors, may be renewable thereafter for an additional period of not to exceed five (5) years.

Fiscal Impact:

The County of Los Angeles General Services Agreement funds were appropriated as part of the Fiscal Year 2021-2022 adopted budget.
15625 Mayor Day Way • City of Industry, California 91744 • 626.333.2211 • www.cityofindustry.org Recommendation:

Accordingly, the provisions of this section are intended by the parties to be interpreted and construed to provide the City with the fullest protection possible under the law. Consultant acknowledges that City would not enter into this Agreement in the absence of Consultant's commitment to indemnify and defend City as set forth in this section.

For the purposes of this section, "City" includes City's officers, officials, employees, agents and volunteers, and "Consultant" includes Consultant's officers, officials, employees, agents and subcontactors.

City agrees that its consent will not be unreasonably withheld provided that Consultant is financially able (based on demonstrated assets including insurance) to fulfill its obligation to indemnify City for the costs of any such settlement as required under this Agreement.

While I was disappointed to give up my seat on the Planning Commission, I am still ready to be of service to my community. As a resident for almost twenty-five years, and neighbor to the Civic Center for over twenty-two of them, I feel as though I can provide valuable input and perspective to this Committee.

As Chair of the El Monte Farmers Market Steering Committee for the past two years, I've gained experience in conducting meeting business, soliciting input and efficiently allocating resources from across multiple City Departments. Through my work as a Legal Assistant with Olivarez, Madruga, Lemieux and O'Neil, LLP, I've been exposed to various real estate transactions, development projects and their respective financing efforts. While the work is complex, it takes a certain amount of creativity to reconcile the various statutory and regulatory requirements with individual project characteristics. In addition to development, I also have experience with general municipal affairs as well as: Planning and Zoning Law, CEQA, the Surplus Land Act, and the revision and adoption of both development standards and design guidelines.

If appointed to this important Committee, I promise to dutifully fulfill the responsibilities entrusted to me by this Council and strive to conduct robust research to support the Committee's recommendations.

Thank you for your consideration.

Very Sincerely,
Manuel D. Perez
