MEMORANDUM
TO: Honorable Mayor and Members of the City Council
FROM: Joshua Nelson, City Manager On
STAFF: Yamini Pathak, Director of Finance up
DATE: July 14, 2022
SUBJECT: Consideration of Resolution No. 2022-30, a Resolution of the City Council of the City of Industry, California, Approving Blanket Purchase Orders for Vendors Totaling $10,000.00 and Over for FY 2022-2023
BACKGROUND:

Annually, after the City's operating budget is adopted, the Finance Department presents to the City Council for its consideration, a blanket purchase order ("BPO") Vendor List for all vendors with whom the City anticipates spending over $10,000.00 in the fiscal year. On June 23, 2022, the City Council approved and adopted the City's Operating Budget for FY 2022-23 ("FY 23"). The FY 23 BPO Vendor List was developed in line with the FY 23 Adopted Budget, and in accordance with the City's Code.

DISCUSSION:

BPOs are a customary financial practice among cities in California, and in summary, are utilized to pay for goods and supplies, professional or maintenance services, and/or equipment with vendors that the City regularly conducts business with during the fiscal year.

Although most BPOs can be created under the City Manager's purchasing authority, as an added level of fiscal control and transparency, at the beginning of each fiscal year a list of BPOs for vendors with whom the City regularly conducts business, that total $10,000.00 and over annually, is presented to Council for formal approval. This streamlines the purchasing process where necessary and assists staff to efficiently obtain goods and supplies, professional or maintenance services, and/or equipment to tend to its day-to-day operations.

BPOs are not intended to bypass or supersede the bidding provisions as outlined in the City's Code or intended to bypass the City's standard agreements and terms. Departments must adhere to the requirements of the City's procurement policy, and must obtain informal bidding, quotes, or go through a formal procurement process as necessary. strictly enforce the procurement policy, and ensure departments are adhering to the correct purchasing procedures.

As such, outlined below is a summary of the City's Code, as it pertains to the Purchasing and Bidding Procedures (Chapter 3.04), that departments must follow and adhere to when obtaining goods and supplies, professional or maintenance services, and/or equipment.

Any additional purchase orders beyond dollar amounts approved in the BPO will be submitted to the City Manager or City Council, following procedures set forth in the City Code and Purchasing Policy.

Supplies & Equipment (Section 3.04.050) - For supplies and equipment, purchases of $100,000.00 and under may be made at the discretion of the City Manager on the open market with the solicitation of at least three (3) written proposals.

Upon the approval of the City Council, BPOs will be created for all vendors the City regularly conducts business with for supplies and equipment for FY 22.

Pursuant to Section 3.04.040 of the Code, purchases of supplies and equipment over $100,000.00 require a formal bidding process and formal approval by the Council. Should items over $100,000.00 be taken to Council during the current fiscal year, BPOs will be created for these items as Council approves them.

Services (Section 3.04.055) - Procurement of professional services of an estimated value of ten thousand dollars or less may be made by the City Manager at his or her discretion on the open market without specific solicitation or competitive bidding requirements.

Professional services greater than ten thousand dollars shall require prior approval by the City Council. For the purposes of this section, professional services shall include, without limitation, consultants, advisors, attorneys, architects, planners and engineers so long as the service performed does not constitute a public works project.

The City is proposing BPOs for services that include on-going periodic facilities maintenance, car services for City vehicles, newspaper bid advertising services, or restroom rentals where needed, for vendors the City regularly conducts business with. These services exclude public works projects. The City is requesting BPOs to streamline the purchase order and invoice processing flow for repetitive, required services for day-to-day operations.

BPO Vendor List for FY 23
The BPO Vendor List for FY 23, attached as Exhibit A, includes all vendors with whom the City regularly conducts business. The BPO amounts are estimated amounts based on historical spending levels; all BPO amounts are in line with the FY 23 Adopted Budget.

BPOs will also be utilized for all vendors that total less than $10,000.00 annually, and with whom the City conducts business on a recurring basis throughout the fiscal year.

FISCAL IMPACT:

The BPOs for all vendors listed in Exhibit A total $855,000.00. This has been accounted for and included in the FY 23 Adopted Budget.

DATE: July 14, 2022
SUBJECT: Consideration of a Facility Use Agreement with Industry Sheriff's Youth Athletic League for Access to 19001 Tonner Canyon Road, for use for its summer youth programming
Background:

• Term: 20 years from the Effective Date, with the option of one additional ten-year term • Compensation: $1.00 per year
• Area of Use: Non-exclusive use of the Camp Courage area for activities including, but not limited to, a ropes challenge course, climbing wall, hiking, and overnight camping.

MEMORANDUM

DATE: July 14, 2022
SUBJECT: Consideration of a License Agreement with Skanska USA Civil West California District, Inc., for Access to Assessor's Parcel No. 8264- 004-908 located at 1123 South Hatcher Avenue, for laydown area for dirt stockpiles
Discussion:

Skanska USA Civil West California District, Inc., ("Skanska") contacted the City regarding the temporary use of City owned property located at 1123 South Hatcher Avenue ("Property"). Skanska is the general contractor working on the Fullerton Grade Separation Project. Due to the proximity to the project and availability, the Property is ideal for a staging area.

The Fullerton Grade Separation Project is scheduled to take approximately two more years to complete. During this time, Skanska requested to use the Property as a laydown area for temporary dirt stockpiles. Under the proposed license agreement, Skanska will share the space with Rowland Water District. Both contractors are required to prevent any environmental contamination on the Property by placing drip pans under staged equipment, straw waddle and filter fabric over nearby catch basins, and any active stockpiles must be covered during rain events to prevent runoff.

Fiscal Impact:

The City supports the Fullerton Road Grade Separation, therefore there will be no charge for the use of the premises.

Recommendation:

1.) Staff recommends that the City Council approve the License Agreement with Skanska USA Civil West California District, Inc., dated July 14, 2022. 15625 Mayor Dave Way • City of Industry, California 91744 • 626.333.2211 • www.cityofindustry.org Exhibit:

CITY COUNCIL
ITEM NO. 5.6

CITY OF INDUSTRY

MEMORANDUM
TO: Honorable Mayor Moss and Members of the City Council FROM: Joshua Nelson, City Manager On
STAFF: Bing Hyun, Assistant City Manager
Sean Calvillo, Director of Operations, CNC Engineering
DATE: July 14, 2022
SUBJECT: Consideration of Amendment No. 1 to the Professional Services Agreement with Oldham Architects, Inc., for architectural and engineering services for the 15710-15718 Rausch Road Building Improvement project, extending the term through March 1, 2023, revising the scope of services, and increasing compensation by $5,000.00
Background:

On October 14, 2021, the City Council approved a Professional Services Agreement ("Agreement") with Oldham Architects Inc. ("Oldham") for the architectural and engineering services for the improvements at 15710-15718 Rausch Road, for the City's future tenant, Priceless Pets, ("Project"). The work includes providing architecture and interior design for the approximately 3,700 square feet of space that will also cover exterior building improvements, new windows, new entry tower features, new metal awnings, and a new parapet roof. Also included in the scope will be landscape design of the adjacent exterior areas to the building, any structural design, as needed, for the new exterior improvements, mechanical, electrical, and plumbing improvements, and construction support.

Discussion:

The Agreement expired on June 30, 2022, and Amendment No. 1 is necessary to extend the Agreement through March 1, 2023 to allow Oldham to continue providing services on this Project. The design is nearly complete and the additional compensation of $5,000.00 is due to revising the scope of services to include the mechanical engineering plans for the replacement of the four HVAC units on the building. These are older units and prime candidates for replacement.

Fiscal Impact:

The fiscal impact for Amendment No. 1 is $5,000.00. In the adopted Fiscal Year 2022/2023 Capital Improvement Project budget, $200,000.00 is approved and no appropriations are required (Account No. 120-726-5130) (MP 20-17 #2).

Recommendation:

It is recommended that the City Council approve the Amendment No. 1 to the Professional Services Agreement with Oldham.
